Hairdressers Act 1988

The Act’s regulatory design pivots on a small set of statutory concepts articulated in s 4 and implemented by the operative provisions that follow.

• Hairdressing (s 4): the Act defines "hairdressing" to include cutting, colouring, setting, permanent waving or "other treatment" of a person’s hair. The list is not exhaustive; the phrase "other treatment" gives the definition a breadth that potentially captures services allied to or beyond traditional cutting and styling.

• Prescribed qualifications (s 4): two mutually exclusive pathways are set. For persons who, as at 30 June 1988, were required to be registered under the repealed Act, "prescribed qualifications" means registration under that Act on that day (s 4(a)). For everyone else, prescribed qualifications are those declared by regulation (s 4(b)). That structure ties a cohort to historical registration status while placing future specification into subordinate legislation.

• Qualified person / Unqualified person (s 4): a "qualified person" is anyone who either holds prescribed qualifications (s 4(a)) or has been determined by the Commissioner under s 4A to have appropriate qualifications, training or experience (s 4(b)). The Commissioner’s recognition therefore operates as an alternative pathway to qualification; the Act defines "unqualified person" correspondingly.

• Commissioner’s recognition (s 4A): the Commissioner may determine an applicant has suitable qualifications, training or experience (s 4A(1)). The Commissioner prescribes the form and manner of applications (s 4A(2)) and may require supporting documents or statutory declaration verification (s 4A(3)). The power is discretionary but procedural requirements are specified.

• Right of review (s 4B): a refusal by the Commissioner can be reviewed to the Tribunal (s 4B(1)). The time limit for review is one month from the Commissioner’s determination (s 4B(2)), subject to timing adjustments where written reasons are requested (s 4B(4)). The Commissioner must provide written reasons if requested (s 4B(3)).

• Offences and penalties (s 5): two distinct offences are created: (1) an unqualified person carrying on hairdressing for fee or reward (s 5(1)); and (2) employing an unqualified person to carry on hairdressing (s 5(2)). Each offence attracts monetary penalties, higher for repeat offences. The Act expressly permits the employment of apprentices by qualified persons (s 5(3)).

• Evidentiary presumption (s 7): for offences, a complaint alleging a person was required to be registered under the repealed Act as at 30 June 1988 but was not so registered will be taken as proved absent contrary proof. That provision shifts the evidentiary burden in specific historical cases.

• Regulations (s 8): the Governor may make regulations, including exemptions of persons or classes from the Act (s 8(2)(a)), branch-specific restrictions (s 8(2)(b)), and penalties not exceeding $500 for contravention of regulations (s 8(2)(c)). This confers significant granularity to subordinate legislation.

• Summary proceedings (s 6): the Act classifies offences as summary, which determines the procedural path for prosecution and sentencing.

These concepts establish a regulatory architecture where legal qualification to provide commercial hairdressing services is gatekept by either historical registration, regulation-declared qualifications, or discretionary administrative recognition by the Commissioner. The Governor and the Commissioner exercise rule-making and administrative recognition powers respectively; the Tribunal is the statutory avenue for merits review of adverse administrative determinations.

The Act imposes legal effects on a defined set of actors, and it creates decision-making powers and fiscal outcomes for public officers and the Minister.

Primary affected private actors

• Practitioners of hairdressing: any person who carries on hairdressing for fee or reward is directly subject to s 5(1). If that person is "unqualified" under s 4 they commit an offence attracting fines ($1,000 first offence; $4,000 subsequent offences). The definition of hairdressing in s 4 includes a range of activities; therefore persons offering cutting, colouring, setting, permanent waving or other hair treatments commercially fall within the scope.

• Employers in the hairdressing context: persons who employ an unqualified person to carry on hairdressing are separately criminalised under s 5(2) with identical penalties. That provision places a compliance duty on employers to verify employee qualification status or face monetary penalties. The Act allows a qualified person to employ apprentices (s 5(3)), so employers using bona fide apprentices remain permissible.

• Applicants seeking recognition: persons without prescribed qualifications but seeking to lawfully practise can apply to the Commissioner under s 4A. The Act affects their administrative obligations because the Commissioner may require documentation and statutory declarations (s 4A(3)).

Secondary affected private actors

• Persons registered under the repealed Act as at 30 June 1988: s 4(a) treats registration on that day as constituting "prescribed qualifications". The evidentiary rule in s 7 means complaints alleging failure of historical registrants to have been registered at that date carry a presumption in prosecutions unless contradicted.

Public-sector and regulatory actors

• Commissioner for Consumer Affairs: the Commissioner is the administrative gatekeeper for recognition (s 4A) and has authority to set application forms and require documentary proof and statutory declaration verification (s 4A(2)-(3)). The Commissioner must provide reasons if requested (s 4B(3)) and faces Tribunal review of refusals (s 4B(1)). The Act thereby concentrates decision-making authority over qualifications in one office.

• Minister: upon commencement the Minister receives the assets and liabilities of the repealed Board (s 3(2)). The Minister discharges liabilities from those assets and may expend surplus funds in promoting the profession as the Minister thinks fit (s 3(3)). This gives the Minister custodial and discretionary fiscal control over legacy resources.

• Governor: empowered to make regulations under s 8, including exemptions and branch-specific restrictions, and to prescribe regulation-level penalties up to $500.

• Tribunal: the South Australian Civil and Administrative Tribunal hears reviews under s 4B as the statutorily named review body (s 4). The legislative history confirms the 2019 amendment moving review jurisdiction to the Tribunal (Statutes Amendment (SACAT) Act 2019 Pt 13). Prior to that change, review jurisdiction was elsewhere, as the transitional provisions indicate.

Others and systemic effects

• Providers of allied services and products may be affected indirectly if the breadth of "other treatment" in s 4 covers chemical or cosmetic services that intersect with hairdressing, triggering qualification checks.

• The public as consumers: enforcement of the prohibition may alter the composition of commercial suppliers. The Act's penalties and the risk of prosecution for unqualified provision influence the supply of hairdressing services, particularly for small operators or casual providers.

Who does not appear to be directly affected

• Unpaid hairdressing done privately does not fall under s 5(1), which applies to carrying on hairdressing "for fee or reward". The Act therefore targets commercial activity rather than private or reciprocal services.

The Act therefore places compliance costs and criminal exposure primarily on commercial practitioners and their employers, gives administrative decision authority to the Commissioner, regulatory and exemption power to the Governor, and vesting and fiscal discretion to the Minister.

The Act lays out a compact set of legal duties for persons providing or facilitating hairdressing services, and a limited set of rights to administrative review and procedural protections.

Primary duties

• Do not practise hairdressing for fee or reward unless qualified (s 5(1)). This duty is absolute in form; the section creates the offending conduct rather than a licensing conditionality. The operative phrase is "carries on the practice of hairdressing for fee or reward", so the legal duty attaches to commercial practice.

• Employers must not employ unqualified persons to carry on hairdressing (s 5(2)). This duty requires employers to exercise some level of verification of employees’ qualification status to avoid criminal liability.

• Where applicable, provide documentary evidence and statutory declarations in support of an application for recognition (s 4A(3)). The Commissioner may require records or information and may require verification by statutory declaration. Applicants who wish to rely on the administrative recognition pathway must comply with evidence and form requirements set by the Commissioner (s 4A(2)-(3)).

• Comply with any regulations made under s 8 if those regulations contain specific operational requirements; breaches of regulations may attract penalties not exceeding $500 under s 8(2)(c).

Rights and procedural protections

• Right to apply for recognition by the Commissioner (s 4A(1)). The Act grants a discretionary but regulated route to be declared a "qualified person" even where prescribed qualifications are absent.

• Right to be informed of reasons and to seek review to the Tribunal (s 4B). An applicant whose application is refused may apply to the Tribunal under s 34 of the South Australian Civil and Administrative Tribunal Act 2013 for review of a Commissioner's determination (s 4B(1)). The applicant has a right to written reasons if requested (s 4B(3)), and the one month review period runs from receipt of those reasons if they were not supplied at the time of determination (s 4B(4)).

• Evidentiary protection limited to the reverse presumption in s 7. Where a complaint alleges a person required registration under the repealed Act on 30 June 1988 but was not registered, that allegation will be taken as proved absent contrary proof. This provision sets a procedural burden on the accused in historic registration disputes.

Static and delegated duties

• The Act delegates substantial content-setting to secondary instruments. "Prescribed qualifications" beyond the 30 June 1988 cohort are to be declared by regulation (s 4(b)). Regulations may also exempt persons or classes and may regulate branches of hairdressing by class (s 8(2)(a)-(b)). Therefore duties under the Act may change according to regulations made by the Governor.

Discretion and limits on rights

• The Commissioner’s recognition power is discretionary in that the Commissioner "may determine" an applicant has appropriate qualifications, training or experience (s 4A(1)). The Act does not prescribe objective equivalence tests or specific criteria beyond the Commissioner’s consideration. The Commissioner can set application formats and evidentiary requirements (s 4A(2)-(3)).

• The Tribunal review right is time-limited to one month as the Act provides (s 4B(2)), unless written reasons are required and supplied later (s 4B(4)). The Act obliges the Commissioner to supply reasons if the applicant requests them (s 4B(3)), which affects the running of the review period but does not itself create a right to rehearing beyond the statutory review route.

Operational implications

• Employers and practitioners must maintain records that will support an application or respond to prosecutions, as the Commissioner may require documentary proof and as s 7 shifts proof burdens for some historic claims. A failure to maintain proof of qualification risks both prosecution under s 5 and an uphill evidentiary position at trial given s 7.

• The Minister and Governor have functions that indirectly affect duties and rights through vesting of assets and regulation-making. The Minister’s discretion to apply surplus funds "towards promoting the interests of the profession" (s 3(3)) and the Governor’s regulation-making power under s 8 are administrative levers that can change the practical duties and entitlements of practitioners without primary legislation.

The Act sets a narrow penalty and enforcement regime comprising statutory fines for primary offences, the classification of those offences as summary, a provision shifting evidentiary burden in specified historical allegations, and delegated regulation penalties.

Fines under the primary offences (s 5)

• Unqualified person carrying on hairdressing for fee or reward (s 5(1)): fixed penalties are set by the Act. The penalty for a first offence is $1,000 and for a second or subsequent offence $4,000. The statutory wording fixes the monetary sums rather than providing a maximum fine range.

• Employer employing unqualified person (s 5(2)): mirror penalties apply to employers. First offence $1,000; second or subsequent $4,000. The employer offence is separate from the practitioner offence, so both could conceivably be charged in related circumstances.

Regulatory penalties (s 8)

• Regulations may prescribe penalties not exceeding $500 for breaches of regulations made under the Act (s 8(2)(c)). These are subordinate-legislation fines and are lower than the primary offence fines; they apply only to regulation contraventions, not to the section 5 offences.

Classification and procedure (s 6)

• All offences under the Act are summary offences (s 6). That classification directs prosecutions to summary jurisdiction procedures rather than indictable processes, which affects procedural rules for plea, evidence, sentencing ranges available to a summary court, and appeal routes.

Evidentiary provision (s 7)

• Section 7 states that in a complaint alleging that a person was required to be registered under the repealed Act as at 30 June 1988 but was not registered, the allegation will, in the absence of proof to the contrary, be taken to be proved. That provision shifts the evidentiary burden in favour of the prosecution in a narrow historical category of cases. It effectively creates a rebuttable presumption against persons alleged to have lacked historical registration.

Enforcement agents and mechanisms

• The Act does not specify an enforcement agency, inspection regime, or complaint-handling body within its text beyond the Commissioner’s recognition function. Prosecutions for summary offences will proceed through the ordinary summary criminal processes of the State. The absence of an express enforcement agency in the Act means standard public prosecutorial authorities would be involved in enforcement.

Repeat offences

• The Act distinguishes second or subsequent offences with a larger fine. The statutory record-keeping and identification of prior offences will therefore feed into sentencing decisions, but the Act itself simply sets the monetary sums tied to repeat offending.

Discretion and delegated enforcement tools

• The Governor’s regulation power (s 8) allows the creation of lower-penalty enforcement levers, exemptions and branch-specific controls. This enables finer-grained compliance instruments that do not require primary-act amendment. However, regulations are limited to penalties not exceeding $500 for their breaches, which is an order of magnitude smaller than the section 5 fines.

Practical enforcement implications

• Prosecutors and complainants can rely on s 7 for historical registration-related allegations without having to prove non-registration beyond reasonable doubt if no contrary proof is adduced. Defendants in such historic cases bear a practical onus to produce evidence of registration.

• Employers and small operators face an enforcement risk that is financial rather than custodial, and enforcement will be pursued in summary courts. The Act’s design concentrates enforcement pressure on monetary penalties, leaving scope for administrative discretionary relief to be exercised outside the criminal scheme only by regulation or by the Commissioner’s recognition.

The Act expressly interfaces with a small number of other instruments and leaves many potential intersections unspecified in the text provided. Where the Act references other legislative or administrative frameworks, those references determine jurisdictional and procedural crossovers.

Statutory repeal and vesting (s 3)

• The Act repeals the Hairdressers Registration Act 1939 (s 3(1)). It vests the repealed Board’s assets and liabilities in the Minister (s 3(2)). The Minister’s responsibilities to discharge liabilities from those assets and to apply any surplus to promoting the profession are statutory consequences internal to the public sector. This creates an interlocking relationship between the present Act and the historical 1939 scheme, but it does not re-establish the Board.

Administrative review and SACAT linkage (s 4, legislative history)

• The Act’s right of review in s 4B refers explicitly to the Tribunal established under the South Australian Civil and Administrative Tribunal Act 2013 (s 4 definition and s 4B(1)). The 2019 Statutes Amendment (SACAT) Act moved review jurisdiction to the Tribunal (see Legislative history: Statutes Amendment (SACAT) Act 2019 Pt 13 and the transitional provisions, s 95). Thus administrative review now sits within the SACAT framework, and the Tribunal’s procedural rules and powers under the SACAT Act will apply to reviews of Commissioner determinations. The transitional provisions in the 2019 amendment instruct how existing appeals are to be treated (see the "Transitional etc provisions associated with Act or amendments" entry, Pt 13, s 95).

Regulations and subordinate law (s 8)

• The Governor’s power to make regulations under s 8 provides the main point of interaction with subordinate law. Regulations may declare prescribed qualifications for new cohorts (s 4(b) in conjunction with s 8), exempt persons or classes (s 8(2)(a)) and regulate or restrict prescribed branches by class (s 8(2)(b)). This means that other regulatory instruments made under the Governor’s power can materially change who is captured by the Act and what behaviours are prohibited.

Reference to administrative procedure statutes

• The Act’s review mechanism cross-references s 34 of the South Australian Civil and Administrative Tribunal Act 2013 (s 4B(1) expressly). That cross-reference imports the Tribunal Act’s procedural framework for merits review, including application processes, time limits where the Tribunal Act prescribes them, stay powers, costs rules, and other SACAT-specific processes.

Gaps and absent interactions

• The Act does not reference occupational health and safety statutes, local government by-laws, consumer protection statutes, or national qualifications frameworks. Therefore any interaction with those regimes would be determined by the broader statutory landscape and regulatory practice rather than by textual cross-reference in this Act.

• There is no express continuing registration regime created in the Act, save for the Commissioner recognition process and the use of regulations to define qualifications. The Minister’s vesting of assets from the repealed Board does not itself recreate a registration board or authorise the Minister to register persons under the principal Act. Instead, the Minister has fiscal custodial functions under s 3.

Transitional provisions and historical interaction

• The legislative history records amendments and transitional rules that affect interaction with other laws. Notably the 2019 transitional provision s 95 provides that appeals under s 4B pending but not exercised before the relevant day are to be exercised as if the Tribunal had been in operation at the time, so that proceedings commence in the Tribunal rather than the Administrative and Disciplinary Division of the District Court (Legislative history: Statutes Amendment (SACAT) Act 2019, Pt 13, s 95). That provision clarifies procedural jurisdictional transfer for ongoing matters.

In short, the Act interacts expressly with the repealed 1939 statute, the Commissioner and the Tribunal established by the SACAT Act, and with regulations made under the Governor’s power. Interactions with other regulatory or licensing regimes are not specified in the Act’s text and would require cross-referencing those other statutes.

The legislative history appended to the Act documents several amendments and consequential changes to provisions. The text supplied lists the principal Act and subsequent amending Acts, the provisions varied, commencement dates and specific insertions and substitutions.

Chronology and principal entries

• 1988: Hairdressers Act 1988 (No 35). Assent 21 April 1988 with a commencement entry (1.1.1989: s 2 referenced in the table; note also s 2 was later omitted under the Legislation Revision and Publication Act 2002 as indicated in the "Provisions amended" table).

• 2001: Hairdressers (Miscellaneous) Amendment Act 2001 (No 1). Assent 22 March 2001; commencement 16 February 2003 (Gazette 13.2.2003 p581). This amending Act made substantive changes: it inserted s 4A and s 4B (see "Provisions amended": ss 4A and 4B inserted by 1/2001 s 4, commenced 16.2.2003). It also inserted "Commissioner" and substituted definitions for "hairdressing" and "qualified person" (inserted by 1/2001 s 3(a), and substituted by 1/2001 s 3(b) and s 3(c) respectively), and removed "unqualified person" (deleted by 1/2001 s 3(d)). Those definitional and procedural changes reworked the qualification and recognition mechanics and introduced an administrative recognition pathway.

• 2019: Statutes Amendment (SACAT) Act 2019 (No 14). Assent 11 July 2019. Commencement entries show Pt 13 (ss 93 to 95) came into operation 2 December 2019 (Gazette 21.11.2019 p3928). The 2019 amendment inserted "Tribunal" as the South Australian Civil and Administrative Tribunal (s 4 definition) and substituted parts of s 4B so the Commissioner’s refusals are reviewable to the Tribunal (s 4B(1) and (2) substituted by 14/2019 s 94(1); s 4B(4) amended by 14/2019 s 94(2)). Transitional provisions (Statutes Amendment (SACAT) Act 2019, Pt 13, s 95) govern how existing rights of appeal are to be exercised in the Tribunal rather than the Administrative and Disciplinary Division of the District Court.

Other revisions

• The Act notes that s 2 was omitted under the Legislation Revision and Publication Act 2002; the "Provisions amended" table lists that omission. The legislative history also lists "Historical versions" with a dated snapshot (16.2.2003) likely reflecting the 2001 amendments coming into operation on that date.

Textual consequences

• The 2001 amendments are the origin of the Commissioner recognition mechanism in s 4A and the initial s 4B review process. The 2019 amendments are consequential and procedural: they transfer review jurisdiction to SACAT’s Tribunal and provide transitional rules preserving rights in existing proceedings.

• The legislative history also documents precise provision-level variations such as the insertion of the Commissioner definition and substitution of "hairdressing" and "qualified person" definitions, which materially altered the statutory framework from the pre-2003 form.

• The transitional provisions in the 2019 amendment contain a savings clause: proceedings commenced before the relevant day in the Administrative and Disciplinary Division of the District Court are unaffected (see Statutes Amendment (SACAT) Act 2019, Pt 13, s 95(2)).

Where to find amendment mechanics

• For practitioners needing to track current obligations, the legislative history entries identify the source amending Acts and commencement dates. The chapter-level notes make clear which variations are deletions versus substitutions and indicate dates of operation for each change.

Overall, the Act began in 1988, was substantively updated by the 2001 amendment which created the Commissioner recognition pathway and modernised definitions, and was procedurally updated in 2019 to align appeals with the Tribunal regime. The Minister’s vesting of assets at commencement and the removal of the old Board together reflect a shift from board-based registration to a combination of regulation and administrative recognition.

The text of the Act and the legislative history supplied contain no listing of judicial decisions, cases, or litigation outcomes interpreting the provisions. The Act itself, however, creates procedural points that would be relevant to any litigation that occurs under it.

Statutory review pathway

• The Act creates a statutory review pathway for applicants refused recognition by the Commissioner (s 4B). That route is to the Tribunal under the South Australian Civil and Administrative Tribunal Act 2013 (s 4B(1)). The 2019 amendment moved review jurisdiction to the Tribunal and contains transitional provisions to transfer pending but unexercised appeals to the Tribunal rather than the Administrative and Disciplinary Division of the District Court (Statutes Amendment (SACAT) Act 2019, Pt 13, s 95). Where litigation arises from refusals under s 4A, the Tribunal is the merits review body for such disputes.

No cases cited in the Act

• The Act’s text does not cite or reference any judicial authority or administrative decisions. The legislative history does not include case names or summaries. Consequently, the Act supplies no direct litigation precedents.

Practical litigation issues that could arise

• Rebuttal of the s 7 presumption in prosecutions: prosecutions alleging historic non-registration as at 30 June 1988 will rely on s 7’s evidentiary presumption. Litigation would likely centre on whether the defendant has adduced sufficient contrary proof to overcome that presumption. The burden-shifting mechanism in s 7 will be the central litigation lever in those cases.

• Judicial review or merits appeals: refusals by the Commissioner could be subject to merits review in the Tribunal under s 4B. Where the Tribunal’s jurisdictional or procedural rules are contested, litigation could involve application of the Tribunal Act’s standards and reviewability principles.

• Sentencing and repeat-offence determinations: prosecutions for section 5 offences may raise factual disputes over whether conduct constituted "carrying on the practice of hairdressing for fee or reward". Litigation would also address whether an offence is a first or subsequent offence for the purpose of fixed penalty amounts.

Absence of litigation history in the text

• Because there is no statutory list of cases, readers must look beyond the Act for any reported decisions. The Act’s text and legislative history constrain the probable lines of litigation but do not disclose outcomes.

In sum, the Act creates litigation-relevant mechanisms (a Tribunal review path, an evidentiary presumption and monetary penalties) but contains no reported litigation history within the supplied text. Any body of case law would need to be sought in external repositories; the Act itself does not supply that material.

The Act is compact but contains several textual features and interaction points that create legal and practical pitfalls practitioners and employers should note. These are matters where a straightforward reading can lead to unintended consequences unless the statutory mechanics are acted upon.

1. Broad statutory definition of hairdressing (s 4)

• The statutory definition lists cutting, colouring, setting, permanent waving and "other treatment" of a person's hair. The open-ended term "other treatment" can encompass services that some providers might not regard as traditional hairdressing. Commercial providers of allied cosmetic or chemical services should not assume exemption; legal risk depends on the service being classified as "hairdressing" within the Act’s broad definition.

2. Prescribed qualifications split by historical cohort (s 4)

• For persons who were required to be registered under the repealed Act as at 30 June 1988, prescribed qualifications mean actual registration on that day (s 4(a)). For everyone else, prescribed qualifications are declared by regulation (s 4(b)). That creates two distinct routes with different evidential needs. Persons who believe they are covered by historical registration must ensure documentary proof as s 7 creates a presumption against them in prosecutions unless they prove otherwise.

3. Evidentiary presumption for 30 June 1988 claims (s 7)

• Section 7 means that in prosecutions alleging someone was required to be registered under the repealed Act but was not registered at 30 June 1988, the allegation is taken to be proved unless contrary proof is produced. Defendants in such historic matters carry an evidentiary burden to rebut the presumption. The presumption does not apply to more recent qualification disputes.

4. Commissioner discretion and document requirements (s 4A(1)-(3))

• The Commissioner’s power to determine someone is qualified is discretionary and the Commissioner may set application form and documentation requirements and require statutory declaration verification (s 4A(2)-(3)). Applicants who fail to meet procedural requirements risk rejection and must beware that the Commissioner can demand statutory declarations, which are formal instruments.

5. Short review time limit and reason-triggered extension (s 4B(2)-(4))

• An applicant must apply to the Tribunal within one month of the Commissioner’s determination (s 4B(2)). However, if the Commissioner did not give written reasons at the time of determination and the applicant requests written reasons within one month, the review period runs from the applicant’s receipt of the written reasons (s 4B(4)). Practically, an applicant must be proactive in requesting written reasons to preserve review time, and must track receipt dates.

6. Employer liability irrespective of knowledge (s 5(2))

• The employer offence is phrased without a knowledge element. That means employers can be criminally liable for employing unqualified persons regardless of whether the employer was aware the employee lacked qualification. Employers must therefore verify and retain evidence of employee qualifications.

7. Apprenticeship exception is narrow (s 5(3))

• The only statutory exception to the employer and practitioner offences is employment by a qualified person of a person undertaking an apprenticeship in hairdressing (s 5(3)). Other forms of training or internships are not expressly protected by the Act. Employers should ensure any trainee is a recognised apprentice to rely on the exception.

8. Regulations can create lower-level but materially significant rules (s 8)

• The Governor may exempt classes or regulate branches of hairdressing (s 8(2)(a)-(b)). Regulations may set penalties up to $500 for breaches (s 8(2)(c)). Because regulations can materially alter who is subject to the Act and what procedures apply, practitioners must monitor subordinate legislation. Regulatory penalties are smaller but can be imposed more widely and more granularly.

9. No express registration board or active licensing machinery in the Act

• The Act does not recreate the old Hairdressers Registration Board. Assets and liabilities vested in the Minister (s 3), but no statutory board or licensing regime is set up in the Act text. Qualification for practice thus depends on historical registration, regulation-declared qualifications, or the Commissioner’s recognition, there is no continuing statutory register established by this Act itself.

10. Silence on enforcement agency and inspection powers

• The Act does not specify which agency enforces offences or how inspections, seizures or compliance audits are to occur. Enforcement will therefore proceed under ordinary summary offence processes, but without specific investigative powers in the Act text. This may create practical uncertainty about complaint handling and investigation pathways.

11. Risk of outdated cross-references and instrument names

• The Act’s notes warn that references to other legislation, instruments or titles may be obsolete unless updated (Legislative history notes). Practitioners must check current sources for the correct titles and applicable procedural rules, particularly when relying on external statutory references.

These "gotchas" are structural and procedural risks embedded in the Act’s text. They affect evidence strategy, time-critical review actions, employer hiring practices, the scope of regulated activity, and the need for vigilance about subordinate regulation.

Compliance under the Act focuses on preventing the commission of the section 5 offences, on ensuring proper documentary proof when needed, on using the Commissioner recognition process correctly, and on managing employer obligations and apprenticeship arrangements.

For practitioners (operators and individual hairdressers)

1. Establish qualification status

• Determine whether you hold "prescribed qualifications" by checking two statutory routes: whether you were registered under the repealed Act on 30 June 1988 (s 4(a)) or whether the regulations declare your qualification as prescribed (s 4(b)). If neither applies, seek recognition from the Commissioner under s 4A.

2. Apply for Commissioner recognition where needed (s 4A)

• If reliance on regulatory or historical qualification is unavailable, lodge an application to the Commissioner in the manner and form approved (s 4A(2)). Provide records and information the Commissioner may require and be prepared to verify those documents by statutory declaration if requested (s 4A(3)). Retain copies of the application and any statutory declarations.

3. Keep records to rebut s 7 presumption

• If you or a colleague was in a cohort that might be alleged as not registered at 30 June 1988, retain original registration documents, certificates, or contemporaneous proof of registration. Section 7 imposes a presumption against persons alleged to lack registration at that historical date, so documentary proof is the practical defence.

4. Avoid commercial practice without qualification (s 5(1))

• Do not "carry on the practice of hairdressing for fee or reward" unless you are a "qualified person". If you undertake occasional private or unpaid hairdressing outside a commercial setting, the Act’s offence language applies to fee or reward and therefore may not capture non-commercial activity.

For employers and salon operators

1. Verify employee qualifications before engagement (s 5(2))

• Implement a verification process and keep records evidencing employees’ qualification status to avoid employer liability. The employer offence does not contain an explicit mental element; therefore due diligence documentation is essential. Verify whether staff are qualified persons either by checking prescribed qualifications or by ensuring they have a Commissioner determination under s 4A.

2. Use the apprenticeship exception correctly (s 5(3))

• If engaging trainees, ensure apprenticeships are formal and recognised as apprenticeships in hairdressing. The statutory exception is limited to apprentices undergoing an apprenticeship; other training arrangements are not protected by the exception in s 5(3).

Administrative and procedural compliance

1. Manage applications and review timetable (s 4A-4B)

• If an application to the Commissioner is refused, the applicant must apply to the Tribunal within one month (s 4B(2)), unless the applicant requested written reasons and the review period runs from receipt of those reasons (s 4B(4)). Applicants should proactively request written reasons where none are provided promptly to preserve entitlement to review. Maintain evidence of posting and receipt of applications and reasons.

2. Monitor regulations made under s 8

• Regularly check for regulations made under the Act because regulations may declare prescribed qualifications, exempt classes from the Act, regulate specific branches, or impose regulation-level penalties up to $500 (s 8(2)). Compliance strategies should therefore include subscription to legislative updates and periodic checks of subordinate instruments.

3. Prepare for summary proceedings and evidentiary burdens (s 6-7)

• Understand that offences are summary and will be prosecuted in summary jurisdiction (s 6). In circumstances implicating s 7, prepare documentary evidence to rebut presumption-based allegations. Engage legal representation early if a complaint is lodged.

For administrators and decision-makers

1. Commissioner’s processes and documentation (s 4A-4B)

• The Commissioner should publish application forms and required documentation standards to provide transparency about the recognition pathway under s 4A(2). Procedures for requiring statutory declarations should be clear and proportionate given the legal significance of determinations.

2. Minister’s handling of vested assets (s 3)

• The Minister must discharge liabilities from vested assets and apply surplus funds to promoting the profession as the Minister thinks fit (s 3(3)). Clear internal governance around the use of those funds and records of decisions will assist transparency and accountability.

Risk management and operational checklist

• Verify qualification status for every commercial employee and contractor before engagement.
• Keep certified copies of qualifications and any Commissioner determinations on file.
• For older practitioners or delegations involving the 1939 Act, retain historical registration documents, as s 7 makes adverse evidentiary presumptions possible.
• Document the application process for Commissioner recognition, including dates, proof of service and statutory declarations.
• If refused recognition, immediately request written reasons if not provided and diarise the one month review deadline (s 4B(2)-(4)).
• Subscribe to official legislative and regulatory update services to capture new regulations under s 8.
• Ensure apprenticeships are formal and documented to rely on the s 5(3) exception.

Following these steps aligns commercial behaviour with the Act’s requirements, addresses the particular evidentiary and timing risks contained in s 7 and s 4B, and reduces employer exposure under s 5(2).
