#### 58B Evidentiary certificate—classification of hazardous waste Hazardous waste (1) The Minister may issue a written certificate stating that a specified substance or object is, or is not, in specified circumstances, hazardous waste: (a) for the purposes of this Act; or (b) for the purposes of the application of this Act to a specified matter. Consultation with relevant experts (2) When deciding whether to issue a certificate under subsection (1), the Minister must consult one or more of the following: (a) a person who the Minister considers has expertise or qualifications relevant to the decision; (b) an industry group; (c) an environmental group; (d) a State or Territory government body. Prima facie evidence (3) In any proceedings relating to this Act, a certificate under subsection (1) is prima facie evidence of the matters in the certificate. Gazettal (4) A copy of a certificate under subsection (1) must be published in the Gazette.
