#### 37 Limits of waiver—bulk payment agreements (1) This section has effect despite: (a) subsections 8(6), 8(7), 8(8), 10(6), 10(7) and 10(8); and (b) sections 35 and 36; and (c) subsections 6(6), 6(7), 6(8), 8(6), 8(7) and 8(8) of the Charges Act; (the exempting provisions). (2) The exempting provisions do not affect the operation of a provision of Division 1 or 2 that creates an offence, if that provision was breached before the start of the period of the bulk payment agreement concerned. (3) The exempting provisions do not affect the operation of a provision of Division 1 or 2 imposing an obligation to do something within a certain time limit, if: (a) the time limit expired before the start of the period of the bulk payment agreement concerned; and (b) the thing was not done within that time limit.
