What it does
This instrument, made under the Health Insurance Act 1973, establishes a body named the Medical Training Review Panel (the Panel) pursuant to sub‑section 3GC(1) of that Act. It is dated 26 June 1997 and signed by the Minister for Health and Family Services, Michael R. L. Wooldridge. The instrument sets out the Panel’s composition, basic governance arrangements, internal flexibility, and limited powers to obtain external expertise.
Mechanically, the instrument does the following: it creates a Panel composed of a Chairman and up to twenty nine members (clause (1)); designates the Chairman as a Senior Executive Service officer of the Department of Health and Family Services nominated by the Secretary of the Department (clause (2)); provides that the Panel’s ability to perform functions is not affected by vacancies in membership appointed under subsection 3GC(3) of the Act (clause (3)); makes the Chairman responsible for convening meetings and presiding at them, with a specific procedure for selecting an alternate Chairman if the Chairman is absent at a meeting (clauses (4) and (5)); allows the Panel to regulate its proceedings (clause (6)); permits the Panel to form sub‑committees for specific tasks (clause (7)); authorises the Panel to inform itself “in such a manner as it thinks fit” for consideration of issues before it (clause (8)); and permits the Chairman, with the Minister’s approval, to engage consultants on behalf of the Commonwealth (clause (9)).
The instrument does not set out an operational remit, powers to make binding decisions, reporting obligations, quorum or voting rules, remuneration or funding arrangements, or detailed appointment procedures for members beyond referencing subsection 3GC(3) of the Act. It is a relatively compact enabling instrument that establishes the Panel’s existence and a framework of internal discretion, but leaves many operational and resource matters unspecified in the text.
