#### 26E Period for making a decision on an application—referrals under the Environment Protection and Biodiversity Conservation Act 1999 If, within the decision period, the proposal to vary the Basel permit is referred under Subdivision A of Division 4 of Part 11 of the Environment Protection and Biodiversity Conservation Act 1999, the decision period is paused until: (a) the Minister administering that Subdivision gives, under section 163 of that Act, advice on the proposed variation; or (b) the Minister administering that Subdivision decides, under section 161A of that Act, that that Subdivision does not apply to the referral. > Note: Under Subdivision A of Division 4 of Part 11 of the Environment Protection and Biodiversity Conservation Act 1999, persons considering whether to authorise certain actions must get advice on environmental matters from the Minister administering that Subdivision.
