Greenhouse and Energy Minimum Standards (Three Phase Cage Induction Motors) Determination 2019

This Determination is organised around a few core legal and technical concepts: product coverage and exclusions; GEMS level requirements; testing methodology and allowable alternatives; labelling obligations; family-of-models rules for registration; and an optional higher efficiency tier.

Product coverage and exclusions. The core product concept is a three phase cage induction motor as defined in the Determination (section 5). Coverage is defined by three technical parameters: rated output power (>= 0.73 kW and < 185 kW), rated voltage (up to 1100 V a.c.), and number of poles (2, 4, 6 or 8) (section 11(1)). The Determination also enumerates explicit exclusions (section 12) which operate as carve-outs: submersible motors designed to operate wholly immersed (12(a)); motors constructed as integral components with a driven unit so that they cannot operate separately (12(b)); multi-speed motors that change speed by reconfiguration of windings via switchgear (12(c)); motors intended solely for S2 short-time duty (12(d)); rewound motors where the supplier does not claim GEMS compliance (12(e)); motors supplied exclusively to third parties for equipment that will be exported (12(f)); and high slip “torque” motors (12(g)). Those exclusions define both the technical bounds of regulatory reach and the cases where the Determination’s labelling and efficiency requirements do not apply.

GEMS level requirements. The Determination sets quantitative minimum efficiency thresholds at specific load points (75 per cent and 100 per cent of rated load) (section 14(1)). For motors whose rated power matches entries in Schedule 1 Table 1, the table value is the minimum efficiency (section 14(1)(a)). For rated powers between table entries, the appropriate interpolation method in IEC 60034-30-1 is to be used (section 14(1)(b)). The tabulated figures in Schedule 1 Table 1 correspond to the IE2 (High Efficiency) levels in the IEC framework, as the Determination notes.

Testing methodology and alternatives. The primary test method is the method referenced in subclause 6.1.3 of IEC 60034-2-1 Ed. 2.0, described in the Determination as Method 2-1-1B - Summation of losses with additional load losses by residual loss (section 15(1)). The Determination permits specific alternative tests listed in Schedule 2 Table 3, namely IEEE 112:2004 and IEEE 112:2017 Method B (Schedule 2 Table 3). There are special test rules for totally enclosed air over motors (TEAO), which require an externally generated air-stream parallel to the shaft at the manufacturer’s declared minimum operating air velocity, measurement of the air velocity using a hot-wire anemometer or similar instrument, use of the same efficiency measurement procedures, and exclusion from the test results of the power required to generate that air-stream (section 15(3)-(5)).

Labelling. GEMS labelling requirements are set by reference to clause 10 of IEC 60034-1 (Rating plates) (section 17). The Determination links labelling obligations to the IEC rating plate content and cross-references the test requirements.

Family of models for registration. For registration and administrative efficiency, models can be grouped into a family if declared to the GEMS Regulator and if each model within the family meets specific similarity criteria: same brand, same frame size, same number-of-poles and duty type per IEC 60034‑1, same rated output power in kW, and same product of rated voltage and rated current; plus the family must rely on a single test report prepared before registration and contain no more than ten models (section 7(1)-(4)).

High efficiency level and designation. The Determination defines an optional “high efficiency” level (Part 5 and Schedule 1 Table 2). A motor may be designated “high efficiency” only if it meets the thresholds in Table 2 at 75 per cent and 100 per cent load as required (section 21(1)-(2)). The Determination notes that Table 2 values are equivalent to IE3 (Premium Efficiency) in the IEC framework.

Incorporation and applicable versions of standards. The Determination identifies by name relevant IEC standards (section 4), and declares the applicable versions of any referenced documents to be those in existence on the date the Determination was made (section 6(2)). This fixes the technical references and avoids automatic capture of later standard revisions.

Administrative and transitional elements. The instrument revokes and replaces the earlier 2018 Determination (section 2) and expressly provides that registrations under the 2018 Determination are not affected (section 9). It also contains a transitional labelling provision that allows compliance with a replacement determination’s transitional labelling requirement to be taken as compliance with this Determination’s labelling requirement if the replacement determination so provides (section 19).

Overall, the Determination is a technical regulatory instrument that ties product coverage to concrete efficiency thresholds and to accredited test methods, links labelling to IEC rating plate requirements, and sets administrative rules for registration via family declarations.

This Determination creates obligations and administrative effects for several identifiable groups in the supply chain and the regulatory ecosystem.

Manufacturers and brand owners. The primary legal actors who must ensure products meet the Determination are manufacturers or entities that supply motors to the Australian and New Zealand markets and make claims of GEMS compliance. They need to design or select motors that meet the minimum efficiencies in Schedule 1 Table 1 at 75 per cent and 100 per cent load, or that meet the higher thresholds in Table 2 if they intend to use the “high efficiency” designation (sections 14 and 21). Manufacturers must also ensure test reports that demonstrate compliance are prepared prior to registration when models are grouped into a family (section 7(2)(d)). Manufacturer-declared parameters, such as the minimum operating air velocity for totally enclosed air over motors used in testing, will affect how tests are conducted and recorded (section 15(3)).

Importers and suppliers. Importers and suppliers of covered motors bear responsibility for ensuring that the motors they place on the market comply with the Determination. The Determination’s registration mechanism under the GEMS Act means suppliers will interface with the GEMS Regulator for model registration and to declare families where applicable (section 7(1)). The exclusion for motors supplied exclusively for export (section 12(f)) affects suppliers who import motors only to incorporate them into equipment destined for export.

Distributors, resellers and OEMs. Equipment manufacturers and original equipment manufacturers who incorporate motors into larger products must check whether the motors they source are covered and compliant. The Determination excludes motors that share common components with driven units and cannot operate separately (section 12(b)), which is directly relevant to OEMs that sell motor-driven equipment as a unit. The exclusion for motors supplied for export (section 12(f)) may shift sourcing decisions for OEMs producing for export markets.

Test laboratories and conformity assessment bodies. Accredited test laboratories will be engaged to perform the efficiency tests required by section 15. The Determination prescribes the primary IEC test method and allows alternative IEEE methods from Schedule 2. TEAO motors require specific test setups, including an externally-generated air-stream measured with a hot-wire anemometer (section 15(3)-(4)), which imposes equipment, procedural and documentation requirements on test labs.

Regulator and government. The GEMS Regulator administers model registration and declarations of families of models (section 7(1)(a)). The Determination was made by the Minister under the Act (section 3), but day-to-day operational decisions, registration approvals, and enforcement actions will be implemented by the Regulator under the GEMS Act framework.

Owners and operators of plant. End users who buy motors face an indirect effect: the available market of compliant motors will be shaped by manufacturers’ and suppliers’ responses to these minimums. Where minimums exclude older, less efficient models or rewound motors (if claims of compliance are made), operators may face higher equipment costs, altered choices, or constraints on replacement parts.

Repair and rewind shops. Rewound motors are excluded from coverage if the supplier has not made any claim that the rewound motor meets a GEMS level requirement (section 12(e)). The exclusion means that rewinding businesses may not need to demonstrate compliance unless a supplier or reseller advertises GEMS compliance for a rewound motor. The regulatory boundary thus affects commercial claims and labelling strategies in the repair sector.

Standardisation and standards purchasers. The Determination incorporates IEC standards and makes specific standards the operative technical references (section 4). Those standards are subject to copyright and must be purchased from Standards Australia Ltd or the IEC, as the determination notes in the copyright section. Entities that must plan compliance will therefore incur costs obtaining the referenced standards and guidance.

Legal advisers and compliance professionals. Lawyers, compliance officers and technical consultants advising industry must interpret the family rules (section 7), exclusions (section 12), and test method nuances (section 15) to put in place procurement, testing, registration and labelling procedures for clients.

Collectors of registrations and testing evidence. Because families may rely on a single test report prepared prior to registration and a family may not exceed ten models (section 7(2)(d), 7(4)), suppliers must plan test strategies and registration groupings carefully. Those administrative requirements will affect how registrants allocate the one-off cost of a test report across models claimed to be in the same family.

The Determination thus affects manufacturers, importers, suppliers, test labs, the GEMS Regulator, repairers and end users. The most concrete immediate obligations fall on suppliers and manufacturers who choose to register models or make claims of GEMS compliance, because they must fund testing, ensure proper labelling per IEC clause 10, and meet the technical thresholds in the schedules. The Determination also creates compliance and administrative tasks for test labs and registration authorities.

This Determination imposes specific duties on suppliers, manufacturers and registrants, and it establishes rights and procedural positions under the GEMS Act framework.

Primary duties

• Ensure covered motors meet minimum efficiencies. A motor covered by this Determination must have efficiency at 75 per cent and 100 per cent of rated load that is not less than the minimum specified in Schedule 1 Table 1 for the motor’s rated power and configuration or the interpolated value per IEC 60034-30-1 where applicable (section 14(1)). This is a substantive duty on the product’s performance characteristics at specified load points.

• Test to the prescribed standards. Efficiency testing must follow the method referenced in subclause 6.1.3 of IEC 60034-2-1 Ed. 2.0 (Method 2-1-1B), unless an alternative listed in Schedule 2 is used (section 15(1)-(2)). For totally enclosed air over motors, additional test configuration duties are imposed, including use of an externally generated air-stream, measurement of the stream velocity with a hot-wire anemometer (or similar), and exclusion of the power used to generate the air-stream from motor test results (section 15(3)-(4)).

• Conform to labelling requirements. GEMS labelling obligations are the content requirements in clause 10 of IEC 60034-1 (Rating plates) (section 17). Suppliers must ensure rating plates carry the required information as set out in that IEC clause.

• Apply family-of-models rules for registration. Where models are registered as a family, the supplier must declare the family to the GEMS Regulator and ensure that each family member satisfies the statutory similarity criteria: same brand, same frame size, same number of poles and duty type, same rated output power, same product of rated voltage and rated current, reliance on a single pre-registration test report, and that the family contains no more than ten models (section 7(1)-(4)).

• Use of “high efficiency” designation. A motor may be designated “high efficiency” only if it meets the higher thresholds in Schedule 1 Table 2 at the specified load points (section 21(2)). The duty to ensure accuracy of any “high efficiency” claim rests with the supplier.

Procedural duties and transitional interactions

• Registrations not affected by prior determination. Models registered under the 2018 Determination are not affected (section 9). Where a model’s registration is not affected, it is treated as registered under this Determination without further action (section 9 note and section 36 of the Act cross-reference in the notes).

• Transitional labelling compliance. If this Determination is revoked and a replacement contains a transitional labelling requirement that provides equivalence, following compliance with that replacement requirement can be taken as compliance with the revoked requirement (section 19). This creates a procedural right to rely on transitional arrangements specified in future replacement determinations, where applicable.

Rights and operational positions

• Right to rely on prescribed alternative test methods. Suppliers and testing bodies may choose the alternative test methods listed in Schedule 2,IEEE 112:2004 or IEEE 112:2017 Method B,instead of the IEC method referenced in section 15(1) (section 15(2) and Schedule 2).

• Right to use family test reports. Suppliers who satisfy the family criteria have the right to register multiple models on the basis of a single test report prepared prior to registration (section 7(2)(d)). This provides a regulatory mechanism for spreading the cost of a single test across multiple models within a properly constituted family.

• Right to exclude certain motors. The Determination explicitly excludes particular classes of motors (section 12). Suppliers of those excluded motors have the right to supply them without being subject to the Determination’s minimum-efficiency, labelling and related requirements, provided the exclusion conditions are satisfied.

Limitations and dependencies

• Applicable standards fixed to the date of the Determination. The applicable versions of incorporated standards and referenced documents are those that existed at the date this Determination was made (section 6(2)). Thus compliance duties are measured against a fixed version of technical standards rather than automatically adopting later amendments.

• Copyright and access to standards. The Determination incorporates IEC standards that are subject to IEC copyright and must generally be purchased from Standards Australia Ltd (copyright notices). Suppliers must pay to access the full standards where necessary for testing and labelling compliance.

Where the Determination references the Act for broader enforcement, the rights to enforcement and the nature and quantum of penalties are matters within the Act. The Determination itself prescribes duties and technical rules but does not specify infringements or penalties in its own text. It is therefore essential for duty-holders to read the Act as well as the Determination to understand enforcement remedies and consequences.

The Determination is made under the Greenhouse and Energy Minimum Standards Act 2012 (section 3) and sets technical and labelling requirements; it does not in itself set out penalty amounts or enforcement procedures. Enforcement mechanisms and penalties for breaches are contained in the Act rather than in the Determination. The Determination therefore acts as the technical specification that, if not met, may expose an entity to enforcement action under the Act.

Enforcement architecture (as implied by the instrument). The Determination repeatedly cross-references provisions of the Act for its authority and interaction (see sections 2, 3, 10, 13, 16, 20 and other notes). This indicates that:

• The GEMS Regulator is the administrative body responsible for registrations, family declarations and likely for monitoring compliance with registration and labelling requirements, because section 7 requires families to be declared to the GEMS Regulator (section 7(1)(a)). The Regulator therefore occupies the central position for registration and the administrative oversight of compliance.
• Civil or administrative enforcement tools including recalls, directions, penalties, or de-registration of models would be exercised under the Act’s enforcement framework rather than under this Determination. The Determination does not reproduce those enforcement powers.

What the Determination does prescribe that supports enforcement:

• Testability and repeatable standards: By mandating a specific test procedure in IEC 60034-2-1 Ed. 2.0 subclause 6.1.3 or listed IEEE alternatives (section 15 and Schedule 2), the Determination provides objective technical benchmarks that can be used to assess compliance. That specificity reduces enforcement ambiguity by tying efficiency claims to defined test methods.
• Labelling content: Requiring the content of clause 10 IEC 60034-1 as the GEMS labelling requirement (section 17) creates an observable compliance point that enforcement authorities can inspect on rating plates.
• Registration and recordability: The family rules (section 7) that link registration to pre-existing test reports mean the Regulator can request and audit test evidence for registered families.

Limits on what this Determination contains about penalties:

• No penalties cited. The instrument contains no schedules or sections specifying monetary fines, criminal offences, or administrative penalty regimes. Any action for non-compliance will therefore rely on statutory powers and sanctions provided in the Act.
• No enforcement procedures detailed. There are no procedural steps (for example notice-and-remedy periods, right to respond, or appeal mechanisms) set out in this Determination itself; those processes, if any, will exist in the Act and in the Regulator’s administrative policies or guidelines.

Practical implications for regulated parties:

• Compliance failures will be judged against the technical requirements and documented testing protocols set out in the Determination, but the legal consequences for failure are governed by the Act. Regulated parties should consult the GEMS Act, the Regulator’s guidance, and the Determination together.
• The prescriptive test and labelling requirements increase the likelihood that non-compliance is objectively detectable, which may increase regulatory enforcement activity because technical non-compliance can be demonstrated via standardised test reports and rating plate inspections.

In summary, the Determination creates enforceable technical duties whose enforcement lever is the GEMS Act. The instrument provides the technical criteria and administrative hooks that enforcement under the Act will use, but it does not itself itemise penalties or enforcement processes; those are matters of, and must be looked for in, the Act and Regulator-administered procedures.

This Determination is an instrument under the Greenhouse and Energy Minimum Standards Act 2012 and must be read in the context of that Act. It repeatedly references the Act as the source of authority and as the framework within which the Determination operates (see section 3 and the notes to various provisions). The Act provides the legal powers to make GEMS determinations, to register models, to define product categories, and to enforce the standards. The Determination therefore interacts with the Act in the following concrete ways.

Delegated rulemaking and commencement. The Determination is made under sections 23 and 35 of the Act (section 3). Section 2 confirms that the Determination revokes and replaces the 2018 Determination and notes the operation of section 35(2) of the Act concerning the timing of revocation and replacement. The Determination’s commencement clause follows the Act’s requirements that a GEMS determination comes into force the day after registration (section 2).

Registration and categories. The Determination nominates the product class as a category A product for the purposes of the Act (section 8) and states how registrations from the prior Determination are affected (section 9). Under the Act, registration triggers specific obligations and administrative records; the Determination therefore sets the technical content of what a registered model must meet under the Act.

Incorporation of external technical instruments. The Determination incorporates multiple IEC standards (section 4) and includes IEEE test methods as alternatives in Schedule 2. It explicitly fixes the applicable versions of those standards and of any referenced documents to those that existed on the date the Determination was made (section 6(2)). Practically, this removes legal uncertainty that might arise from subsequent revisions to the technical standards and ensures the regulatory test methods are stable for the period the Determination is in force.

Intellectual property and copyright. The Determination includes a copyright statement noting that IEC standards are subject to IEC copyright, and that full IEC standards must be purchased from Standards Australia Ltd. Apart from personal and non-commercial use and permitted uses under the Copyright Act 1968, IEC material may not be reproduced without licence. The Determination itself is licensed under a Creative Commons Attribution‑Non‑Commercial‑ShareAlike 4.0 International Licence except for the Coat of Arms and third-party IP. That affects how regulated parties and advisers can disseminate and rely on the full standard documents and may impose transaction costs for obtaining and using the standards for compliance purposes.

Interaction with international standards and trade. By aligning its thresholds to IE2 and IE3 equivalences in the IEC framework (notes in Schedule 1 and Schedule 2), the Determination integrates Australian regulation with internationally recognised efficiency classes. That alignment makes transnational compliance easier for manufacturers who already design to IEC efficiency classes, but the Determination still requires purchase of the fixed versions of the standards specified. The Determination also permits IEEE test methods as alternatives, which can accommodate products tested to those USA-origin standards, reducing friction for suppliers that use those methods.

Interplay with export and OEM integration. The Determination excludes motors supplied exclusively to third parties for incorporation in products that will be exported to a country other than Australia or New Zealand (section 12(f)). It also excludes motors that share components with the driven unit and cannot operate when separated (section 12(b)). Those carve-outs create interaction points with export control and product safety regimes, suppliers must ensure the supply chain destination is properly documented to claim the export-only exclusion.

Cross-references within the Determination. Several sections of the Determination cross-reference IEC clauses for interpolation (section 14(1)(b) referencing IEC 60034-30-1 clauses 5.4.5 and 5.4.6), for rating plate content (section 17 referencing IEC 60034-1 clause 10), and for test methods (section 15 referencing IEC 60034-2-1 subclause 6.1.3). The legal effect is to fold specific technical content from those standards into the regulatory obligations. Because the applicable versions are fixed to the date the Determination was made (section 6(2)), regulators and regulated parties must use those versions, not later revisions, unless and until the Determination is expressly updated.

Administrative law implications. The Determination operates as a delegated instrument within the Act’s statutory framework. Administrative tasks, registration, declaration of families, and compliance oversight, will be carried out by the GEMS Regulator under the Act. Affected parties should therefore expect administrative processes, potential notices, and review or appeal avenues to be determined by the Act and by the Regulator’s administrative practice. The Determination does not itself create appeal routes or dispute resolution processes.

In short, the Determination is a technical instrument that must be implemented within the statutory and administrative legal framework of the GEMS Act, referencing and binding specific versions of international standards, and interacting with intellectual property regimes and export and OEM supply chain considerations. Parties must therefore read the Determination together with the GEMS Act and the applicable standards.

This Determination expressly revokes and replaces the Greenhouse and Energy Minimum Standards (Three Phase Cage Induction Motors) Determination 2018 (section 2(b)-(c)). It states that it commences and comes into force the day after registration (section 2(a)). The Determination’s own language explains the effect of revocation and replacement in light of section 35(2) of the GEMS Act 2012, namely that a revoked determination ceases to be in force immediately before the replacement comes into force (section 2 note). The instrument is dated 3 July 2019 and was made by the Minister for Energy and Emissions Reduction, Angus Taylor, as shown on the front page.

There are no subsequent amendments, variations or corrections recorded in the text provided. The Determination sets the applicable versions of the referenced standards to those in existence on the date it was made (section 6(2)), which freezes the technical references for the Determination’s operative period. The notes to Schedule 1 and Schedule 2 explain that the tabulated values correspond to the IE2 and IE3 efficiency classes in the IEC framework; these notes also clarify that, while the last row of each table lists a 185 kW entry, that last row is not directly relevant to paragraph 14(1)(a) or paragraph 21(1)(a) because motors covered by this Determination cannot have a rated output power of 185 kW (Schedule 1 notes).

Administrative/registration consequences of replacement. Section 9 addresses the effect of the replacement on existing registrations: it states that this Determination does not affect registrations against the 2018 Determination. The notes reference section 48 and section 36 of the Act for the formalities of when registrations are affected by a Determination. The practical import is that models already registered under the 2018 Determination continue to be registered and are treated as registered under this Determination if not otherwise affected (section 9 and notes).

Transitional labelling provisions. Section 19 provides for the impact of a replacement determination on labelling: a GEMS labelling requirement of this Determination is taken to be complied with if a replacement determination includes a transitional labelling requirement that provides equivalence and the replacement transitional requirement is complied with (section 19). That clause is forward-looking, anticipating future replacements, and allows for administrative continuity where the Regulator includes transitional labelling provisions in successor instruments.

No recorded legislative amendments in the text. The Determination itself contains no amendment schedule or staged changes; all requirements are presented as operative as from commencement. To determine whether any later amending instruments or variations exist, one must consult the legislative register or Federal Register of Legislation for instruments subsequent to this 2019 Determination. The instrument’s fixed references to particular editions of IEC and IEEE standards also mean that, absent an amending Determination, subsequent amendments to those standards do not automatically alter the tests and thresholds in this Determination (section 6(2)).

In sum, the immediate amendment history recorded in the text is that this Determination replaced the 2018 Determination on commencement, and it fixes applicable technical standards to versions extant on the date of making. No other amendment entries are present in the provided text.

The Determination text does not identify any litigation arising from or concerning this instrument. There are no cases named or judicial decisions cited in the Determination. The instrument’s notes reference only statutory provisions in the Greenhouse and Energy Minimum Standards Act 2012 and technical standards (IEC and IEEE), not judicial authorities.

Because the Determination is a delegated instrument under the Act, disputes about its application, interpretation, or enforcement would ordinarily be litigated under general administrative law principles and, if they relate to the Act’s enforcement, in the courts or tribunals with jurisdiction over administrative and regulatory matters. The Determination itself provides the technical criteria and reference points (for example, test procedures in section 15 and the tabulated thresholds in Schedule 1), which would be the primary evidentiary material in any dispute about compliance. Any litigation would therefore likely focus on the correct application of those technical standards, the validity of test reports and test methods used, whether a particular motor falls within an exclusion in section 12, and procedural questions about registration and the Regulator’s exercise of powers under the Act.

The Determination does include some procedural and evidentiary hooks that could influence litigation strategy:

• Fixed versions of standards. Section 6(2) fixes the applicable versions of referenced documents to the date the Determination was made, which would be determinative in any dispute about which edition of a standard to apply.
• Prescribed test methods. Section 15 prescribes the primary IEC test method and allows particular IEEE alternatives in Schedule 2. A litigated compliance issue would turn on whether testing complied with the referenced method, and the Determination makes that method explicit.
• Family registration reliance on single pre-registration report. Section 7 requires reliance on a single test report prepared prior to registration for family declarations. Challenges to a family’s registration could target whether that procedural requirement was met.

Absent reported cases in the instrument itself, anyone researching litigation history must consult court databases and registries for matters arising after the Determination’s commencement. The Determination does not provide a record of legal challenges to its validity, nor does it identify precedent cases. Therefore the immediate recorded litigation history in the source is none.

The Determination contains several technical and administrative traps for the unwary. These are concrete risks or compliance pitfalls that emerge from the specific drafting and cross-references in the instrument.

1. Product scope boundaries and exclusions

• Rated power cut-offs. Coverage is for motors with rated output power greater than or equal to 0.73 kW but less than 185 kW (section 11(1)(a)). The schedules include a 185 kW row, but the Determination explicitly notes that motors covered cannot have a rated output power of 185 kW (Schedule 1 notes). Parties must check whether a motor sits just below or above the numeric thresholds; misclassification can result in either non‑compliance or unnecessary compliance costs.
• Exclusions require factual proof. The Determination excludes motors “supplied exclusively to third parties who will incorporate the motors into equipment that will be exported” (section 12(f)). Reliance on this exclusion requires documentation and a clear chain showing exclusive supply for export. Lack of contemporaneous records could expose suppliers to challenges.

2. Rewound motors and claims of compliance

• Rewound motors are excluded only if the supplier has not made any claim that the motor meets a GEMS level requirement (section 12(e)). If a rewound motor is advertised or represented as meeting GEMS requirements, the exclusion is lost and the supplier must have the motor tested and comply. Suppliers must therefore avoid ambiguous marketing language and be careful about claims.

3. Family-of-model restrictions

• Single test report requirement timing. A family must rely on a single test report “that was prepared prior to the application for registration for the model being made” (section 7(2)(d)). If registration occurs before testing is completed, the family declaration may be invalid. Registrants must ensure test reports exist before registration submissions.
• Family size cap. A family cannot contain more than ten models (section 7(4)). Attempting to spread one test report across a larger set risks non-compliance and potential rejection of family claims.

4. The requirement that family members have the same product of rated voltage and current

• Section 7(3) requires that for each model in the family, the product of the rated voltage and the rated current must be the same. This numeric equivalence may not be apparent in marketing data, and differences in nameplate rated voltage and current across models that are otherwise similar can disqualify them from family grouping.

5. Test method specificity and measurement obligations

• Fixed standard editions. Section 6(2) fixes the applicable editions of standards to those in force when the Determination was made. Using a later revision of an IEC standard or an alternate clause not cited risks a technical challenge in enforcement.
• TEAO test set-up details. For totally enclosed air over motors, the tests must use an externally and independently generated air-stream at laboratory ambient temperature directed from the non-drive end, with air-flow parallel to the shaft at the minimum declared air velocity specified by the manufacturer (section 15(3)). The power to generate the air-stream must not be counted in the motor test results (section 15(4)(c)). If a manufacturer fails to declare a minimum air velocity or a test lab fails to generate the required air velocity, the test may be non-compliant.
• Instrumentation requirement for TEAO. Measurement of the externally generated air flow velocity must be made using a hot-wire anemometer or similar instrument (section 15(4)(a)). Tests conducted without appropriate instrumentation may be challenged.

6. Labelling depends on an external standard clause

• Labelling is specified as the requirements mentioned in clause 10 of IEC 60034-1 (section 17). Accessing the precise content of clause 10 requires purchase of the standard. Mistaking a later or earlier edition for the applicable clause could lead to incomplete or incorrect rating plates.

7. Interpolation rules

• For rated powers between table values, the Determination requires use of the interpolation method in the specified clauses of IEC 60034-30-1 (section 14(1)(b) and section 21(1)(b)). Test labs and manufacturers must ensure they apply the correct clause (5.4.5 for 50 Hz, 5.4.6 for 60 Hz) and the fixed edition in force at the Determination’s date.

8. Export-only and OEM integration exclusions may create perverse sourcing incentives

• The export-only exclusion (section 12(f)) requires strict documentation. Suppliers who move some models between domestic sale and export channels risk losing the exclusion. Firms that routinely blend domestic and export distribution should institute rigid inventory controls.

9. Copyright friction

• The Determination notes IEC standards are copyrighted and must be purchased (copyright statement). Relying on unofficial or publicly available copies of the standards risks using outdated or inaccurate technical text and may not be legally viable for compliance.

10. Non-detailed enforcement provisions

• The Determination does not set out penalties. Companies may therefore underestimate the seriousness of non-compliance because administrative penalties and enforcement detail are in the Act, not the Determination. Advisers must consult the Act for the consequences of non‑compliance.

In practice, the combination of precise numerical thresholds, fixed standard editions, family-of-model procedural constraints, and narrow exclusions creates multiple detail-level compliance points. Failing to align testing, registration timing, and labelling with the exact clauses and editions referenced in the Determination creates significant legal and commercial risk.

Below is a practical compliance checklist grounded in the Determination’s provisions. It is framed as a sequence of steps and record-keeping actions that suppliers, manufacturers, test labs and registrants should follow.

1. Confirm product coverage

• Check whether the motor is a three phase cage induction motor as defined in section 5.
• Confirm rated output power is >= 0.73 kW and < 185 kW (section 11(1)(a)).
• Confirm rated voltage is up to 1100 V a.c. and that the motor has 2, 4, 6 or 8 poles (section 11(1)(b)-(c)).
• If any exclusion in section 12 applies (submersible, integral motor-drive unit, multi-speed by switchgear, S2 short-time duty, rewound with no GEMS claim, export-only supply, or torque motors), document the facts to support the exclusion.

2. Obtain and record applicable standards

• Acquire the editions of the IEC standards listed in section 4 that were current on the Determination’s date, because section 6(2) fixes the applicable versions to those in existence when the Determination was made. Also obtain IEEE 112:2004 and/or IEEE 112:2017 if planning to use Schedule 2 alternatives.
• Keep copies of the specific clauses referenced: IEC 60034-2-1 subclause 6.1.3, IEC 60034-30-1 clauses 5.4.5 and 5.4.6, and IEC 60034-1 clause 10 for rating plates.

3. Plan testing strategy

• For initial compliance testing, use the primary method: the requirements mentioned in subclause 6.1.3 of IEC 60034-2-1 Ed. 2.0 (Method 2-1-1B) as specified in section 15(1).
• If relying on an alternative, ensure the chosen method is one of the Schedule 2 alternatives (IEEE 112:2004 or IEEE 112:2017 Method B) and that the test lab documents method equivalency (section 15(2) and Schedule 2).
• For totally enclosed air over (TEAO) motors, plan and document the external airflow test setup: an externally generated air stream at laboratory ambient temperature directed over the stator from the non-drive end, airflow parallel to the shaft, and at the minimum declared air velocity specified by the manufacturer. Measure airflow velocity with a hot-wire anemometer or similar instrument, and record that the power to generate the airstream was excluded from the motor’s measured results (section 15(3)-(4)).

4. Prepare test documentation and timing

• Ensure test reports are prepared before applying for registration if models will be grouped in a family, because section 7(2)(d) requires reliance on a single test report that was prepared prior to registration application.
• Maintain full test traceability: name of test lab, edition of standard used, test method clause references, rated conditions, measured efficiencies at 75 per cent and 100 per cent load, and any special TEAO arrangements (section 15).

5. Evaluate efficiency against Schedule 1

• For a motor whose rated output power matches a row in Schedule 1 Table 1, confirm efficiency at 75 percent and 100 percent is at least the table value (section 14(1)(a)).
• For rated powers between table entries, perform interpolation according to IEC 60034-30-1 clauses 5.4.5 or 5.4.6 as appropriate for 50 Hz or 60 Hz supply (section 14(1)(b)). Document the interpolation calculation and reference the exact clause and edition used.

6. High efficiency designation

• If intending to designate a motor “high efficiency,” test and confirm the motor meets Schedule 1 Table 2 values at 75 percent and 100 percent load. Only then may the “high efficiency” designation be used (section 21(1)-(2)).

7. Labelling

• Prepare rating plates in conformity with clause 10 of IEC 60034-1, which the Determination specifies as the GEMS labelling requirement (section 17). Ensure that the exact content required in clause 10 of the applicable edition is included on the rating plate.
• Retain design proofs, photographic records and production samples of rating plates for audits.

8. Registration and families

• If registering models, consider grouping models into a family only where each family member meets the section 7 similarity criteria: same brand, frame size, number of poles, duty type, rated output power, same product of rated voltage and rated current, single pre-registration test report, and no more than ten models per family (section 7(2)-(4)).
• Submit the family declaration to the GEMS Regulator (section 7(1)(a)). Confirm the Regulator’s procedural requirements and Forms under the Act.

9. Records and retention

• Maintain test reports, interpolation calculations, manufacturer declarations (such as minimum operating air velocity for TEAO), labelling proofs, family declarations, and registration documentation. These records form the evidential basis in any compliance audit.

10. Ensure marketing and product claims are consistent with exclusions

• If a motor is rewound, do not make any GEMS compliance claims unless the rewound motor has been appropriately tested and registered per the Determination (section 12(e)).
• Avoid ambiguous claims about “high efficiency” unless Schedule 1 Table 2 thresholds are met.

11. Export-only supply and documentation

• If relying on the export-only exclusion (section 12(f)), document contractual terms, bills of lading, purchase orders and evidence that the supplied motors are exclusively incorporated into products destined for countries other than Australia or New Zealand. Put in place inventory controls to prevent inadvertent domestic sale.

12. Engage accredited test labs and competent advisers

• Use test laboratories with experience in IEC 60034-2-1 and in performing the specified TEAO tests with the required instrumentation. Confirm that labs will cite the exact edition and clause references used in their reports.

13. Monitor replacement determinations and regulator guidance

• Although section 6(2) fixes applicable versions for this Determination, future replacement determinations may alter test methods, thresholds or labelling. Section 19 provides for transitional labelling equivalence if a replacement determination so provides. Monitor the Federal Register of Legislation and the GEMS Regulator’s guidance for updates.

Who pays and who decides

• Costs fall primarily on manufacturers, suppliers and registrants: testing, acquiring standards, updating rating plates, and administrative registration costs. Test labs and standards bodies incur operational and licensing costs.
• The Minister made the Determination (front page and section 3), but the GEMS Regulator decides on registrations, family declarations and will be the front-line administrative decision-maker for compliance under the Act.

By following these steps and keeping contemporaneous, standardised documentation that cites the precise clauses and editions referenced in the Determination (section 6(2)), entities can reduce legal risk and demonstrate compliance in the event of regulatory audit or enforcement action.
