Guardianship of Infants Act 1972

The Act uses a small set of legal constructs and concept definitions that govern rights to custody, guardianship, maintenance and the procedural steps for recognition of paternity. These concepts determine who makes decisions, who may bring applications, and what standards the courts apply.

• Infant: The Act uses the term "infant" consistently to denote a person who has not reached majority for the purposes of guardianship and custody in this Act. The Act does not itself define the specific age of majority within its text; readers must cross‑reference the Age of Majority Ordinance and other relevant Territory law where necessary (endnotes list Age of Majority Ordinance 1974 as an associated instrument). The Act repeatedly frames powers and duties "while an infant" (for example s 7(1)).
• Guardianship and custody: The Act treats guardianship and custody together and refers to both statutory rights and duties. Guardianship covers authority and responsibility for the infant's person and estate; custody focuses on day‑to‑day possession and control. Section 7 states that the mother shall have guardianship and custody jointly with the father while an infant, and that parents have equal authority, rights and responsibilities. The Act also allows for testamentary appointment of guardians (s 16) and judicial appointment and removal (ss 15, 19).
• Recognition of father for purposes of this Act: Two routes are provided. Administrative recognition ties registration of a father's name in the birth register plus lodging an instrument in the Schedule with the Registrar to recognition under this Act (s 4(1)). Court recognition allows either the Supreme Court (s 5) or the Local Court (s 6) to make a finding of paternity and a recognition order if satisfied paternity and fitness are established. The Act states that a person recognised under s 4 is "recognized as the father of the infant for the purposes of this Act" (s 4(1)). That phrase confines the effect of such recognition to rights and duties created by this Act.
• Welfare paramount: Where the court must decide custody, upbringing, administration of property, or application of income, the welfare of the infant is the first and paramount consideration (s 14(1)). The section expressly forbids the court taking into account the historical common law hierarchy of parental rights in favour of father or mother; it requires a gender‑neutral welfare analysis. The Act states that "upbringing includes religious instruction" (s 14(2)).
• Conduct of parent: The Act repeatedly allows the court to consider parental conduct. Section 9(1) requires the court to have regard to the welfare of the infant and to the conduct of the parents, and to the wishes of both parents. Sections 11, 12 and 13 give the court discretion to refuse production writs, to order repayment when custody is changed, and to refuse to deliver an infant to a parent who has abandoned or deserted the infant unless the court is satisfied of the parent's fitness and that the infant's interests justify delivery (ss 11-13).
• Maintenance and funding: The court may order periodic payments towards maintenance where custody is given to one parent (s 10(2)). The Act also allows courts to order fiduciaries such as trustees or executors to pay from funds held for an infant's maintenance to a parent who has custody, and to vary or rescind those orders if payments are misapplied (s 20).
• Testamentary guardians and disputes: Parents may appoint guardians by deed or will (s 16). Such testamentary appointments operate jointly with surviving parents unless the surviving parent objects, in which case the testamentary guardian may apply to court (s 16(3)-(6)). The court can refuse relief, make the testamentary guardian joint guardian, or make the testamentary guardian sole guardian and then impose access and maintenance directions (s 16(5)-(7)). The Act also provides a route for any joint guardian to apply for the court's direction where joint guardians cannot agree (s 17).

These concepts intersect: administrative recognition of paternity under s 4 confers the status "for the purposes of this Act," which then interacts with the default guardianship rule in s 7(1) and the court powers in ss 9, 10 and 14. The Schedule sets an execution and attestation protocol for administrative recognition, identifying the classes of persons who may witness and the procedural protections to guard against duress or incapacity (s 4(2) and Schedule). Courts exercise broad discretionary power at multiple stages, with welfare as the statutory controlling principle.

Identify who pays, who decides, and who will experience changed rights or obligations under the Act.

• Mothers: The Act sets out baseline rights for mothers of infants. While an infant, the mother has the guardianship and custody of the infant while an infant jointly with the father and equal authority, rights and responsibilities with regard to the infant (s 7(1)). Where the parents were not married at conception and no person is recognised as the father under this Act, the mother is sole guardian and custodian while the child is an infant (s 7(2)). The mother also has the same powers to apply to the court in respect of matters affecting the infant as the father of an infant whose parents were married (s 8(1)).
• Fathers: A man whose name is entered as father on the Births, Deaths and Marriages register together with an executed schedule instrument is recognised as father for the purposes of this Act (s 4(1)). A man who is not so recognised may apply to the Supreme Court (s 5) or the Local Court (s 6) for recognition; the court must be satisfied of paternity and that the applicant is a fit and proper person to have guardianship and custody (ss 5(2), 6(2)). Once recognised as father for the Act's purposes he gains the rights in s 7(1) and equal authority, subject to other orders.
• Surviving parents and testamentary guardians: Sections 15 and 16 affect surviving parents and persons appointed as testamentary guardians. The surviving parent becomes guardian on death of the other parent subject to testamentary appointments; testamentary guardians act jointly with surviving parents unless the surviving parent objects (s 16(3)). Where a testamentary guardian or court‑appointed guardian is acting, the court can decide custody and maintenance arrangements (s 16(5)-(7)).
• Joint guardians and custodians: Persons appointed as guardians under the Act, or who are joint guardians by operation of s 7(1) or s 16(8), are affected by ss 17-19 which govern disputes, powers, and removal. Joint guardians who disagree may apply to the court and the court may make directions about custody and maintenance (s 17).
• People and institutions who have been maintaining or bringing up an infant: Section 12 allows the court to order repayment of reasonable costs, charges and expenses properly incurred in bringing up an infant to the person or institution who has been doing that work if custody is ordered to be transferred. Section 20 allows the court to order payment from funds held by fiduciaries to the parent having custody.
• Registrars and administrative officers: The Registrar under the Births, Deaths and Marriages Registration Act 1996 is the repository for the instrument in the Schedule. The Act requires that an instrument substantially in the form of the Schedule, duly executed and attested, be furnished to the Registrar for the administrative recognition route to operate (s 4(1)). The Schedule prescribes the classes of persons authorised to witness and attest.
• Courts: The Supreme Court and the Local Court have roles. The Supreme Court has jurisdiction to make recognition orders under s 5, and the Local Court may also do so under s 6. Courts decide custody, access, maintenance, repayment of expenses, appointment and removal of guardians, direction in disputes between joint guardians, and payments from fiduciary funds (ss 9-20). The Act places primary decision power with courts, not administrative agencies, for contested issues.
• Trustees, executors, and persons acting in fiduciary capacities: Section 20(1) exposes such persons to court orders forcing periodic payments from funds lawfully applicable to the maintenance of an infant where custody is given to one parent. The court may vary or rescind such orders if the funds are misapplied (s 20(2)).

Who pays: costs of proceedings are addressed by the courts; s 9(3) permits the court to order costs of an application, and s 12 allows the court to order repayment to persons or institutions that have been maintaining the infant. Parents who obtain custody may become the recipients of periodic maintenance orders, and fiduciaries may fill the role of payor if the court orders payments from funds held for maintenance (s 10(2); s 20(1)).

Who decides: courts make ultimate determinations on contested matters. The Act gives broad judicial discretion, constrained by the requirement that the infant's welfare be the paramount consideration (s 14(1)). Administrative actors have a limited role: the Registrar records the instrument required for administrative recognition and the schedule prescribes the attestation procedure (s 4(1)-(2); Schedule).

Behavioural changes: The Act creates incentives to secure either administrative recognition at birth registration (to obtain status under the Act without initial court proceedings) or to seek court recognition where administrative recognition is unavailable or disputed. It incentivises parents to consider formal testamentary appointments for guardianship (s 16), and creates incentives for persons or institutions who raise an infant to seek repayment if custody is later transferred (s 12). The welfare paramount rule and explicit consideration of parental conduct, abandonment and desertion create incentives for parties to present reliable evidence of caregiving and parental fitness in court proceedings.

This Act establishes specific statutory duties and rights for parents, guardians, testamentary appointees, fiduciaries and courts. Below are the operative duties and rights, with section references.

• Mother's baseline guardianship and custody: The mother has guardianship and custody of the infant while an infant jointly with the father, and parents have equal authority, rights and responsibilities (s 7(1)). Where parents were not married at conception and no father is recognised under this Act, the mother is sole guardian and custodian while an infant (s 7(2)). The mother has the same powers to apply to the court as a father in the married situation (s 8(1)).
• Father's recognition rights and duties: A person whose name is entered as father in the Births, Deaths and Marriages Register together with a furnished instrument in the Schedule is recognised as father for purposes of this Act (s 4(1)). A man may alternatively apply to the Supreme Court or Local Court for recognition of paternity; recognition by the court requires the court to be satisfied that he is the father and is a fit and proper person to have guardianship and custody (ss 5(1)-(2); 6(1)-(2)). Once a person is recognised as father for the purposes of the Act, the father has the rights enumerated in s 7(1).
• Court powers to determine custody and access: On application by either parent, the court may make orders it thinks fit regarding custody and the right of access to the infant, having regard to welfare and parental conduct and the wishes of each parent (s 9(1)). The court may alter, vary or discharge an order on application of either parent or after the death of a parent or guardian (s 9(2)). The court may also make orders as to costs (s 9(3)).
• Maintenance where custody awarded to one parent: When the court awards custody to one parent, it may order the other parent to pay weekly or other periodical sums towards maintenance, having regard to the means of both parents (s 10(2)). Orders providing custody or maintenance are not enforceable and do not accrue liability while parents reside together; such orders cease to have effect if for three months after being made the parents continue to reside together (s 10(3)). Any such maintenance order may be varied or discharged on application by either parent (s 10(4)).
• Production and refusal: Where a parent or person at law liable to maintain or entitled to custody applies for a writ or order for production of the infant and the court is of the opinion that the applicant has abandoned or deserted the infant or otherwise so conducted themselves that the court should refuse to enforce their right, the court may decline to issue the writ or make the order (s 11).
• Repayment of costs for raising the infant: If an infant is being brought up by another person or institution at the time an application for production is made and the court orders the infant to be given up, the court may in its discretion order the person to whom the infant is ordered to be given up to pay to the person or institution who raised the infant the whole or such portion of costs properly incurred in bringing up the infant as the court thinks just and reasonable (s 12).
• Consideration of conduct before delivery: Section 13 requires the court to have regard to whether a parent has abandoned, deserted, or been unmindful of duties towards the infant. The court must not make an order for delivery to that person unless satisfied that the person is fit and proper to have custody and that delivery is in the infant's interests (s 13).
• Welfare paramount: In any proceeding concerning custody, upbringing, administration of property or application of income, the court must regard the welfare of the infant as the first and paramount consideration, and must not take into account historical common law hierarchies of parental rights when deciding superiority of claims (s 14(1)). Upbringing expressly includes religious instruction (s 14(2)).
• Surviving parent and court appointment of guardian: On death of a father the mother, if surviving, shall be guardian subject to the Act, either alone or jointly with any guardian appointed by the father. If no guardian was appointed by the father, or appointed guardians are dead or refuse to act, the court may, if it thinks fit, appoint a guardian to act jointly with the mother (s 15(1)-(2)). The mirror position applies on death of the mother (s 15(3)-(4)).
• Testamentary guardians: Parents may appoint guardians by deed or will; such guardians act jointly with a surviving parent unless the surviving parent objects (s 16(1)-(4)). If a testamentary guardian or surviving parent considers the surviving parent unfit, the guardian may apply to court for an order as to custody, and the court may refuse relief, order joint guardianship, or make the testamentary guardian sole guardian and make orders for access and maintenance (s 16(5)-(7)). Guardians appointed by both parents act jointly after death of surviving parent (s 16(8)).
• Disputes between joint guardians: Any joint guardian unable to agree on a question affecting welfare may apply to the court for direction and the court may give directions it thinks proper. Where one joint guardian is a parent, the court's power includes ordering custody and access and ordering maintenance payments (s 17(1)-(2)).
• Powers and removal of guardians: Every guardian appointed under the Act has the powers a guardian appointed by will or otherwise has over the estate and person of an infant (s 18). The court may remove any testamentary guardian or guardian appointed under this Act if satisfied it is for the infant's welfare and appoint another guardian in their place (s 19).
• Payment from funds or fiduciaries: Where custodial arrangements result in a parent having custody, the court may order trustees, executors, curators, or fiduciaries to pay to the parent from funds lawfully applicable to maintenance such portions as the court deems proper (s 20(1)). If the court is satisfied that money paid has been misapplied, it may rescind, alter or vary the order (s 20(2)).
• Separation agreements and enforceability: A separation deed provision that one parent give up custody to the other is not invalid simply because it provides that custody and control be given up to the other parent, but the court will not enforce such an agreement if it is of the opinion that enforcement will not be for the benefit of the infant (s 21).

These duties and rights interact with procedural rules and evidentiary requirements, particularly where administrative recognition under s 4 requires attestation steps in the Schedule, and courts exercise broad discretion subject to the welfare criterion. The Act centralises judicial resolution of contested matters while allowing interested parties to take steps to formalise status outside immediate litigation through registration and testamentary instruments.

The Act is primarily remedial and procedural rather than punitive. It does not create criminal offences or specify fines or imprisonment. Enforcement is achieved through civil judicial remedies and the court's discretionary powers, not through criminal sanction. The key enforcement mechanisms and practical consequences are the following.

• Court orders and writs: The court may make orders about custody, access, costs, maintenance, repayment of reasonable costs of bringing up an infant, dismissal of production writs where abandonment or desertion is found, and removal or appointment of guardians (ss 9-13; ss 16-20). Enforcement of these orders will follow standard civil processes and remedies available to courts in the Northern Territory. The Act itself does not specify the procedural enforcement instruments beyond empowering courts to make the orders.
• Costs orders: Section 9(3) authorises the court to make such orders as to the costs of an application as it thinks just. Costs orders are a conventional civil enforcement tool, shifting litigation expense risk and incentivising settlement or preparation.
• Maintenance orders and payment from funds: The court may order that an other parent pay weekly or other periodical sums towards the maintenance of an infant where custody is given to one parent (s 10(2)). The court may also order trustees, executors or other fiduciaries to pay to the custodial parent from funds lawfully applicable to the infant's maintenance (s 20(1)). These are enforceable civil obligations; the Act does not create separate criminal remedies for non‑payment but the underlying court order can be enforced by civil methods available to the jurisdiction.
• Repayment orders to carers or institutions: If the infant is being brought up by another person or institution, s 12 permits the court to order repayment of the whole or such portion as is just and reasonable of the costs, charges and expenses properly incurred in bringing up the infant, where the court orders the infant be given up to a parent. This shifts economic liability and is a mechanism to compensate carers who had assumed the expense of care.
• Discretion to refuse production: Section 11 gives the court a discretionary power to refuse to make an order for production of the infant if the applicant has abandoned or deserted the infant or otherwise conducted themselves such that enforcement of their right should be refused. This is a defensive enforcement mechanism: the court may deny the applicant relief rather than impose penalty.
• Power to rescind or vary payments where misapplied: Section 20(2) allows the court to rescind, alter or vary orders for payment from fiduciary funds if the court is satisfied that money paid for maintenance has been misapplied. This is a remedial enforcement power focussing on the use of funds.
• Ceasing effect where parents cohabit: Section 10(3) provides that an order providing custody or maintenance is not enforceable and no liability accrues while the mother and father are residing together, and any such order shall cease to have effect if, for a period of 3 months after it is made, the mother and father continue to reside together. This provision effectively limits enforceability during continued co‑residence and creates a conditional termination mechanism.
• Judicial removal and appointment of guardians: Section 19 authorises the court to remove a guardian and appoint another guardian when satisfied it is for the infant's welfare. Removal is an effective enforcement tool because it terminates the guardian's authority conferred under the Act.

What the Act does not include.

• The Act contains no express criminal sanctions for breach of a custody order or failure to comply with court directions. It neither creates offences nor specifies penalties such as fines or imprisonment. Enforcement therefore relies on civil court enforcement mechanisms (for example contempt proceedings available under general court processes) rather than on penalties embedded in the Act itself. Practitioners must look to the court rules and common law mechanisms available to the Northern Territory courts for enforcement in instances of non‑compliance.
• The Act does not itself specify detailed procedural enforcement steps such as contempt powers or enforcement by sheriff's writs; these are matters of court practice and rule.

Practical implications for litigants and advisers.

• Non‑compliance with court orders will be addressed through the court's general enforcement powers rather than under a statutory penal regime found inside this Act. Advisers should prepare clients for civil processes to enforce orders, potential costs exposure under s 9(3), and for the court's power to alter or rescind payments where misapplication is shown (s 20(2)).
• The court's broad discretion under multiple sections means predictability rests on judicial practice and evidence presented. The welfare paramount principle (s 14(1)) shapes enforcement decisions and remains a limiting principle on the exercise of judicial powers.

The Act is not stand‑alone: it explicitly interacts with the Births, Deaths and Marriages Registration Act 1996, and implicitly with broader Northern Territory procedural and substantive law. The endnotes list several consequential amendments and related Acts. The key statutory interactions and dependencies in the source are the following.

• Births, Deaths and Marriages Registration Act 1996: Section 4(1) of this Act expressly ties administrative recognition of a father to the Births, Deaths and Marriages Register. The Act requires that the father's name be entered in the Register under that Act and that an instrument substantially complying with the Schedule be furnished to the Registrar under the Births, Deaths and Marriages Registration Act 1996. Therefore administrative recognition for purposes of this Act depends on compliance with the registration regime under the BD&M Act and the Registrar's processes. The endnotes record the 1996 Act as consequential amendment source (Endnotes, List of legislation and Amending Legislation).
• Acts Interpretation and Interpretation Ordinance effects: Section 2(2) links this Act's repeal of the South Australian Guardianship of Infants Act 1887 to the Acts Interpretation Act 1901-1966 by effect as if that older Act were an Ordinance repealed by this Act. The legislative layering and interpretation structures may affect how older common law constructs are read into the Territory regime.
• Age of Majority and Status of Children: The endnotes list the Age of Majority Ordinance 1974 and the Status of Children Act 1978 in the list of legislation and amending legislation. While the main text of the Act does not define "infant" beyond its repeated use, those other instruments set the statutory context for majority and likely affect the duration of guardianship rights created by this Act. Practitioners should cross‑check the Age of Majority Ordinance and the Status of Children Act for definitions and effects on property and capacity questions.
• Oaths, Affidavits and Declarations: The Schedule's attestation requirements list classes of persons (justices of the peace, commissioners for oaths, notaries public, police officers, post office in‑charges, bank branch in‑charges, authorised marriage celebrants, barristers and solicitors). The endnotes reference the Oaths, Affidavits and Declarations (Consequential Amendments) Act 2010 as having amended the Schedule (Endnotes). That suggests the attestation process is intended to dovetail with existing authentication and declaration law.
• Local Court and Supreme Court jurisdictions: The Act provides that applications for recognition of paternity may be brought to either the Supreme Court (s 5) or the Local Court (s 6). The endnotes list the Local Court (Related Amendments) Act 2016 as consequentially amending this Act (Endnotes). Users should be aware that procedural rules and appeals differ between these courts; the Act itself does not set detailed procedural rules for how the Local Court should handle such applications beyond the substantive test.
• Testamentary and trust law: Section 16 allows appointment of testamentary guardians by deed or will, and s 20 allows payment from funds held under wills, gifts or settlements for maintenance. Those provisions implicitly interact with general trust and estate law, trust instrument terms, and the powers and duties of executors and trustees under other statutes and common law. When courts order payments from fiduciary funds the court's power will interact with the scope and terms of the instrument under which funds are held.
• Court enforcement and civil procedure: The Act confers judicial powers but not the detailed civil procedure for enforcement. Practical enforcement , for example execution of orders for payment or orders for production , depends on rules of court, enforcement mechanisms and possible contempt jurisdiction found in general court practice rather than in the Act.

What the Act does not do regarding interaction.

• It does not purport to alter other statutory regimes outside the Territory unless expressly stated. Administrative recognition under s 4 is limited "for the purposes of this Act" and therefore will not necessarily determine a father's status under other statutes unless those statutes specifically reference this Act or the birth registration regime.
• The Act does not set out how its orders are to be enforced in administrative contexts such as child support assessments under Commonwealth legislation. Matters such as child support assessment, taxation, social security or other federal regimes are not addressed in the Act and require cross‑reference to the relevant Commonwealth laws.

Practical cross‑checks for advisers.

• For fathers seeking administrative recognition: follow the procedural requirements under the Births, Deaths and Marriages Registration Act 1996 and ensure the instrument complies with the Schedule's attestation rules (s 4(1)-(2); Schedule). Confirm that registration will be recorded by the Registrar.
• For testamentary guardians: ensure estate documents and trust instruments are coherent with the powers of executors and trustees and anticipate possible court orders for payment from funds (s 16; s 20).
• For litigation strategy: check Local Court rules and Supreme Court practice rules governing evidence of paternity, fitness, costs, and enforcement because the Act sets standards but defers procedural detail to the courts.

Additional notes in the Endnotes:

• General amendments of a formal nature to ss 2, 4, 5, 6, 9, 10, 17, 20 and the Schedule were made by the Ordinances Revision Ordinance 1973 as amended (Endnotes, General amendments).
• Interpretation Legislation Amendment Act 2018 made formal amendments to ss 1 and 4 and the Schedule (Endnotes note 4). The Endnotes record that general formal amendments, which are not referred to in the table of amendments, were made.

Practical reading and implications:

• The Schedule has received multiple amendments across years, including to the classes of persons who may witness the attestation that a mother understands the implications and is not under duress. The Oaths and Affidavits Act amendments and the 2010 Act indicate the Schedule aligns with existing attestation practices and classes of authorised witnesses.
• The 1996 consequential amendments linking recognition to the Births, Deaths and Marriages Registration Act formalise the administrative route for paternal recognition and reflect a legislative effort to coordinate birth registration with guardianship status.
• The Local Court and 2016 amendments broaden procedural access by enabling Local Court applications for paternity recognition (s 6 amended by No. 8, 2016 s 24), which may affect costs and access to justice for applicants.

This record is drawn precisely from the Endnotes in the source. Practitioners should consult the consolidated and current Northern Territory reprint for any amendments after the source's "as in force at 1 May 2016" date and to check the current text of any referenced external instruments.

The source text does not include or cite any judicial decisions, reported cases or litigation outcomes applying the Guardianship of Infants Act 1972. The Schedule of provisions, the Act text and the Endnotes list amendments and related legislation but contain no case law. Therefore the legislative source provides no litigation history within itself.

Implications of the absence of litigation history in the text.

• Lack of precedential guidance inside the source means the Act's application in contested factual circumstances will turn on judicial interpretation found outside the statutory text in court decisions. Practitioners must therefore search Northern Territory and, where persuasive, other Australian jurisdictions' case law for judicial treatment of the Act's provisions, particularly on matters such as the standard of proof required for paternity in court recognition applications (s 5(2); s 6(2)), the meaning of "fit and proper person," the exercise of discretion under ss 11-13, the quantification of "costs, charges and expenses properly incurred" under s 12, and the circumstances under which courts order payment from fiduciary funds under s 20.
• The Act confers broad discretionary powers (for example ss 9, 11, 12, 13, 16(5)-(7), 17, 19, 20). Where Parliament leaves discretion, litigation history often clarifies how courts balance factors, order evidence, and set procedural terms. The source provides the statutory framework but not how courts have exercised it.
• Because the source does not record litigated interpretations of crucial phrases such as "fit and proper person," "abandoned or deserted," or the measure of "welfare" in contested settings, practitioners should expect that outcomes will depend on contemporaneous case law and the evidence presented in each case.

Recommended practical steps for advisers and researchers.

• Conduct targeted case law research in Northern Territory court databases and law reports to identify judgments that interpret or apply the Act. Focus early on reported decisions that grapple with s 4 recognition via registration, s 5 and s 6 court recognition, s 9 custody orders and s 14 welfare considerations, as those will set application guides for courts.
• Check for decisions implementing the Schedule's attestation requirements in disputes over the validity of a mother's signature or claims of duress, because s 4(2) and the Schedule impose specific formalities.
• Search for decisions that link orders under this Act to enforcement mechanisms under other statutes or rules of court, since the Act itself does not provide enforcement mechanics beyond orders and discretions.

Because the source contains no litigation record, this section identifies the absence and points to the practical need to consult case law outside the Act for interpretative detail.

The Act contains several provisions and procedural details that can catch practitioners and clients if not closely observed. The following are concrete "watch outs" grounded in the statutory text.

1. Administrative recognition is limited to "for the purposes of this Act" (s 4(1)).

   • Effect: Entry of a father's name on the Births, Deaths and Marriages Register coupled with a Schedule instrument recognises him as father "for the purposes of this Act" only. The source text does not say this recognition extends to other statutes, entitlements, or Commonwealth regimes. Practitioners should not assume registration under s 4 automatically resolves issues such as child support assessments or other statutory claims that refer to broader definitions of parentage unless those statutes cross‑refer to the Register or this Act.

2. The Schedule's attestation formalities are specific and strict (s 4(2); Schedule).

   • Effect: A person listed in the final paragraph of the Schedule must read the first paragraph to the mother, be satisfied she understands it and is not signing under duress, and both the mother and witness sign. The classes of authorised witnesses are specifically listed. Failure to comply with these steps may undermine the administrative recognition route. The Schedule has been the subject of amendments (Endnotes), so use the current Schedule text and follow the attestation process exactly.

3. Recognition by court requires both paternity and fitness (ss 5(2), 6(2)).

   • Effect: The court will not make a recognition order based solely on paternity; it must also be satisfied that the applicant is a fit and proper person to have guardianship and custody. That means evidentiary focus must be both on biological status and parental capacity or past conduct. Section 5(3) also states that if an applicant seeks other relief at the same time, the court shall not hear that other application until it first makes the recognition order under s 5(2).

4. Orders cease to be enforceable while parents reside together and may lapse if cohabitation continues for 3 months (s 10(3)).

   • Effect: An order for custody or maintenance is not enforceable while mother and father live together, and any such order ceases if they continue to reside together for 3 months after the order. This can create an unexpected termination of a maintenance stream or custody order if parties restore cohabitation. Practitioners must advise clients about this conditionality.

5. The Act provides courts broad discretion to refuse production where the applicant has "abandoned or deserted" the infant (s 11).

   • Effect: A parent who has not actively maintained contact or who has demonstrably abandoned the child may find that the court declines to order production or enforce his or her custodial claim. Evidence of prior conduct is material and contested claims require careful evidentiary preparation.

6. Courts may order repayment to persons or institutions who have brought up the infant (s 12).

   • Effect: If an infant has been raised by a third party or institution, and a court later orders the infant returned to a parent, the court may require the receiving parent to reimburse reasonable costs. This shifts economic responsibility to the parent obtaining custody and could be a material cost that must be factored into settlement negotiations or litigation risk assessments.

7. The welfare standard forbids reliance on historic common law parental hierarchy (s 14(1)).

   • Effect: The court must not consider whether rights historically belonged more to the father or mother; welfare is the first and paramount consideration. Expect the court to weigh contemporary facts about the child's needs rather than relying on gendered presumptions.

8. Separation agreements may be “valid” but not enforceable if not in the infant's best interest (s 21).

   • Effect: Parties can sign separation deeds where one parent undertakes to give up custody, and such clauses are not per se invalid. However, the court will not enforce an agreement the court thinks not for the infant's benefit. Relying on private agreements to resolve custody should be done with an understanding that the court can set those aside.

9. Testamentary guardians and conflicts with surviving parent (s 16).

   • Effect: A testamentary guardian acts jointly with the surviving parent unless the surviving parent objects. If the surviving parent objects or a guardian considers the surviving parent unfit, the guardian may apply to court. The court may refuse relief, make the testamentary guardian joint guardian, or make the guardian sole guardian and regulate access and maintenance. Drafting wills to appoint guardians requires attention to these potential future disputes.

10. No explicit penalties for breach of orders contained in the Act.

    • Effect: Because the Act does not create statutory offences for breaches of custody or support orders, enforcement will rely on court processes and remedies. Advisers should plan enforcement strategy by reference to court rules, contempt jurisdiction and other civil enforcement tools rather than expecting specific statutory penal consequences.

11. Jurisdictional and procedural variance between Local Court and Supreme Court (ss 5-6).

    • Effect: Section 5 allows applications to the Supreme Court, and s 6 allows the Local Court to make recognition orders. The Act does not specify which matters are appropriated to which court beyond permitting both. Procedural rules, costs, and appeal routes will differ. Check the Local Court rules and Supreme Court practice for differences in evidence admissibility, costs, and appeals.

12. Potential for conflicting sources on age/continuing guardianship.

    • Effect: The Act uses the term "infant" but does not fix the age; the Age of Majority Ordinance and other statutes referenced in the Endnotes set majority and may affect the duration of guardianship. Cross‑check those instruments when advising on duration and termination of parental rights.

13. "Fit and proper person" and evidentiary threshold undefined.

    • Effect: The Act requires courts to be satisfied an applicant for recognition is a "fit and proper person" but does not define that term. Expect case law to supply meaning. Prepare comprehensive evidence of parental fitness and mitigation of adverse facts where necessary.

These are concrete statutory pitfalls the source supports. Practitioners should attend to these details during intake, drafting, and when advising clients about costs, likely routes to recognition, evidentiary preparation and enforcement strategy.

This section sets out practical steps for the principal actors the Act contemplates: parents (mothers and fathers), testamentary drafters, persons or institutions raising an infant, registrars, fiduciaries, and litigators. Each compliance step is grounded in specific provisions.

1. To secure administrative recognition as father under s 4(1)

   • Obtain entry of the father's name in the Births, Deaths and Marriages Register under the Births, Deaths and Marriages Registration Act 1996.
   • Prepare an instrument that "complies substantially with the form in the Schedule" and ensure it is duly executed and attested as described in s 4(2) and the Schedule.
   • Ensure a person from the classes listed in the Schedule (justice of the peace, commissioner for oaths or affidavits, notary public, Commissioner for Declarations, a member of the Police Force of the Northern Territory, person in charge of a Post Office, person in charge of a bank branch, authorised marriage celebrant, barrister or solicitor) reads the first paragraph to the mother, satisfies themself she understands and is not signing under duress, witnesses the mother's signature and signs the instrument (s 4(2); Schedule).
   • Furnish the instrument to the Registrar holding office under the Births, Deaths and Marriages Registration Act 1996 to trigger recognition "for the purposes of this Act" (s 4(1)). Keep copies and proof of lodging.

2. If administrative recognition is not available or is disputed, bringing an application to court (ss 5-6)

   • Choose the correct venue: either the Supreme Court (s 5) or the Local Court (s 6) may hear an application for recognition of paternity. Check current Local Court and Supreme Court practice rules related to family and guardianship matters to determine procedural advantages.
   • Prepare evidence on two axes: (a) paternity; and (b) fitness and propriety to hold guardianship and custody. The court must be satisfied of both (ss 5(2), 6(2)).
   • If seeking other relief at the same time (for example custody or access), note s 5(3) requires the court to first make the recognition order before hearing the other application(s). Structure pleadings and evidence accordingly.

3. Applying for custody, access or variation of orders (ss 9-10)

   • File an application in the appropriate court asking for orders regarding custody and access. Prepare evidence addressing the welfare of the infant as the "first and paramount consideration" (s 14(1)), parental conduct, the child's needs, and the wishes of the parents (s 9(1)).
   • If asking the court to order maintenance payments, prepare financial evidence of means and needs because s 10(2) requires the court to have regard to both parents' means.
   • If parents are still residing together, be aware that any order for custody or maintenance is not enforceable while cohabitation continues and will cease to have effect if cohabitation continues for three months after the order (s 10(3)). Consider whether litigation or consensual agreement is the appropriate route in such cases.

4. Production, repayment to carers or institutions (ss 11-12)

   • If an infant is being cared for by another person or institution and a parent applies for production, prepare evidence of the historical caregiving arrangements and any costs incurred. If successful on production, be prepared for the court to order repayment to the carer for reasonable costs properly incurred (s 12).
   • If representing a guardian or carer who might resist production, collect evidence demonstrating abandonment or desertion on the part of the applicant if that is relevant. Section 11 permits the court to refuse production where an applicant has abandoned or deserted the infant.

5. Testamentary guardians and wills (s 16)

   • Draft deeds or wills appointing guardians with clear language and consider drafting mechanisms that anticipate potential court challenges by surviving parents. The Act gives testamentary appointees active rights but also creates a route for surviving parents to object and for the appointee to apply to court (s 16(3)-(6)).
   • Ensure testamentary documents coordinate with estate administration documents and trust instruments, because the court may order payment from funds in executors' or trustees' hands to maintain an infant in custody (s 20(1)).

6. Trustees, executors and fiduciaries (s 20)

   • If holding funds for an infant's maintenance, be ready to respond to an application asking the court to require periodic payments from those funds to a custodial parent. Review the trust instrument and be prepared to provide evidence that payments are lawfully applicable and used appropriately.
   • Maintain clear accounts for funds applied to the infant's maintenance; if the court concludes that money was misapplied, s 20(2) empowers it to rescind or vary the order.

7. Joint guardians and dispute resolution (s 17)

   • If acting as a joint guardian and unable to agree on questions affecting welfare, apply to the court for its direction under s 17(1) and prepare evidence focused on the child's welfare and the specific disputed question.
   • Where one joint guardian is a parent, be prepared for the court to consider custody, access and maintenance orders under s 17(2).

8. Evidence management and duress concerns

   • For any instrument under the Schedule, ensure the attesting witness follows the precise instruction to read the first paragraph to the mother and to certify understanding and absence of duress (s 4(2); Schedule). Keep attestation contemporaneous and document any communications evidencing voluntary execution.
   • For court applications addressing abandonment, desertion, or unmindful parental conduct, gather documentary and testimonial evidence of caregiving, contact, financial support, and parental conduct to meet the court's inquiry under ss 11-13.

9. Costs strategy (s 9(3))

   • Consider whether negotiating a consent order is more cost‑effective than proceeding to contested hearing because the court has broad discretion in costs and may make orders as it thinks just. Cost exposure is a material compliance consideration.

10. Cross‑statutory checks

• Before advising on wider legal implications, check the Births, Deaths and Marriages Registration Act 1996 for any procedural rules about entries in the Register and the local Age of Majority and Status of Children legislation to confirm the age at which guardianship ceases for different purposes.

11. Record keeping, practical forms and filing

• Retain careful records of the lodged Schedule instrument and of communications with the Registrar. For court applications, prepare comprehensive witness statements and exhibits that address welfare, parental conduct, paternity and fitness. For maintenance orders expect to produce financial statements and proof of income.

These compliance steps are driven by the Act's provisions. Because the Act vests broad discretionary powers in the court, thorough evidentiary preparation and careful compliance with formal requirements such as the Schedule's attestation steps are critical to securing administrative recognition, custody, maintenance and guardian appointments.
