Growers Charge Act 1940

Statutory charge in favour of grower: Section 3(1) creates a monetary charge in favour of the grower where “crops” are subject to a security agreement. The charge is quantified by acreage: 30 cents per acre on the first 500 acres, and 10 cents per acre beyond 500 acres. The charge is a statutory right created by the Act and is not merely contractual.

Narrow crop definition: The Act defines “crops” narrowly at s 2. For the Act’s operation the term covers only “wheat or oats marketed for grain.” The textual scope therefore excludes other crops, and excludes wheat or oats not marketed for grain.

Interaction with security interests: The Act only operates “whenever crops are subject to a security agreement” (s 3(1)). The Act imports the terms “secured party” and “security agreement” from the Commonwealth Personal Property Securities Act 2009 (Cwlth) s 10 (s 2). The charge created operates in the context of those security arrangements and the Act expressly declares that s 73(2) of the Commonwealth Act applies to the charge (s 3(2)).

Priority mechanics: The Act sets a two‑part priority rule. First, the grower’s charge “shall rank immediately after any other statutory charge and any advance for or towards the cost (as ascertained in the prescribed manner) of growing, harvesting, and carting such crops made under any security agreement” (s 3(1)(a)). Second, the grower’s charge “shall be paid or satisfied in priority to all other moneys secured by any security agreement” (s 3(1)(b)). Read together these clauses place the grower’s charge behind statutory charges and behind advances for growing costs under the security agreement, but ahead of other monies secured under the security agreement.

Non‑alienability and protection from set‑off: Section 4 protects the grower’s statutory interest from being charged, assigned, attached, transferred by operation of law (except to the personal representative of a deceased grower), or subject to set‑off. The grower cannot convert the statutory charge into collateral or allow third parties to take security over the statutory interest.

Share‑farming special rules: Section 5 governs share‑farming. If crops are grown under a share‑farming agreement and subject to the grower’s charge, moneys arising from the charge are to be divided between the parties in proportion to their respective interests in the crops or proceeds. If the share‑farming agreement divides produce on a non‑proportionate basis, the Act permits a prescribed method to determine division of moneys arising from the charge. The Act defines when an arrangement qualifies as a share‑farming agreement (s 5(b)): it requires two or more persons contributing land, labour, material or plant and agreeing to divide the proceeds among them.

Regulatory discretions: Section 7 grants the Governor regulation‑making power to prescribe matters required or convenient for carrying out the Act, including the items of expenditure to be taken into account when ascertaining the cost enumerated in s 3, powers to obtain books and documents, prescription of commission allowances to secured parties or persons who pay growers on behalf of secured parties, and conferring powers on persons for effective operation. The regulations may contain penal provisions not exceeding $1,000.

Offences and penalties: Section 6 sets criminal offences for obtaining payment under the Act by false or misleading statements, or presenting false documents to a secured party, authority or any person from or through whom moneys in respect of the charge may be payable, with a penalty of $1,000.

Application date and entrenchment against contracting out: The Act applies to crops sown after 1 March 1941 (s 9). Section 8 bars contracting out: the Act’s provisions apply “in every case notwithstanding any contract or agreement to the contrary heretofore and hereafter made or entered into.”

Link with Commonwealth PPSA: The Act imports key definitions from the Personal Property Securities Act 2009 (Cwlth) (s 2), and declares the applicability of a provision of that Act, s 73(2), to the grower’s charge (s 3(2)). The text thus intentionally situates the grower’s statutory priority within the framework of Commonwealth personal property security law.

Collectively these concepts produce a statutory, non‑assignable, acreage‑based claim in favour of growers of wheat and oats marketed for grain when those crops are encumbered by security agreements, together with regulatory mechanisms to determine the costs that affect ranking and to police compliance.

Growers of specified crops: The primary class the Act affects is growers of “crops,” defined as wheat or oats marketed for grain (s 2). The Act creates a monetary charge in their favour when those crops are subject to a security agreement (s 3(1)), and it confers on them a non‑alienable statutory interest in the crop proceeds (s 4). The Act’s protections are limited to that defined group; persons growing other crops are not covered by the statutory charge as defined in the Act.

Secured parties and creditors under security agreements: The Act affects secured parties as defined under the Personal Property Securities Act 2009 (Cwlth) because the statutory charge arises only when crops are subject to a security agreement (s 3(1)) and the Act imports the term “secured party” from the Commonwealth Act (s 2). Secured parties who hold security over crops must, when dealing with proceeds or enforcing their security, recognise the grower’s charge and pay or satisfy it in priority to all other moneys secured by a security agreement, subject to the limited reservations in s 3(1)(a). Section 7(d) contemplates that secured parties or other persons may act as intermediaries for payment to growers and may be entitled to a commission where regulations provide for a deduction for expenses or services when making payments to growers.

Share‑farming parties: Share‑farming agreements involving two or more persons contributing land, labour, material or plant are covered when those crops are affected by the grower’s charge (s 5). The Act mandates how moneys arising from the grower’s charge are to be divided between parties to a share‑farming agreement, either proportionately to their interests or by a prescribed method where the agreement contemplates non‑proportionate division (s 5(a) and (b)).

Buyers, authorities and intermediaries: Any authority, secured party, buyer, or other person from or through whom moneys in respect of the charge are payable is potentially affected, because the Act prohibits presenting false documents or making false statements to such persons to obtain payment under the Act (s 6). The Governor may make regulations allowing the obtaining of books and documents in relation to compliance (s 7(e)), which affects persons holding records relevant to the ascertainment of cost or entitlement.

Administrators, personal representatives and insolvency officers: Section 4 shields the grower’s statutory interest from attachment and from passing by operation of law, save to the personal representative of a deceased grower. This limits the ability of administrators, trustees in bankruptcy, liquidators or other insolvency officers to appropriate the statutory interest except perhaps to a deceased grower’s personal representative. The text, however, does not elaborate other detailed insolvency mechanics.

Regulators and the Governor: The Governor has regulation‑making authority under s 7 to prescribe matters required for the Act’s operation, including what items of expenditure count for cost ascertainment, powers to obtain books and documents, prescription of commission rates, and conferral of powers necessary for effective operation. Those exercising powers under delegated regulations or authorised by regulations are included among those affected.

Courts and enforcement authorities: Courts and enforcement authorities are affected by the Act’s offences and penalties scheme (s 6), its entrenchment clause preventing contracting out (s 8), and by the statutory priority rule. They may be called upon to adjudicate disputes as to whether crops were subject to a security agreement, whether the prescribed manner of ascertaining costs was followed, or how moneys arising from the charge should be allocated in share‑farming contexts.

In short, the Act places a targeted legal entitlement in growers’ favour and creates obligations that fall mainly on secured parties and intermediaries dealing with proceeds of wheat and oats marketed for grain subject to security agreements, while also involving share‑farming partners, record‑holders and regulatory actors.

Grower’s right to a statutory charge: Where wheat or oats marketed for grain are subject to a security agreement, the grower has a statutory charge in respect of the crop equal to the prescribed per‑acre amounts (s 3(1)). That right is a monetary claim that must be paid or satisfied ahead of most other secured moneys (s 3(1)(b)).

Priority duties on secured parties and others holding proceeds: Secured parties holding security over crops must ensure that the grower’s charge is both recognised and satisfied according to the priority regime in s 3(1). The grower’s charge ranks immediately after any other statutory charge and after any advance for or towards the cost of growing, harvesting and carting made under any security agreement, with the grower’s charge to be paid before other secured moneys (s 3(1)(a)-(b)). Regulations may prescribe a commission or deduction allowed to a secured party or person as compensation for expenses or services when moneys are paid to growers by or through such parties (s 7(d)), so secured parties may have a regulatory entitlement to deduct under prescribed conditions.

Non‑alienability and preservation of grower’s interest: The grower’s statutory interest “shall not be capable of being charged, assigned, or otherwise dealt with by way of security, or attached” (s 4). That is both a right for the grower and a duty on third parties not to treat the statutory interest as available security. The only transfer allowed by operation of law is to a personal representative of a deceased grower, and no claim may be set off against such interest (s 4).

Record‑keeping and documentary obligations: The Governor may make regulations authorising the obtaining of books, documents and information necessary to ensure compliance with the Act (s 7(e)). Persons involved in growing, marketing, or holding security over crops should therefore expect that prescribed documentary evidence may be required to establish acreage, costs, parties’ interests, or entitlement under a share‑farming agreement.

Share‑farming allocation duties: Where crops are grown under a share‑farming agreement and are affected by the charge, moneys arising from the charge are to be split between the parties in proportion to their respective interests unless the agreement provides otherwise, in which case the money is to be apportioned in the manner prescribed (s 5(a)). The Act defines a qualifying share‑farming agreement by reference to two or more persons agreeing to contribute land, labour, materials or plant and to divide proceeds in agreed shares (s 5(b)). Parties to such agreements therefore have duties to quantify and document their respective interests and to follow the statutory allocation rules or the prescribed method.

Offences and standards of honesty: Section 6 imposes criminal liability on persons who obtain payment in pursuance of the Act by false or misleading statements, or who present false documents or make materially false statements to secured parties, authorities or persons from whom moneys might be payable. The penalty specified is $1,000 (s 6). This creates a duty of honesty and a compliance incentive to maintain accurate documentation.

Regulatory compliance and cost ascertainment: The Act contemplates that certain advances for growing costs are to be “ascertained in the prescribed manner” (s 3(1)(a)). The Governor may make regulations specifying the items of expenditure and matters to be accounted for in ascertaining such costs (s 7(b)). Parties involved in advances or claims against crops will therefore have duties to adhere to whatever methodology is prescribed for cost calculation.

No contracting out: Parties to contracts and agreements cannot opt out of statutory entitlements and duties created by the Act; s 8 states that the Act applies “notwithstanding any contract or agreement to the contrary heretofore and hereafter made or entered into.” This is a duty on all contracting parties not to rely on private contractual terms that purport to deprive growers of their statutory charge or to alter the priority regime set out in the Act.

Application timing: The Act applies to crops sown after 1 March 1941 (s 9). This is a temporal limitation on rights and duties under the Act.

In summary, rights and duties under the Act focus on: a grower’s non‑assignable, acreage‑based statutory charge; secured parties’ duty to recognise and satisfy that charge subject to limited reservations; documentary and regulatory compliance duties; allocation rules for share‑farming; and criminal prohibitions against dishonest procurement of payments.

Statutory criminal offences and fines: Section 6 sets out two offences: obtaining payment under the Act by means of any false or misleading statement (s 6(a)); and presenting false documents or making materially false statements to secured parties, authorities or other persons from whom moneys may be payable pursuant to the charge (s 6(b)). The penalty for either offence is a fine of $1,000 as specified in the Act (s 6). The Act does not stipulate imprisonment or other forms of punishment in the provisions provided.

Regulatory penalties: Section 7 empowers the Governor to make regulations and expressly allows the prescription of penalties not exceeding $1,000 for breaches of regulations (s 7(a)). This creates scope for subordinate legislation to create additional offences or enforcement mechanisms, subject to the monetary cap given in the Act.

Administrative measures and documentary powers: The regulation‑making power includes authority to obtain books, documents and information considered necessary for compliance or suspected contraventions (s 7(e)). While the Act itself does not describe a specific administrative enforcement agency or procedure, the regulations are the mechanism by which powers to compel production of documents and information can be prescribed. That is an enforcement pathway of administrative character, dependent on the content of any regulations made under s 7.

Priority enforcement through payment processes: The Act’s priority rules in s 3(1) and the prohibition on contracting out in s 8 operate as statutory constraints on how secured parties and others must distribute proceeds. Enforcement of the priority rules would ordinarily arise in the context of security enforcement, realisation of proceeds, or receivership, where parties or courts would be required to ensure the grower’s charge is satisfied in the order the Act prescribes. The Act itself does not set out a procedural enforcement regime for claims of breach of priority beyond the offences in s 6 and the regulations power in s 7.

Regulatory conferral of functions: Section 7(c) permits conferral upon any person of power or function “incidental to or necessary or convenient for the effective operation of this Act.” Regulations under this paragraph may create or designate persons or officers with enforcement functions. The Act does not specify which persons will receive such powers; the content and reach of enforcement will depend on regulations made under s 7.

Protection of grower’s interest from attachment: Section 4 protects the grower’s interest from being charged, assigned, attached, or passed by operation of law (except to the personal representative) and prohibits set‑off against such interest. That protection functions as an enforcement mechanism in the sense that third parties (creditors, attachers) cannot take or offset against the grower’s statutory interest. The Act does not provide a mechanism for third parties to circumvent this protection.

Limits on remedies and monetary caps: Both the statutory penalty for offences and the permissible maximum penalty for regulations are monetary and capped at $1,000 by the Act (s 6; s 7(a)). The Act does not provide for higher fines, restitution orders, or statutory interest in the text provided. Potential remedies in civil proceedings (for example, to enforce priority or to seek declaratory relief) are not detailed in the Act text supplied and would turn on general principles of civil law and procedure applied to the Act’s statutory entitlement.

Temporal application and continuity: The Act applies to crops sown after 1 March 1941 (s 9). That temporal clause sets the boundary for enforcement: claims under the Act arise only in respect of crops sown after that date.

In practice, enforcement of the Act’s priorities will implicate secured parties, receivers, courts and any persons or officers designated by regulations under s 7, subject to the monetary constraints and offence definitions the Act provides.

Interaction with Commonwealth Personal Property Securities Act 2009: The Act imports the terms “secured party” and “security agreement” by direct reference to s 10 of the Personal Property Securities Act 2009 (Cwlth) (s 2). Section 3(2) of the Growers Charge Act further declares that s 73(2) of the Commonwealth Act applies to a charge created under s 3(1). The Act thus situates its statutory grower charge within the Commonwealth personal property security framework. The Growers Charge Act does not reproduce or define the substance of the Commonwealth provisions; rather it makes those provisions applicable to the charge it creates. Users of this Act must therefore read it alongside the Personal Property Securities Act 2009 when assessing registration, priority and related mechanics.

Primacy notwithstanding other Acts: Section 3(1) creates the charge “notwithstanding the provisions of any other Act.” This wording indicates the Act’s intent to establish a statutory priority for the grower irrespective of inconsistent state legislation. Section 8 reinforces that intent by barring contracting out: the Act applies “notwithstanding any contract or agreement to the contrary heretofore and hereafter made or entered into.” Both provisions constrain the extent to which private contract or other statutory instruments may displace the grower’s statutory entitlement.

Interaction with statutory charges and advances: The grower’s charge is ranked “immediately after any other statutory charge and any advance for or towards the cost (as ascertained in the prescribed manner) of growing, harvesting, and carting such crops made under any security agreement” (s 3(1)(a)). The Act therefore expects existing statutory charges to retain priority over the grower’s charge. In addition, advances that finance growing costs under a security agreement are given priority ahead of the grower’s charge, but only to the extent those advances are “ascertained in the prescribed manner.” The Act permits the Governor to prescribe how costs should be ascertained (s 7(b)). This creates an intersection where the Act interacts with statutory charges established by other laws and with the mechanics of advances under security agreements, with the latter requiring compliance with prescribed cost‑ascertainment methods.

Regulatory layer and delegated powers: Section 7 provides broad regulation‑making powers to prescribe matters necessary to carry out the Act, including powers to obtain books and documents, prescribe expenditure items for cost ascertainment, confer functions on persons, and prescribe commission/deduction rates for secured parties who pay growers. This delegated legislative layer can create substantive rules that affect how the Act interfaces with other administrative regimes, records obligations and commercial practices.

Share‑farming rules and property law: Section 5 addresses distribution of moneys from the grower’s charge in share‑farming arrangements and defines when an arrangement constitutes a share‑farming agreement. The Act sets out a statutory rule for apportionment of proceeds that interacts with private contractual arrangements. Crucially, where the share‑farming agreement divides produce on a non‑proportionate basis, the Act allows for a prescribed method to determine allocation of moneys from the charge (s 5(a)). That creates a point of interaction between private law contracts and regulatory prescription.

Limitations on assignment, attachment and set‑off in property law and insolvency: Section 4 prevents charging, assigning, attaching or setting off the grower’s interest. This interacts with laws governing attachment, insolvency, and assignment, by removing the grower’s statutory interest from the pool of assets available for such remedies, save for the personal representative of a deceased grower. The Act does not specify how insolvency officials should treat the grower’s interest beyond this textual protection; consequential interaction with insolvency law would require analysis of insolvency statutes and authorities but the Act itself sets a prohibition.

Absence of procedural enforcement detail: The Act contains limited procedural directions about enforcement mechanisms; it relies on the existing legal framework, including the Commonwealth PPSA and other civil procedure rules, to effect priorities, payments and dispute resolution. The Act does not itself specify court procedures or enforcement steps, beyond offences and regulation‑making powers that could create such mechanisms.

Temporal interplay with legacy enactments: The compilation table records amendments and commencement details, indicating the Act has been subject to changes such as conversion to decimal currency and consequential amendments linked to the Commonwealth PPSA (Compilation table). Practitioners must therefore attend to the Act as it now cross‑references Commonwealth law and to any subordinate regulations made under s 7 that further define operational mechanics.

In short, the Growers Charge Act is an instrument that creates a discrete statutory priority but is designed to be read in conjunction with Commonwealth personal property security law and with any regulations made under its powers. Its “notwithstanding” and anti‑contracting out clauses give it a degree of statutory entrenchment, while its effectiveness in practice will depend on how it is applied alongside the PPSA and any regulations that govern cost ascertainment, commission deductions and documentary requirements.

Overview of recorded amendments in the Act’s compilation table: The text supplied includes a compilation table listing the Growers Charge Act 1940 as originally assented on 30 December 1940. Amendments and consequential modifications recorded in the compilation table include: the Decimal Currency Act 1965 (No. 113 of 1965), which affected certain sections of the Act with specified commencement dates; the Sentencing (Consequential Provisions) Act 1995 (No. 78 of 1995) and the Sentencing Legislation Amendment and Repeal Act 2003 (No. 50 of 2003) which amended s 6 (the penalty provision), with amendments noted in the table and referenced in s 6; and the Personal Property Securities (Consequential Repeals and Amendments) Act 2011 (Pt 4 Div 5) (No. 42 of 2011), which made consequential amendments to align the Act with the Commonwealth Personal Property Securities Act 2009 and is reflected in amendments to s 2 and s 3 (see compilation table and amendment notes).

Specific section amendments noted in the Act text: The Act text includes bracketed notes that specific sections were amended: s 2 was amended by No. 42 of 2011 s 47; s 3 was amended by No. 113 of 1965 s 8 and No. 42 of 2011 s 48; s 6 was amended by No. 50 of 2003 s 69(2) and No. 42 of 2011 s 49; s 7 was amended by No. 78 of 1995 s 147 and No. 42 of 2011 s 50. Those amendments indicate changes to definitions, penalty provisions, and the regulation‑making powers over time.

Decimal currency conversion and penalty adjustments: The Decimal Currency Act 1965 is recorded in the compilation table as having amended parts of the Act. The Act’s monetary figures (for example the 30 cents and 10 cents per acre rates in s 3(1), and the $1,000 penalty in s 6 and s 7(a)) reflect the currency regime after decimalisation. The compilation table records commencement dates for the decimal currency changes (Compilation table).

Integration with the Personal Property Securities reforms: The Personal Property Securities (Consequential Repeals and Amendments) Act 2011 is listed with a commencement date of 30 January 2012 in the compilation table and is reflected in the Act’s current cross‑references to the Commonwealth Personal Property Securities Act 2009 (see s 2 and s 3(2)). The Act’s amendments in 2011 align it with the Commonwealth regime by importing defined terms and by declaring the application of a specified provision of the Commonwealth Act.

Reprint history: The compilation table notes a Reprint 1 of the Growers Charge Act 1940 as at 22 June 2007 which included amendments up to that date. Later amendments, including those linked to the Personal Property Securities reforms, post‑date that reprint.

Practical consequence of the amendment history for users: The recorded amendments indicate that the Act has been updated to reflect changes in currency and to align with the Commonwealth’s personal property security framework. The Act’s definitions of “secured party” and “security agreement” now point to the Personal Property Securities Act 2009 (Cwlth) rather than defining those concepts within the state Act itself (s 2). The 2011 amendments appear intended to ensure the Growers Charge Act operates coherently with the national PPSA regime.

No textual amendments in the supplied source beyond those cited: The Act text supplied includes the bracketed amendment references and the compilation table; it does not include any other historical legislative detail or a full legislative history. Where the Act permits regulations to be made (s 7), the compilation table does not list any particular regulations; users must consult the statute and relevant regulatory instruments separately to identify subordinate legislation made under s 7.

In sum, the amendment history recorded in the Act shows currency conversion adjustments, penalty and sentencing legislative alignment, and consequential integration with the Commonwealth Personal Property Securities Act 2009, leaving the current Act as a narrowly framed statutory charge regime that is linked to the PPSA definitions and some PPSA provisions by declaration.

No cases or litigation are mentioned in the Act text provided. The supplied source contains no references to judicial decisions, reported cases, or litigation outcomes arising from the Growers Charge Act 1940. The text does not list precedent, interpretative authority, or any recorded disputes.

Potential areas where litigation might arise, based on the Act’s provisions: Although the Act itself does not record litigation history, its provisions identify a number of factual and legal issues that could give rise to disputes in practice, and which courts might be asked to determine. Those issues derive directly from the language of the Act and include:

• Whether particular crops are within the Act’s definition of “crops,” namely whether a given production is “wheat or oats marketed for grain” (s 2). Litigation could arise over whether produce is marketed for grain or is otherwise excluded.

• Whether crops were subject to a “security agreement” within the meaning of the Personal Property Securities Act 2009 (Cwlth) s 10 (s 2), and the effect of PPSA registration or the absence of registration on the operation of the grower’s charge.

• Priority disputes about the relative ordering of statutory charges, advances for growing costs “as ascertained in the prescribed manner,” the grower’s charge and other secured monies under security agreements (s 3(1)(a)-(b)). Questions could include the proper ascertainment of costs under any regulations, and disputes over whether advances qualify and how much they amount to.

• Share‑farming allocation conflicts, including whether an arrangement qualifies as a share‑farming agreement under s 5(b), the proper calculation of parties’ respective interests, and the application of the prescribed method where the agreement allocates proceeds on a non‑proportionate basis (s 5(a)).

• Enforcement issues where secured parties or intermediaries claim the right to deduct commission under regulations made pursuant to s 7(d) when paying growers by or through a secured party, and disputes over the legitimacy or amount of such deductions.

• Questions about the non‑assignability and protection against attachment in s 4, particularly in insolvency, administration, or bankruptcy contexts, where administrators or creditors might challenge whether the grower’s interest can be treated as part of an insolvent estate.

• Allegations of false statements or false documents under s 6, where persons claim that payments were procured fraudulently or through material misstatements.

Practical note on research: The absence of litigation history in the supplied source means that practitioners seeking judicial guidance on interpretation, enforcement or interplay with the Commonwealth PPSA will need to search case law databases and registries for decisions that consider the Growers Charge Act post‑enactment, and to review decisions applying or construing the relevant Commonwealth provisions the Act imports (for example the courts’ treatment of PPSA s 73(2) where applied to site‑specific statutory charges).

In summary, while the Act text contains no litigation record, it sets out a framework that, in practical commercial and insolvency disputes, could generate contested issues in court or tribunal proceedings relating to scope, priority, ascertainment methods, share‑farming allocations, and the exercise of regulatory powers.

Scope limited to wheat and oats marketed for grain: The Act’s definition of “crops” at s 2 confines operation to “wheat or oats marketed for grain.” A common trap is assuming the Act applies broadly to all agricultural produce. Growers of barley, canola, pulses, hay, pasture, horticultural crops, livestock or wheat/oats not marketed for grain fall outside the statutory definition in the text provided.

Small, fixed per‑acre amounts and currency implication: The charge is specified in nominal cents per acre amounts (s 3(1)). Those amounts are low in absolute terms (30 cents per acre up to 500 acres; 10 cents per acre thereafter). Readers should note the Act’s text is literal: the charge is the specified monetary amount. The Act does not include an automatic indexation mechanism or escalation clause in the text supplied. Expectations that the statutory charge will be a material economic protection should be checked against the fixed numerical values contained in the Act.

Non‑assignability prevents use as collateral: Section 4 prevents the grower’s statutory interest from being charged, assigned or otherwise dealt with by way of security. A grower may not be able to convert the statutory charge into negotiable security or use it to secure borrowings. That protection of growers simultaneously limits growers’ ability to monetise the statutory entitlement in advance.

Priority ordering nuances: The grower’s charge ranks immediately after any other statutory charge and after advances for growing costs “as ascertained in the prescribed manner” (s 3(1)(a)), and then takes priority over all other moneys secured by any security agreement (s 3(1)(b)). A practical pitfall is failing to account for advances that have parity or superior priority if they satisfy the Act’s ascertained methodology. The words “as ascertained in the prescribed manner” point to potential regulatory detail that will matter in practice but is not specified in the Act text.

Dependence on regulations for operational detail: The Act delegates key operational definitions and mechanisms to regulations: the prescribed manner for cost ascertainment (s 7(b)), the rate of commission or deduction allowed to secured parties (s 7(d)), and the power to obtain books and documents (s 7(e)). Absence of clear or accessible regulations can lead to uncertainty about how to calculate priority amounts or how payments and deductions are to be handled. Practitioners should check whether regulations exist and their content.

Cross‑reference to Commonwealth law without embedded text: The Act imports defined terms from the Personal Property Securities Act 2009 (Cwlth) (s 2) and declares the application of a specific Commonwealth provision (s 3(2)). The Act’s efficacy in particular situations therefore depends on understanding the corresponding Commonwealth provisions. Failing to consult the PPP Act for interpretative content, registration requirements, or priority rules that interact with this statutory charge is a practical omission.

Anti‑contracting out and private arrangements: Section 8 prevents contracting out of the Act’s provisions. Parties who attempt to achieve contrary priority orderings by contract cannot rely on private terms to exclude the statutory charge. Practitioners drafting security documents or marketing agreements should therefore not assume contractual priority terms will prevail against the statutory regime.

Share‑farming definition and disputes: Section 5(b) defines a share‑farming agreement narrowly. Agreements that do not meet the Act’s definition may not attract the share‑farming allocation rules, and the Act’s prescribed approach to non‑proportionate divisions can be invoked where relevant. Failing to document clearly the parties’ respective contributions and shares may complicate allocation of the grower’s charge proceeds.

Criminal penalties constraint and regulatory cap: The Act sets a monetary penalty of $1,000 for offences in s 6, and allows regulations to prescribe penalties not exceeding $1,000 (s 7(a)). That cap may affect enforcement strategies and expectations about punitive remedies; civil recovery and priority enforcement remain available through ordinary civil process, but the Act’s criminal sanction is modest and fixed unless regulations alter the landscape within the capped limit.

Temporal application: The Act only applies to crops sown after 1 March 1941 (s 9). Although that is largely historical, practitioners should note that the Act is tied to sowing dates and that the Act’s application to particular cropping cycles will depend on whether the sowing dates fall within the Act’s temporal scope.

Ambiguity over administrative implementation: The Act enables the Governor to confer powers on persons for effective operation (s 7(c)), but the Act does not specify which persons will be given those functions or the process for designating them. This can create operational uncertainty about who is authorised to obtain documents, calculate costs or administer distributions in practice.

In summary, common "gotchas" arise from the Act’s narrow crop definition, fixed small monetary amounts, non‑assignability of the right, regulatory dependence for essential operational rules, interplay with Commonwealth personal property security law, and modest criminal penalty caps. Users should confirm the existence and content of any regulations and consult the Commonwealth PPSA provisions the Act imports when applying the statutory provisions in practice.

Establish whether the Act applies: First, determine whether the produce in question qualifies as “crops” under s 2, that is, wheat or oats marketed for grain. Confirm that the crops were sown after 1 March 1941 to fall within the Act’s temporal scope (s 9). Then confirm whether the crops are subject to a “security agreement” as defined in the Personal Property Securities Act 2009 (Cwlth) s 10, because the grower’s charge arises only when crops are subject to a security agreement (s 3(1)).

Document acreage precisely: The statutory charge is calculated per acre (s 3(1)). Maintain contemporaneous, verifiable records showing the area sown with wheat or oats marketed for grain, because the charge amount depends on accurate acreage figures (30 cents per acre up to 500 acres; 10 cents per acre thereafter). Be prepared to produce planting records, sale receipts, or marketing documents as evidence.

For growers: assert the statutory entitlement and avoid assignment: Growers should assert and preserve their statutory interest under s 3(1) and take note that the interest cannot be charged, assigned or attached (s 4). Growers should not attempt to treat the statutory interest as collateral, and must instead seek payment of the statutory amount when crops are realised or proceeds are distributed under the security agreement.

For secured parties: account for priority and possible deductions: Secured parties holding security over the crops must ensure the grower’s charge is satisfied in the statutory order. That means paying or satisfying the grower’s charge after any other statutory charge and after advances for growing costs that are validly ascertained in the prescribed manner, and before other secured moneys (s 3(1)(a)-(b)). Check whether regulations under s 7(d) prescribe a rate of commission or deduction allowed to secured parties when paying growers; if such regulations exist, ensure any deductions comply with the prescribed rate and record the basis for deductions.

Check for applicable regulations and prescribed methods: The Act delegates essential operational matters to regulation (s 7), including the prescription of items to be taken into account in ascertaining the cost of growing, harvesting and carting crops (s 7(b)), and the method for dividing proceeds where share‑farming agreements allocate produce on a non‑proportionate basis (s 5(a)). Identify and comply with any relevant regulations that define cost ascertainment methods, commission rates, or documentary obligations. If regulations confer powers on specific persons for administration or enforcement (s 7(c)), engage with those persons in the prescribed manner.

Maintain accurate records and be ready to produce documents: Because the Governor may by regulation enable the obtaining of books, documents and information needed to ensure compliance or to investigate suspected contraventions (s 7(e)), all parties should maintain complete, accurate records of acreage, costs of production, sales proceeds, advances, and any share‑farming arrangements. These records will be necessary to support claims, to enable correct allocation under s 5, and to withstand enquiries or regulatory inspections.

Draft share‑farming agreements carefully: Parties to share‑farming arrangements should document contributions (land, labour, material, plant) and clearly specify how proceeds are to be divided. If the agreement anticipates a non‑proportionate division of produce or proceeds, parties should be aware that the Act permits a prescribed method to determine division of moneys accruing by reason of the grower’s charge (s 5(a)). Consider documenting the parties’ respective interests in a way that aligns with the Act’s allocation rules or anticipate that regulations may prescribe the method.

Avoid false or misleading statements: Section 6 criminalises obtaining payment under the Act by false or misleading statements, or presenting false documents or materially false statements to persons who may pay moneys in respect of the charge (s 6). All parties should ensure accuracy in communications and in documentation presented to secured parties, authorities or payors.

Consider registration and interaction with the PPSA: Because the Act imports the definitions of “security agreement” and “secured party” from the Personal Property Securities Act 2009 (Cwlth) (s 2), and declares that s 73(2) of the Commonwealth Act applies to the grower’s charge (s 3(2)), parties should consider how PPSA registration, perfection, notice and priority rules interact with the statutory charge. While the Act does not itself set out registration mechanics, compliance will likely require contemporaneous attention to PPSA processes where applicable.

Recognise non‑assignability and insolvency constraints: The grower’s statutory interest cannot be assigned or attached and does not pass by operation of law except to the personal representative of a deceased grower (s 4). Parties should not attempt to secure or enforce against that statutory interest. In insolvency contexts, consider how the prohibition in s 4 interacts with statutory insolvency regimes; obtain legal advice if administrators or insolvency officers are involved.

Seek clarity on commission and payment pathways: If payments to growers will be routed via secured parties or intermediaries, confirm whether any regulations prescribe permissible commission or deductions for secured parties under s 7(d). Where permitted deductions exist, claimants and payors should document commission rates, services rendered and expenses to justify any deduction.

Legal review and proactive dispute avoidance: Given the Act’s narrow scope, its interdependence with the Commonwealth PPSA and the role of regulations in filling operational detail, obtain legal advice to confirm applicable regulations, to align security documentation with statutory priorities, and to mitigate the risk of disputes over acreage, cost ascertainment, share‑farming allocations and deductions. Parties preparing or responding to claims under the Act should be ready to present documentary evidence consistent with the potential regulatory powers to obtain books and documents.

In short, compliance requires verification of crop type and sowing date, accurate acreage and cost records, adherence to any regulations prescribing cost ascertainment or commission deductions, careful drafting of share‑farming arrangements, avoidance of false statements, and attention to the interaction with Commonwealth PPSA processes.
