### 35W Conscientious objection > > (1)  Despite any other provision of this Part, a health practitioner may refuse to comply with a provision of an advance care directive if the health practitioner has a conscientious objection to complying with the provision. > > > (2)  If a health practitioner refuses to comply with a provision of an advance care directive under [subsection (1)](#GS35W@Gs1@EN) the health practitioner – > > > > > > (a) must refer the patient’s care on to another health practitioner in the same profession as the referring health practitioner; and > > > > > > > (b) must not, in any event, provide treatment that would prevent provisions in an advance care directive from being given effect.
