74 Scope of clinical practice committees—giving information to health board and health services commissioner (1) A scope of clinical practice committee may give protected information to a health board if the committee is satisfied that giving the information would be likely to facilitate the improvement of health services provided in the ACT. (2) If a clinical practice committee gives protected information to a health board under subsection (1), the committee must give the information to the health services commissioner. (3) A scope of clinical practice committee must tell the relevant health board, and the health services commissioner, if the committee is satisfied that the clinical practice of a practitioner has failed to meet a required standard of practice, or that the practitioner does not satisfy the suitability to practise requirements. Note The Health Practitioner Regulation National Law (ACT), pt 8, div 2 imposes an obligation to report misconduct or impairment.
