32M Preservation of liability
Nothing in this part relieves a health professional from liability in
relation to the provision of medical treatment, or the carrying out of
low-risk research, if the health professional would have been subject
to the liability—
(a) had the protected person not had impaired decision-making
ability; and
(b) had the treatment been provided or research been carried out
with the protected person’s consent.
