What it does
The Hawkesbury Racecourse Act 1996 is a short, enabling statute that performs two main mechanical functions: it facilitates the incorporation of the previously unincorporated Hawkesbury Race Club, and it confirms the ongoing status of the Hawkesbury Racecourse as Crown land dedicated for specified purposes. The Act does not create a regulatory scheme, impose ongoing duties, or establish a new body. Instead, it is a transitional and declaratory piece of legislation that clears legal obstacles to the club’s incorporation and clarifies the land’s tenure after the repeal of the older Hawkesbury Racecourse Act of 1890.
Section 6 permits the former club (defined as the members of the unincorporated body known as the Hawkesbury Race Club) to incorporate under any law enabling persons to form a body corporate. Once the Minister is satisfied that incorporation has occurred, he or she must publish a notice in the Gazette declaring that body to be the incorporated Hawkesbury Race Club for the purposes of the Act. That notice triggers section 7, which automatically vests all assets, rights and liabilities of the former club in the incorporated club without any need for conveyance, transfer, assignment or assurance. The vesting extends to assets held by the chairman of the former club in trust for the club, and includes any existing lease of the racecourse. Section 7 also provides that the vesting does not constitute a breach of contract, a civil wrong, or an event of default, and no attornment by a lessee is required. No compensation is payable to any person in connection with the transfer.
Section 4 (as substituted in 2017) declares that the Hawkesbury Racecourse continues to be Crown land dedicated for use as a racecourse, a training ground, a sports ground, and for any other form of public amusement or public purpose that the Governor declares by Gazette order. This section does not prevent the revocation or alteration of the dedication under the Crown Land Management Act 2016. The former reserve trust was abolished and replaced by a statutory land manager under that Act by operation of clause 11 of Schedule 7 to the Crown Land Management Act 2016 on the repeal day of the Crown Lands Act 1989.
