Health (Fluoridation) Act 1973

The Act’s core concepts are tightly defined. A “public water supply” is any water supply under the control of a “water supply authority” (s 2). The definition of water supply authority was amended over time and now means: an authority under the Water Act 1989 that has a water district; a council performing water supply functions under the Local Government Act 1989; or Melbourne Water Corporation (s 2). This covers essentially all Victorian entities that manage reticulated drinking water. “Fluoride” includes any compound of fluorine, so the Act covers all fluoride compounds, not just sodium fluoride or fluorosilicic acid (s 2). The “Secretary” is defined as the Department Head of the Department of Health (s 2), which means the statutory decision-maker is a senior public servant, not a minister. The “prescribed” matters are those set out in regulations under the Act.

The central permission and obligation system is set out in s 5. A water supply authority “may and when required by the Secretary shall” add fluoride. This is a permissive power coupled with a mandatory duty. The authority cannot add fluoride except by its own direction or through a contractor acting under a contract (s 5(2)). The maximum average optimum concentration is capped at 1 part fluoride per million parts of water (s 5(3)). The Act does not impose a minimum floor; it only sets a ceiling. The pre-approval procedure in s 6 requires the authority to submit plans and specifications, identify the district, and provide any further information the Secretary requires. The Secretary then determines the maximum fluoride concentration, specifies the allowed compounds, and advises the authority. The authority must keep concentration below that maximum and use only the specified compounds. For authorities that were already fluoridating before the Act commenced (20 March 1974), s 7 required them to submit plans retrospectively but allowed them to continue operating in the interim. The immunity in s 4 extends to the water supply authority, its members, persons acting under its direction, and persons acting under contract with the authority. That immunity covers “anything done in regard to the fluoridation of a public water supply in accordance with the provisions of this Act.” The limitation on Supreme Court jurisdiction in ss 12 and 13 is expressed as intending to alter or vary s 85 of the Constitution Act 1975, which is the provision that ordinarily vests the Supreme Court with unlimited jurisdiction. This makes the ouster explicit.

The Act directly affects several categories of persons and entities. Primary duty-holders are water supply authorities: the bodies defined in s 2 (being water corporations, councils with water functions, and Melbourne Water). Their officers and members are not directly subject to penalties under s 10 (the penalty provision only applies to “any person, not being a water supply authority” for contravention of the Act, and to water supply authorities for contravention of the Act or regulations), but they may be indirectly affected by the authority’s liability. Contractors who add fluoride on behalf of an authority are also affected: they must act only under a contract and in accordance with the authority’s direction (s 5(2)), they are covered by the immunity, and they must keep records under s 11(ca). Persons employed in operating fluoridation plant may need licences under regulations made pursuant to s 11(d). The Secretary of the Department of Health is the central regulator: he or she determines fluoride concentration and compounds, requires fluoridation, approves plans, recommends capital funding, and authorises entry for sampling. The Crown is bound by the Act (s 3), meaning government departments and agencies are subject to its terms.

Indirectly affected parties are more numerous. Every person who receives drinking water from a fluoridated public water supply is a consumer of the intervention. The Act gives them no right to opt out or to sue for harm, as s 4 bars any “right of action” against fluoridation actors. The limitation of Supreme Court jurisdiction reinforces that bar. Residents in districts where the Secretary requires fluoridation have no statutory mechanism to object; the Act does not require a public consultation process or a referendum. The Victorian taxpayer bears the net capital costs of installing fluoridation equipment through parliamentary appropriations (s 8). Ongoing operational costs are not addressed in the Act; they are presumably borne by the water supply authority and recovered through water charges, which means consumers ultimately pay. Competing water suppliers or alternative treatment providers are not directly addressed, but the Act’s monopoly over public water supply fluoridation means that any private entity adding fluoride to a public water supply without authority direction would commit an offence under s 10.

The Act imposes asymmetrical duties and rights. The primary duty on a water supply authority is to comply with the Secretary’s determination: it “shall so regulate the concentration of fluoride that such concentration shall not exceed the maximum concentration determined by the Secretary” and “shall not add to the public water supply fluoride in any form other than that specified by the Secretary” (s 6(3)). It also has a duty to submit plans, specifications, and information before adding fluoride (s 6(1)). If the Secretary requires fluoridation, the authority has a duty to add fluoride (s 5(1)). There is no duty to fluoridate absent a Secretary’s requirement; the authority has a discretion to decide whether to add fluoride on its own initiative. However, that discretion is constrained by the need to obtain Secretary approval of the scheme.

The authority has a right to be paid its net capital costs out of moneys provided by Parliament, on the Secretary’s recommendation (s 8). The authority also has the right to add fluoride (s 5(1)), and to continue using existing equipment if it was fluoridating before commencement, pending approval (s 7(2)). The authority and its members, persons acting under its direction, and its contractors have a broad right to immunity from any civil action “in respect of anything done in regard to the fluoridation of a public water supply in accordance with the provisions of this Act” (s 4). This immunity is not contingent on proof of “good faith” or reasonableness; it is absolute provided the action is done in accordance with the Act. The Secretary has the right to require fluoridation, to determine concentration and compounds, to require information, to approve plans, and to authorise entry onto land to inspect equipment and take samples (ss 5(1), 6, 9). Authorised persons have a right of entry “at any time” (s 9), which is an unusually broad power with no constraint on timing.

The rights of individuals who consume fluoridated water are conspicuously absent. The Act does not create a right to be informed, to consent, to opt out, or to seek removal of fluoride. The Act deliberately extinguishes any common law or statutory right of action for harm caused by fluoridation. The only recourse is through the offence provisions (s 10), which are criminal and not compensatory.

Section 10 creates two categories of offences. Any person who is not a water supply authority and who contravenes or fails to comply with any provision of the Act is guilty of an offence. A water supply authority that contravenes or fails to comply with any provision of the Act or of the regulations is also guilty of an offence. The penalty is a fine of not less than $200 and not more than $1,000, and in the case of a continuing offence, a daily penalty not exceeding $40. These penalty amounts are fixed in the Act and have not been updated since 1973. Adjusting only for cumulative inflation, $1,000 in 1973 is roughly equivalent to $10,000-$12,000 in 2025, and the minimum $200 is about $2,000-$2,400 today. While the nominal amounts appear low, the continuing daily penalty can accumulate for a non-compliant authority that fails to correct a breach.

Enforcement mechanisms are not detailed in the Act. No specific regulator is named as the prosecuting body; presumably it would be the Department of Health or a relevant authority under the Public Health and Wellbeing Act 2008. The Secretary’s right of entry under s 9 allows gathering evidence of non-compliance. Regulations may impose additional duties and create offences for breach of regulations (s 11). The regulation-making power under s 11 includes the licensing of plant operators; operating without a licence could be an offence under the regulations. The Act does not provide for infringement notices or civil penalties; prosecution would be in the Magistrates’ Court. The limitation of Supreme Court jurisdiction in ss 12 and 13 does not affect criminal proceedings, only civil actions of the kind barred by s 4. Therefore, a person who suffers alleged harm from fluoridation cannot bring a civil suit, but they could theoretically make a complaint that leads to a prosecution for breach of the Act’s requirements (e.g., exceeding the maximum concentration). However, the complainant would not receive compensation from any resulting fine.

The Act explicitly interacts with the Constitution Act 1975. Sections 12 and 13 state that it is the intention of those sections to alter or vary s 85 of the Constitution Act 1975 to the extent necessary to prevent the Supreme Court from entertaining actions of the kind referred to in s 4. Section 85 of the Constitution Act is the provision that confers on the Supreme Court unlimited jurisdiction unless expressly excluded. By purporting to oust that jurisdiction for claims against fluoridation actors, the Act creates a statutory immunity that overrides the general law. This interaction is significant because it limits judicial review of administrative action in relation to fluoridation. The Water Act 1989 is cross-referenced in the definition of water supply authority; an “Authority within the meaning of the Water Act 1989 that has a water district” is included (s 2). The Local Government Act 1989 is similarly referenced for councils performing water supply functions. The Public Administration Act 2004 is referenced for the definition of the Secretary as the Department Head of the Department of Health (s 2). The Act binds the Crown (s 3), meaning government entities are subject to its provisions, though the Crown itself is unlikely to be prosecuted.

The Act does not interact with the Victorian Civil and Administrative Tribunal (VCAT) or the Australian Consumer Law, because s 4 bars any “right of action”, not just actions in tort. The term “right of action” is broad and would encompass claims for breach of contract, negligence, nuisance, trespass, or breach of statutory duty. The limitation of Supreme Court jurisdiction in ss 12-13 appears designed to prevent any end-run around the immunity by suing in the Supreme Court under some other head. No standalone cause of action is created by the Act itself; it is purely a regulatory and immunity statute. It may interact with occupational health and safety laws regarding the handling of fluoride, but those are not referenced. The regulations under s 11 may further prescribe safety measures. Water quality standards under other Victorian or Commonwealth laws (e.g., the Australian Drinking Water Guidelines) are not mentioned but would overlap in practice; the Act does not override them.

The Health (Fluoridation) Act 1973 received assent on 11 December 1973 and commenced on 20 March 1974. Its amendment history is recorded in the Act’s endnotes and reflects administrative restructures rather than policy shifts. The first set of amendments came in 1977 and 1983 via the Health Commission Act 1977 and the Statute Law Revision (Repeals) Act 1982, which removed references to former entities like the “Chief General Manager” and the “Commission”. The Water and Sewerage Authorities (Restructuring) Act 1983 and the Water (Central Management Restructuring) Act 1984 updated the definition of water supply authority to reflect the evolving water industry structure. The Health (Amendment) Act 1985 further updated references to the Secretary and the Commission. The Local Government (Consequential Provisions) Act 1989 and the Water (Consequential Amendments) Act 1989 aligned the definition with the new Water Act 1989 and Local Government Act 1989.

A significant amendment came through the Health and Community Services (Further Amendment) Act 1993 (No. 124/1993). That Act substituted a new s 4, which extended the immunity from rights of action to any person acting under a contract with a water supply authority, and also inserted s 12, which for the first time included a limitation on Supreme Court jurisdiction. Section 10(b) of that Act amended s 9 to remove reference to the Secretary’s authorisation for entry (the provision now reads “any person authorised in writing by the Secretary may at any time enter”). The Water Acts (Further Amendment) Act 1997 inserted s 13 to add an additional limitation on Supreme Court jurisdiction tailored to the expanded definition of water supply authority. The Public Sector Reform (Miscellaneous Amendments) Act 1998 replaced references to the Secretary with the Department Head under the Public Administration Act 2004, and deleted the definition of “Chief General Manager”. The Public Administration Act 2004 updated the Secretary definition. The Health and Human Services Legislation Amendment Act 2010 substituted the Secretary definition to refer to the Department Head of the Department of Health. Finally, the Water Amendment (Governance and Other Reforms) Act 2012 amended the water supply authority definition to include an authority under the Water Act 1989 that has a water district. The penalty amounts in s 10 have never been amended.

The source text contains no reference to any court decision or litigation history under this Act. The endnotes include an “Explanatory Details” section that states “No entries at date of publication.” This suggests that as at the last version (August 2012), no reported cases or explanatory notes existed. However, the Act itself is structured to prevent litigation: s 4 gives immunity from suits, and ss 12-13 oust the Supreme Court’s jurisdiction to hear such suits. This indicates the legislature anticipated potential legal challenges, particularly on grounds of interference with bodily autonomy or property rights, and acted to foreclose them. The limitation on jurisdiction attempts to bypass the principle in Kirk v Industrial Court of NSW (2010) 239 CLR 531, which held that state legislation cannot wholly oust Supreme Court judicial review for jurisdictional error. However, ss 12-13 do not purport to oust all judicial review; they only bar “actions of the kind referred to in section 4”, which are civil claims for damages or other relief arising from fluoridation. Judicial review of administrative decisions (e.g., the Secretary’s determination) on non-jurisdictional grounds may still be possible, but the Act’s plain text suggests a broad intent to shut down challenges.

Because the source provides no cases, we cannot state that any particular challenge succeeded or failed. The practical absence of reported litigation may reflect the Act’s effectiveness in deterring suits, or it may indicate that disputes have been resolved through other mechanisms such as political pressure, media campaigns, or individual complaints to health authorities. The lack of explanatory notes suggests no significant judicial consideration as of 2012. Lawyers advising clients should be aware that the Act’s immunity and ouster clauses are likely to be tested if a novel claim is brought, and that any such litigation would involve constitutional arguments about the extent to which a state parliament can limit access to the Supreme Court.

Several subtle features of the Act pose traps for practitioners and affected parties. First, the immunity in s 4 is extraordinarily broad. It covers “anything done in regard to the fluoridation of a public water supply in accordance with the provisions of this Act.” This includes not just the act of adding fluoride, but presumably planning, design, monitoring, and even decisions not to fluoridate (if that decision is in accordance with the Act, which does not mandate fluoridation unless required by the Secretary). The immunity covers members of the authority, persons acting under direction, and contractors. There is no “good faith” or “reasonable care” qualifier. If the action is in accordance with the Act, the actor is immune even if negligent.

Second, the limitation of Supreme Court jurisdiction in ss 12 and 13 may not be as comprehensive as it appears. Section 12 says it is the intention to “alter or vary section 85 of the Constitution Act 1975 to the extent necessary to prevent the Supreme Court from entertaining an action of the kind referred to in section 4.” This provision may be interpreted as a partial ouster, not a complete bar to judicial review. The High Court of Australia has held that state legislation cannot exclude review for jurisdictional error, and s 12 does not explicitly attempt to oust all review; it only targets “an action of the kind referred to in section 4.” A litigant could argue that a challenge to the Secretary’s decision (e.g., that it was ultra vires or procedurally unfair) is not an “action of the kind referred to in section 4” because s 4 deals with liability for acts done in fluoridation, not with the validity of the decision authorising those acts.

Third, the Act does not address removal of fluoride if the Secretary later decides against continued fluoridation. There is no decommissioning procedure or cost recovery mechanism. An authority that decides to cease fluoridation may face residual liabilities (e.g., from contractors) that are not covered by s 4 because the cessation is not “adding fluoride.” Fourth, the right of entry in s 9 is at “any time” and does not require notice. This creates potential issues for privacy and property rights, but the Act does not provide for compensation for interference. Fifth, the penalty in s 10 is fixed and has not been updated in 40+ years; a court may impose a fine at the lower end ($200) which is trivial for a water authority, making the offence provision a weak deterrent.

Compliance obligations under the Act fall primarily on water supply authorities, but also on contractors, employees, and the Secretary. For an authority that wishes to voluntarily add fluoride, the first step is to develop a fluoridation scheme with plans and specifications, and submit them to the Secretary under s 6(1). The submission must identify the public water supply and the districts involved, and include any further information the Secretary may require. The authority must await the Secretary’s determination, which will specify the maximum fluoride concentration (not exceeding 1 ppm) and the allowed fluoride compound(s). Only upon receiving that determination may the authority proceed. The authority must then add fluoride in accordance with the determination, strictly ensuring that the concentration never exceeds the maximum set by the Secretary (s 6(3)(a)) and using only the specified compound (s 6(3)(b)). Ongoing monitoring and sampling are required under the regulations (s 11(a)-(b)). The authority must keep records as prescribed (s 11(c)). It must also allow entry to authorised persons under s 9. For authorities already fluoridating before 20 March 1974, s 7 requires them to submit plans retrospectively but allows continued operation in the meantime.

If the Secretary requires fluoridation under s 5(1), the authority has no choice: it must add fluoride and comply with the same procedure and constraints. In that case, the authority should still submit plans and obtain a determination. Capital costs should be documented and submitted to the Secretary to trigger the recommendation for funding under s 8; however, funding is not guaranteed (it depends on parliamentary appropriation). An authority that decides to fluoridate must ensure that no person adds fluoride except under its direction, and if it contracts with a third party, the contract must explicitly provide that the contractor is acting on behalf of the authority (s 5(2)). The authority should also ensure that the contractor is covered by the immunity and that the contract imposes compliance with all Act and regulation requirements. Contractors must keep records (s 11(ca)) and ensure their operators are licensed if regulations so require. For any entity or individual not a water supply authority, compliance simply means not adding fluoride to a public water supply without authorisation from the relevant authority and direction from the Secretary. Doing so would be an offence. The Act does not require private citizens to do anything; it creates a permissive and mandatory scheme for authorities. The best practical compliance advice for any affected entity is to maintain clear documentation of the Secretary’s determination, records of fluoride concentration levels, compound purchases, and operator training, and to ensure all contractors are contractually bound to comply.
