sec.366 Failure to comply with serious situation direction

A GHG tenure holder to whom a serious situation direction has been given must comply with the direction. Maximum penalty—1000 penalty units. Subsections (3) and (4) apply if— the direction requires the GHG tenure holder to take steps reasonably necessary to remedy the serious situation the subject of the direction within a stated reasonable period; and the direction states the steps the Minister reasonably believes are necessary to remedy the serious situation within the period. The GHG tenure holder is taken to have complied with the requirement if all of the stated steps are taken within the period. Subsection (3) does not prevent the GHG tenure holder from complying with the requirement in another way.
