Greenhouse and Energy Minimum Standards Regulation 2012

The regulation establishes a limited set of administrative concepts and requirements. The main concepts, and where they appear in the text, are as follows.

GEMS product, model, and GEMS determination: The regulation operates in the conceptual field of the Greenhouse and Energy Minimum Standards Act 2012, referring repeatedly to "models of GEMS products" and "GEMS determinations". The regulation does not itself define those substantive terms beyond linking to the Act (s 1.3 defines "Act" but not the substantive terms). The regulation therefore presupposes the Act’s substantive definitions and standards.

Exemption mechanism: Division 4.1 sets out an exemption pathway under the Act. The central provision is that the GEMS Regulator may exempt a model of a GEMS product from one or more requirements of a GEMS determination, either on the Regulator’s own initiative or on application by a supplier or commercial user (s 4.1.2). An "exemption" in this instrument means relief from one or more requirements imposed by a GEMS determination; the instrument contemplates that exemptions may be conditional under s 37(2) of the Act (see s 4.1.6(b)(ii)).

Application form and supporting material: Applications for exemption must be in a form approved by the Regulator, must set out precise contact details, must state reasons addressing matters in s 4.1.5, and must be accompanied by supporting documentation (s 4.1.3(1)). The regulation prescribes the minimum contact particulars for individuals and businesses, including ABN or ACN where relevant (s 4.1.3(2); s 5.1(3)). For registration (Part 5), the contact person must be an officer or employee of the applicant (s 5.1(2)), and the regulation specifies the contact person’s positional details and contact information (s 5.1(4)).

Regulator’s evidence-gathering and procedural powers: The GEMS Regulator may request further information or documentation by written notice and may require it within a specified time. The Regulator may refuse to consider the application until the material is supplied (s 4.1.4). The Regulator must give written notice of its decision as soon as practicable, and delivery to the contact person suffices as delivery to the applicant (s 4.1.7).

Matters to be considered: The Regulator has both mandatory and discretionary considerations. Mandatory matters include the impact on Australia’s greenhouse gas emissions if the exemption is granted, and any grounds or matters relied upon in making the GEMS determination under s 23 of the Act, including the matters used to determine efficiency and labelling requirements (s 4.1.5). Discretionary matters include the cost to the applicant of complying if the exemption is refused, whether conditions could minimise negative greenhouse impacts while delivering reasonable outcomes for the applicant, and any other relevant matters (s 4.1.6).

Service and timing concepts: The regulation includes a practical timing concept: the instrument commences the day after registration (s 1.2). It requires prompt written notice of decisions (s 4.1.7(1)). For procedural responses the Regulator may set a time in its request for further information (s 4.1.4(1)).

Cross-reference to other legislation: The regulation incorporates the definitional scheme of other Commonwealth Acts by reference. For example, ABN and ACN are defined by reference to the A New Tax System (Australian Business Number) Act 1999 and the Corporations Act 2001 respectively (s 1.3). The regulation also expressly operates for specific sections of the Act (for example, s 4.1.1 notes that Division 4.1 is for section 37 of the Act; s 5.1(1) states the section is made for section 42 of the Act).

Operational note: The regulation is procedural and administrative rather than substantive. It specifies the minimum documentary and contact requirements and the decision-making considerations that must or may inform the Regulator. It creates administrative discretion and prescribes some limits on process, such as the Regulator’s ability to postpone consideration pending the provision of requested material.

This instrument directly affects three groups: suppliers and commercial users of GEMS products, applicants seeking registration of models of GEMS products, and the GEMS Regulator. Indirectly it affects any businesses and individuals whose products are subject to GEMS determinations because it sets out the pathway by which exemptions may be granted.

Applicants for exemption and registration: The regulation expressly contemplates applications by "a supplier or commercial user of the GEMS product" for exemptions (s 4.1.2(b)). For registration, the applicant may be an individual or a business; the regulation sets different contact detail requirements for each (s 5.1(3)). The contact person for registration must be an officer or employee of the applicant (s 5.1(2)). In practical terms, the regulation places the obligation to prepare and lodge applications, and to supply the specified contact and supporting information, squarely on the applicant.

Businesses with ABN or ACN: Where the applicant is a business the regulation requires the ABN or ACN to be included among the contact details (s 4.1.3(2)(b)(iii); s 5.1(3)(b)(iii)). This imposes a minimal identification and traceability requirement on registered businesses. Applicants that are sole traders or individuals must still provide the individual’s name and standard contact details (s 4.1.3(2)(a); s 5.1(3)(a)).

GEMS Regulator and administrative staff: The GEMS Regulator is empowered to accept applications on the Regulator’s own initiative, to request further material, to defer consideration, to consider specified mandatory and discretionary matters, and to communicate decisions in writing (ss 4.1.2, 4.1.4, 4.1.5-4.1.7). The regulation therefore allocates decision-making authority and procedural control to the Regulator.

Third parties affected by exemptions: Although not listed as applicants, other market participants may be affected by an exemption being granted to a particular model. The regulation requires the Regulator to assess the impact on Australia’s greenhouse gas emissions as a mandatory consideration (s 4.1.5(a)). This embeds a public interest factor in the decision-making calculus that can affect competitors and downstream purchasers as well as environmental stakeholders.

Legal representatives and consultants: The documentation and form requirements, and the Regulator’s power to request further material and to base decisions on grounds used in the GEMS determination process, create a demand for careful legal and technical submissions. Such advisors will be the intermediaries preparing the reasons and supporting documents the Regulator requires under s 4.1.3(1)(c)-(d).

Agents and contact persons: Part 5 prescribes that the contact person for a registration application must be an officer or employee of the applicant (s 5.1(2)). This limits the use of external agents as the designated contact point, unless those agents are formally officers or employees. The contact person’s positional detail must be provided (s 5.1(4)(b)), which supports accountability and line-of-responsibility tracing within the applicant organisation.

Information clients: The regulation contemplates delivery of written decisions to the contact person and treats service on the contact person as service on the applicant (s 4.1.7(2)). Applicants who do not maintain a reliable contact person risk delayed notice. The inclusion of fax among the required contact media (s 4.1.3(2)(c); s 5.1(4)(c)) may impose archaic but mandatory technical requirements unless the Regulator approves alternative communication means by the form or other administrative direction.

Overall, the regulation affects market participants engaging with the GEMS administrative processes by imposing documentary, identity and contact obligations, and by designating the Regulator as the central decision-maker with procedural discretion. The costs of compliance, and the operational choices about who to nominate as contact person, fall on applicants and registrants.

The regulation creates specific duties for applicants and prescribes decision-making obligations and discretions for the GEMS Regulator. It also confers limited rights on applicants. The key duties and rights follow directly from the text.

Duties on applicants

• Use an approved form and lodge a complete application for an exemption: An application must be in a form approved by the GEMS Regulator (s 4.1.3(1)(a)). Applicants are required to set out reasons addressing the matters listed in s 4.1.5 and to supply supporting documentation (s 4.1.3(1)(c)-(d)).
• Provide prescribed contact details: The applicant must supply specific contact details. For businesses this includes the name, trading name if any, and ABN or ACN (s 4.1.3(2)(b); s 5.1(3)(b)). The application must also include the applicant’s address, phone, fax and email (s 4.1.3(2)(c); s 5.1(3)(c)).
• Nominate a contact person for registration who is an officer or employee: For registration applications the contact person must be an officer or employee of the applicant (s 5.1(2)); the contact person’s name, position, and contact details must be supplied (s 5.1(4)).
• Respond to Regulator requests for further information within the specified time: The Regulator may issue a written notice requiring further information or documentation and may specify a time for compliance (s 4.1.4(1)). If an applicant does not supply the requested material the Regulator may refuse to consider the application until it is provided (s 4.1.4(2)).

Administrative duties and discretions of the GEMS Regulator

• Power to exempt on initiative or application: The Regulator may grant exemptions on the Regulator’s own initiative or decide applications lodged by suppliers or commercial users (s 4.1.2).
• Procedural control to request and withhold consideration: The Regulator may ask for further information in writing and may refuse to consider an application until the material is provided (s 4.1.4).
• Mandatory and discretionary decision-making factors: In making an exemption decision, the Regulator must have regard to specific matters including the impact on Australia’s greenhouse gas emissions and the grounds or matters relied upon in making the GEMS determination under s 23 of the Act (s 4.1.5). The Regulator may also consider the applicant’s compliance cost, whether a condition could minimise negative emissions impacts while delivering a reasonable outcome, and any other matter considered relevant (s 4.1.6).
• Obligation to notify decisions: The Regulator must provide written notice of the decision as soon as practicable after making it, and service on the contact person counts as service on the applicant (s 4.1.7).

Applicants’ rights and procedural protections

• Right to apply for an exemption: Suppliers and commercial users are expressly given standing to apply for exemptions (s 4.1.2(b)). This is a statutory entitlement to seek relief from GEMS determination requirements.
• Expectation of written reasons and service: The Regulator must provide written notice of decisions as soon as practicable, which ensures applicants receive formal communication of outcomes (s 4.1.7(1)). The regulation requires the application to set out reasons and supporting documentation, providing an evidentiary record for the Regulator’s decision-making (s 4.1.3(1)(c)-(d)).
• Regulatory discretion to attach conditions: The regulation contemplates that the Regulator may impose conditions on any exemption under s 37(2) of the Act, and the Regulator must consider whether such conditions could limit greenhouse impacts and deliver reasonable outcomes to applicants (s 4.1.6(b)). This creates a practical right to propose and negotiate conditional relief.

Limits and omissions

• No penalty provisions are included in the regulation: The instrument does not set out offences or penalties. The regulation operates within the Act’s framework, and enforcement and penalty regimes if any are contained in the Act rather than in this instrument (see s 1.3 defining the Act).
• No timelines for decision-making beyond "as soon as practicable": The Regulator’s duty to notify is expressed as "as soon as practicable" (s 4.1.7(1)); the regulation does not prescribe fixed statutory time limits for decisions or for the Regulator’s initial processing of applications.

In practice, these duties place the onus of supply, verification and procedural responsiveness on applicants, while giving the Regulator a broad but structured discretion to decide whether exemptions are appropriate and whether conditions are required to protect greenhouse gas outcomes and reconcile public and private interests.

The regulation itself does not establish criminal or civil penalties, nor does it specify enforcement mechanisms. The instrument is procedural and administrative, focused on the requirements for exemption applications and registration applications. Consequently the reader should note the following points grounded in the text.

Absence of penalty clauses in the regulation: The regulation’s text contains no provisions creating offences, monetary penalties, infringement notices, or enforcement powers exercisable by the GEMS Regulator. The Parts and sections supplied relate to application form and content, the Regulator’s power to request further information, matters to which the Regulator must or may have regard, and notification of decisions (Parts 4 and 5). There is no provision in the instrument that prescribes penalties for non-compliance with these requirements.

Delegation to the Act for enforcement and sanctions: The regulation operates under the Greenhouse and Energy Minimum Standards Act 2012 (the Act), as defined in s 1.3. Where enforcement, sanctions or offences are relevant they will be found in the Act itself. This instrument repeatedly cross-references sections of the Act (for example, its Division 4.1 is "for section 37 of the Act" (s 4.1.1) and s 5.1(1) is "made for section 42 of the Act"). Any penalty, compliance, or enforcement mechanisms applicable to failures in relation to GEMS determinations, exemptions or registration therefore derive from the Act rather than from this regulation. Users must consult the Act to identify the applicable enforcement regime.

Administrative controls and potential consequences from process rules: Although there are no penalties in this regulation, aspects of the procedure can produce significant practical consequences for applicants. The GEMS Regulator may issue a written notice requesting further information and may refuse to consider an application until the information is provided (s 4.1.4). Refusal to consider an application delays or effectively blocks relief until the applicant complies. The Regulator may also exercise discretion to grant or refuse exemptions (s 4.1.2). While not formal penalties, procedural refusals or de facto non-decision can have material commercial consequences, such as ongoing compliance costs or lost market access.

Conditional exemptions as a control mechanism: The regulation contemplates that exemptions may be granted subject to conditions under s 37(2) of the Act, and it requires the Regulator to consider whether conditions could minimise greenhouse impacts while delivering reasonable outcomes for applicants (s 4.1.6(b)). Conditions attached to an exemption can be an enforcement tool; failure to comply with such conditions would normally be addressed under the Act’s enforcement provisions, not under this regulation.

Service and procedural notice: The Regulator must give written notice of decisions as soon as practicable after the decision is made, and service on the contact person is treated as service on the applicant (s 4.1.7). This rule affects how applicants receive notices of refusals or conditional grants, and therefore affects how prompt applicants must be in monitoring communications. Failure to monitor may lead to missed opportunity to seek reconsideration or to comply with conditions, with any resulting consequences governed by the Act and the Regulator’s processes.

Practical implication: For compliance and enforcement consequences, stakeholders should consult the Act for the substantive enforcement regime. This regulation should be read as providing the administrative steps that determine whether and how regulatory relief is processed, rather than as specifying sanctioning powers.

This regulation is an instrument subordinate to the Greenhouse and Energy Minimum Standards Act 2012 and expressly connects to other Commonwealth statutes for definitions and cross-references. The interactions to note, as the regulation itself presents them, are as follows.

Delegation and primacy under the Act: The regulation is made "under the Greenhouse and Energy Minimum Standards Act 2012" (preamble; s 1.3). Several provisions explicitly state that particular sections are made for or relate to sections of the Act. For example, Division 4.1 is "for section 37 of the Act" (s 4.1.1), and s 5.1(1) is "made for section 42 of the Act". This means that the Act is the primary statutory source for substantive rules governing GEMS determinations, exemptions, registration and any enforcement measures. The regulation supplies procedural detail to operationalise specified sections of the Act.

Cross-reference to other Commonwealth legislation for definitions: The regulation adopts definitional cross-references to other Commonwealth statutes. Section 1.3(a) defines ABN by reference to section 41 of the A New Tax System (Australian Business Number) Act 1999. Section 1.3(b) defines ACN by reference to section 9 of the Corporations Act 2001. These references integrate the instrument into the wider Commonwealth framework for business identification and corporate registration, ensuring ABN and ACN follow existing legal definitions and registries.

Interaction with GEMS determinations under the Act: The regulation requires the Regulator, when deciding exemptions, to have regard to "any grounds relied upon, or matters considered, in the making of the GEMS determination for the GEMS product under section 23 of the Act, including the matters considered in determining the efficiency and labelling requirements" (s 4.1.5(b)). This creates a direct evidential link between the original policy and evidentiary bases for GEMS determinations and the Regulator’s discretion to grant exemptions. Decisions under this regulation therefore must be consistent with and informed by material relevant to earlier determinations under the Act.

Procedural interplay with administrative law principles: While the regulation does not expressly reference the Administrative Decisions (Judicial Review) Act or other judicial review mechanisms, the text sets out procedural elements (approved form, reasons addressing specified matters, supporting documentation, written notices, and the Regulator’s power to request further information). These features create an administrative record that will be relevant for any review under general administrative law principles. The requirement for written notice "as soon as practicable" (s 4.1.7(1)) and the Regulator’s explicit consideration of specified matters (s 4.1.5) establish decision-making standards that can be examined in administrative review processes, albeit the regulation itself does not specify review rights.

Relation to corporate and tax registration systems: By requiring ABN or ACN where the applicant is a business (s 4.1.3(2)(b)(iii); s 5.1(3)(b)(iii)), the regulation links the GEMS administrative regime to the Australian Business Register and the Corporations Register. This intersection supports traceability and auditability and ties compliance obligations to the existing corporate and tax identification frameworks.

No express interaction with state or territory laws in the text: The regulation makes no express reference to state or territory statutes or instruments. The scope of the regulation is limited to Commonwealth administrative requirements. Any interface with state and territory labelling, product safety or environmental schemes is not addressed in this instrument and would need to be considered separately.

Registry and publication: The regulation includes a note that all legislative instruments and compilations are registered on the Federal Register of Legislative Instruments under the Legislative Instruments Act 2003 (note following s 5.1). This signals that the instrument’s entry, and any amendments, are recorded on the Commonwealth registry, which affects how practitioners locate authoritative versions and track changes.

In summary, the regulation is procedurally integrated with the Act and uses defined identifiers from existing Commonwealth statutes. It mandates that Regulator decisions must be informed by the evidentiary bases for original GEMS determinations, thereby creating a legal and evidentiary bridge between determinations and exemption decisions. For enforcement, penalties, and substantive obligations the Act is the relevant primary source.

The instrument text includes the formal making and registration details but contains no in-text amendments or schedules that amend other legislation. The material available in the instrument itself indicates the following verifiable history points and practical implications for tracking amendments.

Original making and registration: The regulation is presented as a Select Legislative Instrument 2012 No. 239, made by the Governor-General and dated 11 October 2012 (preamble). It states that it commences on the day after it is registered (s 1.2). Those are the primary chronological markers contained in the text.

No express amendments recorded in the text: The instrument as supplied contains no subsequent amendment provisions, no substitution or repeal schedules, and no marginal notes indicating that its provisions have been amended since registration. The instrument therefore, as presented, appears in its original form as registered in 2012.

Registry and the formal record: The instrument contains a note directing users to the Federal Register of Legislative Instruments kept under the Legislative Instruments Act 2003 for all legislative instruments and compilations (note following s 5.1). That note implies that authoritative records of registration and any subsequent amendments are maintained on that federal register. Practitioners seeking the instrument’s amendment history are therefore directed to consult that register for authoritative, up-to-date information.

Practical implications: Because the instrument cross-references the Act and other Commonwealth Acts (for ABN and ACN definitions), any amendments to those primary statutes could affect how terms in this regulation operate in practice. However, the regulation itself does not purport to amend those Acts; it simply adopts their definitions by reference (s 1.3). Any change to the Act’s relevant sections (for example, to sections 23, 37 or 42 of the Act) could change the practical operation of the processes set out in this regulation even if the regulation itself remains unchanged. Those changes would be recorded in the Act’s amendment history rather than in this regulation, unless the regulation were expressly updated to reflect consequential amendments.

Recommended verification step: The regulation explicitly instructs users to consult the Federal Register of Legislative Instruments for the registered instrument and any compilations. Practitioners should therefore verify the instrument’s currency, and check for any amending legislative instruments or revocations recorded on that register, before relying on the text for compliance or advisory purposes.

In short, the instrument supplies its original registration details and a pointer to the official register, but contains no in-text record of later amendments. Users must consult the Federal Register for any subsequent legislative changes.

The regulation text supplied contains no references to judicial decisions, administrative appeals, or litigation concerning the instrument. There are no cases, determinations, or adjudications referenced in the instrument’s body or notes.

What the instrument shows about potential reviewability

• Administrative decisions amenable to challenge: The instrument creates administrative decision points (granting or refusing exemptions, specifying conditions, request for further information, refusal to consider applications until material is supplied). Such decisions, made by the GEMS Regulator under powers conferred by the Act and operationalised by this regulation, are typically amenable to administrative review and judicial review under Commonwealth administrative law principles. However, the instrument itself does not stipulate appeal or review procedures, nor does it enumerate any privative clauses or ouster provisions. Any right of review therefore derives from the Act and from general administrative law, not from this regulation.
• Record-creating processes: The requirement that applications address specific matters and include supporting documentation (s 4.1.3(1)(c)-(d)) and the Regulator’s duty to provide written notice of decisions (s 4.1.7(1)) create an administrative record. That record would be the basis for any legal challenge or review, but the regulation does not itself provide procedural routes or timeframes for appeal.

Absence of litigation history in the text: Because the instrument itself is limited to administrative form and process and contains no narrative about past disputes or precedent, there is nothing in the text to report about prior litigation. For an authoritative picture of any litigation or disputes concerning exemptions, registrations, or the Regulator’s decision-making under the Act, practitioners must search judicial and tribunal databases and the Federal Register to identify cases referencing the Act and the GEMS regime.

Practical note for advisers: If a client contemplates judicial review or administrative challenge, the regulation provides the procedural touchpoints to examine: whether the application was in an approved form, whether required supporting documentation was supplied, whether the Regulator requested and was supplied with further information, whether the Regulator had regard to the mandatory matters in s 4.1.5, and whether a written notice of decision was given as required by s 4.1.7. These are evidentiary and procedural issues that would be central in any challenge, but the instrument does not specify remedies, time-limits or review pathways.

In summary, the instrument contains no litigation history and no express procedural appeal mechanisms; any litigation or review would engage the Act and general administrative law principles, using the procedural structures the regulation prescribes as evidential and adjudicative touchstones.

The regulation is compact but contains several operational traps and potential surprises for applicants and registrants. The following points are grounded in the instrument’s text and draw attention to compliance and procedural risks.

Form and approved form requirement: Applications must be "in a form approved by the GEMS Regulator" (s 4.1.3(1)(a)). Failure to use the approved form risks the application being defective. The instrument does not specify where to obtain the approved form or how the Regulator publishes it. Applicants should confirm the current approved form with the Regulator or through the Federal Register. The absence of the form in the regulation means administrative missteps are possible if practitioners assume any particular template suffices.

Mandatory content tied to decision factors: An application must "set out the reasons for seeking the exemption including addressing the matters mentioned in section 4.1.5" and must be "accompanied by documentation supporting the applicant’s reasons for seeking the exemption" (s 4.1.3(1)(c)-(d)). Section 4.1.5 requires the Regulator to have regard to the impact on Australia’s greenhouse gas emissions and the grounds/matters relied upon in making the GEMS determination under s 23 of the Act. Practically this means that a bare commercial or convenience-based argument will likely be insufficient. Applications must directly confront greenhouse impacts and the original grounds of the relevant GEMS determination.

Regulator’s power to refuse to consider applications pending more information: The Regulator may request further information and "may refuse to consider the application until the applicant provides the information or documentation" (s 4.1.4(2)). That is not merely a request for clarification; it is a power to suspend admissibility. Applicants who do not respond timely risk having their application put on hold indefinitely.

Contact person must be an officer or employee: For registration, the contact person "must be an officer or employee of the applicant" (s 5.1(2)). Nominees who are external consultants, contractors or third-party agents may not qualify unless they are formally officers or employees. That requirement constrains the use of external agents to manage correspondence unless organisations structure their arrangements to satisfy the definition.

Service on contact person suffices as service on applicant: The Regulator’s written notice to the contact person is "taken to have been given to the applicant" (s 4.1.7(2)). If the contact person is poorly chosen, out of office, or lacks reliable channels, the applicant may miss critical notices. Applicants must ensure the contact person will reliably receive and attend to communications.

ABN/ACN and corporate traceability: The regulation requires ABN or ACN where the applicant is a business (s 4.1.3(2)(b)(iii); s 5.1(3)(b)(iii)). Omitting this information risks a defective application. Sole traders or entities without ABN/ACN should confirm which category applies and ensure the correct identification is supplied.

No prescribed decision timeframe: The Regulator must give written notice "as soon as practicable" (s 4.1.7(1)). The absence of a fixed statutory timeframe can create commercial uncertainty. Applicants facing time-sensitive market decisions should plan for potential delays.

Conditions under the Act: The regulation contemplates that the Regulator may impose conditions under s 37(2) of the Act and asks whether imposing such a condition could "deliver a reasonable outcome for the applicant" (s 4.1.6(b)(ii)). Applicants should be prepared to negotiate or propose conditional exemptions that balance greenhouse outcomes and commercial practicability. The instrument presumes that conditions are a likely regulatory tool.

Regulator-initiated exemptions: The Regulator may grant exemptions on its own initiative, not only on application (s 4.1.2(a)). Stakeholders should not assume that exemption activity will be confined to applicant-initiated processes.

Requirement to address original determination grounds: The Regulator must have regard to "any grounds relied upon, or matters considered, in the making of the GEMS determination" including efficiency and labelling considerations (s 4.1.5(b)). Applicants need to obtain and engage with the original determination materials; failure to do so will weaken an application.

Electronic communication and fax: The regulation requires fax numbers among the contact details (s 4.1.3(2)(c); s 5.1(4)(c)). While including fax likely reflects legacy practice, applicants should ensure that the Regulator accepts alternative electronic communication and confirm methods of service to avoid missed notices.

Documentary burden: The combination of an approved form requirement, mandated reasons addressing greenhouse impacts, and supporting documentation creates a non-trivial evidentiary burden. Businesses should plan for technical analysis (for example, lifecycle emissions or efficiency comparisons) to address s 4.1.5(a).

In sum, the regulation creates multiple procedural levers where administrative missteps can delay or sink an application. Practitioners should focus on complying with the approved form, supplying ABN/ACN where appropriate, nominating an accountable contact person who is an officer or employee, and preparing evidence that addresses greenhouse gas impacts and the original grounds for the relevant GEMS determination.

The regulation prescribes specific documentary and procedural steps for exemption applications and for registration. The checklist below translates the regulation’s text into operational action items, with citations to the relevant provisions. The guidance covers preparation, filing, and follow-up.

1. Confirm the applicable statutory pathway

• Check whether the relief sought is an exemption from one or more requirements of a GEMS determination. The exemption pathway is set out in Division 4.1 (s 4.1.2). If registration of a model is sought, consult Part 5 s 5.1.

2. Obtain the approved form

• Applications for an exemption "must be in a form approved by the GEMS Regulator" (s 4.1.3(1)(a)). Contact the GEMS Regulator or the Federal Register of Legislative Instruments to locate the current approved form and any accompanying guidance.

3. Prepare required contact details

• For all applications, include the applicant’s contact details. If the applicant is an individual, provide the individual’s name (s 4.1.3(2)(a); s 5.1(3)(a)). If the applicant is a business, provide the name of the business, trading name if any, and ABN or ACN (s 4.1.3(2)(b); s 5.1(3)(b)). Provide the applicant’s address, phone number, fax number and email address (s 4.1.3(2)(c); s 5.1(3)(c)).
• For registration applications, nominate a contact person who is an officer or employee of the applicant (s 5.1(2)) and provide that person’s name, position, and contact information (s 5.1(4)).

4. Draft reasons and supporting documentation

• The application must set out the reasons for seeking the exemption and must address the matters in s 4.1.5 (s 4.1.3(1)(c)). In particular, address:
  • The impact on Australia’s greenhouse gas emissions if the exemption is granted (s 4.1.5(a)).
  • The grounds or matters relied upon in the making of the original GEMS determination under s 23 of the Act, including efficiency and labelling considerations used in that determination (s 4.1.5(b)).
• Attach technical documentation, test reports, economic assessments, or other evidence that substantiate the stated reasons (s 4.1.3(1)(d)).

5. Anticipate and quantify compliance costs

• Because the Regulator may have regard to the applicant’s cost of compliance (s 4.1.6(a)), quantify the cost to the applicant of complying with the GEMS determination if the exemption is not granted. Provide evidence such as quotes, quotes for testing, cost-benefit analysis, or certification costs.

6. Propose conditions where appropriate

• The Regulator may consider whether imposing conditions could minimise greenhouse impacts while delivering a reasonable outcome (s 4.1.6(b)(i)-(ii)). If a full exemption is unlikely, include proposed conditions that mitigate emissions effects and are commercially practicable.

7. Submit and monitor communications

• Lodge the application via the method directed by the Regulator or in the approved form. Record the contact person and ensure that person will monitor communications, because written notice to the contact person is treated as notice to the applicant (s 4.1.7(2)).
• Ensure the contact person is an officer or employee for registration applications (s 5.1(2)).

8. Respond promptly to requests for further information

• If the Regulator issues a written notice requesting more material, comply within the specified time. The Regulator may refuse to consider the application until the information is supplied (s 4.1.4(1)-(2)). Track any deadlines and preserve evidence of service and receipt.

9. Keep copies and an audit trail

• Maintain a full copy of the approved form, reasons, supporting documents, all communications with the Regulator, and proof of delivery for any notices received from the Regulator. The regulation’s procedural elements make the administrative record central to outcome and any potential review.

10. Plan for timing uncertainty

• The Regulator must notify decisions "as soon as practicable" (s 4.1.7(1)). That phrase lacks a fixed statutory deadline. For projects or supply chains with timing sensitivity, factor in potential delays and consider contingency plans while the application is under consideration.

11. Cross-check original GEMS determination materials

• Because the Regulator must consider the grounds and matters relied upon in the original GEMS determination (s 4.1.5(b)), assemble the original determination documents, labelling and efficiency rationale, and address those directly in submissions.

12. Consider legal or technical assistance

• The regulation requires reasoned submissions on greenhouse impacts and original determination grounds, and contemplates conditional relief. Engage legal counsel and technical experts early to produce robust evidence and conditional proposals.

13. Verify instrument currency

• Before relying on any operational detail, check the Federal Register of Legislative Instruments for the current registered instrument and any amending instruments (note following s 5.1).

Following these steps will align an applicant’s approach with the regulation’s explicit requirements and reduce the risk of procedural defects, deferral of consideration, or missed notices. The regulation centralises the Regulator’s discretion, so high-quality, targeted evidence and clear contact arrangements materially improve the chance of an efficient administrative outcome.
