Greenhouse and Energy Minimum Standards (Registration Fees) Act 2012

This Act creates a delegated, instrument-based mechanism by which the GEMS Regulator can impose fees for registration applications to register models of GEMS products under the Greenhouse and Energy Minimum Standards Act 2012. Section 8(1) gives the Regulator power to specify registration fees by legislative instrument. Section 8(2) declares those registration fees to be imposed as taxes. The power permits the instrument to specify multiple fees for a single registration application, and includes examples showing the instrument might differentiate fees by product class or by filing method (s8 and its examples).

The Act restricts the basis on which fees may be set. Section 9(1) allows a legislative instrument either to set a fixed amount or to prescribe a method for calculating a fee. Section 9(2) limits the matters the GEMS Regulator may take into account when specifying amounts or calculation methods to the cost of processing registration applications (s9(2)(a)) and the cost of compliance monitoring, including testing, in relation to models of GEMS products for the purposes of the Greenhouse and Energy Minimum Standards Act 2012 (s9(2)(b)). Those are the only matters the Regulator may consider under this Act when specifying fee amounts or calculation methods.

The Act does not itself create new registration obligations, enforcement powers, offences or refund procedures; it operates to authorise the imposition of fees linked to the registration process established under the GEMS Act. The Act explicitly notes that the GEMS Regulator may, under section 64 of the GEMS Act, waive, reduce or refund a registration fee in particular cases or classes of cases (note to s8). The Act binds the Crown (s3), extends to external Territories (s4), and applies extraterritorially (s5). It also contains a constitutional limitation that the Act does not impose a tax on property belonging to a State (s6(1)), reflecting section 114 of the Constitution (s6(2)). The power to make regulations for carrying the Act into effect is in s10. The Act’s operative registration-fee powers (s3-s10) commenced when s3 of the Greenhouse and Energy Minimum Standards Act 2012 commences, and the short title and commencement provisions commenced on the day after Royal Assent (Commencement table).

Registration application: The Act defines registration application as an application under s41 of the Greenhouse and Energy Minimum Standards Act 2012 to register one or more models of GEMS products in relation to one or more product classes (s7(1)). This definition ties the fee framework to the substantive registration regime in the GEMS Act; the Act does not itself define what a registration application contains or triggers beyond that cross‑reference.

Registration fees and legislative instruments: The GEMS Regulator specifies registration fees by legislative instrument (s8(1)). The Act labels those fees taxes (s8(2)). The legislative instrument may set multiple fees for a single registration application (s8(3) and example). Section 9(1) authorises the instrument to specify a fee either by stating an amount or by prescribing a method for calculating the fee, which allows for fixed fees, formula-based fees, or potentially tiered or granular calculations depending on the instrument’s drafting.

Permissible considerations for fee-setting: Section 9(2) narrowly confines the matters the GEMS Regulator may take into account when determining fee amounts or calculation methods to two things: (a) the cost of processing registration applications and (b) the cost of compliance monitoring, including testing, in relation to models of GEMS products for the purposes of the GEMS Act. That constraint is a statutory limitation on the Regulator’s revenue-setting discretion; the Act does not include an express list of excluded factors beyond this positive list, but by specifying the only matters that may be taken into account, it creates a legal boundary on the permissible bases for fee design under this Act.

Waiver and refund reference: The Act contains a note to s8 that directs readers to s64 of the GEMS Act, which permits the GEMS Regulator to waive, reduce or refund fees in particular cases or classes of cases. This Act does not itself create the waiver power; rather it acknowledges that the GEMS Act contains that administrative discretion that will operate alongside the fee-imposition power authorised here.

Scope and limits: The Act binds the Crown (s3), extends to external Territories (s4), applies extraterritorially (s5), and provides that it does not impose a tax on property of a State (s6). The Governor-General may make regulations to prescribe matters necessary or convenient for carrying out this Act (s10), which may be used to refine procedural or ancillary matters not set out in the Act.

Commencement mechanics: The commencement table identifies different start dates: the short title and commencement provisions took effect on 22 September 2012, and sections 3-10 commenced at the same time as s3 of the GEMS Act, on 1 October 2012, indicating coordinated commencement between this Act and the broader GEMS statutory framework.

Fee payers: The primary economic actors affected are persons or entities who lodge registration applications under s41 of the GEMS Act, as the Act defines registration application to mean such an application (s7(1)). Practically, that will include manufacturers, importers, or suppliers seeking to register models of GEMS products in specified product classes. Because the Act permits multiple fees for a single registration application (s8(3)), applicants covering multiple models or product classes can expect multiple fee items.

GEMS Regulator: The Regulator is the decision-maker who specifies the registration fees by legislative instrument (s8(1)). The Regulator therefore exercises delegated regulatory power to design fee schedules and methods, constrained by the statutory limits in s9(2). The note to s8 signals that the Regulator also operates waiver and refund discretion under s64 of the GEMS Act, so the Regulator will administer both the imposition and potential remission of fees.

State and Commonwealth interests: The Act binds the Crown in each capacity (s3), so federal agencies and the Crown are within the Act’s ambit for fee imposition, though s6(1) states the Act does not impose a tax on property of a State. The constitutional cross-reference in s6(2) limits how the tax might operate in relation to State property as defined in section 114 of the Constitution.

Third parties involved in processing and compliance monitoring: Entities or labs engaged to perform compliance monitoring or testing incur costs that the Regulator may take into account when specifying fees (s9(2)(b)). While they are not direct fee payers under this Act, they may be engaged by applicants or the Regulator as part of the compliance-monitoring ecosystem.

Businesses and markets: By authorising fees tied to registration applications for models of GEMS products, the Act affects costs of market entry for manufacturers, importers, or distributors of energy-using products regulated under the GEMS Act. Registration fees are imposed as taxes (s8(2)); that characterisation may influence accounting treatment and the interaction with other fiscal or statutory regimes. The examples in s8 indicate that fee design might reflect product class differences or filing method; those design choices will differentially affect actors depending on product mix and administrative capability.

Legislative instrument recipients: The instrument-making process, which the Act requires rather than an express parliamentary schedule in the Act, means stakeholders will need to consult the text of the particular legislative instrument to determine precise fee amounts or calculation methods as they are specified by the Regulator under s8(1).

Duties to pay fees: The Act’s core duty is the obligation to pay registration fees as specified by the legislative instrument, applied to registration applications under the GEMS Act, although the Act does not itself create the timing, collection mechanism or penalties for non‑payment; those operational details are expected to be governed by the GEMS Act or by the legislative instrument and associated administrative practice. Section 8(1) establishes the power to specify fees, and s8(2) confirms they are imposed as taxes; naturally, the effect is that applicants should expect a legal obligation to pay the fees attached to their registration application.

Regulator’s duties in fee specification: The GEMS Regulator must specify registration fees by legislative instrument (s8(1)), and when setting amounts or methods is constrained to taking account only of the processing and compliance monitoring costs listed in s9(2). This places a statutory duty on the Regulator to limit the basis for fee-setting to those two cost categories; fees that take into account other factors would be inconsistent with the clear list in s9(2).

Right to waive or refund: The Act notes that the GEMS Regulator may, under s64 of the GEMS Act, waive, reduce or refund fees in particular cases or classes of cases (note to s8). That is an administrative discretion under the GEMS Act, not this Act. From a rights perspective, applicants have a statutoryly recognised administrative avenue for seeking relief from fees, subject to the terms and exercise of s64 of the GEMS Act.

Right to know fee design: Because the Act requires specification by legislative instrument (s8(1)) and allows specification of methods rather than only fixed amounts (s9(1)(b)), affected persons have the right to inspect the legislative instrument to determine precise fee liabilities and the calculation methods used. The Act does not itself prescribe required consultation or notice periods for the legislative instrument, nor does it set indexation, maximum amounts or review processes for fee instruments; rights to seek judicial review of an instrument would depend on general administrative law grounds outside the text of this Act.

Crown obligations and immunities: The Act binds the Crown (s3), so the Crown is not immune from the Act’s application; however, the constitutional limitation in s6(1) excludes taxes on property of a State. That carve-out imposes a duty on the Commonwealth to observe the constitutional prohibition when applying the fees to State property, though the precise interface with State assets is not further detailed in this Act.

Absence of specific penalties in this Act: The Act does not itself create offences, penalties or express enforcement mechanisms for non-payment of registration fees. It authorises the imposition of fees (s8), but does not set out collection methods, recovery processes, or penalties for failure to pay. Enforcement procedures, including fines or suspension of registration processes for non-payment, are therefore matters that would be governed by the Greenhouse and Energy Minimum Standards Act 2012, the relevant legislative instrument, or by regulation under s10, rather than by this Act.

Characterisation of fees as taxes: Section 8(2) declares registration fees to be imposed as taxes. That characterisation may have legal consequences for the mechanisms available to collect unpaid taxes under other Commonwealth revenue or taxation laws, but the Act itself does not detail which collection regimes or enforcement tools apply. Because the Act is silent on collection and penalties, interested parties must consult the GEMS Act and the legislative instrument that sets the fees for procedural and enforcement details.

Regulator administrative discretion and remedial powers: The note to s8 refers to s64 of the GEMS Act, which provides the GEMS Regulator the power to waive, reduce or refund registration fees in particular cases or classes of cases. While not a penalty provision, this is an administrative remedial mechanism to modify fee burdens; this Act explicitly recognises that such discretion exists in the complementary GEMS Act framework. The Act does not set standards or limits on how that discretion is to be exercised beyond the reference.

Regulations: Section 10 authorises the Governor-General to make regulations necessary or convenient for carrying out the Act. Regulations might therefore provide procedural rules for fee collection, payment deadlines, refund procedures or infringement mechanisms, but the Act itself does not specify those elements. Users must check any regulations made under s10 and instruments made under s8(1) for enforcement detail.

Interaction with constitutional limitation: Section 6(1) limits the Act so it does not impose a tax on property belonging to a State; an enforcement action that sought to collect a fee characterised as a tax against State property would be incompatible with this statutory limitation. The Act thereby provides a narrow legal protection for State property, which could affect enforcement approaches if State assets were involved.

Administrative law and judicial review: Because the Act delegates fee-setting to the GEMS Regulator via legislative instrument, decisions concerning fee instruments could be amenable to judicial review under general administrative law principles where the instrument is allegedly inconsistent with the Act’s constraints, for example by taking into account matters beyond s9(2). The Act itself does not prescribe a review mechanism, but the statutory limits set out potential legal bases for challenge to instruments or their application.

Primary statutory cross‑reference to the GEMS Act: The Act is explicitly framed to operate in relation to the Greenhouse and Energy Minimum Standards Act 2012. It defines registration application by reference to s41 of the GEMS Act (s7(1)), it notes the Regulator’s power to waive or refund under s64 of the GEMS Act (note to s8), and it links substantive matters, processing and compliance monitoring costs,to activities under the GEMS Act (s9(2)). Thus the Act operates as a fee-authorising adjunct to the broader GEMS regulatory scheme rather than as a standalone regulatory framework.

References to other Commonwealth instruments and constitutional provision: The Act mentions subsection 33(3A) of the Acts Interpretation Act 1901 in its examples (s8 examples), indicating that fee differentiation by product class or by electronic filing is consistent with standard statutory interpretation principles applied to instruments. Section 6(2) references section 114 of the Constitution when defining property of a State, grounding the Act’s exclusion for State property in the constitutional text.

Delegated legislation relationships: Section 8(1) requires the GEMS Regulator to specify fees by legislative instrument. The Act does not set out parliamentary scrutiny or disallowance for those instruments; it simply imposes an instrument-making requirement. Section 10 authorises regulations by the Governor-General for matters necessary or convenient to carry out the Act. Consequently, the Act relies on secondary legislation and instruments for operational detail, placing significance on the content of those instruments and any regulations as the operative legal sources for fee amounts, methods, payment processes and potentially enforcement.

Administrative law overlay: The Regulator’s exercise of power under s8(1) and s9 is subject to the limits in this Act and to general administrative law principles; instruments exceeding the boundaries of s9(2) would be susceptible to challenge on the basis they go beyond authorised considerations. The Act itself does not list internal review avenues or merits review rights; such review rights, if any, will be found in the GEMS Act or other administrative law provisions.

Interaction with State property immunity: Section 6(1) provides that the Act does not impose a tax on property belonging to a State. That clause interacts with constitutional limits under section 114 of the Constitution, as noted in s6(2). Any attempt to apply registration fees characterised as a tax against State-owned property will be constrained by this provision; the Act signals that the Commonwealth intends not to infringe the constitutional protection against taxation of State property.

Original enactment and commencement: The Act was assented to on 21 September 2012. The commencement table in s2 specifies that sections 1 and 2, and any provision not otherwise covered by the table, commenced on 22 September 2012 (the day after Royal Assent). Sections 3 to 10 commenced at the same time as section 3 of the Greenhouse and Energy Minimum Standards Act 2012, which the table records as 1 October 2012. The table contains a note that it relates only to the provisions as originally enacted and will not be amended to reflect later amendments of the Act.

No amendments recorded in the text provided: The copy of the Act supplied contains only the original enactment text and commencement table. There are no subsequent amendment provisions, schedules, or notation of later amendments in the version of the Act provided. The Act’s own commencement note states that the table will not be amended to deal with later amendments; the current source therefore reflects the Act as originally enacted.

Implication for practitioners: Because the Act relies on legislative instruments and regulations for operational detail, most practical changes to fee levels or fee methods will occur by instruments and regulations made under this Act rather than by frequent statutory amendment of the Act itself. Any statutory amendments altering the constraints in s9(2), the instrument-making power in s8(1), or other structural features would require formal amendment of this Act. The provided text shows no such amendments.

Record-keeping and versions: The Act’s own commencement table clarification in s2(2) states that any information in column 3 is not part of the Act and that it may be edited in published versions. This indicates that published versions may contain editorial metadata but that the statutory text is as shown. Practitioners should ensure they consult authorised, up-to-date versions and check for any later amendments or instruments made under the Act that are not present in the provided text.

No litigation or case law recorded in the source: The text provided contains no references to litigation, court decisions, or legal challenges arising under this Act or to the legislative instruments made under it. The Act itself names no cases and the second reading speech is cited only as having been made; there is no judicial history contained in the source material.

Potential legal challenge avenues implied by the Act: While the supplied text does not record litigation, the Act’s structure implies possible legal issues that could, in principle, give rise to challenges. Examples include whether a legislative instrument respects the statutory constraint in s9(2) by taking into account only the permitted matters when specifying amount or calculation methods; or disputes over the Regulator’s exercise of waiver or refund powers as noted to be in s64 of the GEMS Act. Those are logical potential points of contestation given the Act’s framework, but the source text does not contain any reports of litigation or outcomes.

Record for practitioners: Because the Act delegates fee-design to legislative instruments, litigation is more likely to engage the content or application of particular instruments, the Regulator’s exercise of discretion, or interplay with the GEMS Act, rather than the text of this short Act itself. Practitioners should therefore examine any relevant legislative instrument and the GEMS Act for administrative decisions, procedural fairness, or statutory interpretation disputes, but there is no litigation history provided in the Act text to assess.

Limited fee-basis window: Section 9(2) is prescriptive; when the GEMS Regulator specifies amounts or calculation methods the Regulator may take account only of the cost of processing registration applications and the cost of compliance monitoring, including testing (s9(2)(a)-(b)). That narrow list excludes other commonly considered factors such as policy cost recovery beyond processing and testing, contributions to general programme overhead, or revenue raising to fund unrelated regulatory functions. Fee instruments that implicitly or explicitly rely on other bases may be vulnerable to legal challenge for exceeding the Act’s authorised considerations.

Multiple fees per application: Section 8(3) expressly allows two or more registration fees to be specified for a single registration application. Practitioners should anticipate that a single application covering multiple models or product classes can attract several fee line items. The example in s8(3) makes that explicit. Applicants must read the legislative instrument carefully to determine whether fee items will be applied per model, per class, or by another unit of account.

Characterisation as taxes: The Act expressly states that registration fees are imposed as taxes (s8(2)). That legal characterisation may affect accounting treatment, the appropriations framework, or interactions with taxation and public finance rules. It may also intersect with constitutional constraints relating to State property in s6. Users should not treat these fees as mere user charges without considering the tax label embedded in the Act.

Waiver and refund not in this Act: The Act’s note to s8 reminds readers that the GEMS Regulator may waive, reduce or refund fees under s64 of the GEMS Act. Practically, that means relief mechanisms exist but are governed by the separate GEMS Act; a search limited to this Act will not reveal the criteria or procedures for relief. Applicants should check s64 of the GEMS Act and any related policies or instruments to understand relief pathways.

Legislative instrument detail: The Act delegates the specification of fees to a legislative instrument (s8(1)) and allows methods of calculation (s9(1)(b)). This enables complex or formulaic fee regimes, which can reduce transparency if not clearly drafted. The Act does not mandate consultation or explanatory requirements for the instrument within its text. Consequently, the instrument’s drafting quality is pivotal to predictability and compliance.

No collection or penalty mechanics in the Act: Because the Act does not set payment procedures, collection mechanics, timing, interest or penalty provisions, practitioners must consult the GEMS Act, the legislative instrument, and any regulations for operational details. Assuming collection procedures from this Act alone would be mistaken.

Identify whether you are an applicant: The Act makes registration fees payable in relation to registration applications as defined by reference to s41 of the GEMS Act (s7(1)). Step one for any person or entity is to confirm whether their activity triggers a registration application under the GEMS Act. If so, they will be within the scope of the fee regime authorised by this Act.

Examine the legislative instrument: Because the GEMS Regulator specifies registration fees by legislative instrument (s8(1)), the precise fee amounts and any calculation methods will be set out in that instrument. Obtain the current instrument and read: (a) the defined units of charging (per application, per model, per product class), (b) whether the fee is a fixed amount or formula-based (s9(1)), and (c) any special provisions for electronic filing or other differentiators (s8 examples). The instrument will set the practical obligations for payment.

Calculate fees according to the instrument: The Act permits fees to be prescribed either as amounts or by methods (s9(1)). If the instrument specifies a method, apply that method carefully; the method may include parameters such as number of models, tests required, or filing modes. Remember the Act allows multiple fees for a single application (s8(3)), so aggregate obligations may arise; calculate total fees before filing.

Check for waiver or refund pathways: The Act notes that the GEMS Regulator may waive, reduce or refund fees under s64 of the GEMS Act (note to s8). Before paying, or if the fee imposes hardship or is otherwise contestable, consult s64 of the GEMS Act and any guidance documents to determine whether a waiver or refund is available and the required procedure to apply.

Account for classification and filing method effects: The examples in s8 indicate the instrument might set different fees for different product classes or for electronic versus non‑electronic filing. Confirm how your products are classified and whether electronic submission channels are treated favourably or unfavourably; filing method may alter the fee liability.

Prepare for compliance monitoring costs: Section 9(2)(b) allows the Regulator to take into account the cost of compliance monitoring, including testing, in setting fees. If the instrument includes test-related fees or passes testing costs through to applicants via fee design, budget for testing or monitoring costs that may be attributed to your models as part of the fee structure.

Monitor commencement and regulatory changes: The fee‑setting power under this Act commenced alongside the GEMS Act (s2 table). However, fee levels and methods can change by subsequent legislative instruments or regulations made under s10. Regularly monitor the Federal Register of Legislative Instruments and the GEMS Regulator’s website for new instruments and regulations to ensure you are paying the current fee schedule.
