Guardianship of Infants Act 1940

The Act organises around a small set of recurring legal concepts: guardianship and custody; welfare as paramount; court discretion; maintenance and funding; testamentary guardianship; abandonment and conduct; and procedural regulation by rules of court. Each concept is defined or given functional effect in discrete provisions.

Guardianship and custody: Section 4 establishes that, subject to this Act and other enactments, mother and father jointly have guardianship and custody, each with equal powers and responsibilities. The provision is phrased as subject to the Act and any other enactment, indicating the statutory rule is without prejudice to inconsistent provisions elsewhere (s 4).

Welfare as paramount: Section 11(1) imposes a single organising principle for decision-making in all relevant proceedings, directing that "the welfare of the infant" is the first and paramount consideration. The section also expressly instructs courts not to weigh claims on common-law paternal preference; the court must disregard whether the father's claim is superior at common law to the mother's claim or vice versa.

Court discretion and powers: The Act repeatedly uses discretionary language. A court "may" make orders for custody and access on application by a person with a proper interest (s 6(1)), may vary or discharge orders (s 6(4)), may decline to issue writs for production where a parent has abandoned or otherwise conducted himself so as to justify refusal (s 8), may order repayment of costs properly incurred in bringing up an infant when returning custody (s 9), and may remove or appoint guardians where in the infant’s welfare (s 16). The Act also entrusts the court with resolving disputes between joint guardians about upbringing and welfare (s 6(2)).

Proper interest and standing: The Act defines a person with a "proper interest" for the purposes of applications under s 6(1) as including the parents, guardians, and "a person who, in the opinion of the court, has in the circumstances of the case a proper interest in the welfare of the infant" (s 6(7)). This leaves standing partially to judicial assessment rather than a strict statutory list.

Maintenance and funding: The Act treats maintenance broadly to include education (s 3(1)), and provides several mechanisms for funding maintenance: the court may order periodical maintenance payments from parents when custody is awarded (s 7(2)-(3)); it can direct funds held by guardians, trustees, executors or other fiduciaries to payment for maintenance up to the lawfully applicable portion (s 17); and maintenance orders under this Act are enforceable by the machinery of the Community Welfare Act 1972 (s 20A).

Testamentary and court-appointed guardians: Parents may appoint testamentary guardians by deed or will (s 13(1)-(2)). Such appointed guardians act jointly with the surviving parent unless the parent objects, or unless the guardian considers the parent unfit and seeks court relief, in which case the court has broad powers to make orders for guardianship and custody (s 13(3)-(4)). Where both parents have appointed guardians, those appointed guardians act after the death of the surviving parent (s 13(5)). Where a guardian has been appointed by the court to act jointly with a surviving parent, that court-appointed guardian continues after the surviving parent’s death (s 13(6)).

Abandonment and conduct: The Act makes the conduct of a parent a discrete statutory consideration. The court can decline to enforce a parent's custodial rights where it finds abandonment or desertion, or otherwise that the parent has so conducted himself that enforcement should be refused (s 8). Section 10 makes the duty explicit: for parents who have abandoned or deserted the infant, the court shall not make an order for delivery of the infant to the parent unless the parent has satisfied the court that, given the infant’s welfare, he or she is a fit person to have custody.

Procedural regulation and saving provision: The Act authorises rules of court under the Supreme Court Act 1935 and the Local Courts Act 1926 to regulate the practice, form and procedure in proceedings under this Act (s 22). The Act preserves equitable jurisdiction of the Supreme Court to appoint or remove guardians and the jurisdiction of courts in matrimonial causes, so it does not displace existing equitable or matrimonial jurisdiction (s 21).

Definitions and cross-reference: The Act’s definitions in s 3(1) are operational and include that "maintenance includes education" and the term "person" in ss 8, 9 and 10 includes any school or institution. Section 3(2) places an external legal condition on recognition of the father of a child born outside marriage: a person will not be recognised as the father of a child born outside marriage under this Act unless he is so recognised under the provisions of the Family Relationships Act 1975. This introduces a statutory dependency on another Act for a core identity question.

These concepts form the legal architecture of the statute: parental primacy subject to welfare review; court-centred dispute resolution with broad discretion; routes for private appointment of guardians; and statutory financial mechanisms for maintenance and reimbursement.

The Act uses a tight set of relational categories: infant, mother, father, guardian, person with a proper interest, guardians/trustees/executors/fiduciaries, schools or institutions, and courts. The statutory text identifies who holds rights and duties and who may be targeted by court orders.

Infants: The Act applies to "infants", a term that is not numerically defined in the text but is used consistently. The Act explicitly includes "an infant born outside marriage" in the definition of infant (s 3(1)), and the welfare of the infant is the paramount consideration for courts in related proceedings (s 11(1)).

Parents: Both mothers and fathers are named as default joint guardians and custodians with equal powers (s 4). Parents can be ordered to pay maintenance when custody is awarded to the other parent or to a non-parent (s 7(2)-(3)). The court must have regard to parental conduct in exercising its powers (s 6(3)) and there are express provisions dealing with surviving parents and the rights of surviving parents as guardians (s 12).

Fathers of children born outside marriage: The Act restricts recognition of a father of a child born outside marriage to situations where he is so recognised under the Family Relationships Act 1975 (s 3(2)). This affects who can be treated as a parent for purposes such as guardianship, custody, and orders under ss 8, 9 and 10.

Guardians, testamentary appointees and court appointees: Persons appointed as guardians by will or deed act under s 13 and may act jointly with surviving parents unless objection is taken. The court may appoint guardians in several circumstances and may remove guardians where it deems it in the infant’s welfare (s 12, s 13, s 16). Executors, trustees and other fiduciaries who hold funds for an infant’s maintenance can be ordered to pay such funds to the custodian (s 17).

Third parties with "proper interest": The Act admits applications from a broader class than parents and guardians. Section 6(7)(c) allows a person who, "in the opinion of the court, has in the circumstances of the case a proper interest in the welfare of the infant" to apply for custody or access orders. This is a flexible, fact-sensitive category determined by judicial discretion and can include carers, relatives, or other stakeholders the court accepts.

Schools and institutions: For the limited purposes of ss 8, 9 and 10, "person" is defined to include any school or institution (s 3(1)). That makes schools and institutions potential respondents or applicants under provisions dealing with production of the infant, repayment of costs of bringing up the infant, and court regard to parental conduct.

Trustees and fiduciaries: Those holding funds by will, gift, settlement or otherwise which are applicable (in whole or part) to the maintenance of an infant are within the Act’s ambit for court orders directing payment of those funds for maintenance (s 17).

Courts and judges: The Act assigns decision-making to the Supreme Court or any judge thereof and to the local court of full jurisdiction nearest to the infant’s residence; those are the courts referenced by "the court" in the Act (s 3(1)). The Supreme Court and local courts are empowered to make procedural rules (s 22), and the Act preserves the equitable jurisdiction of the Supreme Court (s 21).

Persons contemplating leaving the State: The Act expressly disavows residency abroad or planned departure as an automatic disqualification for custody applications; the fact of being resident outside the State, or contemplating leaving, "shall not of itself constitute a ground for denying custody" (s 6(5)). This provision affects applicants living interstate or overseas.

Who pays and who may be ordered to pay: The Act contemplates parents paying maintenance (s 7) and being ordered to repay costs properly incurred in bringing up an infant if custody is returned to them (s 9). It also contemplates trustees and fiduciaries being ordered to make payments from funds held for maintenance (s 17). The enforcement mechanism for maintenance orders is the machinery of the Community Welfare Act 1972 (s 20A).

The Act therefore affects a network of private parties (parents, guardians, guardians appointed by will, trustees, institutions) and public bodies (Supreme Court and local courts), with standing and remedy rules that privilege welfare review and court discretion.

The Act creates both substantive rights and procedural powers, and it allocates duties among parents, guardians, fiduciaries and courts. The principal rights and duties are statutory and many are conditional on court orders.

Parents’ rights and duties:

• Joint guardianship and custody rights: Subject to this Act and other enactments, the mother and father "shall jointly have the guardianship and custody of the infant" and each parent has "equal powers, authority, rights and responsibilities" (s 4). That is a baseline legal entitlement.
• Maintenance duty: When custody is awarded to one parent or a non-parent, the court can order the other parent to pay weekly or other periodical sums towards maintenance "having regard to the means of both parents" (s 7(2)-(3)). The Act treats maintenance as including education (s 3(1)), so a parent’s financial duty may extend to educational expenses as part of "maintenance".
• Duty to satisfy the court where abandoned: If a parent has abandoned or deserted an infant, the court must not order delivery of the infant to the parent unless the parent satisfies the court that he or she is fit to have custody and that it is in the infant’s interests (s 10).

Guardians’ powers:

• Guardians have the powers over the estate and the person of an infant "as any guardian appointed by will or otherwise has" (s 15). That imports traditional guardian powers into the Act’s framework.
• Testamentary guardians act jointly with a surviving parent unless the parent objects; if a parent objects, or the appointed guardian considers the parent unfit, the guardian may apply to the court and the court has broad powers to make orders including making the appointed guardian sole guardian and ordering maintenance payments from the mother or father (s 13(3)-(4)).

Court duties and powers:

• Power to make custody and access orders: The court "may" make such orders as it thinks fit on application by a person with a proper interest (s 6(1)). The court may also vary or discharge orders (s 6(4)) and award costs (s 6(6)).
• Regard to conduct and welfare: The court has an express duty to have regard to the conduct of parents and any other party (s 6(3)) and a statutory duty to make welfare of the infant the first and paramount consideration in decisions touching custody, upbringing or property administration relating to an infant (s 11(1)).
• Discretion to decline production: The court may decline to issue a writ or order for production where the parent has abandoned the infant or otherwise conducted himself such that enforcement of custody is inappropriate (s 8).
• Orders for repayment of costs: If an infant being brought up by a non-parent is ordered to be given up to a parent, the court may order the parent to repay the "whole of the costs, charges and expenses properly incurred in bringing up the infant" or a reasonable portion (s 9).
• Power to order payments from fiduciary funds: The court may direct any guardian, trustee, executor or person acting in a fiduciary capacity, who holds funds lawfully applicable to maintenance, to pay such portion of the fund as deemed proper to the person who has custody for the infant’s maintenance (s 17). The court may then rescind or vary the order on proof of misapplication (s 17, proviso).
• Removal and appointment of guardians: The court may, in its discretion, remove any testamentary guardian or guardian appointed under the Act if for the infant’s welfare and may appoint another guardian (s 16).

Procedural duties:

• Rules of court: The Supreme Court and local courts are empowered to make procedural rules regulating practice, form and procedure in proceedings under this Act (s 22). That places on courts the duty to provide regulatory frameworks for the Act’s processes.
• Enforcement duties: Maintenance orders under this Act are to be enforced in the same manner as maintenance orders under the Community Welfare Act 1972 (s 20A), which imposes on relevant authorities the duty to enforce under that other Act’s machinery.

Rights created or preserved:

• Right of a surviving parent to guardianship: On the death of one parent, the surviving parent becomes guardian subject to the Act and may act alone or jointly with a guardian appointed by the deceased parent; the court can appoint a guardian to act jointly if the deceased parent did not appoint one or appointed ones are dead or refuse to act (s 12).
• Right to appoint testamentary guardians: Both father and mother have express rights to appoint guardians by deed or will (s 13(1)-(2)).
• Right to seek costs and repayment: Persons bringing up an infant who are non-parents can, in the court’s discretion, secure repayment of costs properly incurred if custody is returned to a parent (s 9). The court may also make costs orders in proceedings under s 6 (s 6(6)).

Limits and qualifications:

• Subject to other enactments: Section 4’s declaration of joint guardianship is explicitly subject to "this Act, and any other enactment", so statutory or regulatory exceptions elsewhere will modify the default rule (s 4).
• Recognition of father must follow Family Relationships Act 1975: A person cannot be recognised as father of a child born outside marriage under this Act unless so recognised under the Family Relationships Act 1975 (s 3(2)), which limits who can exercise parental rights under this Act.
• Separation agreements not enforceable where not in the infant’s benefit: A separation deed provision transferring custody is not invalid per se, but is unenforceable where the court is of the opinion that enforcement will not benefit the infant (s 18).

These provisions allocate and condition duties and rights, give courts broad remedial and supervisory powers, and create financial duties enforceable either directly by the court or via external enforcement machinery.

The Act does not create criminal penalties in its text for breaches of statutory duties. Its enforcement architecture is primarily civil and court-centred: orders, variation and discharge of orders, costs, recovery from fiduciary funds and enforcement of maintenance by cross-application of the Community Welfare Act 1972 procedures.

Civil enforcement mechanisms:

• Court orders and variation: The principal enforcement tool is the court order itself, which the court can make, vary or discharge under s 6(4). Compliance with custody or access orders is compelled through the courts’ powers in civil process.
• Costs orders: The court may make such orders for costs in relation to proceedings under s 6 as it thinks fit (s 6(6)). Costs orders provide financial consequence within litigation but are not framed as penal sanctions for non-compliance with custody arrangements; rather they address litigation costs.
• Repayment of costs of bringing up an infant: Where an infant being brought up by a non-parent is ordered to be given up to a parent, the court may order that parent to pay the whole or a fair portion of costs properly incurred in bringing up the infant (s 9). This is a civil monetary remedy linked to a custody change.
• Payment from fiduciary funds: The court may order trustees, executors or fiduciaries who hold funds lawfully applicable to maintenance to pay such portion as the court deems proper to the person having custody (s 17). This is a direct civil enforcement mechanism against third-party funds.
• Removal and appointment of guardians: Where the court finds it is for an infant’s welfare, it can remove and replace guardians (s 16). That is a structural remedy rather than a penalty.

Enforcement of maintenance:

• Section 20A specifies that orders for payment of sums towards maintenance under this Act "may be enforced in the same manner as a maintenance order under the Community Welfare Act 1972 in all respects as if it were a maintenance order made under that Act." That imports the enforcement regime, remedies and processes set by the Community Welfare Act 1972 for recovery of maintenance sums, though the present Act does not reproduce those procedures. The Act thereby delegates enforcement detail to the machinery of the Community Welfare Act 1972.

Absence of criminal sanctions and immediate coercive powers:

• The statute contains no express criminal offences, no specified fines, no custodial penalties and no enforcement mechanisms such as contempt provisions explicitly in its text. It relies on the civil powers of courts and cross-enforcement channels for maintenance (s 20A).

Procedural enforcement and rules:

• The courts are empowered to make rules regulating practice, form and procedure in proceedings under this Act (s 22). These rules are the procedural backbone for enforcement through civil process: they determine how applications are litigated, served, and enforced by courts.

Discretionary protections and checks:

• The Act builds in judicial discretion at multiple points (s 6, s 8, s 9, s 13, s 16, s 17). That discretion also functions as a gatekeeping mechanism against automatic enforcement where the infant’s welfare might be harmed. For example, the court may decline to issue a writ for production where the parent’s conduct warrants refusal (s 8).

Who implements enforcement:

• The Supreme Court and local courts of full jurisdiction nearest to the infant’s residence are the forums with power to make and enforce orders (s 3(1), s 22). Maintenance enforcement uses authorities or procedures under the Community Welfare Act 1972 (s 20A); the Act does not itself specify which agency will execute enforcement under that Act.

Practical implication:

• Enforcement under the Act is implemented through civil litigation and collateral enforcement mechanisms under other legislation. Parties seeking to compel compliance will bring applications under the Act in the relevant court and, where maintenance is ordered, rely on the Community Welfare Act 1972 machinery for recovery. The Act preserves equitable and matrimonial jurisdictions (s 21), allowing other equitable remedies to remain available.

The Act explicitly references and depends on other South Australian statutes for identity, enforcement and procedural matters, and it preserves existing equitable and matrimonial jurisdiction. The text establishes inter-legislative dependencies at several points.

Family Relationships Act 1975: Section 3(2) mandates that a person shall not be recognised under this Act as the father of a child born outside marriage unless he is so recognised under the provisions of the Family Relationships Act 1975. This is a gating condition that cross-links parental recognition under this Act to statutory recognition criteria set in another Act. The practical effect is that rights of guardianship and custody (s 4 and elsewhere) that flow from "father" status under this Act will only attach if the Family Relationships Act 1975 recognises the person as father for these purposes.

Community Welfare Act 1972: The Act delegates enforcement procedures for maintenance orders to the Community Welfare Act 1972 by stating that any maintenance order under this Act "may be enforced in the same manner as a maintenance order under the Community Welfare Act 1972 in all respects as if it were a maintenance order made under that Act" (s 20A). That imports the enforcement rules, remedies, and administrative mechanisms established by the Community Welfare Act 1972 for maintenance recovery, rather than duplicating them in this Act.

Supreme Court Act 1935 and Local Courts Act 1926: Section 22 authorises rule-making for procedural matters by reference to existing powers: the Supreme Court Act 1935 confers power to make rules for Supreme Court practice and the Local Courts Act 1926 confers power to make rules for local courts. The Act does not set out procedural detail; it relies on these Acts to supply rule-making authority and thereby the procedural framework for proceedings under this Act.

Equitable jurisdiction and matrimonial causes: Section 21 expressly preserves the equitable jurisdiction of the Supreme Court to appoint or remove guardians and the jurisdiction of any court in a matrimonial cause. That indicates this Act is not intended to oust existing equitable or matrimonial remedies; rather it operates alongside them. Practically, this allows parties to seek relief under equitable principles or in matrimonial proceedings where appropriate.

Subject to other enactments: Section 4 states that the declared joint guardianship of mother and father is "subject to this Act, and any other enactment." That formulation leaves the door open for other statutes to modify, limit or displace this default rule in specified circumstances.

Historical amendments and repeal references: The legislative history records amendments and deletions enacted by other statutes over time, for example the Family Relationships Act amendments in 1984 that substituted the definition of "child born outside marriage" (see legislative history listing: 1984 No 102 Family Relationships Act Amendment Act 1984 and the annotation under "Provisions amended since 3 February 1976" that s 3 had its "child born outside marriage" definition substituted by 1984 s 8(3) Sch Pt 3). Those entries demonstrate past interactions and the way other Acts have altered the operation of the 1940 Act.

Procedural overlap and forum choice: The Act defines "the court" to mean the Supreme Court or any judge thereof or the local court of full jurisdiction nearest to the infant’s residence (s 3(1)), so proceedings may be brought in different judicial fora depending on circumstances. The preservation of equitable jurisdiction and matrimonial causes (s 21) means litigants may have forum options or parallel remedies across statutes and equitable law.

In sum, the Act is not a closed system. It imports parentage recognition from the Family Relationships Act, enforcement machinery from the Community Welfare Act, procedural rule-making authority from the Supreme Court Act and Local Courts Act, and it coexists with equitable and matrimonial jurisdiction. Practitioners must therefore coordinate pleadings, evidentiary and enforcement strategies with the provisions and procedures of those other statutes.

The legislative history printed in the text lists the original enactment and subsequent amending statutes with dates of assent and commencement where provided. The Act repealed an earlier Guardianship of Infants Act 1887 when first enacted in 1940 (Legislative history: "The Guardianship of Infants Act 1940 repealed the following: Guardianship of Infants Act 1887").

Principal Act and amendments listed:

• 1940 No 55 Guardianship of Infants Act 1940, assent and commencement 5 December 1940 (principal Act).
• 1975 No 116 Guardianship of Infants Act Amendment Act 1975, assent 4 December 1975, commencement 29 January 1976 (Gazette 29.1.1976 p356).
• 1984 No 102 Family Relationships Act Amendment Act 1984, assent 20 December 1984, commencement 14 February 1985 (Gazette 14.2.1985 p366). The legislative history notes that the 1984 amendment substituted the definition of "child born outside marriage" in s 3(1) (see "Provisions amended since 3 February 1976" entry: "child born outside marriage substituted by 102/1984 s 8(3) (Sch Pt 3) 14.2.1985").
• 2016 No 35 Statutes Amendment (Gender Identity and Equity) Act 2016, assent 4 August 2016, with Part 9 (s 34) commencing 8 September 2016 (Gazette 8.9.2016 p3676). The legislative history indicates that s 20 was deleted by 35/2016 s 34 on 8.9.2016. The text as provided shows a s 20A was inserted (enforcement of maintenance orders); the historical note records deletion of a former s 20.

Other revisions:

• The legislative history notes s 2 was omitted under the Legislation Revision and Publication Act 2002. That deletion is recorded in the "Provisions amended since 3 February 1976" section.
• Historical versions and reprint: The text lists a Reprint No 1,15.8.1991.

Marginal notes in the consolidation point to earlier legislative history prior to 3 February 1976 appearing in volume consolidations.

Practical implications of amendment history:

• The definition of "child born outside marriage" was altered in 1984/1985, which affects who is characterised as an infant under the Act and interacts with s 3(2)’s cross-reference to the Family Relationships Act 1975. The legislative history makes explicit where the 1984 amendment substituted that term.
• The deletion of s 20 in 2016 and the appearance of s 20A in the consolidated text indicate changes in the enforcement regime for maintenance orders; the Act now expressly ties enforcement to the Community Welfare Act 1972 under s 20A, while an earlier s 20 (deleted) may have provided a different mechanism prior to 2016.

Record-keeping and caveats:

• The text includes a prefatory "Notes" paragraph warning that references in the legislation to other legislation or titles are not automatically updated and may be obsolete. It also indicates earlier versions of the Act are listed at the end of the legislative history and provides pointers for further information such as the Index of South Australian Statutes or the legislation website. Practitioners should therefore verify cross-references (for example to the Family Relationships Act 1975, Community Welfare Act 1972, Supreme Court Act 1935 and Local Courts Act 1926) against current texts.

The amendment history as recorded in the Act provides discrete markers for when definitions and enforcement provisions were changed. Those changes can materially affect parentage recognition and enforcement practice, so attention to the cited amending statutes and commencement dates is required.

The statutory text provided contains no case law citations, no judicial decisions, and no descriptive summary of litigation arising under the Act. The legislative history records enactments and amendments but does not list any judicial authorities or specific cases. Therefore, based on the supplied material:

• There are no cases named, quoted or annotated in the Act text provided.
• The Act’s text refers to courts and to their powers but does not describe how those powers have been interpreted in reported decisions.

Practical consequence for research and practice:

• Any argument about how courts have applied the Act,examples being how "proper interest" is construed for standing under s 6(7)(c), how s 11(1)’s "welfare of the infant" has been operationalised, or thresholds for refusing production under s 8,must be informed by external case law research. The Act itself does not supply interpretive guidance beyond the statutory language.
• Practitioners will need to consult Supreme Court and local court decisions, and possibly appellate decisions, to determine the practical application of discretionary standards in the Act (for example, how courts weigh parental conduct under s 6(3) or what constitutes "abandonment" in s 8 and s 10).
• The absence of litigation history in the text supplied means that this report cannot summarise trends or precedent. It simply notes the Act’s provisions that will be engaged in litigation.

Recommendation for due diligence:

• When litigating under this Act, or advising clients, obtain and review relevant case law interpreting key provisions: welfare assessment (s 11), proper interest standing (s 6(7)), recognition of fathers under s 3(2) in light of the Family Relationships Act 1975, and enforcement mechanisms under s 20A linked to the Community Welfare Act 1972. The Act as printed does not provide judicial gloss; that work must be done in court reports and databases, which are not included in the provided text.

This Act contains several points likely to surprise practitioners or clients absent careful reading. These are concrete, textual features that produce legal consequences or procedural traps.

1. Recognition of father depends on another Act (s 3(2)). A man who believes himself to be the father of a child born outside marriage is not automatically treated as "father" under this Act. Section 3(2) requires recognition under the Family Relationships Act 1975 before the person can be recognised under this Act. That affects standing, guardianship claims and entitlement to custody, so practitioners must verify parental status under the Family Relationships Act 1975 before relying on s 4 rights.

2. Maintenance expressly includes education (s 3(1)). Financial obligations or court-ordered maintenance payments may encompass educational expenses. Parties and fiduciaries holding funds for maintenance should be aware that education is within the statutory meaning of "maintenance."

3. "Person" in ss 8, 9 and 10 includes schools and institutions (s 3(1)). Provisions governing production of the infant, repayment of costs of bringing up the infant, and the duty of the court to consider parental conduct apply to "person" as that term includes schools and institutions in those sections. That means schools or institutions may be parties to some proceedings or covered by the court’s discretion.

4. The welfare principle supersedes common-law gendered claims (s 11(1)). The Act explicitly instructs courts not to take into consideration whether a father's common-law claim is superior to the mother's claim or vice versa when deciding custody, upbringing or administration issues. That removes a default paternal preference at common law from statutory decision-making but does not remove the court’s discretion to award custody where welfare requires.

5. Separation agreements are not self-enforcing (s 18). A separation deed provision that one parent gives up custody to the other is not invalid per se, but the court will not enforce it if enforcement is not in the infant’s benefit. Parties attempting to finalise custody by private agreement risk court non-enforcement if the court forms the view the agreement is not beneficial to the infant.

6. Custody applicants resident outside the State are not barred (s 6(5)). The Act states that residency outside the State or contemplation of leaving does not by itself disqualify a person from custody. However, the absence of a per se bar does not mean residency is irrelevant; courts retain discretion to consider such matters in the infant’s welfare.

7. Wide judicial discretion on costs and repayments (ss 6(6), 9). The court may order repayment of "whole of the costs, charges and expenses properly incurred in bringing up the infant" or such portion as is just and reasonable considering all circumstances (s 9). This is discretionary and fact-specific. It is not an automatic reimbursement right.

8. Enforcement of maintenance routed to another Act (s 20A). Maintenance orders under this Act are not enforced under the Act itself but "in the same manner as a maintenance order" under the Community Welfare Act 1972. Practitioners must consult enforcement procedures and remedial options under that Act. The deletion of a former s 20 (2016) hints at earlier differences in enforcement which are not reproduced here.

9. Procedural rules are not in the Act (s 22). The Act leaves practice and procedure to rules made under other Acts (Supreme Court Act 1935 and Local Courts Act 1926). If a practitioner needs specific filing, service or interlocutory procedure, that information will be found in court rules rather than in this Act.

10. No criminal penalties provided. The Act contains no express criminal sanctions for non-compliance with custody orders. Enforcement is civil and, for maintenance, depends on the Community Welfare Act 1972 mechanisms. Practitioners should not expect the Act itself to provide penal coercion.

11. The Act is subject to other enactments (s 4). The declared default of joint guardianship is qualified by "and any other enactment," which may alter or displace the default in specific contexts. Practitioners must cross-check other relevant statutes.

12. Limited textual guidance on "proper interest" (s 6(7)(c)). The phrase "in the opinion of the court" vests standing assessment in judicial discretion. There is no statutory list defining "proper interest" beyond parents and guardians, so litigants outside immediate family should be prepared to prove the nature and extent of their interest at hearing.

Each of these "gotchas" arises directly from textual provisions and creates practical consequences for client strategy, evidentiary planning, and enforcement routes.

Compliance under the Act is primarily about procedure when seeking or defending custody, access and maintenance, and about meeting judicial expectations on evidence of welfare, parental conduct and financial means. The following points translate statutory obligations into actionable tasks, each tied to specific sections.

1. Verify parental status before asserting parent-based rights (s 3(2), s 4). Where a client claims to be the father of a child born outside marriage, confirm recognition under the Family Relationships Act 1975 before filing a guardianship or custody application under this Act. If recognition under that Act is absent, the person may lack standing to claim the rights conferred under s 4.

2. Prepare welfare-centred evidence (s 11(1)). The court must regard the welfare of the infant as the first and paramount consideration in custody, upbringing and property administration decisions. Compliance therefore means assembling evidence focusing on the infant’s physical, emotional, educational and social needs, future stability, and any factors relevant to welfare. Evidence about parental capacities and proposed caregiving arrangements should be foregrounded.

3. Address parental conduct proactively (s 6(3), s 8, s 10). Because the court must have regard to parental conduct and may refuse orders where abandonment or desertion is proved (s 8, s 10), parties should prepare documentary and witness evidence regarding caregiving history, periods of abandonment, responsibilities undertaken by non-parents, and steps taken to remedy past conduct if relevant. Where a parent seeks the return of custody after long absence, present rehabilitation evidence that directly addresses fitness and the infant’s welfare.

4. If custody is to be transferred to or from a non-parent, quantify maintenance needs and means (s 7(2)-(3)). The court may order maintenance payments "having regard to the means of both parents." Compile financial affidavits, wage records, assets and liabilities of both parents and any third-party carer’s expenditure to assist the court in setting reasonable sums.

5. Use testamentary guardianship carefully (s 13). If a client wishes to appoint a testamentary guardian by will or deed, ensure the appointment is properly executed and the will’s terms are clear about the intended scope and start of guardianship. If the surviving parent objects or the appointed guardian believes the parent unfit, the appointed guardian must be prepared to make a court application; an application should include evidence on the parent’s unfitness relative to the infant’s welfare.

6. Keep and present records of costs if seeking repayment (s 9). A person who has brought up an infant as a non-parent and faces a court order returning custody to a parent should document costs, charges and expenses properly incurred in the infant’s upbringing. Receipts, invoices, school fees and other clear financial records will be required to persuade the court to order repayment or a proportionate award.

7. Where fiduciary funds exist, prepare trustees for possible orders (s 17). Guardians, trustees, executors and other fiduciaries should be advised that the court may order payments from funds lawfully applicable to maintenance to be paid to the person with custody. Trustees should maintain clear accounts and be ready to provide evidence to the court about the lawful application of funds and any restrictions under the will or settlement.

8. If relying on a separation deed, test enforceability against infant’s benefit (s 18). Parties should not assume separation agreements transferring custody are self-enforcing. Before relying on such agreements, obtain legal advice and consider seeking an approbative court order or obtaining agreement that the arrangement is in the infant’s benefit to reduce the risk the court will refuse to enforce the deed provision.

9. Anticipate rules of court and local practice (s 22). Rules of practice and procedure for proceedings under the Act will be found in Supreme Court and local court rules authorised by the Supreme Court Act 1935 and the Local Courts Act 1926. Practitioners should obtain relevant rules before filing to conform to forms, timelines, service requirements and interlocutory procedures.

10. For maintenance enforcement, follow Community Welfare Act procedures (s 20A). When seeking to enforce a maintenance order under this Act, be ready to invoke the enforcement mechanisms prescribed by the Community Welfare Act 1972. That may require filing in or notifying the relevant enforcement body designated under that Act.

11. Consider forum and alternative remedies (s 3(1), s 21). The Act defines "the court" to include the Supreme Court and local courts of full jurisdiction nearest to the infant's residence. Consider practical forum choices, and assess whether an equitable application or a matrimonial cause might be warranted given s 21’s preservation of other jurisdictions.

12. Expect judicial discretion and prepare accordingly (s 6(1)-(7)). Because many powers are discretionary, prepare the strongest possible factual case on the statutory criteria: welfare, conduct, means and the bona fides of any proposed guardian or custodian. For applicants other than parents and guardians, prepare to persuade the court that the applicant has a "proper interest" in the infant’s welfare under s 6(7)(c).

13. Record and secure evidence about educational needs (s 3(1)). Given that maintenance includes education, ensure educational costs and plans are included in maintenance calculations and in welfare evidence, including school placements, special needs and likely schooling expenses.

14. Where custody applicants live outside the State, prepare risk mitigation evidence (s 6(5)). Because residency outside the State is not disqualifying by itself, supply evidence addressing stability, logistics, contact arrangements, and welfare considerations to mitigate any concern the court may have about cross-jurisdictional parenting arrangements.

Following these concrete steps will align filings, evidence and fiduciary conduct with the Act’s statutory requirements and the judicial considerations the Act directs courts to apply.
