Guidelines for the Classification of Computer Games 2023

The Guidelines centre on a small set of structural concepts that determine whether a computer game will be assigned a classification, and which one. These concepts appear across Schedule 1 and structure the Board’s assessment.

1. Impact hierarchy. The Guidelines adopt a six-step impact hierarchy used to translate treatment of content into classification: very mild (G), mild (PG), moderate (M), strong (MA 15+), high (R 18+), very high (RC). The Board must assess not only each classifiable element singly but the cumulative effect of elements and the purpose and tone of sequences (Schedule 1, “Assessing impact”).

2. The six classifiable elements. The Guidelines identify six elements to be assessed: themes, violence, sex, language, drug use and nudity (Schedule 1, “The classifiable elements”). For each category (G through RC) the Guidelines specify how that element should be treated and provide thresholds for frequency, intensity and context that will push a game into a higher classification or into RC.

3. Context and treatment. The Guidelines repeatedly direct that context is crucial. The same depiction may produce different classification outcomes depending on story-line, themes, purpose, tone and whether treatment is justified by context (Schedule 1, “Importance of context”; category entries).

4. Interactivity as an aggravating factor. The Guidelines make interactivity a central concept distinct from passive media. Because players actively control outcomes and may be rewarded for actions, interactive sequences can produce higher impact than similar passive depictions. The Guidelines list features that increase impact: close-ups, slow motion, accentuation techniques (lighting, perspective, resolution), special effects (sound, characterisation), prolongation/repetition, realism versus stylisation, high degrees of interactivity (e.g. first-person vs third-person), and the use of incentives or rewards (Schedule 1, “Assessing impact”; “Interactivity and computer games”).

5. Incentives/rewards, monetary elements and simulated gambling. The Guidelines treat incentives and rewards as amplifying impact and, in some contexts, as independently disallowed. They distinguish (a) in-game purchases linked to elements of chance (Paid Loot Boxes), (b) simulated gambling (interactive activities resembling age-restricted real-world gambling but without real-world currency rewards), and (c) rewards convertible to real-world value. The rules vary by classification: Paid Loot Boxes are explicitly disallowed in G and PG, permitted in M and MA 15+ with constraints, and both in-game chance purchases and simulated gambling are permitted in R 18+ (Schedule 1, category entries; List of Terms).

6. Definitions that change scope. Key definitional choices expand or constrain scope: Real World Currency expressly includes cryptocurrency, and Paid Loot Box covers virtual items purchased with either real currency directly or via in-game currencies that are purchasable with real currency (List of Terms). The definition of Simulated Gambling targets interactive activities that resemble real-world gambling but do not provide real-world cash-outs. Interactivity itself is defined broadly to include technical features, incentives and competitive intensity.

7. Legal vs guideline status. The instrument explicitly locates the Guidelines as a tool to assist Board decisions under the Act and the National Code; it does not itself change the statutory Code or create offences. It states that the Act requires classification before release or advertising and that States and Territories are responsible for enforcement (Schedule 1, “The legal context”; opening paragraphs).

8. Refused Classification triggers. The RC category is articulated by reference to specific types of content and treatment that will result in refusal. These include detailed instruction/promotion of crime, depictions of child sexual abuse or persons who appear under 18, very high impact or excessively repetitive/prolonged detailed violence, actual sexual violence, sexual conduct connected to incentives/rewards, certain explicit simulated sexual activity (including bestiality and exploitative fetish material), and detailed instruction in the use of proscribed drugs (Schedule 1, RC).

Together, these concepts convert the Act’s broader criteria (morality, merit, character, intended audience) into operational rules responding to the specific features of modern computer games , interactivity, microtransactions, virtual currencies and immersive audiovisual techniques. For compliance and product design, the definitions and interaction of these concepts are the decisive elements: impact + interactivity + incentives = upward pressure on classification.

The Guidelines have a broad set of actors subject to their operational effects. The instrument text identifies responsible decision-makers and the categories of private parties whose activities will be governed by the Guidelines.

Primary decision-makers and public actors:

• Classification Board: the entity to which the Guidelines are directed; the Board applies them when classifying computer games or when other authorised methods are used (Schedule 1, “Classification Board’s application of the Guidelines”).
• Participating Ministers: the instrument is made with the agreement of each participating Minister (cl 5) and references the cooperative Commonwealth, State and Territory arrangement that underpins the National Classification Scheme (Schedule 1, “Background” and “The legal context”).
• Classification Review Board: an administrative review avenue is available for certain decisions (Schedule 1, “Classification Board’s application of the Guidelines”).
• Administrative support: provided by the Australian Government department named in the Schedule (Department of Infrastructure, Transport, Regional Development, Communications and the Arts at the time of drafting), which administers the Boards' support (Schedule 1).

Private-sector and public-facing actors directly affected:

• Game developers and creative teams: responsible for the content and treatment of themes, violence, sexual content, nudity, drug depiction, language, and the design of interactivity, rewards and purchase mechanics. The Guidelines’ definitions of Paid Loot Boxes and Real World Currency materially affect monetisation design choices (Schedule 1, List of Terms).
• Publishers and platform partners (distributors, digital storefronts): responsible for ensuring games are classified before release or advertising (Schedule 1, “The legal context” and “Classification categories”), presenting consumer advice, and ensuring that a game’s marketed classification matches its content. They will also carry costs for classification fees, submission time, and possible rework to meet classification thresholds.
• Online storefront operators and console ecosystems: will receive pressure to enforce regional classifications and may need to implement content flags, metadata and geoblocking to comply with state/territory enforcement; they may also be asked to restrict sales of RC material.
• Retailers and physical distributors: states and territories enforce classifications at retail level; the Guidelines therefore affect which products retailers may legally stock and sell in particular jurisdictions.
• Consumers and parents: consumers are the ultimate recipients of content; the Guidelines also require consumer advice to assist choices (Schedule 1, “Consumer advice”). Parents will face guidance restrictions (PG not recommended for under 15 without guidance; M not recommended for under 15; MA 15+ legally restricted).
• Age-restriction/verification service providers: where a game is MA 15+ (legally restricted) or R 18+ (legally restricted to adults), marketplaces and publishers must operationalise age limits , the Guidelines themselves do not prescribe mechanisms, but the existence of legally restricted categories assigns the enforcement role to States/Territories (Schedule 1, MA 15+, R 18+ notes).

Who pays and who decides:

• Publishers/developers will bear the economic costs of classification compliance: preparing submissions, possible re-editing or content removal to secure a preferred classification, implementing technical controls (region locks, age gates), and adapting monetisation models to avoid prohibited mechanics in lower classifications (e.g. Paid Loot Boxes in G/PG). The Board (or approved classification tools) decides the classification outcome after applying the Guidelines (cl 5, Schedule 1).
• States and Territories enforce the classification decisions; the instrument notes the cooperative scheme: Commonwealth makes classification decisions; States and Territories enforce them (Schedule 1, “The legal context”). The Guidelines do not set enforcement penalties themselves; those remain within the Act and State/Territory enforcement regimes.

Secondary effects on other actors:

• Payment processors and marketing partners may need to reconfigure offers and promotions to align with classifications and marketing claims.
• Monetisation advisers and legal/compliance teams engaged by publishers will be engaged more frequently to interpret the new definitions (e.g. Paid Loot Box) and their interaction with virtual currencies and crypto (List of Terms).
• International publishers targeting multiple jurisdictions must reconcile the Australian Guidelines with overseas rules; the instrument’s explicit definitions of Real World Currency (including crypto) and in-game currencies convert many global monetisation designs into regulated Australian concepts.

In sum, the Guidelines affect content creators, commercial partners, digital platforms and enforcement agencies, with the private sector bearing the immediate compliance and design costs and the Classification Board and States bearing decision and enforcement roles respectively.

The instrument itself primarily sets duties and expectations for application by the Classification Board and indirectly imposes compliance obligations on publishers and distributors via the Act. The Guidelines, read with the Act, create practical duties and certain rights.

Duties placed on the Classification Board and administrative actors:

• Apply the Guidelines when classifying computer games: Schedule 1 states that the Board is required to apply the Guidelines in making classification decisions (Schedule 1, “Classification Board’s application of the Guidelines”).
• Consider the Act’s statutory criteria: the Guidelines restate that classification must take into account standards of morality, decency and propriety generally accepted by reasonable adults; literary, artistic or educational merit; general character of the computer game; and the persons to whom it is published or intended (Schedule 1, “The Act” under “Classification criteria”).
• Use the impact hierarchy and assess context, interactivity, cumulative effect and purpose/tone of sequences when assigning classifications (Schedule 1, “Importance of context”; “Assessing impact”; “Interactivity and computer games”).

Duties and obligations that affect publishers, developers and distributors (derived from Schedule 1 statements and definitions):

• Ensure computer games are classified before release or advertising: the Schedule states that the Act requires films and computer games to be classified before they are released or advertised (Schedule 1, “The legal context”). This is a duty imposed by the Act and reiterated in the Guidelines.
• Provide consumer advice: the Act requires provision of consumer advice about the content of classified computer games; the Guidelines confirm this requirement and describe consumer advice as information that helps consumers make informed choices (Schedule 1, “Consumer advice”).
• Adhere to classification category content limits: publishers seeking a particular classification must ensure the game’s treatment of the six classifiable elements conforms to the thresholds set for that category (e.g. Paid Loot Boxes not permitted in G/PG; sexual activity not tied to incentives or rewards except in certain circumstances; interactive or detailed drug use may cause RC) (Schedule 1, category entries and List of Terms).
• Account for in-game purchase mechanics and virtual currencies: Paid Loot Box is defined to include purchases made either with real currency or with in-game currencies that are purchasable using real currency; developers must treat such mechanics accordingly during content design and submission (Schedule 1, List of Terms).

Rights and procedural protections:

• Right of review: the Guidelines note there are avenues for review of certain classification decisions, including by the Classification Review Board (Schedule 1, “Classification Board’s application of the Guidelines”).
• Administrative support and transparency expectations: the Schedule sets out administrative structures (Boards supported by a named Department) and a framework that links the Guidelines to the Code and the Act; this structure implies procedural records and decision-making traceability for review, though the Guidelines do not specify procedural steps or timelines.

Practical obligations implied for digital distribution and enforcement:

• Where a classification is legally restricted (MA 15+ and R 18+), distributors and retailers must implement measures to prevent access by underage persons in accordance with State/Territory enforcement rules; the Guidelines reiterate that the States and Territories enforce the Scheme (Schedule 1, “The legal context”; category notes).
• Publishers who alter a game post-classification (for example, by adding a paid loot box or new interactive drug-use sequences) must be aware that changes in content may change classification and could require re-submission or risk contravening the Act’s requirement that published or advertised games be classified.

Limits in the instrument:

• The instrument determines Guidelines but does not itself create criminal offences or fee schedules. It refers users to the Act for the statutory obligations and enforcement regime. Where the Guidelines set limits (e.g. RC triggers), the enforcement mechanism and penalties are derived from the Act and State/Territory law, not the Guidelines text itself (cl 3; Schedule 1, “The legal context”).

In practice, the combined duties that flow from the Guidelines and the Act create a compliance duty for publishers to assess game elements against the six elements and the impact hierarchy, adjust design and monetisation mechanisms to fit the targeted classification, provide consumer advice, and use available review avenues where classification outcomes are unfavourable.

The instrument itself does not create new criminal penalties or civil sanctions; it determines Guidelines to be applied by the Classification Board. However, it situates those Guidelines within the National Classification Scheme in a way that triggers enforcement responsibilities and potential penalties under the Classification (Publications, Films and Computer Games) Act 1995 and State/Territory laws. The Schedule is explicit that the Commonwealth makes classification decisions and the States and Territories enforce them (Schedule 1, “The legal context”).

What the text says about enforcement and sanctions:

• The instrument notes that classification decisions must be made before release or advertising of computer games under the Act (Schedule 1, “The legal context”). Failure to comply with the Act’s statutory mandates (for example, releasing unclassified material or distributing a Refused Classification item) will expose parties to whatever penalties the Act and State/Territory enforcing laws provide. The Guidelines themselves do not specify penalties, fines or enforcement mechanisms (cl 3 and Schedule 1).
• The Schedule indicates that classification decisions are reviewable in some circumstances by the Classification Review Board and that administrative support is provided by the Commonwealth department named (Schedule 1, “Classification Board’s application of the Guidelines”).

How enforcement is likely to operate in practice, as framed by the Schedule:

• Decision stage: The Classification Board (or an authorised method such as an approved classification tool) issues the classification for a computer game. That classification is the operative label that governs distribution and advertising in Australia (Schedule 1).
• Distribution stage: States and Territories enforce compliance with classification decisions within their jurisdictions. The instrument references a cooperative agreement between Commonwealth and State/Territory governments and indicates the enforcement role lies with States and Territories (Schedule 1, “The legal context”).
• Retail and platform consequences: Retailers and digital storefronts may be required by State/Territory law to refuse sale of RC items, or to prevent underage access to MA 15+ and R 18+ material. The Guidelines’ content definitions (e.g. Paid Loot Box, Real World Currency) inform whether an item can lawfully be offered in a given classification; offering an item with a label that does not match actual content may invite enforcement action.

Gaps and implementation risk about penalties:

• The Guidelines do not state the quantum of penalties, the specific enforcement procedures, or administrative processes for taking enforcement action; those remain within the Act and State/Territory statutes and are not reproduced in the Guidelines. Practitioners must therefore consult the Act and relevant State/Territory laws for the exact penalties and enforcement pathways.
• The instrument leaves to the existing legal machinery the role of imposing sanctions for non-compliance. This separation creates uncertainty for publishers about the scale of financial or criminal risk until the relevant Act/State rules are consulted.

Key enforcement-triggering behaviours, as set out in the Guidelines:

• Release or advertising of a computer game before classification (contravening the Act’s requirement referenced in the Schedule).
• Distribution, advertising or offering access to content that has been Refused Classification.
• Failing to observe legally restricted classifications in distribution (MA 15+, R 18+), where State/Territory law will define the enforcement measures.
• Offering content that contravenes the specific RC triggers (e.g. detailed instruction in crime, depictions of child sexual abuse, actual sexual violence) which, under the Act and supporting laws, are the categories most likely to be subject to prohibition and enforcement.

Practical note for risk management:

• Because the Guidelines determine the practical content thresholds that will lead to RC or legally restricted categories, publishers and distributors should treat classification outcomes as regulatory gatekeepers. Operational compliance should assume that non-conformance risks enforcement action under the Act and State/Territory statutes; those consequences are not detailed in the instrument but are real under the broader Scheme.

In short, the instrument defines the content and thresholds that determine classification outcomes; enforcement and penalties flow from the underlying Act and the States/Territories that enforce the Scheme, not from the Guidelines text itself. Practitioners must therefore map classification outcomes against the relevant statutory enforcement provisions to quantify legal and financial exposure.

The Guidelines are an instrument under the Classification (Publications, Films and Computer Games) Act 1995 and cannot be read in isolation. The instrument repeatedly places itself within the National Classification Scheme and the legislative and cooperative framework connecting Commonwealth classification decisions with State and Territory enforcement.

Relationship to the Act and the Code:

• The instrument is made under subsection 12(1) of the Act (cl 3) and explicitly refers to the Act as the legal source of the Code and of the power to make Guidelines (Schedule 1, “The legal context”). The Guidelines must be read as an implementation aid for applying the National Classification Code which sits within the Act. The Act contains the primary statutory duties (for example, classification before release or advertising) and the enforcement mechanisms; the Guidelines translate Code principles into applied tests for computer games (Schedule 1, “Classification criteria”).

Interaction with State and Territory law:

• The Guidelines state that while the Commonwealth makes classification decisions, the States and Territories enforce them (Schedule 1, “The legal context”). That means enforcement measures, penalties, and practical compliance duties (for example, how age-restrictions are operationalised at retail or online) will be governed by domestic State/Territory statutes and regulatory instruments, and any compliance strategy must accommodate those jurisdictional differences.

Regulatory overlap with consumer protection and advertising law:

• The Guidelines require consumer advice to accompany classified games (Schedule 1, “Consumer advice”). That consumer advice sits alongside existing consumer protection and advertising standards (for example, the Australian Consumer Law). Publishers must ensure that consumer advice is accurate and not misleading; consumer protection laws could apply if the advice or classification label misstates content or suitability. The Guidelines themselves do not specify the precise labelling or format of consumer advice; practitioners will need to coordinate with the Act and any relevant guidelines or standards about labels and advertising.

Monetary instruments, payments and financial regulation:

• The Guidelines define Real World Currency to include cryptocurrency (List of Terms). That definition pulls games that use crypto or other real-money instruments into scope for classification triggers regarding Paid Loot Boxes and in-game purchases linked to chance. While the Guidelines do not regulate cryptocurrencies as financial instruments, they create a regulatory interaction between game-design features that use cryptocurrency and classification thresholds. This may have secondary interactions with financial regulation (for example, anti-money laundering or payments regulation) when cryptocurrency or cross-border payments are involved, though the Guidelines do not itself regulate those domains.

Criminal law and child protection:

• The RC category explicitly references depictions involving persons who are, or appear to be, under 18 and prohibits descriptions or depictions of child sexual abuse and the promotion or provision of instruction in paedophile activity (Schedule 1, RC). These prohibitions interact with criminal and child protection laws; certain depicted conduct may also be prohibited by criminal statutes beyond classification. The Guidelines operate in the same space and provide classification thresholds, but criminal liability would be determined under relevant criminal laws.

Intellectual property and contractual obligations:

• The Guidelines impose content constraints that can affect contractual arrangements (licensing, platform agreements) and IP exploitation strategies. For example, licensors and publishers whose contracts require distribution across all major markets will need to allocate responsibilities for modifications to achieve an acceptable classification in Australia. The Guidelines themselves do not supersede contractual arrangements but will influence whether contractual obligations can be met without content changes or market segmentation.

Data protection and minors’ privacy:

• The Guidelines’ impact on age-verification practices and age restrictions may intersect with privacy and data protection obligations when platforms collect and process personal information to verify users’ age. The Guidelines do not mandate specific age-verification methods, but compliance strategies that implement age gates must consider privacy law obligations.

Administrative law and judicial review:

• Classification decisions are administrative decisions made under the Act and can be subject to administrative review mechanisms provided by the Act and available review avenues, including by the Classification Review Board (Schedule 1, “Classification Board’s application of the Guidelines”). Affected parties will also retain any judicial review rights applicable to administrative decisions under general administrative law, though the Guidelines themselves do not articulate those remedies.

In summary, the Guidelines operate as part of a broader legal ecosystem. They translate statutory classification criteria into applied rules for computer games and therefore interact with criminal, consumer protection, financial, privacy and administrative law domains. Practitioners must read the Guidelines in conjunction with the Act, the National Classification Code and the specific State/Territory enforcement regimes to understand the full legal obligations and consequences.

This instrument consolidates and replaces the prior Guidelines for the Classification of Computer Games 2012. The instrument’s formal amendment history within the text is compact but precise.

• Repeal of prior instrument: Clause 6 expressly repeals the Guidelines for the Classification of Computer Games 2012 (cl 6). The effect is that, on commencement, the 2012 Guidelines cease to have legal effect and are replaced by the 2023 Guidelines contained in Schedule 1.

• Making and dating: The instrument is signed by the Minister for Communications and dated 24 October 2023 (instrument header and cl 3). It states its authority as subsection 12(1) of the Classification (Publications, Films and Computer Games) Act 1995 (cl 3).

• Commencement: Clause 2 stipulates that the instrument commences on 22 September 2024 (cl 2). Between the date of signing and commencement, the previous Guidelines remain in force.

• Determination mechanism: Clause 5 indicates that the Guidelines in Schedule 1 are determined “with the agreement of each participating Minister” to assist the Board apply the Code to computer games. That clause records the cooperative federal process for enacting Guidelines under the Act rather than a unilateral executive action.

What the instrument does not do:

• The instrument does not amend the Act itself or the National Classification Code; it determines Guidelines under the Act (cl 3). Any statutory amendments to the Act or to the Code would require separate legislative or regulatory action by the relevant bodies.

Implications for transitional issues:

• Because the instrument repeals the 2012 Guidelines and specifies a commencement date, there is a transition period in which publishers and developers must anticipate the new Schedule 1 rules. Games released or advertised before the commencement date will remain governed by the pre-existing 2012 Guidelines, unless otherwise constrained by the Act. After 22 September 2024, all new classifications will be governed by the 2023 Guidelines in Schedule 1.

Observable content updates relative to prior guidance (textual evidence within the instrument):

• The Schedule adds or clarifies modern constructs explicitly relevant to contemporary game monetisation and technology: Paid Loot Box, Real World Currency including cryptocurrency, and a specific focus on interactivity as an impact amplifier (Schedule 1, List of Terms; “Interactivity and computer games”). These definitions and emphases reflect an alteration in content focus compared to older guidance, though the instrument does not include a preface that itemises every change from 2012.

Record of consultation:

• The Schedule’s introductory paragraph states the Guidelines are revised from time to time with extensive community input (Schedule 1, “Background”), indicating the Guidelines were developed with stakeholder consultation. The instrument itself, however, does not append a consultation report or explanatory memorandum that documents submissions or policy trade-offs.

In sum, the amendment history within the instrument is limited to repeal of the 2012 Guidelines, determination of the 2023 Schedule, signature and commencement timing. The Schedule’s updated definitions and emphases reflect modernisation for current game features, but the instrument does not effect statutory change to the Act or Code; it replaces the subordinate Guidelines that the Board must apply.

The Guidelines document contains no litigation history. It does not cite cases, nor does it summarise any judicial or tribunal decisions about the application of classification standards. The instrument confines itself to setting out policy and procedural guidance for the Classification Board and does not attempt to catalogue past litigation.

What the Schedule does record about dispute and review mechanisms:

• The Schedule states that classification decisions are made by the Classification Board or by other methods authorised under the Act (for example, by using an approved classification tool) and that there are avenues for review of certain decisions, including by the Classification Review Board (Schedule 1, “Classification Board’s application of the Guidelines”). That indicates an administrative review route but does not describe judicial review options or previous court decisions.

What is missing that practitioners will often seek:

• No examples of decisions that have turned on particular interpretations of interactivity, paid loot boxes, or simulated gambling are provided in the Guidelines. Practitioners looking for precedent examples or Board reasoning on where a specific mechanic (for example, a particular loot-box implementation or first-person procedural violence) fell within the M/MA 15+/R 18+ spectrum will not find them in this instrument.
• No appellate or judicial outcomes are summarised. If a party seeks to understand how courts have treated classification decisions or to rely on judicial interpretation of the Act and Code, they must consult external case law sources and not the Guidelines.

Consequences for legal practice and strategy:

• The absence of litigation history in the text increases the importance of administrative review records and prior Board decisions available separately. Practitioners should use the Review Board process and any published Board determinations to build a record and, where necessary, prepare grounds for judicial review based on administrative law (procedural fairness, irrationality, error of law) if the classification decision appears inconsistent with the Act and Code.
• Because the Guidelines set new or clarified definitional boundaries (Paid Loot Box, Real World Currency) and emphasise interactivity and incentives, litigators and compliance counsel should anticipate future disputes where these definitions are pivotal. Expect a body of administrative decisions and possibly judicial consideration over interpretation as cases arise post-commencement.

In practical terms, while the Guidelines provide the Board’s working rules, they do not contain or summarise legal precedents. Parties seeking to challenge or rely on classification outcomes must look to the Board’s decisions, the Classification Review Board determinations and, where applicable, judicial decisions interpreting the Act and Code outside the instrument.

The Guidelines contain multiple drafting features and definitional choices that create practical pitfalls for publishers, developers and distributors. The following are concrete “gotchas” drawn directly from the instrument text that counsel and compliance teams should highlight.

1. Paid Loot Box definition is broad and includes virtual currencies purchasable with real money. The List of Terms defines Paid Loot Box to include virtual containers purchasable using real world currency or using in-game virtual currency, items or credits that can be purchased using real-world currency (Schedule 1, List of Terms). Practically, this captures systems where players buy in-game currency with real money and then use that currency on chance-based rewards. If your game’s monetisation uses purchasable in-game currency that buys chance-based rewards, it meets the Paid Loot Box definition.

2. Real World Currency includes cryptocurrency. The Real World Currency definition explicitly includes “cryptocurrency” (Schedule 1, List of Terms). This extends the classification consequences to crypto-based payments and means blockchain or token-based economies that can be purchased with fiat or crypto may be caught by Paid Loot Box rules.

3. The distinction between “in-game purchases linked to elements of chance” and “simulated gambling” matters , and they are treated differently by category. The Guidelines permit in-game purchases linked to elements of chance in M and MA 15+ but prohibit simulated gambling at those levels; R 18+ permits simulated gambling (Schedule 1, M, MA 15+, R 18+ entries). Developers must map their mechanics carefully: an in-game crate bought for virtual currency might be a Paid Loot Box (chance element); a mini-game that resembles a slot machine without cash-out might be simulated gambling. The two concepts overlap but carry distinct classification consequences.

4. “Except in material restricted to adults, nudity and sexual activity must not be related to incentives or rewards.” This sentence (Schedule 1, “Interactivity and computer games”) introduces a textual tension with other provisions. It suggests that in R 18+ material (restricted to adults) nudity and sexual activity could, in some circumstances, be related to incentives or rewards; however, other category rules still prohibit certain sexual depictions (for example, actual sexual activity is “not permitted” in R 18+, and explicit, realistic simulated sexual activity is disallowed) and RC forbids sexual content involving people who are, or appear, under 18. The result is an area of interpretive complexity: tying sexual content to incentivisation in R 18+ may nonetheless be prevented by other constraints.

5. Sexual content rules remain restrictive even at R 18+. R 18+ explicitly states that “depictions of actual sexual activity are not permitted” while allowing certain simulated sexual activity (Schedule 1, R 18+). Therefore developers cannot assume R 18+ is an unfettered adult category; explicit or realistic sexual depictions remain constrained and some simulated sexual activity may be refused if explicit and realistic or exploitative.

6. Interactive drug use and incentives are a narrow trigger for RC. The Guidelines make RC where there is “detailed instruction in the use of proscribed drugs” and state computer games will be refused if they contain (i) illicit or proscribed drug use related to incentives or rewards; (ii) interactive drug use which is detailed and realistic (Schedule 1, RC; M/MA 15+/R 18+ entries). If gameplay requires players to actively perform detailed, realistic drug-use interactions, or if games reward illicit drug use, a publisher may face RC.

7. High interactivity multiplies impact. The Guidelines list interactivity features that increase impact (Schedule 1, “Assessing impact” and “Interactivity and computer games”). Designers using first-person perspective, high-fidelity graphics and repeated reward loops should expect upward pressure on classification because those features accentuate impact even for the same underlying depiction.

8. Cumulative effect test can push a game higher than any single element. The Guidelines direct assessment of cumulative effect. Multiple moderate elements combined (e.g. moderate violence plus repeated strong coarse language plus chance-based monetisation) can collectively produce a higher classification than each element alone would suggest (Schedule 1, “Assessing impact”).

9. Consumer advice is required but format is unspecified. The Schedule says the Act requires provision of consumer advice (Schedule 1, “Consumer advice”) but does not specify presentation, granularity or placement. Publishers must therefore consult the Act or the Board’s administrative policies to ensure compliance with labelling/advertising rules and avoid misleading consumers.

10. Post-release changes can alter classification status. The Guidelines do not expressly address patches, DLC or post-release monetisation changes but the Act requires classification before release or advertising. Adding Paid Loot Boxes after classification, or introducing new interactive drug-use sequences, can change the product’s compliance posture and may require re-submission or risk enforcement. The instrument’s definitions treat feature changes as potentially material to classification.

11. Jurisdictional enforcement differences remain. The instrument clarifies that the Commonwealth classifies and States/Territories enforce (Schedule 1, “The legal context”). Practitioners must therefore map distribution strategies to State/Territory enforcement rules and cannot rely on a single national enforcement approach.

12. No penalties in the Guidelines. The instrument does not quantify penalties or enforcement processes. Compliance risk therefore requires consulting the Act and State/Territory statutes to determine concrete sanctions.

13. Ambiguity over “simulated sexual activity” vs “actual sexual activity.” R 18+ allows simulated sexual activity but disallows depictions of actual sexual activity; RC disallows explicit and realistic simulated sexual activity. Determining what is “simulated” versus “actual” or what is “explicit and realistic” is inherently context-dependent and will be a frequent source of Board interpretation.

14. Public-facing metadata and storefront labelling can create enforcement exposure. Mislabelled games or promotional materials that present unclassified or mis-classified content as suitable for a lower age group will attract enforcement scrutiny given the Act’s pre-release classification requirement.

To manage these gotchas, publishers should not rely on informal or international classification analogues; they must run a content audit against the six classifiable elements and the explicit definitions in the List of Terms, evaluate the role of monetisation and incentives, and when in doubt seek pre-submission guidance or use the approved classification tool and the Board’s review channels.

Compliance under these Guidelines requires a structured, repeatable process that maps product design choices to the six classifiable elements, the impact hierarchy and the specific definitions in the List of Terms. Below are practical steps, organised for product, legal and distribution teams, to reduce risk and align with the Guidelines.

1. Early-stage content audit and design decisions

• Conduct a content inventory mapped to the six classifiable elements: themes, violence, sex, language, drug use and nudity (Schedule 1, “The classifiable elements”). For each asset and gameplay mechanic, record frequency, intensity, interactivity and context.
• Assess interactivity features: identify first-person vs third-person perspectives, degrees of control, reward/incentive mechanisms, repetition and realism. Flag sequences where player actions may cause realistically depicted injury, post-mortem damage, sexual activity, or detailed drug-use performance (Schedule 1, “Interactivity and computer games”).
• Analyse monetisation: if you plan in-game purchases linked to chance, determine whether those purchases are Paid Loot Boxes under the Guidelines (List of Terms). If in-game currency is purchasable with real money, Paid Loot Box rules apply.

2. Classification target decision and design trade-offs

• Choose a target classification early (G, PG, M, MA 15+, R 18+). Use the Guidelines’ “impact test” for the target category to inform allowable content thresholds (Schedule 1, category entries).
• Where achieving a lower classification is commercially important, remove or rework mechanics that are explicitly disallowed in that category (e.g. Paid Loot Boxes are not permitted in G and PG; avoid chance-based monetisation for those targets) (Schedule 1, G and PG entries).
• If targeting R 18+, remember that some sexual depictions remain disallowed (actual sexual activity is not permitted; explicit/realistic simulated sexual activity is disallowed) and that simulated gambling is permitted only in R 18+ (Schedule 1, R 18+).

3. Technical and monetisation controls

• Implement feature toggles and build-time/configuration flags to enable/disable content per region or classification outcome. This allows the publisher to ship base game content while selectively enabling or disabling elements that would alter classification in Australia.
• For in-game currencies, maintain auditable purchase flows that separate purchases of consumables from chance-based purchases; document whether in-game currency is purchasable with real-world currency to determine Paid Loot Box status (List of Terms).
• For simulated gambling mini-games, ensure their availability is restricted to jurisdictions and storefronts where R 18+ distribution and age-verification are operational, or remove such features to retain a lower classification.

4. Pre-submission and Board engagement

• Consider an early classification submission or use an approved classification tool authorised under the Act if available to generate an initial assessment. The Guidelines note classification decisions may be made by the Board or by such authorised methods (Schedule 1, “Classification Board’s application of the Guidelines”).
• Prepare a submission packet that documents context, purpose and treatment for contested sequences (e.g. narrative justification for violence, how interactivity is framed, whether sexual activity is contextualised and discreet). The Guidelines stress context and treatment are essential to the Board’s decision.
• Where feasible, request pre-submission guidance from the Board or administrative support staff to clarify ambiguous areas (e.g. whether a mechanic is Paid Loot Box or simulated gambling).

5. Consumer advice and labelling

• Prepare consumer advice content (content descriptors) aligned with the Act’s consumer advice requirement (Schedule 1, “Consumer advice”). Ensure it accurately describes the presence and nature of violence, sexual content, drug depiction, strong language, nudity, and monetisation mechanics such as Paid Loot Boxes.
• Coordinate with platform storefronts to ensure the consumer advice is visible at point-of-sale and consistent with the Board’s final classification.

6. Distribution, age verification and jurisdictional measures

• Implement geoblocking and storefront restrictions for Australia if a game is Refused Classification or contains R 18+ elements that you cannot restrict by age verification. The Guidelines note States/Territories enforce classification outcomes and that legal restrictions apply to MA 15+ and R 18+ categories (Schedule 1, “The legal context”; MA 15+ and R 18+ notes).
• For legally restricted categories, deploy robust age-verification measures and retain records demonstrating reasonable steps to limit access to adults in line with State/Territory enforcement expectations.
• If the game is being distributed on multiple platforms, ensure synchronised content and monetisation settings. A mismatch between an Australian-classified product and a storefront-enabled feature that alters classification could result in enforcement action.

7. Post-release monitoring and patch management

• Establish a formal change-control process that flags any post-release changes that could affect classification: new DLC, additional microtransactions, rebalancing that increases violence realism, or new simulated gambling features. Such changes may require re-submission for classification or risk non-compliance with the Act’s pre-release/advertising requirement (Schedule 1).
• Maintain an audit trail of classification submissions, decisions and consumer advice. Keep records of technical settings, region restrictions and age-verification procedures to demonstrate compliance in the event of an enforcement inquiry.

8. Legal review and risk assessment

• Legal teams should map classification outcomes to the Act and to State/Territory enforcement statutes to quantify exposure to penalties or remedial requirements. The Guidelines do not specify penalties; those are found in the Act and enforcement laws.
• Consider scenario-based risk assessments: e.g. if a Board classification yields RC, what is the commercial plan (remove content, rework and resubmit, or block distribution in Australia)? Plan contractual clauses with licensors and distribution partners to allocate costs and responsibilities for reclassification or content removal.

9. Communications and public relations

• Prepare a public communications plan that accurately reflects the classification and the consumer advice; do not market the product as suitable for a lower age group than the Board’s classification. Misleading marketing may trigger enforcement and consumer law exposure as well as regulatory scrutiny.

10. Use of the Review Board

• If the Board’s decision is unfavourable, use the available administrative review channels, including the Classification Review Board, as identified in the Guidelines (Schedule 1, “Classification Board’s application of the Guidelines”). Prepare a detailed review application that addresses context, cumulative impact and treatment to argue for a different classification.

In practice, compliance is a cross-functional exercise spanning creative, technical, legal and commercial teams. The Guidelines make monetisation mechanics and interactivity central to classification outcomes; publishers must therefore integrate legal review into product design and release pipelines rather than treating classification as a post-production checkbox.
