What it does
The Health Complaints (Code of Conduct) Regulations 2026 prescribe a code of conduct for health care workers providing health services in Tasmania. Regulation 4 does this for the purposes of s 56AAA of the Health Complaints Act 1995. The code is in Schedule 1 and sets out conduct requirements across clinical practice, client communication, safety, financial dealings, privacy, records, insurance and information displayed at practice premises.
The regulations were made on 25 May 2026 and, according to the text, notified in the Gazette on 3 June 2026. Regulation 2 says they take effect “21 days after the day on which their making is notified in the Gazette”. Counting 21 days from the day after 3 June points to 24 June 2026. The instrument itself does not state a separate calendar commencement date.
The code is framed mainly as duties on individual health care workers. It requires workers to stay within their competence, obtain appropriate consent, respect informed choices and respond to risks and adverse events. It also regulates representations about services and qualifications, restrictions on financial arrangements, relationships with clients, handling of health information and insurance. Several duties refer to other laws, including privacy legislation and the Public Health Act 1997.
The regulations also prescribe categories of offences for the purposes of two provisions of the Act, s 56AAB(2)(a)(iii) and s 56AAC(2)(a)(iii). The supplied text does not include those Act provisions, so it establishes which offence categories are prescribed but not what legal consequence follows from that prescription. The regulations do not, by themselves, set out a complete complaint, investigation or disciplinary process.
