What it does
This instrument, the Health Insurance (Section 3C Diagnostic Imaging Services - Cardiac MRI for Myocarditis) Repeal Determination 2025, repeals an earlier instrument of that name made in 2024. The mechanical operation is short and specific: Schedule 1 names the instrument to be repealed in full, and s 4(1) sets out the effect of the Schedules. The Schedule entry is explicit: Schedule 1,Repeals lists the Health Insurance (Section 3C Diagnostic Imaging Services - Cardiac MRI for Myocarditis) Determination 2024 and the item says “The whole of the instrument , Repeal the instrument.” See Schedule 1 and s 4.
Commencement is conditional and procedural. Section 2 reproduces a commencement table. The whole of this instrument is set to commence immediately after the commencement of the Health Insurance Legislation Amendment (2025 Measures No. 3) Regulations 2025. The table also records that “the provisions do not commence at all if the event mentioned above does not occur.” The instrument therefore creates a contingent repeal: the legal effect activates only upon the other instrument commencing, and remains inactive if that other instrument never commences. See s 2 and the commencement table.
The instrument is made under subsection 3C(1) of the Health Insurance Act 1973, which is the statutory authority cited in s 3. The text does not identify the specific office-holder or Minister who signed or made the instrument; it records only the enabling subsection. See s 3.
There are no transitional, savings, or consequential amendments in the text beyond the categorical repeal in Schedule 1 and the commencement provision. The instrument does not amend the Health Insurance Act 1973 itself, it only repeals a prior determinations instrument that had been made under that Act. See s 4 and Schedule 1.
In short, the instrument is a narrow statutory instrument that, contingent on a separate regulation commencing, removes the 2024 Determination in its entirety. The instrument is silent about substantive consequences beyond the repeal and about any transitional arrangements or savings for actions taken under the repealed instrument.
