sec.102 Deciding potential storage area application
The Minister may declare an area the subject of the application to be a potential storage area only if satisfied— the area is no more than is needed to cover the maximum extent of a GHG stream storage site identified in the report; and the applicant does not and will not soon have an available GHG stream for GHG stream storage in the area to be declared, but a GHG stream is likely to become available for GHG stream storage in the area. The area declared must form a single parcel of land. In deciding the application, regard must be had to whether the conditions of the relevant GHG permit have been substantially complied with. To remove any doubt, it is declared that the declaration may be made even if the GHG permit has been continued in force under section 95 or 116 . If the Minister decides to refuse the application, the Minister must give the applicant an information notice about the decision. s 102 amd 2010 No. 31 s 408 sch 2 pt 1 (sec.102-ssec.1) The Minister may declare an area the subject of the application to be a potential storage area only if satisfied— the area is no more than is needed to cover the maximum extent of a GHG stream storage site identified in the report; and the applicant does not and will not soon have an available GHG stream for GHG stream storage in the area to be declared, but a GHG stream is likely to become available for GHG stream storage in the area.
