Greyhound Industry Reform Inspector Act 2024

Inspector: The Greyhound Industry Reform Inspector is a single person employed in the Public Service of South Australia (s4(2)). The Inspector must be independent of the controlling authority, must not have been involved in the Independent Inquiry that produced the Report, and must not accept any office or role relating to greyhound racing in any jurisdiction (s4(3)). The Inspector is not subject to Ministerial direction in exercising functions (s5(2)), but the Minister may request reports and may delegate functions under the Act (s7). The Inspector may appoint authorised officers from among public service employees (s14).

Controlling authority: Defined by reference to the Authorised Betting Operations Act 2000 as the body designated as the racing controlling authority for greyhound racing. In practice this is Greyhound Racing SA (or its successor). The entire oversight regime targets this body’s implementation of the Report recommendations.

Report and Report recommendations: The Report of the Independent Inquiry into the Governance of the Greyhound Racing Industry, and specifically those recommendations that relate to the controlling authority. The Act does not set out the content of those recommendations; they are defined by reference to an external document. This means that industry participants and the controlling authority must look to the published Inquiry report to understand exactly what reforms are being monitored.

Functions of the Inspector: Oversee and assess implementation of Report recommendations; receive reports from the controlling authority on integrity and welfare matters at a frequency determined by the Inspector; facilitate collaboration between the controlling authority and the Minister; gather information relating to greyhound racing and the controlling authority; provide reports to the Minister on request or on own initiative; and prepare the final report (s5). The phrase “facilitate collaboration” is broad and could include mediating disputes, suggesting changes, or compelling meetings.

Authorised officer: A person appointed by the Inspector under s14, who is a public service employee. Authorised officers exercise many of the same powers as the Inspector, including entry and inspection (s9), requiring information (s8), and serving attendance notices. They must carry a certificate of identity and produce it on request (s14(5)).

State authority: A defined category under s12(6) that includes office-holders under Acts, public sector agencies, South Australia Police, local councils, and bodies established for a public purpose by or under an Act (other than voluntary organisations). The regulations may add or exclude persons. This definition allows information sharing with a very broad set of government and quasi-government entities.

Prescribed information and documents: Information or documents relating to greyhound racing, greyhound welfare or the controlling authority, plus any kind prescribed by regulations (s12(6)). This is deliberately wide and can be further expanded by regulation without amending the Act.

The primary addressee of the Act is the controlling authority for greyhound racing, which is the body designated under the Authorised Betting Operations Act 2000. That body must comply with information notices, provide regular integrity and welfare reports at the Inspector’s determined frequency, cooperate with entry and inspection, and implement the Report recommendations under the Inspector’s oversight. The controlling authority’s officers and employees are also directly affected: s8 allows the Inspector to issue notices requiring them to provide information or documents in their possession, and s8(5) expands “employee” to include contractors (persons performing work under a contract for services), volunteers, and persons of a prescribed kind. This means that independent contractors such as veterinarians, transport providers, or kennel staff who work for the controlling authority could be compelled to produce documents and attend before the Inspector. The Act does not limit the scope to current workers; the definition includes persons who “have previously carried out work” for the controlling authority, so former employees and contractors remain subject to compulsory information notices.

Greyhound racing participants who own or operate premises used in the course of greyhound racing are indirectly affected because the Inspector or an authorised officer may enter those premises. Premises not owned or operated by the controlling authority require a warrant from a magistrate (s9(3)), but premises owned or operated by the controlling authority can be entered without a warrant (s9(2)). This could include training tracks, kennels, and racecourse facilities. Participants may be required to answer questions on the spot and produce documents. The Act does not require the Inspector to give notice of entry, so unannounced inspections are possible.

State authorities as defined in s12 are affected because they are permitted to share prescribed information and documents with the Inspector and with each other regarding greyhound racing, greyhound welfare, or the controlling authority, despite any other Act or law. This creates a broad information-sharing network that includes police, local councils, public sector agencies, and any body declared by regulation. The Act does not require the provider to seek consent from the person to whom the information relates; the provider’s reasonable belief that the information would assist the recipient to perform “official functions” is the only trigger.

Public Service employees assigned as Inspector staff or appointed as authorised officers are affected by the confidentiality obligations in s16. They must not divulge personal information, trade secrets, business processes or financial information acquired in the administration of the Act, except in specified circumstances. Breach carries a maximum penalty of $10,000. The obligation continues after they leave the role.

Taxpayers bear the cost of the Inspector’s office, staffing, and compliance costs imposed on the controlling authority, which are likely passed on to participants and ultimately to betting operators and consumers through higher fees or reduced prize money.

Duty to comply with information notices: The controlling authority and its officers and employees must, when served with a written notice under s8(1), provide the specified information or documents within the period specified in the notice. The period must be reasonable, but the Act does not define “reasonable” and the Inspector alone determines it. Failure to comply is an offence punishable by a $10,000 fine. The person served must also attend at a specified time and place if required (s8(3), (4)(b)). The duty applies even if compliance might incriminate the person (s11), though the fact of production or the answer given is not admissible against the person in penalty or criminal proceedings (other than for false or misleading statements). The contents of documents and information are admissible; only the act of compliance is protected.

Duty not to hinder or obstruct: Under s10, a person must not, without reasonable excuse, hinder or obstruct the Inspector or authorised officer in the exercise of powers under Part 3. The section also requires a person to answer questions to the best of their knowledge, information or belief, and to comply with any other lawful requirement or direction. The use of “without reasonable excuse” places the burden on the person to justify non-compliance. The Act does not list what excuses are reasonable; presumably physical incapacity or impossibility would qualify, but subjective inconvenience is unlikely to suffice.

Duty to produce identity certificate: An authorised officer must, at the request of a person in relation to whom the officer has exercised or intends to exercise powers, produce the certificate of identity provided by the Inspector (s14(5)). This gives industry participants a procedural right to verify the officer’s authority before complying. If no certificate is produced, the person arguably has a reasonable excuse to refuse entry or compliance, though the Act does not explicitly say so.

Duty of confidentiality: Persons engaged in the administration of the Act must not divulge personal, trade secret, business process or financial information acquired through their role, except with consent, as authorised by the Inspector, in connection with administration, to police, to a person involved in administering another law, or for legal proceedings (s16(1)). Information disclosed under one of these exceptions must not be used for any other purpose (s16(2)). Both breaches carry a $10,000 penalty.

Right to claim privilege: The Act removes the right to refuse to answer a question or produce a document on grounds of self-incrimination, but gives limited use immunity in s11(2): the fact of production or the answer given is not admissible in proceedings for an offence or penalty (other than for false or misleading statements). This is a narrow protection: the contents of documents and information remain admissible, and the immunity does not apply to derivative evidence discovered from the compelled disclosure. In practice, a person who is compelled to give self-incriminating information may still face prosecution if the prosecution uses that information to obtain other evidence.

Right to seek legal advice: The Act does not expressly grant a right to consult a lawyer before answering questions or producing documents, but s10’s “reasonable excuse” for hindering or obstruction might encompass seeking immediate legal advice if it does not cause unreasonable delay. The prudent course for a person served with a notice is to contact a lawyer before the compliance period expires, but the Act makes no allowance for extension of the time limit for that purpose.

The Act creates six distinct criminal offences, all of which are punishable by fine, imprisonment or both.

Failure to comply with information notice: A person who refuses or fails to comply with a notice to provide information or documents under s8(1), or who without reasonable excuse refuses or fails to attend as required under s8(3), is guilty of an offence with a maximum penalty of $10,000 (s8(4)). This is a summary offence (inferred from the penalty amount). The offence applies to the controlling authority itself (as a corporation) and to its officers, employees, contractors and volunteers.

Hinder or obstruct Inspector: A person who without reasonable excuse hinders or obstructs the Inspector or authorised officer in exercising Part 3 powers; fails to answer a question to the best of their knowledge; fails to comply with any other lawful requirement or direction; or uses abusive, threatening or insulting language, is guilty of an offence with a maximum penalty of $10,000 (s10). This is a broad provision that criminalises passive non-compliance (failing to answer) as well as active obstruction. The inclusion of abusive language is notable; it is a disorderly conduct-style provision that applies even if the person is not otherwise resisting.

Impersonating an authorised officer: Falsely representing, by words or conduct, that one is an authorised officer carries a maximum penalty of $5,000 (s15). This is the only offence with a lower maximum; it is not imprisonment.

Breach of confidentiality: Divulging protected information acquired through administration of the Act, other than as authorised, is an offence punishable by a $10,000 fine (s16(1)). Additionally, using information disclosed under the section for a purpose other than that for which it was disclosed carries the same penalty (s16(2)). This applies to the recipient as well as the original discloser.

False or misleading information: Making a statement that is false or misleading in a material particular in any information provided under the Act is an offence carrying a maximum penalty of $10,000 or imprisonment for 2 years (s17). This is the most serious penalty in the Act, reflecting the importance the Act places on the integrity of information provided to the Inspector. The offence can be committed by inclusion or omission - so leaving out a material fact qualifies.

Enforcement is through ordinary criminal prosecution, likely by the police or the Inspector’s office. The Act does not create a new enforcement body, nor does it provide for infringement notices or on-the-spot fines. The maximum penalties are relatively modest by corporate law standards but potentially significant for individuals. Because the Act abrogates self-incrimination, prosecutors may use compelled testimony and documents to gather evidence for these very offences, subject to the use immunity in s11 which protects only the fact of production or the answer given, not the contents.

Authorised Betting Operations Act 2000: The Act relies on that Act’s definition of “controlling authority” for greyhound racing. The Inspector’s oversight does not replace the powers or duties of the controlling authority under that Act; rather it adds a layer of scrutiny over the authority’s implementation of the Inquiry recommendations. The controlling authority remains subject to its existing statutory obligations, and the Inspector’s information-gathering powers can potentially duplicate or conflict with reporting obligations already in place. No provision in this Act exempts the controlling authority from complying with other laws.

Public Sector (Data Sharing) Act 2016: Section 13 provides that nothing in Part 4 of this Act affects the operation of the Public Sector (Data Sharing) Act 2016. This means the existing data‑sharing regime for public sector agencies remains in force and is not overridden or in any way diminished. Where both Acts apply, agencies must comply with both sets of requirements. The Inspector’s information‑sharing power under s12 is supplementary, not exclusive.

Other Acts prohibiting disclosure: The information‑sharing provision in s12(2) operates “Despite any other Act or law”. This overrides secrecy provisions in other statutes (such as privacy laws, racing legislation, and welfare Acts) that would otherwise prevent a state authority from providing information about greyhound racing, welfare or the controlling authority to the Inspector or other listed bodies. The override applies only to “prescribed information and documents” as defined, but that definition is extremely broad: it includes any information or documents relating to greyhound racing, greyhound welfare or the controlling authority, plus any additional kinds prescribed by regulation. The override does not extend to information outside that scope.

Self-incrimination privilege and criminal procedure: Section 11 abrogates the common law privilege against self‑incrimination for individuals compelled to answer questions or produce documents under the Act. This is an override of both the common law and the implied right that arises under the uniform evidence legislation (South Australia applies the common law on this point). The limited use immunity provided by s11(2) is typical of such abrogating provisions, but its scope is narrow: only the fact of production or the answer is protected from admission, not the contents or derivative evidence. This interacts with other state laws that allow the use of compelled evidence in coronial inquiries, disciplinary proceedings or civil penalty regimes.

Warrant issuance: The power to obtain a warrant from a magistrate under s9(4) is subject to the magistrate being satisfied that the warrant is “reasonably required in the circumstances”. This test is the same as the general standard for search warrants under the Search Warrants Act or equivalent, but the Act does not incorporate the detailed procedural safeguards from that Act. The Inspector may use force to break into premises under the authority of a warrant, but only “such force as is reasonably necessary” (s9(1)(a), (f)). The Act does not require the Inspector to notify the occupier before executing a warrant, nor does it impose a time limit on the warrant’s validity.

Employment law: The definition of “employee” in s8(5) extends to contractors and volunteers. This may create tension with the terms of service agreements or volunteer arrangements, particularly where those persons are not otherwise subject to direction by the controlling authority. The Act does not provide any indemnity or compensation for persons required to comply with a notice who incur professional or personal costs.

The Greyhound Industry Reform Inspector Act 2024 was assented to on 5 December 2024 as Act No 63 of 2024. It commenced on 27 February 2025, the day on which the Minister fixed by proclamation in the Gazette (Gazette 27.2.2025 p225). As at the date of this analysis, there are no amendments to the Act. The Act is recent and has been in force only a short time; amendments are possible if the oversight regime needs adjustment, for example to extend the Inspector’s tenure, expand the definition of controlling authority, or modify the penalty levels. The legislative history note at the foot of the Act refers readers to the Index of South Australian Statutes or www.legislation.sa.gov.au for further information. Because the Act contains a regulation-making power (s19) that allows the Governor to make regulations contemplated by the Act, significant operational detail may appear in subordinate legislation. Regulations can define “prescribed information and documents”, add to the list of state authorities, prescribe circumstances relating to the definition of employee, set requirements for information‑sharing, and otherwise flesh out the framework. Any regulations would become part of the Act’s “amendment history” in a practical sense, though they are not amendments to the principal Act itself.

The Act is too recent to have generated any published litigation. No reported decisions of South Australian courts or tribunals deal with the Greyhound Industry Reform Inspector Act 2024. Given that the Act is in force and is being applied, it is possible that future litigation may arise in the following areas: (a) challenge to the validity of an information notice on grounds of unreasonableness or exceeding the Inspector’s functions; (b) challenge to the issuance of a warrant for entry onto premises not owned or operated by the controlling authority, on grounds that the magistrate was not properly satisfied that the warrant was reasonably required; (c) prosecution for an offence under ss8, 10, 16, or 17, where the accused may argue that the use‑immunity provision in s11 was insufficient or that compelled evidence was used in breach of the immunity; (d) judicial review of the Inspector’s decisions concerning the frequency of reporting or the content of the final report; and (e) constitutional challenge on the basis that s11 abrogates the implied right against self‑incrimination derived from Dietrich principles or the uniform evidence legislation, though South Australia’s position on the privilege is common law based. Given the Act’s limited scope (greyhound racing in one state) and temporary nature, legal challenges are likely to be few. The most probable scenario is a dispute over the reasonableness of a compliance time period in an information notice, which could lead to a prosecution and a subsequent test of what constitutes a “reasonable” period and a “reasonable excuse” under s10.

Self‑incrimination abrogation is broad and use‑immunity is thin: Section 11 removes the right to refuse to answer or produce on grounds of self‑incrimination. The only protection is that the fact of production or the answer given is not admissible in proceedings for an offence or penalty (except for false‑and‑misleading offence). The contents of a document or the information itself remain fully admissible. Moreover, derivative evidence - evidence obtained by using the compelled information to find other witnesses or documents - is not protected. This is a rare and aggressive override for a regulatory oversight body, and is not limited to serious misconduct; it applies to all compelled answers. Anyone subject to a compulsory notice should obtain legal advice before responding, because anything they produce or say can be used later.

Definition of “employee” catches contractors and volunteers: Section 8(5) extends the compulsory information notice power to persons carrying out work under a contract for services (independent contractors) and volunteers, as well as persons of a prescribed kind. This means a greyhound trainer who has a service contract with the controlling authority, or a volunteer at a track, can be required to produce documents and attend questioning, even if they are not technically employed. The Act does not limit the obligation to current relationships; it includes persons who have previously carried out work. A former contractor could be reached years later.

No right to non‑self‑incrimination for corporations: A corporation has no privilege against self‑incrimination at common law. For the controlling authority (a body corporate), compliance with a notice under s8 is mandatory and there is no use‑immunity protection at all. The penalty of $10,000 applies to the corporation if it fails to comply.

Inspector’s independence is qualified: Section 5(2) says the Inspector is not subject to Ministerial direction in respect of the exercise of functions. However, the Minister can request reports (s5(1)(e)), can extend the deadline for the final report (s18(1)), and can delegate functions (s7). The Inspector’s staff are public servants subject to general public sector management. The Minister also fixes the expiry date of the Act (s20). This gives the Minister considerable indirect influence over the Inspector’s pace and priorities, despite the formal independence provision.

No notice requirement for entry to controlling authority premises: The Inspector may enter premises being used in the course of greyhound racing without any prior notice if the premises are owned or operated by the controlling authority (s9(2)). For premises not owned or operated by the controlling authority, a warrant is required (s9(3)), but the Act does not require notification to the occupier before seeking the warrant. Unannounced inspections are lawful.

Final report deadline is extendable without limit: The Inspector must submit a final report before the second anniversary of the commencement of s18, or “such later date as the Minister may allow” (s18(1)). There is no outer limit on the extensions the Minister may grant. Combined with the fact that the Act expires only after the final report is tabled and the Minister fixes a day by notice in the Gazette (s20), the scheme could last many years if the Minister repeatedly extends the deadline. The two‑year period is a floor, not a ceiling.

Information‑sharing override does not require consent: Section 12(2) allows a state authority to provide prescribed information and documents to another listed body if the provider reasonably believes the information would assist the recipient to perform official functions. This override applies “Despite any other Act or law”, meaning that privacy laws, secrecy provisions, and even contractual confidentiality clauses are overridden. The person to whom the information relates need not be notified or given the opportunity to object. The information can be provided without a request (s12(5)). The only restriction is that the provider must reasonably believe the provision would assist the recipient’s official functions; this is a subjective test that would be hard to challenge.

False‑and‑misleading offence is strict or near‑strict: Section 17 makes it an offence to make a statement that is false or misleading in a material particular in any information provided under the Act. There is no requirement that the person knew it was false or misleading, or intended to deceive; the actus reus is simply making the false statement. Defences of reasonable mistake or due diligence are not imported by the text. Given the maximum penalty of 2 years imprisonment, this is a serious provision that places a high burden on accuracy on anyone providing information to the Inspector.

For the controlling authority: The most immediate obligation is to identify one or more points of contact for the Inspector and establish a system for receiving, reviewing and responding to information notices under s8. Because the Inspector determines the frequency of integrity and welfare reports (s5(1)(b)), the authority should proactively discuss with the Inspector what those reports will cover and at what intervals they will be provided. All document retention policies should be reviewed to ensure records relevant to greyhound racing governance, integrity and welfare are preserved and easily retrievable. The authority should also train its officers, employees, contractors and volunteers (as broadly defined) on their obligations under the Act, particularly the duty to comply with notices and the prohibition on hindering an authorised officer. Because the Act abrogates self‑incrimination, the authority should advise individuals who receive a notice to seek legal advice before responding; the authority may wish to provide a legal support protocol. For entry and inspection scenarios, the authority should designate a senior staff member to accompany inspectors and ensure that production of documents and answering of questions is done in an organised manner. The authority should also keep a log of all interactions with the Inspector, including copies of notices, responses, and any directions given.

For officers, employees, contractors and volunteers of the controlling authority: If served with a written notice under s8, the person must comply within the specified time. The notice may require attendance at a particular time and place. Before complying, the person should seek legal advice, because the abrogation of self‑incrimination means that the contents of documents and information provided can be used against them in criminal proceedings (other than the fact of production). The person should ensure that any documents produced are complete and accurate; making a statement that is false or misleading in a material particular is a serious offence (s17). If an authorised officer arrives at premises, the person should request the officer’s certificate of identity under s14(5) before allowing entry or answering questions. If the premises are not owned or operated by the controlling authority and no warrant is produced, the person should not consent to entry (s9(3) requires a warrant). The person should answer questions honestly but is entitled to provide only the information that they actually know; stating “I do not know” is permissible if true. The person must not hinder or obstruct the officer, use abusive language, or fail to comply with any lawful direction (s10). If the person believes a direction is unlawful, they should comply under protest and seek legal review later.

For state authorities: An authority that holds information or documents relating to greyhound racing, greyhound welfare or the controlling authority may share that information with the Inspector or with other listed state authorities under s12, notwithstanding any other Act or law. Before sharing, the authority should be satisfied that it reasonably believes the information will assist the recipient to perform official functions relating to those subject matters. The authority should document the basis of that belief. Information that does not disclose identity may be provided without restriction (s12(3)). Once information is shared, the recipient must not use it for a purpose other than that for which it was disclosed (s16(2)). The authority should review its data‑sharing policies to account for this expanded power.

For persons who are not employees of the controlling authority but whose premises are used for greyhound racing: A warrant must be obtained before entry if the premises are not owned or operated by the controlling authority (s9(3)). The person may request to see the warrant before allowing entry. The person is not required to answer questions or produce documents unless the Inspector or authorised officer makes a lawful direction; if a direction is given, the person should comply and seek legal advice later. The person should not physically resist an entry authorised by a warrant; force beyond that which is reasonably necessary is prohibited by s9(1)(a), but the attending officer decides what is reasonably necessary.

General best practice: Any person who receives a notice or attends a compulsory interview should make a contemporaneous written record of the event, including the name of the officer, the time, the questions asked, and the answers given. Legal representation should be sought at the earliest opportunity. The Inspector’s powers are broad but must be exercised for the performance of the Inspector’s functions. If a notice appears to go beyond those functions (e.g., requests information unrelated to the Report recommendations), the recipient may challenge it through administrative review or in a prosecution defence, but the safer course is to comply under protest while reserving the right to seek review. The Act does not provide a statutory mechanism for objecting to a notice, so judicial review in the Supreme Court is the only avenue. Given the time and cost, most recipients will need to balance the risk of non‑compliance against the burden of compliance.
