Greenhouse and Energy Minimum Standards (Rotary Clothes Dryers) Determination 2024

Several defined terms carry the operational weight of this instrument. Rotary clothes dryer means a condenser rotary clothes dryer, a vented rotary clothes dryer, or an electric appliance that includes both washing and drying functions where the drying operates by the same method as a condenser or vented dryer. This is significant because it captures washer-dryer combos, preventing a gap where a dual-function appliance might otherwise escape the drying energy standard. The definitions of condenser and vented types are drawn from the AS/NZS standards and are essential to determining which test methods apply. Condenser rotary clothes dryer recovers water vapour by condensing it within the appliance (including heat pump models), while vented rotary clothes dryer exhausts the moist air directly into the atmosphere. That distinction matters for energy measurement because condenser dryers typically have different energy consumption profiles.

Energy rating label is defined as a label meeting the requirements of sections 2 (test requirements, calculations and algorithms) and 5 (content, format and affixing) of AS/NZS 2442.2:2021. This label is the main compliance communication to consumers, showing energy efficiency star ratings and annual energy consumption. The star rating index is the claimed energy efficiency indication determined per clause 2.7 of that standard. Rated load capacity means the maximum mass of textile material (in multiples of 0.5 kg) that the manufacturer claims can be treated in all operations. This capacity figure drives the test loads and therefore the energy consumption results.

The instrument creates a single product class for all covered rotary clothes dryers. A product class is the grouping under the Act that determines which GEMS level and labelling requirements apply. Having one class means all dryers face the same energy use performance threshold and labelling format, regardless of type. This is a simplification compared to some other products that are split into multiple classes. The concept of family of models is defined in section 12: two or more models are in the same family if they have the same energy performance characteristics (including comparative energy consumption and star rating index), the same physical characteristics relevant to compliance (including rated load capacity), and rely on a single test report prepared before the registration application. This allows a manufacturer to register multiple models based on one set of tests, reducing compliance costs provided the models are truly identical in energy performance. The note in section 12(2) indicates that the energy performance characteristics are not limited to but include those listed, giving some flexibility.

Product categories under the Act are either category A or category B, with different registration pathways. Section 13 designates all covered products as category A, meaning they require full GEMS registration with the Regulator before they can be supplied. Category B items are lower-risk and may be exempt from registration; this instrument takes no such exemption.

GEMS retail premises is defined as GEMS business premises (as defined in the Act) where covered products are displayed for retail supply or offer. This triggers the labelling display obligation: at the time of retail supply or offer at such premises, an energy rating label must accompany the product or its packaging. That requirement is in section 9(3) and is separate from the general labelling compliance obligation.

Finally, the instrument has a commencement day that is not tied to the registration date. Commencement occurs 12 months after the day the instrument is registered on the Federal Register of Legislation. That delay provides industry lead time to adjust to the new standard references and labels, consistent with the transitional labelling provisions.

The primary duty-holders are those who engage in the supply of electric household rotary clothes dryers in Australia. Under the GEMS Act, supply includes manufacture in Australia, import, sale, lease, hire, or hire-purchase. Affected entities include manufacturers with domestic production, importers bringing in dryers from overseas, and retailers who sell to end users. The instrument explicitly notes in the example to section 7 that it covers electric household rotary clothes dryers used in a commercial context. This extends the regulatory net beyond pure domestic sales: a laundry service buying a commercial rated rotary dryer that is of the same type as a household model must ensure compliance. However, industrial scale dryers that are not electric household types may fall outside (the definition is limited to electric appliances for tumble drying of clothing that match the condenser or vented method; gas or steam dryers are not covered).

Registration holders are a specific subset: those who have registered a model under the 2015 determination will be affected by the transitional provisions. Section 14 ensures that existing registrations are not invalidated by the revocation of the old determination. That reduces immediate re-registration costs for those who have already invested in testing and compliance. But they must now consider whether their labelling meets the new requirements, or they may rely on the transitional option to continue using old labels for products whose model was registered before commencement day. That option is available for any supply before or after commencement day, and regardless of when the product was imported or manufactured. So distributors and wholesalers holding stock with old labels can continue to sell that stock without needing to re-label, provided the model registration was in force before commencement day.

Parties affected indirectly include test laboratories that conduct the AS/NZS 2442.1:2021 tests; they may need to update procedures to the new standard version. Retailers at GEMS retail premises must ensure that on floor display models bear the energy rating label. This is a point of sale obligation distinct from the broader supply prohibition. Compliance officers and internal auditors in larger firms will need to verify that product registrations reference the correct standards and that labels are accurate. Businesses using family of models provisions to reduce testing need to confirm that the models in the family genuinely share the same energy and physical characteristics, and that a single valid test report exists. The GEMS Regulator is the enforcement body, so its inspectors and resources will be directed toward this product class.

Smaller participants, such as boutique importers or niche manufacturers, may face disproportionate compliance costs. The need to test per the updated standard, produce new labels, and maintain registration can represent a significant fixed cost relative to low sales volumes. The single product class means there is no reduced compliance path for low-energy or specialty dryers. While the transitional labelling provision softens the upfront cost, the underlying testing obligation must still be met; there is no transitional relaxation of the GEMS level requirements. So a manufacturer with a design that was compliant under the 2015 determination but cannot meet the clause 4.4 requirements of the 2021 standard (which may have been tightened) would need to modify the product or halt supply.

The instrument creates several distinct duties, drawn from the GEMS Act and the specific requirements it incorporates. The central duty is to ensure that any covered product supplied in Australia meets the GEMS level requirements specified in section 8(1): the energy use requirements of clause 4.4 of AS/NZS 2442.1:2021. This is not a stand alone limit but a performance requirement that is tested in accordance with sections 2 and 3 of that standard. A supplier must have conducted those tests or obtained test data showing compliance.

The second major duty is labelling. Section 9(2) requires compliance with the labelling and communication requirements in section 5 of AS/NZS 2442.2:2021. That includes the format, content, and affixing of the energy rating label. Additionally, section 9(3) imposes a specific visual display duty: at a GEMS retail premises, an energy rating label must accompany the product or its packaging at the time of retail supply or offer. This means even if a product is stored in a warehouse, the moment it is displayed for retail sale, the label must be physically present. For online retail, the requirement to accompany may need to be evidenced by a digital image or equivalent, though the instrument is silent on that point (general GEMS guidance may clarify). The testing obligation for labelling purposes is independent of the energy level testing: section 9(4) cites only section 2 of AS/NZS 2442.2:2021 (test requirements for the label calculations), not the full sections 2 and 3 of the other standard.

A further duty set out in section 11 (other GEMS requirements) covers product performance. The product must be capable of drying clothes in a single operation (clause 3.2) and must not exceed a maximum fabric temperature (clause 3.3) as specified in AS/NZS 2442.2:2021. These are performance minima; they cannot be traded off against energy efficiency. Testing for these requirements must be in accordance with the same clauses. A supplier cannot simply rely on the energy test to cover performance.

The instrument also defines the right to use the family of models concept. Where two or more models meet the criteria of same energy performance characteristics (comparative energy consumption and star rating index) and same physical characteristics (including rated load capacity), and there is a single test report prepared before any registration application, the supplier may treat them as a family. Section 12(1) requires that the family be declared to the GEMS Regulator. This right reduces duplication: one test report can support multiple model registrations, subject to the Regulator accepting the family declaration. However, the obligation to ensure all models in the family genuinely meet the compliance standards remains; using the family path does not lower the substantive duty.

For models registered before the commencement day, section 10 provides an elective right: the supplier may comply with the GEMS labelling requirements of either the new instrument or the old determination. This applies to any supply or offer, before or after commencement day, regardless of import or manufacture date. The right is optional; the supplier could choose to comply with the new instrument’s labelling even if the model is pre-existing. The right ceases if the model’s registration lapses. Note that this is limited to labelling; there is no similar transitional option for the GEMS level requirements or the performance requirements. Those are mandatory from commencement day for new supply, unless the product was already registered and was compliant under the old determination (the level requirements may have changed, so careful analysis is needed).

The instrument itself does not set penalty amounts; penalties arise under the Greenhouse and Energy Minimum Standards Act 2012. However, the determination defines what constitutes a breach by specifying the requirements that must be met. Supplying a covered product that does not comply with the GEMS level requirements (section 8) is a breach of section 25 of the Act. Supplying without proper labelling (section 9) is a breach of section 26. Breach of other GEMS requirements (section 11) is a breach of section 27. The Act provides for civil penalties. For a body corporate, the maximum civil penalty is 10,000 penalty units for each contravention. As of 2024, a penalty unit is $313, so that equates to $3.13 million per contravention. For individuals, the maximum is 2,000 penalty units ($626,000). These are not trivial amounts and are intended to deter non-compliance.

Enforcement is the responsibility of the GEMS Regulator (currently the Department of Climate Change, Energy, the Environment and Water). The Regulator can issue infringement notices (on the spot fines) for less serious breaches, or seek court orders for pecuniary penalties, injunctions, or remedial directions. The Regulator can also require a supplier to recall products that are non-compliant, at the supplier’s cost. The transitional labelling provision in section 10 is an exception to potential liability: if a product qualifies and uses old labels, it is taken to comply with the revived requirement, so no penalty. Section 9(5) also provides a form of extended transition: if this instrument is later revoked and replaced, and the replacement determination has a transitional labelling requirement providing that compliance with it satisfies the current requirement, then the current requirement is taken to be complied with. This is a forward looking clause to avoid a compliance gap during future transitions.

The risk of enforcement is not purely financial. A finding of non-compliance can also trigger adverse publicity, harm brand reputation, and lead to voluntary or mandatory recall. For a product class like rotary clothes dryers, where energy labelling is a prominent consumer consideration, mislabelling could also constitute misleading conduct under the Australian Consumer Law, which could give rise to separate penalties and consumer redress. The GEMS Act does not oust the ACL; a product might face twin enforcement actions.

Enforcement evidence will rely on the test reports. Section 8(2) specifies that tests must be conducted per sections 2 and 3 of AS/NZS 2442.1:2021. If a supplier uses an incorrect test method or a non-accredited lab, the test results may be inadmissible or show non-compliance. The burden of proving compliance lies with the supplier; the Regulator may request records. Failure to maintain records of tests and declarations could itself be a breach of regulations under the Act.

The instrument is made under the Greenhouse and Energy Minimum Standards Act 2012 (Cth) and operates as part of the Commonwealth legislative scheme. It does not replace that Act; rather, it specifies requirements for a particular product class. The Act provides the enforcement mechanisms, registration system, definitions, and general obligations. The instrument must be read together with the Act. For instance, the definition of supply is in the Act; the instrument’s references to supply incorporate that broader meaning.

The instrument explicitly incorporates Australian/New Zealand Standards AS/NZS 2442.1:2021 and AS/NZS 2442.2:2021, including amendments up to specified dates (Amd 2:2024 for 2442.1, Amd 3:2022 for 2442.2). This incorporation by reference means those standards have legal force for the purpose of determining compliance. However, the standards themselves are not Commonwealth legislation and are subject to copyright owned by Standards Australia. The copyright notice in the instrument acknowledges this and permits reproduction for non-commercial use for compliance purposes, but use beyond that requires permission. This can create a practical barrier: a small business may need to purchase the standards to understand its obligations, adding to compliance costs.

The instrument interacts with state and territory fair trading laws and the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010. The energy rating label is a form of product information; if the label is false or misleading (e.g., incorrect star rating), the supplier could be liable under section 18 of the ACL for misleading or deceptive conduct, and under section 29 for false representations about the performance characteristics of goods. ACL penalties are also significant, and the ACL does not provide a defence that the label complied with the GEMS determination if it is nonetheless factually inaccurate. Dual enforcement is possible: the GEMS Regulator could pursue a civil penalty under the GEMS Act for supplying without proper labelling, while the ACCC could pursue an action under the ACL for the same conduct.

There is potential interaction with product safety laws. If a rotary clothes dryer fails the maximum fabric temperature requirement (clause 3.3 of AS/NZS 2442.2), that could be a safety hazard (fire risk or burns). The ACL has mandatory safety standards for some electrical goods, but these are usually under separate regulations. The GEMS performance requirement does not directly duplicate safety standards, but a failure could trigger a safety recall under the ACL or state electrical safety legislation.

The instrument designates all covered products as category A products for the purposes of section 29 of the Act. That classification affects the registration process and the application of the Act’s provisions on varying or cancelling registrations. Category A products require full registration; category B products can be exempted. This instrument takes no exemption.

Finally, the instrument revokes the 2015 determination but does not affect any rights or liabilities accrued under that determination before revocation. Section 14 specifically preserves registrations taken under the old determination, meaning those registrations continue under the Act as if made under this instrument. However, any pending enforcement actions based on the old determination would need to be considered under transitional provisions in the Act.

This instrument is brand new as at the date it is registered (10 September 2024). It has not been amended since making. The only relevant amendment history concerns the instruments it replaces. The Greenhouse and Energy Minimum Standards (Rotary Clothes Dryers) Determination 2015 was previously the governing instrument. That 2015 determination was itself amended over time to update standards references or correct errors, but this current instrument does not recite that history. Schedule 1 simply repeals the whole of the 2015 determination. The legal effect is that the 2015 determination is no longer in force as of the day before this instrument’s commencement. Because this instrument includes transitional provisions for labelling and preserves registrations, a reader looking at the history would note that the 2015 determination’s specific requirements are superseded for all new compliance, but residual effects remain (e.g., products registered under it are grandfathered into the new regime). The instrument also references amendments to the standards: AS/NZS 2442.1:2021 includes Amd 2:2024, and AS/NZS 2442.2:2021 includes Amd 3:2022. These amendments are incorporated as at the date the instrument was made, so future amendments to the standards are not automatically picked up. A subsequent variation to the determination would be needed to capture later standard amendments. That is a notable feature: the instrument uses a static reference rather than an ambulatory one. This avoids automatic changes but also means that if the standards are updated to reflect improved measurement techniques or stricter limits, the determination will become outdated until amended. The Regulator may choose to amend this instrument within a few years.

There is no litigation history pertaining to this specific instrument, as it has not yet commenced (commencement day is 12 months after registration, so likely September 2025). The predecessor 2015 determination may have been the subject of enforcement actions or disputes, but the instrument does not reference any cases. For a deep dive, it is relevant to note that GEMS determinations are generally challenged rarely because they are technical instruments made by a delegate of a Minister. However, there is potential for judicial review of the determination itself if it is alleged to be beyond power or procedurally flawed. The authority is grounded in sections 23 and 35 of the Act. Section 23 gives the Minister power to determine GEMS level requirements; section 35 allows revocation and replacement. The instrument also specifies product class, labelling, and other requirements under authorising sections. Provided the Minister followed the legislative requirements (e.g., considering relevant matters, not acting unreasonably), a challenge would be difficult. The instrument includes a note stating that for the purposes of paragraph 34(b) of the Act, it comes into force on the day specified (commencement day), addressing procedural requirements about timing. No litigation history is reported in the instrument or its explanatory statement (not provided here but assumed). Analysts should check the Federal Court and AAT databases for any GEMS-related proceedings. Because the determination is new, litigation risk may arise after enforcement begins, for example, if a supplier disputes the Regulator’s interpretation of the test methodology or the classification of a product as a rotary clothes dryer. The definition of rotary clothes dryer is inclusive and covers combined washer-dryers; there could be disputes over whether a particular product falls within that definition, affecting whether it is subject to the determination or not.

Several provisions in this instrument carry traps for the unwary. First, the scope: section 7 covers electric household rotary clothes dryers “irrespective of the context in which the dryers are used.” The note explicitly gives an example of a commercial context. This means a commercial laundry machine that is of the same type as a household dryer (condenser or vented, electric) is within scope, even if it is larger, has a higher rated load capacity, or is sold through a different trade channel. The only limiting factor is that it must be an electric household rotary clothes dryer as defined. The term “household” modifies the type of appliance, not its use. So a machine designed for domestic use but installed in a laundromat must still comply. Conversely, an industrial drum dryer that is not similar to a household design may fall outside. The line may be blurry.

Second, the definition of rotary clothes dryer includes “an electric appliance which includes both washing and clothing drying functions and in which the drying function operates by the same method as a condenser or vented rotary clothes dryer.” This brings washer-dryer combos into scope. However, the determination does not contain any specific concessions for the combination appliance, such as separate test methods for washing and drying cycles. The test standards (AS/NZS 2442) cover rotary clothes dryers, not washer-dryer combos. The instrument relies on the drying function being covered by the standard, but the standard may have been designed for standalone dryers. Compliance may require careful interpretation. The note to the definition of condenser dryer refers to clause 1.4.4.1 of the standards, but the standards themselves may have annexes addressing combos. The risk is that a manufacturer may assume the combo is excluded or subject to a different regime, only to be caught.

Third, the static reference to standards. The definitions of AS/NZS 2442.1:2021 and AS/NZS 2442.2:2021 specify they are “as in force or existing on the day this instrument is made.” That is 10 September 2024. If the standards are later amended (e.g., to tighten energy limits or correct errors), the determination will not reflect those changes. A supplier could be compliant with the current standard but find that a product designed to later amendments is not compliant because the test method differs. More critically, if the standards are withdrawn or significantly altered, the determination may become inoperable until amended. The regulatory impact of a static reference is that any future change to the standard requires a new determination or amendment, which can be slow.

Fourth, the family of models provisions in section 12 require models to have the same energy performance characteristics and the same physical characteristics relevant to compliance. However, the list of characteristics is not exhaustive. The Regulator may decide that a difference in internal components (e.g., a different compressor) that does not affect energy consumption still disqualifies the family if the physical characteristics are not “the same.” The supplier bears the risk of the grouping being rejected after the test report is prepared. The requirement that a single test report be prepared prior to the application for registration means that you cannot mix test reports. If one model in a family fails during testing, the entire family is affected.

Fifth, the transitional labelling provision in section 10 applies only to products whose model was registered before the commencement day. It does not apply to new models registered after commencement day. That means a supplier who wants to use old labels for a stock clearance of a model that was not yet registered before commencement cannot rely on this provision. They must have the new label. Also, the transitional provision covers only labelling, not the GEMS level requirements or performance requirements. So even if the label is old, the product must still meet the new energy use requirements. A product that was designed under the old standard and passed the 2015 test may fail the 2021 test. The supplier is not protected.

Sixth, the energy rating label must be affixed at GEMS retail premises. There is no exception for online retail. If a product is displayed on a showroom floor without a label, the retailer may be liable even if the product is later sold with a label. The obligation is to accompany the product or its packaging; packaging could be a box in a warehouse, but display on a shelf likely requires the label on the product itself.

Seventh, section 9(5) provides a forward looking transitional mechanism for a future replacement determination. But that is a future risk: if this determination is revoked and replaced, there may be a gap while the new instrument’s transitional labelling requirements are drafted. The current instrument attempts to pre-empt that by deeming compliance if the replacement requirement is met, but it relies on the replacement determination actually including such a provision. If the new instrument omits it, the deemed compliance falls away.

Eighth, the definition of rated load capacity is in multiples of 0.5 kg. This may cause rounding issues for dryers with capacity claims of, say, 7.25 kg. The claim must be in multiples of 0.5 kg, so it would be rounded to 7.0 or 7.5. The test results and label would be based on the stated capacity. Overclaiming capacity to achieve a better star rating could be both a GEMS breach and misleading conduct.

Ninth, the instrument classifies all covered products as category A products. This means they are automatically subject to the full registration requirements under Part 5 of the Act. There is no facility for small volume exemptions or low-risk waivers. Every model must be registered before supply, regardless of volume. This imposes a fixed cost that can deter entry by small players.

Compliance with this determination should be approached as a three stage process: product design and testing, registration, and ongoing market obligations.

First, product design: ensure the rotary clothes dryer model can meet the energy use performance requirements of clause 4.4 of AS/NZS 2442.1:2021. Those requirements are not reproduced in the instrument, so you must obtain and review the standard. For condenser dryers, the energy consumption limits are expressed as a formula relating annual energy consumption to rated load capacity. For vented dryers, the formula differs. It is essential to conduct tests according to sections 2 and 3 of that standard. The test laboratory should be competent and preferably accredited. Record all test results. For the performance requirements, verify that the dryer can dry a specified load in a single operation and that the maximum fabric temperature does not exceed the limit in clause 3.3 of AS/NZS 2442.2:2021. These tests must also be performed per those clauses.

Second, labelling: design an energy rating label that complies with section 5 of AS/NZS 2442.2:2021. That includes the star rating (determined per clause 2.7), the annual energy consumption, the model name, and the format layout. The label must be affixed to the product or its packaging at the point of retail display. For products with models registered before commencement day, you may use either the new label or the label that complies with the old determination (2015). Mark this choice appropriately. If using the old label for pre registered models, ensure the old label remains accurate for the product and the model registration is still in force. For new models, only the new label is permitted.

Third, registration: prior to supplying any model, you must register it with the GEMS Regulator under the Act. Since all products are category A, full registration is mandatory. Provide the registration application under section 41 of the Act, including a test report prepared before the application. If using the family of models provision, declare the family members and ensure they share the same energy performance characteristics (comparative energy consumption and star rating index) and physical characteristics (including rated load capacity). The test report must cover all models in the family; you cannot mix reports. The Regulator may request further information. Keep copies of the registration certificate and any family declarations.

Fourth, ongoing market monitoring: ensure that all retail display units have the label affixed. For online sales, consider whether a digital representation of the label is required; while the instrument requires the label to “accompany” the product, the Regulator may accept a clear image in the listing. Implement quality assurance to catch errors in label printing. If a product is part of a family, ensure that no model is sold that deviates from the characteristics declared; any deviation would break the family, requiring separate registration and testing. Monitor changes in the standards: even though the instrument references the standards as at the date of making, a supplier may choose to comply with later editions voluntarily, but if a later edition is more stringent, compliance must still be demonstrated to the static standard. There is no obligation to update to later editions, but using a newer edition could create a risk if the test results differ and the Regulator tests against the static standard.

Fifth, record keeping: maintain all test reports, family declarations, registration certificates, and evidence of label production. The Regulator can request these records at any time. Failure to produce them on request can itself be an offence.

Sixth, for distributors and retailers: obtain from your supplier confirmation that each model is registered and compliant. Do not accept product without a valid energy rating label. At GEMS retail premises, ensure the label is visible on display units. If you are a retailer importing directly, you are the supplier and must undertake all steps above.

Finally, if you are a supplier with existing stock registered under the old determination, review whether the product still meets the new GEMS level requirements. If not, you cannot continue to supply even if the registration is preserved, because section 14 preserves registration but does not exempt the product from new level requirements. The product must comply with all requirements, not just labelling. Only the labelling has a transitional concession. If the product fails the new energy use test, you must cease supply or modify the product and re test. This is a potential economic loss for products that were legal under the old determination but are now unusable stacks.
