Growers Committees (Polling) Regulations 1990

Key definitional and structural concepts are laid down up front and recur through the instrument. The definitions in regulation 3 are the anchor terms that determine how the procedures work. They include eligible producer, list of producers, meeting, poll, relevant area and returning officer. The term eligible producer is defined by reference to the list compiled by the Commission under section 16 of the Act (regulation 3), giving the Commission the upstream role in establishing the voting population.

The list of producers is central. Regulation 9 requires the Commission to furnish a list of producers who are eligible to vote to the returning officer. Regulation 11 prescribes how that list must be formed and presented: it must specify the relevant committee (regulation 11(a)), contain the names and addresses of those determined by the Commission to be eligible as at the day 14 days before the poll (regulation 11(b)), be sorted alphabetically by trading name (regulation 11(c)) and have names numbered consecutively (regulation 11(d)). The list therefore operates as the master roll against which counterfoils in the postal system are checked during scrutiny (regulation 22(2)(b), (d)).

Voting methods. The Commission controls the voting method: it may direct that a poll be taken at meeting(s) or by postal ballot (regulation 6(1)). If it considers a meeting is not representative of eligible producers, it may convert to a postal ballot even after a meeting-based poll (regulation 6(2)). Where a meeting is used, the returning officer must nevertheless provide postal voting facilities for those eligible producers who qualify for absent voting under regulation 12 (regulation 6(3)). This hybrid approach creates two distinct procedural tracks , meeting plus absent postal votes, or full postal ballot , with overlapping rules (regulation 12(3) makes regulations 17-23 apply to absent votes).

Postal voting mechanics are specified. The returning officer must send the ballot pack by prepaid post not less than 14 days before the ballot (regulation 18(1)). The pack includes printed arguments where submitted and accepted (regulation 17(4), regulation 18(1)(a)), the ballot paper with the returning officer’s initials or a facsimile signature (regulation 18(1)(b)), a ballot paper envelope and a counterfoil envelope bearing the committee name and the eligible producer’s number and with provision on the reverse for name and signature (regulation 18(1)(c)), and an envelope addressed to the returning officer (regulation 18(1)(d)). Counterfoils are checked against the list during scrutiny (regulation 22(2)(b)-(f)). Grounds for rejecting a ballot paper are strictly limited and stated (regulation 22(3)).

Eligibility and nomination rules constrain who appears on the ballot. Where multiple persons run a single enterprise, they must nominate one of their number to be the listed eligible producer (regulation 10(1)). Corporate producers must nominate a named person for listing (regulation 10(2)). A single person cannot be listed for more than one enterprise or appear multiple times on the same list (regulation 10(3)-(4)). These rules constrain aggregation of voting rights and define how voting entitlement attaches to enterprises rather than to every legal person involved.

Procedural oversight. The Commission appoints the chairperson for meeting-based polls and must not appoint someone entitled to vote to that role (regulation 15(1)-(2)). The chairperson appoints two tellers (regulation 15(3)). The returning officer appoints scrutineers for postal ballots and must give them reasonable notice of the count (regulation 21). The returning officer also controls the reception point for postal returns (regulation 13).

Time limits and publication. Notices must be published not less than 21 days before the poll (regulation 8(2)(b)) and postal ballots require public notice in an area newspaper not less than 21 days before the ballot (regulation 17(3)). Arguments for and against a question in a postal ballot must be submitted not later than 18 days before the ballot, and the Commission prints only one such argument for and one such argument against (regulation 17(4)). Results must be declared as soon as practicable and published in a newspaper circulating in the relevant area (regulation 24).

Taken together, these concepts show a system that is centrally administered by the Commission and operationalised by a returning officer, with procedural controls concentrated on lists, counterfoils and signature verification designed to validate postal votes and preserve the integrity of meeting-based polls where absent votes are permitted.

Primary decision-makers and administrators. The Commission is the instrument’s central decision-maker: it compiles the list of producers (regulation 9), determines who is a producer (regulation 4), decides the poll method (regulation 6), approves questions or candidate lists for ballots (regulation 17(2), regulation 8(2)(db)), appoints the returning officer (regulation 7) and the chairperson for meetings (regulation 15(1)). The Commission therefore controls who votes, how they vote, what question(s) are asked and the overall timetable.

Returning officer. The returning officer executes nearly all operational tasks. The Commission must appoint someone to that role (regulation 7). The returning officer receives and maintains the list supplied by the Commission (regulation 9), sends ballot material (regulation 18), provides a reception box or other address for postal returns (regulation 13), runs the count and scrutiny (regulation 22), appoints scrutineers (regulation 21) and may order recounts (regulation 23). The returning officer is central to the chain of custody for ballots.

Eligible producers and nominated persons. The voting population consists of eligible producers listed by the Commission under section 16 of the Act (regulation 3, regulation 11(b)). Where an enterprise is a multi-person undertaking, those persons must nominate one named individual to be listed as the eligible producer (regulation 10(1)); where a producer is a corporate entity, the body corporate must nominate a person to be listed (regulation 10(2)). An eligible producer may lodge an absent postal vote if they satisfy the returning officer at least 7 days before a meeting that they live more than 30 kilometres from the meeting, are ill, absent from the State, or travelling at the time of the meeting (regulation 12(2)). Producers must ensure they are correctly nominated and listed, and that the Commission has their information under section 13 of the Act if that is how the Commission determines producer status (regulation 4(a)).

Chairperson and tellers. For meeting-based polls, the Commission appoints the chairperson who must not be entitled to vote (regulation 15(1)-(2)). The chairperson appoints two tellers (regulation 15(3)). The chairperson controls the meeting’s proceedings, reads the notice, opens the meeting, explains the purposes, moves motions and declares the meeting closed after the vote (regulation 16).

Scrutineers and argument submitters. Those who submit printed arguments for or against a postal ballot question are entitled to have a scrutineer represent them at the count (regulation 17(4), regulation 21(1)). Candidates for election to committee membership may also be represented by scrutineers (regulation 21(1)). The returning officer must give scrutineers reasonable notice of the time and place of the count (regulation 21(2)).

Third parties and the public. Notices must be published in a manner approved by the Commission (regulation 8(2)(a)) and postal ballot notices must appear in a newspaper circulating in the area where the committee operates (regulation 17(3)). The public at large may therefore be informed through public notices, but the entitlement to be present at a meeting is limited to eligible producers, Commission members and persons permitted by the returning officer (regulation 14(1)).

Entities not directly affected by the Regulations include other classes of stakeholders whose roles are not mandated here. The Regulations do not create new financial obligations such as fees or levies, and they do not provide offences or penalties in the text provided. The primary burdens of compliance fall on the Commission, the returning officer and the eligible producers, with particular obligations on enterprises and corporate producers to nominate a single listed person and on producers who wish to use absent voting to satisfy the returning officer within strict deadlines and criteria (regulation 10, regulation 12).

Statutory duties are divided between the Commission and the returning officer, with rights conferred on eligible producers, scrutineers and persons submitting argument material.

Commission duties and discretions

• Determine who is a producer for purposes of a producers’ committee, using producer-supplied information under section 13 of the Act or other information the Commission considers relevant (regulation 4). This gives the Commission a fact-finding and eligibility-determination role.
• Furnish a list of eligible producers to the returning officer (regulation 9) and ensure the list meets format requirements (regulation 11).
• Decide the method of taking a poll: meeting(s) or postal ballot (regulation 6(1)). If an initial meeting-based poll is unrepresentative the Commission may require a postal ballot (regulation 6(2)).
• Approve the question(s) or candidate list for postal ballots (regulation 17(2)) and approve the manner of publication of notice (regulation 8(2)(a)).
• Appoint the returning officer and the chairperson (regulation 7, regulation 15(1)). The Commission must not appoint a voter as chairperson (regulation 15(2)).

Returning officer duties and discretions

• Be appointed by the Commission (regulation 7) and act as the operational officer for the poll.
• Receive from the Commission the list of eligible producers and use it to verify counterfoils and mark persons who have forwarded envelopes (regulation 9, regulation 22(2)(b), (d)).
• Provide for absent voting by post where a meeting is convened, accepting applications and arranging postal dispatch and receipt (regulation 6(3), regulation 12(1), regulation 12(2)).
• Use a private box at a post office or another address thought fit for receipt of absent votes and postal ballot papers (regulation 13).
• Dispatch ballot packs by prepaid post not less than 14 days before the ballot and reissue packs in cases of non-receipt or spoilt/damaged papers on written application prior to polling day (regulation 18(1), regulation 19).
• Conduct scrutiny and counting in the presence of attending scrutineers after the poll closes, opening outside envelopes, checking counterfoils against the list, placing properly made-up ballot paper envelopes into a sealed ballot box and then opening the ballot box for counting (regulation 22(2)(a)-(f)).
• Reject ballot papers that lack the returning officer’s initials, carry identifying marks, or are not completed according to directions (regulation 22(3)).
• Appoint scrutineers for argument submitters and candidates and give reasonable notice of the count (regulation 21).
• Declare the poll result as soon as practicable and publish it in a newspaper circulating in the relevant area (regulation 24).

Eligible producer rights and responsibilities

• Right to receive a ballot pack where voting is by postal ballot and an entitlement to absent mail voting where a meeting is held and the producer satisfies the returning officer under specified conditions at least 7 days before the meeting (regulation 18(1), regulation 12(1)-(2)).
• Responsibility, where voting entitlement derives from being part of a joint enterprise or corporate producer, to ensure the enterprise or body corporate has nominated a single person to be listed (regulation 10(1)-(2)).
• Right to request a recount by written request to the returning officer (regulation 23).
• Duty to sign the counterfoil envelope that accompanies postal ballot material so that the returning officer can verify the sender against the list (regulation 18(1)(c)(ii), regulation 22(2)(c), (d)).

Scrutineer and submitter entitlements

• Persons who submit printed arguments in a postal ballot or candidates for committee membership may have a scrutineer appointed to represent them during the count (regulation 17(4), regulation 21(1)). Scrutineers must be given reasonable notice of the place and time for the count (regulation 21(2)).

Meeting procedural duties and rights

• Meetings are presided over by a Commission-appointed chairperson who is not entitled to vote (regulation 15(1)-(2)), with procedural rules modelled on usual rules of debate and, where uncertain, the Standing Orders of the Legislative Assembly (regulation 16(5)). Only eligible producers, Commission members and persons permitted by the returning officer may be present at meetings (regulation 14(1)).

Constraints and limitations

• The Regulations confer substantial discretion to the Commission to determine producers and voting method, but they also prescribe procedural checks on the returning officer during postal scrutiny. The Regulations do not set out penalties for breach or enforcement mechanisms other than operational controls such as rejection of ballots and recounts. They do not specify appeal rights or an administrative review path within the text provided.

In sum, duties are procedural and administrative; rights are primarily functional and limited to participation, absent voting subject to eligibility criteria, scrutineer access and recount requests. The Commission orchestrates the electoral structure while the returning officer is charged with integrity and chain-of-custody tasks.

The Regulations as provided do not create express criminal offences, fines or civil penalties. Nowhere in the text is there a provision imposing a penalty for breach, nor language specifying enforcement action beyond procedural steps the Commission and returning officer must take. Enforcement in these Regulations is therefore operational and internal to the poll process, relying on procedural checks, verification and rejection mechanisms rather than on sanctions.

Operational enforcement mechanisms contained in the Regulations include:

• Identification and verification via the numbered list and counterfoil system. The returning officer must check counterfoils against the list of eligible producers and mark the list for those who have forwarded envelopes (regulation 22(2)(b), (d)). This is a preventive integrity control that would prevent duplicate voting by making the list the master roll.
• Rejection of invalid ballot papers. Ballot papers are to be rejected where they do not bear the returning officer’s initials or facsimile signature, where they contain identifying marks, or where they are not marked according to directions (regulation 22(3)). Rejection is the primary corrective sanction for improperly completed or improperly authenticated ballots.
• Preservation of chain of custody protocols. The returning officer must place properly formed ballot paper envelopes into a sealed ballot box and thereafter open the box for counting in the presence of scrutineers (regulation 22(2)(e)-(g)). Where counterfoils are not in order, the unopened envelope is marked “Not in Order” (regulation 22(2)(f)), which preserves evidence of irregularity for potential administrative follow-up.
• Recount power. The returning officer may order a recount on his or her own motion or on the written request of any eligible producer or a scrutineer before declaration of the poll (regulation 23). This provides a mechanism to correct counting errors before the result is final.

Publication and public record. The returning officer must declare the poll result as soon as practicable and publish it in a newspaper circulating in the relevant area (regulation 24). Publication serves a public transparency function and enables interested parties to become aware of results and potential grounds for challenge.

Absence of express statutory sanctions. Because the instrument does not prescribe offences, penalties or an express appeals process within its own text, enforcement beyond the immediate procedural mechanisms may depend on other statutory mechanisms in the Agricultural Produce Commission Act 1998 or general administrative law remedies not contained in these Regulations. The Regulations themselves do not state whether any failure to comply with a procedural provision invalidates the poll or gives rise to a specific remedy; they only set out the processes to be followed. Any legal consequences of non-compliance will therefore depend on the underlying Act, general law principles and any other applicable statutory framework.

Practical enforcement responsibility. The Commission and the returning officer, by their obligations to act and to publish, are the de facto enforcers of these Regulations. The returning officer’s responsibilities for secure receipt and scrutiny of postal ballots (regulation 13, regulation 18, regulation 22) are the operational levers for maintaining poll integrity.

In short, enforcement within these Regulations is procedural rather than punitive. The Regulations provide tools for validation, rejection and correction but do not specify penalties; resolution of disputes or enforcement escalation beyond the returning officer’s recount power and publication requirements must be sought under the Act or general administrative law channels, which are not contained in the text before us.

The Regulations explicitly operate in the context of the Agricultural Produce Commission Act 1998 and reference several of its provisions. Interaction is therefore both referential and functional. Important cross-references include:

• Section 16 of the Act. Regulation 11 refers to the list of producers compiled by the Commission under section 16 of the Act. Regulation 9 requires the Commission to furnish to the returning officer a list of producers eligible to vote at a poll in relation to a committee. The Regulations therefore depend on the Act’s allocation to the Commission of the power to compile the roll and the content of section 16 for the legal validity of the list. Any statutory requirements in section 16 about how lists are compiled or who qualifies will feed directly into the operation of the Regulations (regulation 9, regulation 11).
• Section 13 of the Act. Regulation 4(a) permits the Commission to determine that a person is a producer on the basis of information supplied by a producer to the Commission under section 13 of the Act. This creates a procedural link where compliance with the Act’s information-gathering provisions can establish vote entitlement under the Regulations.
• Sections 10 and 11(1a) of the Act. Regulation 8(2)(c)-(d) and regulation 8(2)(da) refer to polls under section 10 of the Act and polls under section 11(1a) respectively. The Regulations therefore implement processes for different types of polls envisaged by the Act , section 10 polls require notice to specify objects and the agricultural produce and relevant area, while section 11(1a) polls require the names of candidates to be stated. The Regulations provide the mechanics that give effect to those sections by prescribing notice content and ballot processes.
• Standing Orders of the Legislative Assembly. Regulation 16(5) makes the Standing Orders of the Legislative Assembly a default source for resolving doubts about rules of debate at a meeting. This is not a direct cross-reference to a provision of the Act but rather to parliamentary procedural rules for debate where the Regulations are silent.
• Publication and media requirements. Regulation 17(3) requires publication of postal ballot notice in a newspaper circulating in the area. That interacts with local media and publication standards but within the Regulations is expressed as a minimum method of notice; any obligations under other statutes about public notices or electoral communication are not expressly referenced.

Limitations on interaction in the text. The Regulations do not expressly mention how they interact with general electoral law, privacy laws, or postal laws. They require the returning officer to use prepaid post and a private postal box (regulation 18(1), regulation 13), which implies compliance with postal service rules, but no statutory references to postal legislation appear in the text. The Regulations also do not set out appeal routes or administrative review procedures; any judicial review or statutory appeals would therefore arise from the Act or general administrative law, not from the Regulations themselves.

Delegation and administrative law. The Commission’s broad discretion to determine producers (regulation 4) and to select poll methods (regulation 6) will operate subject to general administrative law principles, though those principles are not part of the Regulations. Where the Commission exercises discretion under the Act and these Regulations, affected parties would likely rely on the Act and administrative law for challenges concerning unlawful exercise, bias or procedural unfairness, but those remedies are external to the Regulations as presented.

In essence, these Regulations are implementation rules that assume and rely on powers and definitions in the Agricultural Produce Commission Act 1998. They prescribe process while leaving substantive definitions and enforcement mechanisms to the parent Act and the general law.

The compilation table at the end of the instrument records the legislative provenance and the two principal entries in the Regulations' amendment history. The instrument was originally made as the Growers Committees (Polling) Regulations 1990 and was gazetted on 23 November 1990 (Growers Committees (Polling) Regulations 1990) (compilation table). A 2001 amendment is recorded as Growers Committees (Polling) Amendment Regulations 2001 and appears in the Government Gazette on 13 February 2001 (Gazette 13 Feb 2001 p. 867-72). The 2001 instrument effected amendments across the Regulations and the reprint notes that the name is now Producers Committees (Polling) Regulations 1990 with the citation changed, as recorded in the note under regulation 1.

Specific amendments reflected in the text are identified by bracketed notes at the end of many regulations stating "Regulation X amended: Gazette 13 Feb 2001 p. 867-72." Those bracketed amendment notes indicate where provisions were altered by the 2001 instrument rather than providing a change log within the body of the Regulations themselves. The reprint date is recorded as 6 August 2004 and the compilation table notes that Reprint 1 includes the amendments listed above.

Matters demonstrably changed or added through amendment include:

• Citation change. Regulation 1 shows an amendment note that the citation was amended (Gazette 13 Feb 2001 p. 867). The compilation table records that the original title was Growers Committees (Polling) Regulations 1990 and it is now Producers Committees (Polling) Regulations 1990.
• Multiple regulations show the 2001 amendment flag, indicating textual updates to definitions, processes and timelines across the instrument (for example regulation 3, regulation 4, regulation 6, regulation 8, regulation 10, regulation 11, regulation 12 and others all show amendment footnotes).
• The compilation table notes that the reprint incorporates the amendments and lists the gazettal and commencement dates for the original instrument and for the 2001 amendment.

No subsequent amendments beyond 2001 are recorded within the compilation table in this text, and the reprint status is as at 6 August 2004. There are no amendment notes indicating later changes or revocation within the material provided.

Users should therefore note that the Regulations as presented reflect the 1990 origin with amendments made in 2001 and compiled into a reprint in 2004. Any further amendments, repeals or replacements after 6 August 2004 are not reflected here and would require checking the current version in the Government Gazette or the official statute reprint database for updates beyond the compilation date.

The Regulations as provided include no report, reference or notation of judicial decisions, tribunal determinations or litigation outcomes. They do not name any case law, nor do they include annotations recording that the provisions have been subject to judicial interpretation. The compilation table and the body of the Regulations are administrative and procedural; no litigation history is recorded in the reprint materials included here.

Because the instrument contains no litigation references, the following is what can be derived from the text itself rather than from external case law:

• The Regulations establish processes and discretionary decision points for the Commission and the returning officer. Such decision points, including the Commission’s determination of who is a producer (regulation 4), the Commission’s decision on whether a meeting is representative (regulation 6(2)) and the returning officer’s acceptance of absent voting applications (regulation 12(2)), are plausible anchors for complaint or challenge in practice. However, the text does not provide any statutory appeal route or adjudicative mechanism within the Regulations themselves.
• Procedural safeguards exist within the Regulations in the form of recounts (regulation 23) and scrutineer attendance (regulation 21), which are internal checks a dissatisfied voter may use before the declaration of the poll (regulation 24).
• Because no litigation is recorded here, any challenge to decisions under the Regulations would likely be pursued under the Act or general public law principles, but no guidance is contained in these Regulations on whether and how such challenges should be made.

If a practitioner requires actual judicial treatment of these Regulations, the absence of litigation references here means they must search external judicial databases and the relevant jurisdiction's law reports for cases mentioning the Producers Committees (Polling) Regulations 1990 or the underlying Act. The Regulations themselves do not supply case names, citations or summaries.

The Regulations are precise on certain points where practitioners, administrators or producers commonly encounter procedural pitfalls. The provisions create a set of strict timelines, documentary requirements and discretionary gateways that, if missed or misapplied, will affect participation and the validity of ballots. Key practical issues to watch are:

Timelines and cutoff days

• Notice publication minimums. The Commission must give notice of the conduct of a poll not less than 21 days before the poll (regulation 8(2)(b)). For postal ballots there is a separate publication requirement of not less than 21 days in a circulating newspaper (regulation 17(3)). Missed notice timelines can defeat participation opportunities.
• List determination date. The list of eligible producers must contain names of those determined by the Commission as eligible on the day 14 days before the date fixed for the poll (regulation 11(b)). This creates a fixed cutoff for eligibility regardless of events after that day, which can surprise producers who expect more recent changes to be reflected.
• Postal dispatch timing. The returning officer must send postal packs not less than 14 days before the ballot (regulation 18(1)). Late dispatch may compress producers’ time to vote and can be consequential where legal challenges rely on procedural unfairness.
• Absent vote applications. Producers wanting absent voting in respect of a meeting must apply not less than 7 days before the meeting (regulation 12(2)). Where travel or illness is foreseeable but not anticipated more than seven days ahead, producers who fail to meet this deadline may be excluded from absent voting.

List and nomination traps

• Single nomination per enterprise or corporate body. Multiple-person enterprises must nominate one person whose name will be listed (regulation 10(1)), and corporate producers must nominate a person for listing (regulation 10(2)). Failure to nominate in writing to the Commission will leave the enterprise without a listed voter and therefore unable to participate via postal or meeting vote.
• A person cannot be listed more than once or in relation to more than one enterprise (regulation 10(3)-(4)). This prevents aggregation of votes and requires careful co-ordination where a person is involved in multiple enterprises.

Postal pack completeness and the counterfoil system

• Counterfoil requirement. The counterfoil envelope must bear the committee name and the number printed against the producer’s name in the eligible producers list and must make provision for the name and signature on its reverse (regulation 18(1)(c)). Scrutiny includes checking that counterfoil envelopes are in order and that the counterfoil has name and signature (regulation 22(2)(b)-(c)). Absent or mismatched counterfoils may lead to a ballot being marked “Not in Order” and potentially excluded from the count.
• Returning officer initials. Ballot papers must bear the returning officer’s initials or a facsimile signature, otherwise ballot papers are to be rejected (regulation 18(1)(b); regulation 22(3)(a)). A returning officer’s administrative failure to initial every ballot could result in otherwise valid votes being invalidated.

Limits on argument material and scrutineer access

• Only one printed argument for and one against. The Commission will print only one argument in favour and one argument against a ballot question for circulation (regulation 17(4)). Parties should be aware that competing submissions may be excluded by this one-for-one rule and should plan to submit their preferred argument in a timely manner (regulation 17(4) requires submission not later than 18 days before the ballot).
• Scrutineer appointment. The returning officer appoints scrutineers for the persons who submitted arguments and for candidates (regulation 21(1)). There is no guaranteed right for other stakeholders to appoint scrutineers beyond these categories, and scrutineers depend on the returning officer’s appointment and notice (regulation 21(2)).

Postal detail and evidence preservation

• “Not in Order” envelopes remain unopened. If the counterfoil is not in order the entire envelope remains unopened and is marked “Not in Order” (regulation 22(2)(f)). This preserves evidence but effectively excludes the ballot from the count.
• Reissue of spoilt or non-received papers only on written application prior to polling day. Producers must apply in writing before polling day for a replacement pack if they did not receive or have a spoilt ballot (regulation 19). Missing this step risks disenfranchisement.

Chairperson cannot be a voter

• The Commission must not appoint a voting-eligible person as chairperson of a meeting (regulation 15(2)). If the Commission makes an invalid appointment, procedural challenges can arise.

Discretion and representativeness

• Commission discretion to switch to postal ballot. Where the Commission considers a meeting was not representative, it may require a postal ballot even after a meeting-based poll (regulation 6(2)). This discretionary safeguard can, however, be the basis of contention by stakeholders who preferred the outcome at the meeting.

No penalty or appeal provisions

• Absence of enforcement or appeal mechanisms within the Regulations. The Regulations do not set out penalties for non-compliance or specify appellate remedies. Parties relying on remedies must look beyond the Regulations to the Act or to general administrative law.

These are the primary operational pitfalls. Lawyers and administrators should map timelines against notice and list cutoffs, ensure strict compliance with the counterfoil and signature requirements, and advise clients about the nomination rule where multiple persons or corporate bodies are involved. Returning officers should maintain rigorous administrative practices to avoid the ballot rejection traps identified in regulation 22(3).

Compliance requires coordinated action among the Commission, returning officer, eligible producers and enterprises. The following is a practical, source-grounded checklist addressing the main compliance obligations, timelines and documentary standards set out in the Regulations.

For the Commission

• Determine producer status in accordance with regulation 4: use information supplied under section 13 of the Act where relevant and any other information the Commission considers appropriate (regulation 4).
• Compile the list of eligible producers under section 16 of the Act and ensure it conforms to regulation 11: specify the relevant committee (regulation 11(a)); include names and addresses of those determined eligible on the day 14 days before the poll (regulation 11(b)); order the list alphabetically by business name and number the names consecutively (regulation 11(c)-(d)).
• Furnish the list to the returning officer in a timely way so the returning officer can meet postal dispatch timelines (regulation 9).
• Decide the method of poll (meeting(s) or postal ballot) and ensure notices state the method and all required particulars (regulation 6(1), regulation 8(2)(f)). If a meeting is used, ensure the returning officer provides postal facilities for absent voters (regulation 6(3)).
• Approve questions for postal ballots or the candidate list (regulation 17(2), regulation 8(2)(da)). For section 10 polls include the objects and agricultural produce and relevant area in the notice (regulation 8(2)(c)-(d)).
• Publish notices at least 21 days before the poll in a manner approved by the Commission and ensure the newspaper notice requirement for postal ballots is followed (regulation 8(2)(b), regulation 17(3)).

For the returning officer

• Confirm appointment by the Commission and obtain the list of eligible producers (regulation 7, regulation 9).
• Prepare and send postal ballot packs by prepaid post not less than 14 days before the ballot date (regulation 18(1)). Ensure all packs include the printed arguments (where applicable), the ballot paper initialled or facsimile initialled, the ballot paper envelope, counterfoil envelope with producer number and space for name and signature, and an addressed return envelope (regulation 18(1)(a)-(d)).
• Provide a secure postal reception point using a private post box or other address considered fit (regulation 13).
• For meeting-based polls, accept absent voting applications at least 7 days before the meeting and verify that applicants meet the criteria (reside more than 30 km away, ill health, absent from the State that day, or travelling at the time of the meeting) (regulation 12(1)-(2)). Process absent votes in accordance with regulations 17-23 as modified by regulation 12(3).
• On polling day, conduct scrutiny and counting only after the poll has closed and in the presence of attending scrutineers (regulation 21(2), regulation 22(1)-(2)). Follow the prescribed sequence:
  • open each outside envelope addressed to the returning officer (regulation 22(2)(a));
  • check counterfoil envelopes against the list (regulation 22(2)(b));
  • verify the signature and name on the counterfoil (regulation 22(2)(c));
  • mark the list for each eligible producer who has forwarded an envelope (regulation 22(2)(d));
  • where counterfoils are in order, place ballot paper envelopes unopened into a sealed ballot box (regulation 22(2)(e));
  • where counterfoils are not in order, mark the whole unopened envelope “Not in Order” and preserve it (regulation 22(2)(f));
  • open the sealed ballot box and remove ballot papers for counting (regulation 22(2)(g)).
• Reject ballot papers that do not bear the returning officer’s initials or facsimile signature, contain identifying marks, or are not marked as directed (regulation 22(3)).
• Appoint scrutineers for argument submitters and candidates and give them reasonable notice of the count (regulation 21).
• Be prepared to supply replacement ballot packs on written application prior to the poll if a pack was not received or was spoilt, lost, damaged or destroyed (regulation 19).
• Exercise discretion on recounts, which may be ordered on the returning officer’s own motion or on written request from any eligible producer or scrutineer before declaration (regulation 23).
• Declare the result as soon as practicable and publish it in a newspaper circulating in the relevant area (regulation 24).

For enterprises and corporate producers

• Ensure nomination of a single person for listing. Where two or more persons carry on business together, submit a written nomination to the Commission naming the one whose name is to be listed (regulation 10(1)). Where the producer is a body corporate, submit a written nomination of the person to be listed (regulation 10(2)).
• Do not rely on multiple listings. Ensure no person is listed in relation to more than one enterprise and that names are not listed more than once (regulation 10(3)-(4)). Confirm with the Commission that nominations have been accepted and that the nominated person appears on the list.
• If unable to attend a meeting-based poll, apply for absent voting at least 7 days before the meeting and provide the required reason (residence more than 30 km away, ill health, absence from the State, or travelling) (regulation 12(2)).

For eligible producers voting by postal ballot

• Check for the ballot pack and counterfoil details as soon as the pack is received; ensure the counterfoil is completed with name and signature on the reverse (regulation 18(1)(c)(ii), regulation 22(2)(c)).
• Follow the directions on the ballot paper exactly to avoid rejection (regulation 20, regulation 22(3)(c)). Mark the voting intention in the manner directed on the paper (regulation 20).
• If the ballot paper is spoilt, lost or not received, make a written application to the returning officer before the day of the poll for a replacement (regulation 19).
• Keep record of postage or any tracking used to send the return to the returning officer, noting the returning officer’s nominated reception address (regulation 13, regulation 18(1)(d)).

For persons submitting printed argument material

• If seeking circulation of argument material for or against a postal ballot question, submit the material to the Commission not later than 18 days before the ballot date (regulation 17(4)). Only one argument for and one against will be printed by the Commission, so coordinate to ensure the preferred argument is the one submitted.
• If argument material is accepted, arrange for scrutineer attendance through the scrutineer appointment process (regulation 21).

General administrative practice

• Keep detailed records of dates for determination of eligibility, notice publication, list finalisation, postal dispatch and receipt, absent vote applications and recount requests. Many obligations are triggered by strict days-before cutoffs, so a timeline matrix is essential.
• Use template forms that meet the counterfoil and signature requirements and that replicate the exact committee name and producer list number to avoid mismatches at scrutiny (regulation 18(1)(c), regulation 22(2)(b)-(c)).
• Ensure returning officer initials or facsimile initials are applied to all ballot papers prior to postal dispatch to avoid rejections (regulation 18(1)(b); regulation 22(3)(a)).
• Keep preserved envelopes marked “Not in Order” as they may be relevant evidence in any post-poll administrative review or legal challenge (regulation 22(2)(f)).

Following the Regulations’ explicit steps and deadlines will be the primary compliance route. The text offers internal remedies such as recounts and scrutineer attendance but does not provide statutory penalty frameworks or explicit appeal channels within the Regulations, so parties should be prepared to rely on the parent Act or general administrative law if disputes arise.
