36 Varying special permits on application
(1) The Minister may, on application by the holder of a special permit, vary the permit if: (a) the Minister is satisfied that, if the Minister were asked to grant the special permit (as proposed to be varied), the Minister would decide to grant the permit; and (b) the Minister has taken into account any relevant public comments received in response to an invitation under paragraph 33(1)(aa) of the Act about the application.
Note: Examples of a variation include imposing a condition on the permit, or varying or revoking a permit condition.
(2) The application must: (a) be in the form approved by the Minister; and (b) set out, or be accompanied by, such information in relation to the proposed variation as is required by the form. (3) Regulation 33 applies to the imposition or variation of a condition under this regulation as if a reference in regulation 33 to the grant of a special permit were a reference to a variation of a special permit.
