Ground Water (Qualco-Sunlands) Control Regulations 2018

The Regulations rest on a handful of statutory concepts that determine who pays and what information must flow to the administering body.

Notional maintenance costs (regulation 4)

• The Trust must determine, annually, an amount described as a "notional amount" that it considers will cover pumping to prevent increases in the ground water mound and underground water above the Blanchetown Clay layer in the Scheme Area during the contribution year (r4). The expression frames the Trust's task as an annual budgeting/estimation exercise tied directly to a specified hydrological objective.

Cost sharing and the unauthorised rate (regulations 5 and 6)

• The Regulations link the notional maintenance costs to contributions from owners and occupiers of category 1 land, in proportion to their risk management allocations (r5). The same base underpins the "unauthorised rate" used in the calculation of penalties for unauthorised irrigation: UR is defined as "the rate per megalitre payable by the owners and occupiers of the category 1 land for the relevant contribution year under regulation 5" (r6). In practice, the rate per megalitre that funds maintenance becomes the unit price used to compute liabilities for unauthorised water use.

Categories of land (regulation 7)

• The Regulations operationalise the Act’s classification of irrigated land by risk of irrigation‑induced waterlogging and salinisation (r7; the Act’s section 33 is invoked by the Regulations). Category 1 comprises: land at high risk from rising levels of the ground water mound or the perched water table, and land at medium risk from both the ground water mound and the perched water table. Category 2 includes the remaining combinations of medium/low risk across the two factors (r7(2)(a)-(b)). The result is a two‑tier partition whose membership is determined by risk classification under the Act.

Irrigation declarations (regulation 8)

• The Trust must serve declaration forms by 30 June, owners must return them by 31 July, and the forms require detailed operational, spatial and historical irrigation information (r8(1)-(3)). Required items capture: areas to be irrigated using licensed water, the category(s) and boundaries, the irrigation method and monitoring for efficiency, attached risk management allocations (and reasons for reductions), areas certified by the Minister as "zero impact", prior‑year crop and area data, and quantities of water used by category in the previous water usage year (r8(3)(a)-(b)). Owners may include applications for increased allocations and must indicate willingness to accept a partial allocation under particular conditions (r8(3)(c); r8(4)).

Perched water table (regulation 3)

• The Regulations define "perched water table" as the water table of underground water accumulated above the layer of Blanchetown Clay in the Scheme Area (r3). This climatic/hydrogeological term is key to the risk assessments and to the objective specified for the Trust’s pumping in r4. It ties the Regulations’ operational concerns to a defined physical layer.

Ministerial certification and satisfaction (regulations 8 and 9)

• Certain provisions require Ministerial action: areas that will be irrigated with "zero impact" must be certified by the Minister to be treated as such in declarations (r8(3)(a)(vi)); and new or increased allocations attached to the highest risk land under section 45(4) of the Act may only be so attached if it is a term of the agreement and the Minister is satisfied the addition will not increase the risk to other highest risk land or increase any other owner’s share payable under the Act (r9).

Temporal structure

• The Regulations operate year to year, with key administrative cut‑offs: the Trust must serve declarations by 30 June, owners must return by 31 July, and a substituted declaration correcting a genuine error may be provided by 31 August if the Trust is satisfied (r8(1)-(2), (5)). Liability for unauthorised use is assessed in a water usage year but is calculated with reference to a "relevant block of 3 consecutive water usage years" for the multiplier P in r6.

The Regulations identify specific actors who hold duties or are exposed to financial liability.

Owners and occupiers of category 1 land (primary payers)

• The Regulations explicitly place the cost burden of the notional maintenance costs on "the owners and occupiers of the category 1 land" in proportion to their risk management allocations for the contribution year (r5). They also make these same persons the payers of the "unauthorised rate" used to calculate liabilities for unauthorised water use (r6). Thus owners and occupiers of category 1 land both finance the scheme and carry the principal financial exposure for unauthorised irrigation.

Owners and occupiers of land where unauthorised water is used

• If water is used to irrigate land without authorisation (referring to s50 of the Act), both the owner and occupier of the land are liable for the amount calculated under regulation 6 (r6). The liability is therefore joint and applicable regardless of which party actually caused the unauthorised use.

Owners of irrigated properties required to complete declarations

• The Trust must serve irrigation declaration forms on the owner of each irrigated property to which, or part of which, a risk management allocation is attached (r8(1)). The owner must complete and return the declaration (r8(2)). The declaration obligations extend to providing information about occupancies, irrigated areas, categories, irrigation methods and monitoring, crop history, past water usage and any applications for increases (r8(3)).

The Trust

• The Trust is required to determine the notional maintenance cost annually (r4) and to serve declaration forms by 30 June (r8(1)). The Trust also receives and may accept substituted declarations that correct genuine errors if satisfied the owner has shown the error by 31 August (r8(5)). Additionally, the Trust is the entity whose rate per megalitre (under r5) becomes the unauthorised rate (UR) used in penalties (r6).

The Minister

• The Minister certifies zero‑impact areas for use in declarations (r8(3)(a)(vi)) and must be satisfied that attaching new or increased risk management allocations to the highest risk land will not increase the risk to other highest risk land or increase the share payable by any other owner of that category (r9). The Minister thus exercises a gatekeeping and protective role in respect of high‑risk land allocations.

Owners of category 2 land

• Category 2 owners are affected by the categorisation scheme (r7) and by the declaration requirements where their land is part of an irrigated property with a risk management allocation attached (r8). However, the explicit cost‑sharing obligation in regulation 5 applies only to owners and occupiers of category 1 land, which shifts the direct financial burden away from category 2 owners under these Regulations.

Other administrative actors under the Act

• The Regulations refer repeatedly to provisions of the Act (for example, sections 33, 43(8), 45(4), 50). Those sections in the Act will allocate other powers, rights and enforcement mechanisms; the Regulations operate within the Act’s framework and impose procedural and cost‑sharing details to be executed by the Trust and overseen by the Minister.

Who decides and who pays

• The Trust decides the yearly notional maintenance cost and administers the declaration process (r4, r8). The Minister decides certification and satisfaction in specific allocation circumstances (r8(3)(a)(vi); r9). Owners and occupiers of category 1 land pay the maintenance notional and bear the unauthorised rate for calculations of liability (r5-6). Owners and occupiers of land where unauthorised water is used are liable for the penalty amount (r6).

This section identifies the specific obligations the Regulations create, the decision rights they allocate, and the information flows required.

Trust’s duties (regulations 4 and 8)

• Annual notional cost determination: The Trust must determine an amount in respect of each contribution year that it considers will be required to cover pumping costs to prevent any increase in the ground water mound and underground water above the Blanchetown Clay layer (r4). This is an administrative duty to estimate and set a notional budget each year.
• Service of declarations: The Trust must serve, on or before 30 June each year, an irrigation declaration form on the owner of each irrigated property to which a risk management allocation is attached (r8(1)). It must receive and process returns by 31 July (r8(2)), and may accept substituted declarations correcting genuine errors if satisfied by 31 August (r8(5)). Those tasks create an information‑collection duty for the Trust and impose deadlines it must observe.

Owners’ duties (regulation 8)

• Completion and return: Owners receiving a declaration must complete and return it by 31 July preceding the contribution year (r8(2)). The form must include identification of irrigated areas to be irrigated using water under a water licence, categories and boundaries, irrigation methods and monitoring, attached risk management allocations (and reasons for reduction), areas certified as zero impact, crop history and prior‑year water usage quantities by category, and may include an application for an increase (r8(3)(a)-(c)).
• Applications for increased allocations and conditional acceptance: If an owner applies for increased allocation and is willing to accept, in partial satisfaction, a lesser allocation than their entitlement under s43(8) of the Act, the owner must state that willingness and the alternative allocation they will accept in the declaration (r8(4)). This creates a formal mechanism to accept partial allocations and binds the owner to state their fallback preference on the form.
• Correcting errors: An owner who timely returns a declaration may substitute a corrected declaration by 31 August if they satisfy the Trust that the first included a genuine error (r8(5)). The substituted declaration must correct only the error and must not make other changes.

Right to apply for allocation increases (regulation 8(3)(c))

• Declarations may include applications for increases in risk management allocations for one or both categories of land on the property (r8(3)(c)). The Regulations do not specify the test for granting an increase; they reference the Act’s procedures (for example, s45(4), s43(8)) and set process and timing for applications.

Liability for unauthorised use (regulation 6)

• Owners and occupiers of land on which unauthorised water was used are jointly liable to pay an amount calculated by reference to three variables: P (a multiplier either 1 or 3 depending on usage over a relevant block of three years or absence of authorisation), UW (the quantity of unauthorised water in megalitres used or taken to be used in that water usage year on the land), and UR (the unauthorised rate equal to the rate per megalitre payable by owners and occupiers of category 1 land under regulation 5 for the contribution year) (r6). The effect is to convert unauthorised volumetric use into a financial penalty tied to the contribution year rate.

Minister’s duties and rights (regulations 8 and 9)

• Certification of zero‑impact areas: The Minister must certify areas that will be irrigated during the current water usage year with zero impact on waterlogging and salinisation and salinity levels in the River Murray; only such certified areas may be identified as zero‑impact in the declaration (r8(3)(a)(vi)). This assigns an important factual gatekeeping function to the Minister.
• Satisfaction regarding attachment of new/increased allocations: Regulation 9 makes attachment of a new or increased risk management allocation to the highest‑risk category conditional on it being a term of the agreement and on the Minister being satisfied that the allocation will not increase risk to other highest‑risk land or increase the share payable by other owners of the category (r9(a)-(b)). The Minister thus has a veto based on specified criteria.

Rights implicit in the form content

• Owners gain a formal means to request additional allocation (r8(3)(c)) and to state willingness to accept a partial allocation as a fall back (r8(4)). They also have a limited remedy to correct genuine errors after initial submission (r8(5)). These are procedural rights embedded in the declaration process.

Information and record duties

• The level of detail required by the declaration (r8(3)) implies owners must maintain spatial records of irrigated areas, meter or other monitoring for irrigation efficiency, crop history and volumetric use by category for at least the prior water usage year. The Regulations require this data to be supplied to the Trust on the prescribed timetable.

The Regulations create monetary liabilities and procedural enforcement mechanisms; they do not, themselves, create separate criminal penalties or enforcement machinery beyond what the Act provides.

Monetary liability for unauthorised use (regulation 6)

• The principal penalty mechanism in the Regulations is the monetary liability for unauthorised water use. Where use is unauthorised (as defined in section 50 of the Act), owners and occupiers of the land are liable to pay an amount calculated using the variables set out in regulation 6. The liability depends on:
  • UW, the quantity of unauthorised water in megalitres used or taken to be used in the water usage year on the land;
  • UR, the unauthorised rate which is "the rate per megalitre payable by the owners and occupiers of the category 1 land for the relevant contribution year under regulation 5"; and
  • P, which is 1 if the total quantity of water used to irrigate the land over the relevant block of three consecutive water usage years is 110% or less of the total quantity authorised for irrigation during that block, or is 3 if that percentage is greater than 110% or no water was authorised for irrigation by a risk management allocation during the block (r6).
• The monetary figure A is therefore calculated from those variables (r6). The Regulations do not specify downstream recovery procedures, interest, late payment consequences or criminal sanctions in relation to unpaid amounts; those matters are likely provided for in the Act or other instruments.

Administrative deadlines and process (regulation 8)

• The Trust is required to serve declaration forms and owners are required to return them on a strict timetable (serve by 30 June; return by 31 July) (r8(1)-(2)). Failure to comply with these procedural requirements is not itself assigned a specific penalty in the Regulations, though non‑compliance will affect an owner’s ability to apply for allocations or to have up‑to‑date records for calculating authorised usage. The Regulations also allow a narrow correction window for genuine errors with Trust satisfaction by 31 August (r8(5)).

Ministerial oversight and conditional approval (regulation 9)

• The Minister’s satisfaction that attaching new or increased allocations to highest‑risk land will not increase risk to other highest‑risk land or increase other owners’ shares is a precondition for such attachments (r9). That condition operates as a control on allocation arrangements; the Regulations do not specify penalties for non‑compliance but the absence of Ministerial satisfaction prevents the allocation from being attached as contemplated.

Reference to Act enforcement provisions

• Regulation 6 refers to "unauthorised" use per section 50 of the Act. The Regulations therefore rely on the Act to define unauthorised use and to supply any associated enforcement powers, notices, or sanctions. The Regulations provide the financial computation for liabilities arising from that prohibited conduct (r6), but the Act will determine how such liabilities are enforced, recovered, or litigated.

What the Regulations do not specify

• The Regulations do not define billing, collection, interest, enforcement powers, inspection or audit regimes, administrative review processes, or civil or criminal penalties beyond the monetary liability formula. They therefore create liabilities and process obligations but leave enforcement operational details to the Act, the Trust’s internal procedures, or other law.

The Regulations are subordinate to, and operate within, the Ground Water (Qualco‑Sunlands) Control Act 2000 (the Act). They repeatedly invoke and implement specific Act provisions; the Regulations do not attempt to displace the Act’s framework.

Direct textual links to the Act

• The Regulations define "Act" as the Ground Water (Qualco‑Sunlands) Control Act 2000 (r3). Several provisions explicitly reference sections of the Act:
  • Risk categories are based on classification under section 33 of the Act (r7(2)).
  • The declaration form process requires owners to provide information about "the water taken pursuant to a water licence" and otherwise operates within the licensing framework the Act establishes (r8(3)(a)(i)). The Act provides the substantive water licence and allocation rights; the Regulations specify declaration content relevant to those licences.
  • The Regulations reference section 43(8) of the Act in relation to owners’ entitlement to shares of the available excess risk management capacity and how owners may indicate a willingness to accept partial satisfaction of an application (r8(4)).
  • Regulation 9 refers to section 45(4) of the Act regarding attachment of new or increased risk management allocations to the highest risk land; it supplements the Act by imposing Ministerial satisfaction criteria (r9).
  • Regulation 6 refers to "unauthorised" use as defined by section 50 of the Act (r6). The Regulations therefore rely on the Act’s definition and any procedural or enforcement consequences contained in the Act for unauthorised use.

Subordinate instrument implementing Act duties

• The Regulations take certain high‑level duties and discretions in the Act and convert them into annual administrative steps and formulas. For example, the Trust’s annual estimation of pumping costs in r4 translates into a notional maintenance cost which the Regulations then allocate among category 1 owners (r5). The Act likely confers powers on the Trust to manage the Scheme; the Regulations put a specific annual budgeting and cost‑allocation mechanism into place.

Ministerial role and certification

• The Minister’s certification of zero‑impact areas (r8(3)(a)(vi)) and satisfaction as to the non‑increase of risk or financial share for owners when attaching new allocations to highest‑risk land (r9) rely on powers and criteria in the Act to define the scope and legal effect of such certifications and satisfactions. The Regulations do not elaborate the substantive tests beyond those two specified outcomes.

Intersection with water licensing and salinity control law

• Declarations must identify areas to be irrigated "using water taken pursuant to a water licence" (r8(3)(a)(i)). The Regulations therefore presuppose operation within the broader water licensing regime that the Act or other water laws provide. They also explicitly target irrigation‑induced waterlogging and salinisation and salinity levels in the River Murray (r4, r8(3)(a)(vi)), tying the administrative machinery to environmental objectives that may intersect with other environmental legislation or River Murray management instruments.

No standalone criminal penalties added

• The Regulations create a monetary liability framework for unauthorised use but do not create separate criminal offences or enforcement powers beyond those in the Act. Enforcement and appeal pathways, as well as mechanisms for recovery of unpaid amounts, would arise under the Act or general administrative law.

Administrative law and review

• Because the Regulations impose administrative obligations on the Trust and Minister, decisions under the Regulations, for example the Trust’s notional maintenance cost, the Minister’s certification or satisfaction, the Trust’s acceptance of a substituted declaration, are likely subject to general administrative law principles (procedural fairness, reasonableness) and any review mechanisms available under the Act or general judicial review. The Regulations do not set out review or appeal processes.

The Regulations have a concise legislative history recorded in the instrument.

• Principal regulations: Ground Water (Qualco‑Sunlands) Control Regulations 2018, No. 202 of 2018 (as listed in the Legislative history section of the instrument).
• Gazettal and commencement: The Regulations were published in the South Australian Government Gazette on 16 August 2018 at p 3148 and commenced on 16 August 2018 (r2 and Legislative history entry).
• There are no amendment entries recorded in the instrument text provided beyond the principal regulations and their commencement notice.

What the legislative history indicates about change mechanics

• The Regulations are a single subordinate instrument that took effect on the date made (r2), indicating a wholesale replacement or update of the subordinate rules relating to the Qualco‑Sunlands Scheme at that time. The Legislative history in the text provides only the original enactment reference; no subsequent amendments or reprints are recorded in the supplied document.

Implications for legal research

• Any practitioner needing the current text should verify whether later amending regulations exist beyond the Principal regulations listed, and check the Act for amendments affecting the referenced sections (for example sections 33, 43(8), 45(4), 50) that the Regulations implement. The instrument itself refers readers to the Index of South Australian Statutes or legislation.sa.gov.au for further information (Legislative history Notes).

The instrument contains no case citations, and its text records no litigation history. The Regulations do not name any court decisions or provide summaries of legal challenges. Concretely:

• The Regulations do not cite, nor do they include, any judicial decisions or administrative tribunal determinations.
• The instrument records no recorded appeals, stayed provisions, or active litigation concerning interpretation or application.

Practical implications

• Because the Regulations primarily set procedural duties and a formulaic monetary liability tied to the Act, litigation issues that could plausibly arise include disputes over:
  • The Trust’s determination of the notional maintenance cost under regulation 4 (challengeable on administrative law grounds if affected persons contend the figure is irrational or procedurally unfair).
  • Classification of land into category 1 or category 2 under regulation 7 (disputes over factual risk classification).
  • Whether an owner’s use was "authorised" under the Act and, if not, the correct computation of the liability under regulation 6 (including the computation of the relevant three‑year block and whether P should be 1 or 3).
  • Ministerial certification of zero‑impact areas and satisfaction under regulation 9 (whether the Minister’s decision complied with the required statutory criterion).
• None of the above is actually recorded in the instrument as having been litigated.

Recommendation for researchers

• Because the Regulations reference several sections of the Act, a search for litigation should include challenges to the Act’s administration and to Trust decisions under the Act as well as specific disputes applying regulation 6, regulation 8 declarations, and regulation 9 Ministerial satisfactions. The Regulations themselves contain no litigation record; any such material must be sought in case law databases and administrative decisions relating to the Act and the Trust.

This section flags precise, source‑grounded mechanics and operational pitfalls that may not be obvious on a high‑level reading.

Cost allocation is limited to category 1 land (regulation 5)

• The notional maintenance costs determined by the Trust are shared only among owners and occupiers of category 1 land in proportion to the risk management allocations attached to their respective land at the start of the year (r5). Category 2 landholders are not directly charged under regulation 5, even though their irrigation activity and category must be recorded in declarations (r7, r8). Practically, this concentrates scheme costs on a subset of irrigators (those on higher risk land) rather than spreading costs across all irrigated land.

Unauthorised rate ties penalty to annual charge for category 1 (regulations 5 and 6)

• UR, the "unauthorised rate", is defined as "the rate per megalitre payable by the owners and occupiers of the category 1 land for the relevant contribution year under regulation 5" (r6). This means the unit price used to calculate penalties for unauthorised use is not a fixed statutory fine but is linked to the Trust’s annual notional cost allocation outcome. If the notional maintenance cost rises, UR rises, and unauthorised usage becomes more expensive per megalitre.

Three‑year block multiplier (regulation 6)

• The multiplier P is binary: 1 if over the relevant block of three consecutive water usage years total water use is 110% or less of the total authorised; otherwise 3, or 3 where no water was authorised for irrigation in the block (r6). The use of a three‑year rolling block introduces a cumulative compliance measure, so overshoot in one year can affect the multiplier for an unauthorised use calculation. Those subject to allocations must track aggregate usage across three years and correlate that with authorised quantities.

Definition of "unauthorised" ties to the Act (regulation 6)

• The Regulations reference "unauthorised" per section 50 of the Act (r6). Interpreting whether a particular use is authorised requires checking the Act’s definitions and any licence terms; the Regulations do not define "unauthorised". Practitioners must consult section 50 of the Act to determine the conduct to which r6 applies.

Ministerial certification required for "zero impact" areas (regulation 8)

• Owners may identify areas to be irrigated with "zero impact" only if certified by the Minister (r8(3)(a)(vi)). The existence of a declared zero‑impact area therefore depends on Ministerial action, not merely owner assertion. If an owner omits to secure certification, that area cannot be treated as zero‑impact for declaration purposes.

Correction window narrow and conditional (regulation 8(5))

• An owner who timely submits a declaration can correct a genuine error by substituting a corrected declaration by 31 August, but only if the owner "satisfies the Trust" on or before that date that the original included a genuine error (r8(5)). The requirement that the owner satisfy the Trust places the evidential burden on the owner, and the timing is tight, only one month after the 31 July return date.

Attachment of new/increased allocations to highest risk land conditioned on Minister’s satisfaction and agreement terms (regulation 9)

• A new risk management allocation or increase under section 45(4) of the Act may be attached to highest‑risk land only if it is a term of the agreement and the Minister is satisfied the addition will not increase risk to other highest‑risk land or increase any other owner’s share under the Act (r9). Parties negotiating such agreements must build these conditions into the agreement and secure Ministerial satisfaction; absent either, the attachment cannot lawfully occur.

Possible misalignment of financial incentives

• Because only category 1 owners pay the notional maintenance costs and because penalties for unauthorised use are tied to the category 1 rate, category 1 owners bear both the ongoing maintenance burden and the primary enforcement cost base. Category 2 owners, by contrast, may avoid direct financial maintenance charges while still being subject to declaration obligations. The Regulations do not provide an explicit mechanism to reconcile this cross‑subsidy or to adjust allocations if the risk profile of land changes during the year.

No collection or recovery mechanics in the Regulations

• The Regulations create payment liabilities but do not specify how the Trust will bill, collect, recover, or enforce unpaid amounts. Practitioners should look to the Act and the Trust’s own procedures for operational details. The absence of collection mechanics in the Regulations means uncertainty may arise about timelines, interest, enforcement measures and dispute resolution.

This section gives a practical checklist and process map strictly based on the Regulations’ text.

For the Trust (administrative steps)

1. Determine the notional maintenance costs for each contribution year:
   • Perform the annual assessment required by regulation 4, determining an amount that in the Trust's opinion is required to pump sufficient water into disposal basins to prevent increases in the ground water mound and underground water above the Blanchetown Clay layer (r4).
2. Serve irrigation declaration forms:
   • Serve the prescribed irrigation declaration form on the owner of each irrigated property to which, or part of which, a risk management allocation is attached on or before 30 June each year (r8(1)).
3. Receive and process declarations:
   • Receive completed declarations by 31 July and record the information required under regulation 8(3) for the next contribution year (r8(2)-(3)).
4. Accept substituted declarations for genuine errors:
   • If an owner returns a declaration and subsequently demonstrates a genuine error on or before 31 August, accept a substituted declaration that corrects only that error (r8(5)). The Trust must be satisfied that the corrected declaration is genuinely correcting an error and does not introduce other changes.

For owners and occupiers (compliance checklist)

1. Expect and return the irrigation declaration on time:
   • If you receive an irrigation declaration from the Trust (served by or before 30 June), complete and return it by 31 July for the next contribution year (r8(1)-(2)).
2. Prepare the necessary information to include in the declaration:
   • Identify areas of land in the Scheme Area to be irrigated during the current water usage year using water taken under a water licence (r8(3)(a)(i)).
   • State the category or categories of that land and the boundaries where more than one category applies (r8(3)(a)(ii)).
   • Provide the method(s) of irrigation, including the method for monitoring irrigation efficiency, and if more than one method is used, state the area and category for each method (r8(3)(a)(iii)).
   • State the risk management allocation attached to the land, and if divided, the allocation for each category (r8(3)(a)(iv)).
   • If an allocation is less than in the previous year, include the reason for the reduction (r8(3)(a)(v)).
   • If you propose any area to be irrigated with zero impact, ensure that area has been certified by the Minister prior to including it in the declaration (r8(3)(a)(vi)).
   • Provide crop(s) grown in the immediately preceding water usage year and the area and category on which each crop was grown (r8(3)(a)(vii)).
   • State the quantity of water used to irrigate each category of land in the previous water usage year (r8(3)(b)).
3. If seeking an increase in allocation:
   • Include an application for an increased risk management allocation for one or both categories in the declaration (r8(3)(c)).
   • If you are prepared to accept a smaller allocation in partial satisfaction of the application (particularly where applications by owners cannot be fully satisfied), state that willingness and the allocation you will accept, noting section 43(8) of the Act is relevant (r8(4)).
4. Correct genuine errors promptly:
   • If you return a declaration by 31 July and later identify a genuine error, satisfy the Trust on or before 31 August that an error occurred and submit a corrected declaration by that date, correcting only the error and making no other change (r8(5)).
5. Monitor water use across the three‑year block:
   • Track authorised quantities and actual use across the relevant block of three consecutive water usage years to avoid triggering the higher multiplier P in the unauthorised use calculation (r6). If your total use over the block exceeds 110% of authorised quantities, a P of 3 can apply to liabilities for unauthorised use; if it is 110% or less, P is 1 (r6).
6. Avoid unauthorised use and understand liability mechanics:
   • If water use is unauthorised under section 50 of the Act, both owner and occupier are jointly liable to pay an amount A calculated using the quantity of unauthorised water (UW), the unauthorised rate (UR) which is the category 1 rate under regulation 5 for the contribution year, and the multiplier P (r6). Ensure meters, licences and operational practice align with authorised allocations.

For the Minister (procedural steps)

1. Certify zero‑impact areas:
   • Where owners identify areas to be irrigated with zero impact, consider and, where appropriate, certify those areas so they may be identified as zero impact in declarations (r8(3)(a)(vi)).
2. Satisfy conditions for allocation attachment:
   • Where an agreement contemplates the attachment of a new or increased risk management allocation to highest‑risk land under s45(4) of the Act, ensure it is a term of the agreement and be satisfied that doing so will not increase the risk to other highest‑risk land or increase any other owner’s share payable under the Act (r9).

Recordkeeping and evidence

• Owners should maintain clear records of irrigated areas, categories, irrigation methods and efficiency monitoring, crop history, and water quantities used by category for at least the prior water usage year to ensure accurate declaration completion (r8(3)). These records will be necessary to demonstrate authorised use and to contest any allegation of unauthorised use.

Financial planning

• Owners and occupiers of category 1 land should budget for their proportionate share of the Trust’s notional maintenance costs (r5), knowing that this share becomes the unit rate used in calculating liabilities for unauthorised use (r6). Because the Trust sets the notional cost annually (r4), those liable should anticipate year‑to‑year variation.

Legal and administrative review

• If there is disagreement with the Trust’s notional cost, a category designation, the Minister’s certification or satisfaction, or the calculation of an unauthorised use amount, consult the Act for review and enforcement pathways. The Regulations do not set out appeal rights; administrative law principles and the Act’s provisions govern reviewability and remedies.

Keep the Act close at hand

• The Regulations implement and cross‑refer to multiple Act provisions (e.g., ss 33, 43(8), 45(4), 50). Compliance requires reading those Act provisions alongside these Regulations to understand licence authorisations, the meaning of "unauthorised", entitlement calculations and any enforcement or review mechanisms not specified in the Regulations.
