43Content of notices

#### 43 Content of notices (1) The notice must specify: (a) how the person is to give the information or how the document is to be produced; and (b) the period within which the person is to give the information, or to produce the document; and (c) the Departmental employee (within the meaning of the Human Services (Medicare) Act 1973) (if any) to whom the information is to be given or the document is to be produced; and (d) that the notice is given under section 42. (2) The period specified under paragraph (1)(b) must end at least 28 days after the notice is given. (3) The notice may require the person to give the information by appearing before a specified Departmental employee (within the meaning of the Human Services (Medicare) Act 1973) to answer questions. (4) If the notice requires the person to appear before an officer, the notice must specify a time and a place for the person to appear. The time must be at least 28 days after the notice is given. (5) A reference in this section to a Departmental employee (within the meaning of the Human Services (Medicare) Act 1973) includes a reference to a person to whom the Chief Executive Medicare or the Secretary has delegated powers under section 41.
