What it does
This Act creates a statutory entitlement for three categories of persons to be accompanied by a guide dog in public places and on public passenger vehicles, and prohibits refusal, exclusion or denial of accommodation or service on the basis of the presence of a guide dog. The core operative provisions are in section 3. Section 3(1) gives a person who is blind or vision impaired, deaf or hearing impaired, or a trainer, the right to be accompanied by a guide dog into any public place and onto any public passenger vehicle, and states that taking a guide dog into such places does not itself constitute an offence (s 3(1)). Section 3(2) imposes a negative duty on the person in charge of a public place or public passenger vehicle, and their servants or agents, not to refuse admission, direct to leave, or deny accommodation or service to a person accompanied by a guide dog, with a penalty of a fine not exceeding 20 penalty units for breach (s 3(2)).
The Act defines what counts as a guide dog, and what institutions may be approved for training them, in section 2. The definition covers guide dogs trained by an approved guide dogs institution for blind or vision impaired persons, hearing dogs trained by an approved hearing dogs institution for deaf or hearing impaired persons, and dogs being trained by an approved institution that are identified as dogs in training by a distinctive coat or harness showing the institution’s name (s 2).
Section 3 also treats omission as a means of refusal or denial (s 3(3)), provides statutory defences where a defendant can show reasonable cause unrelated to the presence of the dog, or that the person could not produce an identity card on request made before refusal and that such a request was reasonable in the circumstances (s 3(4)). The Act sets up an identity card regime, requiring approved institutions to issue identity cards in a form they determine, and to include the institution’s name and the cardholder’s name and address; cardholders must return the card as soon as practicable after ceasing to be a trainer or to whom a guide dog is assigned, with a penalty up to 0.5 penalty units for failing to return the card (s 3(5)-(6)).
