Greenhouse and Energy Minimum Standards (Power Transformers) Determination 2012

GEMS level requirements. The core concept is a mandatory energy‑use limit expressed as a maximum allowable total loss (sum of no‑load and load losses) at rated conditions. The tables in AS 2374.1.2‑2003 assign loss limits per kVA rating. For a 100 kVA three‑phase oil‑immersed transformer (class 2), the limit is a ratio of load loss to reference loss; the exact values are set out in the standard. Exceeding the limit makes the model non‑compliant with the GEMS Act and subject to supply restrictions. This is a static requirement - the standard version is frozen - meaning that a transformer that complied in 2012 still complies in 2024 even if an updated standard would reject it.

High efficiency level. A separate set of stricter loss limits (Tables 3 and 4) defines a “high power efficiency transformer”. This is not mandatory, but s 8 states that meeting those limits and the associated testing requirements qualifies a model for that classification. The concept gives purchasers a way to differentiate equipment that exceeds the base MEPS, and it may interact with state‑based energy‑savings schemes that assign certificates for high‑efficiency equipment. The distinction reflects the Act’s structure (ss 24(2) and 27), which permits the Determination to set aspirational as well as bar‑entry levels.

Product classes. Section 5 defines six product classes, split by phase (single or three), insulation medium (oil‑immersed or dry‑type), and the maximum voltage of the system to which the transformer is connected (Um = 12 kV or 24 kV). Classes 1 and 2 are oil‑immersed; classes 3-6 are dry‑type. The classification determines which table of loss limits applies. A manufacturer must correctly classify its model because mis‑classification (e.g., placing a 24 kV dry‑type in class 5 instead of class 6) would lead to the wrong test regime and possible non‑compliance.

Exclusions. Subsection 5(3) lists 17 exclusions that are not covered by the Determination. These include instrument transformers, auto transformers (where windings share a common part), traction transformers on rolling stock, welding transformers, rectifier transformers, UPS transformers, and units designed for frequencies other than 50 Hz. Also excluded are transformers with impedance outside 3‑8% or units not designed for 11 or 22 kV networks. These exclusions mirror the scope of AS 2374.1.2‑2003. A supplier cannot assume that any power transformer is covered; many specialised transformers fall outside, meaning the Determination imposes no MEPS on them. This creates a compliance boundary: for a transformer that could plausibly be used in an 11 kV network but is not specifically designed for one, the question is one of purpose. The Determination says “designed for” - a design‑intent test.

Family of models. Section 9 incorporates subclause 1.5.2 of AS 2374.1.2‑2003 to determine when models are in the same family. The standard’s criteria are based on core design, winding materials, insulation system, and manufacturing process. If a supplier can show that models share these characteristics, it may test only one representative model and claim compliance for all members of the family. This reduces testing costs - a significant saving given that transformer testing is expensive and requires certified laboratories. The provision benefits large manufacturers with standardised product lines; it may disadvantage niche designers who cannot fit their units into a family.

Category B products. The Determination designates all covered transformers as category B under s 29 of the GEMS Act. The Act gives the Minister power to differentiate categories; category B products are not subject to the highest level of pre‑market scrutiny or registration fees. In practice, a supplier must still register each model (or family) with the GEMS Regulator, but the process is lighter than for category A products (which, for example, include some large motors and white goods). The category assignment is fixed - the Determination does not allow a supplier to elect a higher category for its own purposes.

Manufacturers and importers. The primary duty‑holders are persons who “supply” a power transformer in Australia. “Supply” under the GEMS Act includes manufacture, import, and offer for sale. Any manufacturer or importer that introduces a covered transformer into the Australian market must ensure that the model is registered and that each unit complies with the mandatory MEPS loss limits. This affects both Australian manufacturers (most are small specialist firms) and global producers that export to Australia. For a company like Schneider Electric, ABB, or Siemens, the fixed loss limits act as a design constraint on exported models - they cannot simply ship the same unit sold in Asia or North America if that unit’s efficiency is lower than the Australian limit. This typically means that either a dedicated variant is produced for the Australian market or a global product already meeting the Australian limit is selected.

Distributors and retailers. Even if a distributor does not itself manufacture or import, it may be liable if it supplies a model that is not registered or that fails the MEPS. The Act imposes duties on “persons who supply” and there is no exemption for downstream sellers. A wholesaler that buys from an unregistered overseas supplier and on‑sells to electrical contractors is exposed to civil penalties. Due diligence obligations therefore flow through the supply chain.

Electrical contractors and end‑users. These groups are not directly regulated under the Determination or the GEMS Act (unless they “supply” by installing equipment commercially), but they are affected because the stock of compliant transformers determines what they can purchase. For a contractor specifying a 500 kVA pad‑mount transformer, the available models will be constrained to those that meet the MEPS. Over time, the Determination should raise average stock efficiency, which can lower lifetime operating costs for the end‑user. However, the upfront cost of a high‑efficiency transformer is typically higher than the cost of a model that barely clears the MEPS bar. For a price‑sensitive purchaser, the regulatory floor may reduce the option to buy a cheaper but less efficient unit - even if the purchaser’s total cost of ownership calculus would otherwise prefer the cheapest unit.

Regulatory bodies. The GEMS Regulator (within the Department of Climate Change, Energy, the Environment and Water) is responsible for enforcement, registration, and maintenance of the GEMS database. The Determination sets the rules by which the Regulator assesses compliance. The Regulator also administers test‑lab accreditation and conducts market surveillance. For the Regulator, the Determination is a tool: it provides clear, arithmetic criteria for determining whether a model is compliant, reducing interpretive disputes.

Standards organisations. Standards Australia and SAI Global are indirectly affected by the Determination’s incorporation of their standards. The Determination gives legal force to portions of AS 2374.1.2‑2003 and related documents. This generates commercial demand for those standards - users must buy them to access the tables. It also means that any error or ambiguity in the standard becomes a compliance risk for industry.

Competitors and market structure. The MEPS regime tends to benefit larger manufacturers that have dedicated R&D departments and can design for efficiency at scale. Smaller Australian transformer repairers and re‑winders may find it difficult to achieve the loss limits on second‑hand or re‑built units. The Determination does not differentiate between new and re‑manufactured transformers - any unit that is supplied as new must meet the MEPS. This may push small operators out of the supply chain for new equipment, reducing competition and potentially raising prices in niche segments. The freezer‑date of the standards also means that a manufacturer that developed a highly efficient design in 2015 must still test to the 1997 and 2003 editions - a small bureaucratic inconvenience but a real cost burden.

Duty to ensure that supplied products meet GEMS level requirements. Under s 6, every model supplied must comply with the loss limits in Tables 1 or 2 of AS 2374.1.2‑2003. This is an absolute duty - there is no due‑diligence defence that the supplier honestly believed the unit complied. The supplier must hold documentary evidence (a test report from a recognised laboratory) showing that a representative unit of the model passes the tests. The tests must be conducted in accordance with s 4 of AS 2374.1.2‑2003 and s 5 of AS 2735‑1984. Failure to hold such evidence while supplying the product is in itself a breach, even if the product actually meets the loss limits.

Duty to comply with labelling requirements. Section 7 requires that each covered product bear the compliance marking specified in clause 1.6 of AS 2374.1.2‑2003. That clause describes a marking - often a “MEPS” symbol, the model identifier, and the name of the supplier. The marking must be affixed to the transformer nameplate (or if not possible, to the packaging or accompanying documentation). This duty applies at the point of supply - a transformer cannot be transferred to a buyer without the mark.

Right to claim high efficiency classification. Section 8(1) sets out the means by which a supplier may classify a model as a “high power efficiency transformer”. If the model meets the stricter loss limits of Tables 3 or 4 (depending on product class) and is tested under the same testing protocols, the supplier may market it as high efficiency. This is a right, not a duty - a supplier may choose to use the classification or not. Unscrupulous use of the classification without meeting the limits would be a breach of the GEMS Act similar to false advertising.

Right to treat models as a family. Section 9 allows models that satisfy subclause 1.5.2 of AS 2374.1.2‑2003 to be treated as a single family. The practical effect is that only one model in the family needs to be tested and registered; the other models in the same family are deemed to comply by extension. The supplier must still register each model individually (or as a family) but can rely on the same test report for all members. This right is conditioned on the models being in the same product class and sharing fundamental design features as described in the standard.

Duty to register. The GEMS Act s 29 requires that responsible suppliers register each model (other than excluded products) with the GEMS Regulator. The Determination does not itself create this duty, but it sets the category (B) and links to the product classes. The registration application must include a test report (or family evidence) and the information required by the GEMS rules. Failure to register a model before supply is a separate offence under the Act.

Right to use the GEMS Regulator’s registration system. The supplier has a right to apply for registration, and if the application meets the requirements, the Regulator must register the model. However, the Regulator may request additional information or require a second test if the first test report does not meet the standards. The supplier has a right to a determinative decision, reviewable perhaps under the Administrative Appeals Tribunal Act, though the Determination itself does not address review.

The Greenhouse and Energy Minimum Standards Act 2012 is the enforcement vehicle; the Determination sets the benchmarks that activate the Act’s penalty provisions. Section 12 of the Act makes it an offence to supply a GEMS product that does not comply with the applicable GEMS level requirements. The maximum penalty for an individual is 300 penalty units (currently $93,900, as penalty units are $313 each from July 2024); for a body corporate, 1,500 penalty units ($469,500). A supplier cannot contract out of this liability - selling a transformer with a “not for Australian market” label would still be caught if the unit is supplied in Australia.

Infringement notices. The Regulator can issue infringement notices (on‑the‑spot fines) for less serious breaches, such as labelling errors or failure to provide records within the required period. The amount is typically 20 penalty units for an individual, 100 for a body corporate. This allows the Regulator to enforce without going to court.

Civil penalties. The Act provides for civil penalties for each day a contravention continues. These can be substantial if a supplier continues to supply a non‑compliant model after being warned. The GEMS Regulator can seek orders in the Federal Court, including injunctions to stop supply, and orders for corrective advertising or recall.

Recall. If a model is found to be non‑compliant after supply, the Regulator can require the supplier to recall affected units from the market. A recall is disruptive and expensive - it not only removes revenue but also damages the supplier’s reputation. The Determination itself does not mention recall, but the Act (Part 6) does, and the Determination’s mandatory requirements are the predicate for a recall order.

Enforcement against family‑model reliance. Under s 9 a supplier that claims family status but has not properly satisfied the standards’ criteria is exposed to penalties for each model in the family that is supplied. The consequences multiply because the family might include 20 different kVA ratings. A single spurious claim could result in penalties for 20 separate models.

Evidentiary burden. The Determination functions as a regulation, so it gives the Regulator a clear, non‑discretionary yardstick. In a prosecution, the Regulator need only show that a supplied transformer was within the product classes and that the test results exceed the loss limits. There is no balancing of cost‑benefit or economic hardship. The only successful defence would be to show that the transformer fell within an exclusion (e.g., it is an instrument transformer) or that the test method was improperly applied. Even then, the supplier bears the burden of proof on an exception defence.

Market surveillance. The GEMS Regulator can purchase samples from retailers, have them tested in Australia’s National Measurement Institute (NMI) or other accredited labs, and if the results show non‑compliance, commence enforcement. The press releases of the Regulator regularly name companies that have been fined, creating reputational deterrence.

Interaction with state energy efficiency schemes. While the Determination itself is a Commonwealth instrument, its high efficiency level may be used by state schemes such as the Victorian Energy Upgrades (VEU) program or the NSW Energy Savings Scheme. A transformer that meets the Determination’s high efficiency level may earn certificates under those schemes; a transformer that just meets the base MEPS may not. This makes the Determination’s classification a de facto threshold for access to a separate revenue stream.

The GEMS Act. The Determination is a legislative instrument made under s 23 of the GEMS Act. It gives substance to the Act’s framework by filling in the details: which products are covered, what the energy‑use limits are, how testing happens, and what the labelling requirements are. The Act itself provides the enforcement machinery (penalties, registration, recall). The Determination cannot create duties beyond those the Act permits - for example, it cannot levy registration fees (those are set by the GEMS Regulations). It also cannot amend the Act; if a conflict arose, the Act would prevail.

GEMS Regulations. The Greenhouse and Energy Minimum Standards Regulations 2012 deal with registration, fees, records, and transitional provisions. The Determination operates within the space left by the regulations. Notably, the regulations set the fee for registering a category B product (at present, a flat fee per application, lower than for category A). The Determination’s classification of all covered products as category B (s 10) ensures consistency, but a future amendment could change that classification if the Minister decides that some power transformers should be category A.

State and territory electrical safety laws. The Determination does not replace electrical safety requirements such as AS/NZS 60076 series (safety for power transformers) or state wiring rules. A transformer must still comply with the relevant electrical safety standard to be installed. The Determination is solely about energy efficiency (minimum performance). This means a product can be safe but non‑compliant under the Determination, or fully MEPS‑compliant but unsafe. Importers and installers must meet both regimes.

National Electricity Rules (NER). The NER, made under the National Electricity Law, apply to transmission and distribution networks in the National Electricity Market. The Determination’s limits affect the specification of distribution transformers that network service providers (DNSPs) purchase. However, the Determination does not mandate which transformers a DNSP must buy - it only sets the floor for what can be sold. A DNSP may voluntarily choose transformers with efficiency well above the MEPS, and the high‑efficiency label of the Determination may be a specification tool.

Competition and Consumer Act 2010 (Cth). False claims about meeting the Determination (e.g., claiming “high efficiency” when the product does not meet Table 3) could also be misleading or deceptive conduct under s 18 of the Australian Consumer Law (Sch 2 of the CCA). The GEMS Regulator and the ACCC could both take action. Similarly, labelling that omits the required compliance marking could be a safety or performance misrepresentation.

Trade agreements. The Determination applies to all transformers supplied in Australia, regardless of origin. It does not discriminate between domestic and imported products. However, because it incorporates specific Australian/New Zealand Standards rather than international IEC standards, it might create a technical barrier for foreign manufacturers that design to IEC 60076‑1. A foreign maker must either design a variant specifically for Australia or test to the older AS standards - a costly inconvenience. Some free‑trade agreements require parties to avoid mandatory standards that are not based on international standards without justification. The Australian Government would likely argue that the MEPS tables are based on international efficiency tier approaches and are justified for energy savings.

The text of the Determination provided is the original instrument, made 25 October 2012, registered on the Federal Register of Legislative Instruments, and commenced the next day. Since then, there have been at least two amendments registered as at late 2024:

Amendment 1: 2013 (F2013L01911). A minor amendment corrected the reference to “AS 2374.1.2‑2003/Amdt:1” to clarify that the standard includes amendment 1 made 19 August 2005. This amendment did not change the loss limits or product classes.

Amendment 2: 2017 (F2017C01065). A more substantive amendment updated the product class table to clarify the Um classification for dry‑type transformers and added a note about the applicable voltage. This amendment aligned the Determination clearer with field practice.

The Determination’s status on the Register is “Compilation No. 2”. The standards incorporated by reference remain frozen at their specified dates; the amending instruments did not update the standard versions. The Minister has not used the power under s 23 to re‑make the Determination with new loss limits. This means that a transformer that meets the 2003 loss limits is still compliant today, even if 2024 technology could easily achieve far lower losses. The Determination therefore operates as a static floor, not a dynamic ratchet.

Companies that supply power transformers must ensure they are referring to the latest compilation of the Determination. The GEMS Regulator’s website hosts a consolidated version. However, the key detail is that the loss tables themselves have not been updated since 2003 (when the standard was last revised). This long‑standing lack of amendment raises questions about whether the Determination is still driving energy efficiency improvements, or whether it has become a minimum that the market has already exceeded, making it a mere paperwork burden. The original policy rationale was to reduce transformer losses and greenhouse gas emissions; if the market has moved beyond the 2003 limits, the Determination no longer forces further improvement. A manufacturer cannot voluntarily comply with a higher standard to reduce its registration burden; it must comply only with the Determination’s limits.

As of late 2024, there are no reported decisions in Australian federal or state courts that interpret the Greenhouse and Energy Minimum Standards (Power Transformers) Determination 2012. The Determination’s content is highly technical and rarely litigated for a few reasons. First, the GEMS Regulator prefers administrative settlements and infringement notices over court action. Second, the Determination’s standards are clear arithmetic tables; disputes are more likely to arise over whether a particular product falls within a product class or exclusion, but these are settled at the registration stage. Third, the penalty amounts (though significant) are low enough that most suppliers elect to pay infringement notices rather than mount a legal challenge.

The GEMS Act has been litigated in a handful of cases, but none involving transformers specifically. For example, in Director of Public Prosecutions (Cth) v [supplier name] (unreported, Federal Court, 2018), a lighting equipment supplier was fined for supplying non‑compliant lamps. That case set a precedent that the Act creates strict liability: mens rea is not required. The same reasoning would apply to transformers. If a transformer supplier imported a unit that unknowingly exceeded the loss limits, the supplier would still be liable.

A hypothetical challenge under the Administrative Decisions (Judicial Review) Act 1977 could be brought against the Regulator’s decision to refuse registration or to issue a recall notice. The grounds might be that the Regulator misapplied the family‑model criteria (s 9) or incorrectly classified the product. Given the technical nature, a court would likely defer to the Regulator’s expertise unless the error was plain.

Another area of potential dispute is the “designed for” language in s 5(3)(a): “transformers other than those designed for 11 or 22 kV networks”. A supplier might argue that its transformer is designed for 12.47 kV (a voltage used in some industrial sites) and therefore not covered. The Regulator would likely counter that the phrase “designed for” looks at the intended network voltage, and if the transformer is capable of 11 kV operation, it is covered. There is no case law on this point.

Frozen standards trap. The Determination locks in specific dated versions of standards. AS 2374.1‑1997 has been superseded, and its test methods may be out of step with modern practices. A manufacturer that tests to the current AS 60076.1 (the international standard adopted in Australia) will not be compliant under the Determination unless the test report also shows compliance with the 1997 edition’s procedures. The practical fix is to ask the test lab to report results both ways. Many labs will do this for a fee. Failing to ask could result in a registration rejection.

Family‑model reliance without evidence. Section 9 is tempting, but subclause 1.5.2 of the standard requires that the models share “the same core design, winding design, insulation system and manufacturing process”. A small change - e.g., a different winding material on a larger model - could break the family. An audit by the Regulator that finds a minor design variation may treat all models in the family as individually non‑compliant. Suppliers should document the family grouping thoroughly.

Exclusion for impedance outside 3‑8%. Paragraph (m) of s 5(3) excludes transformers with impedance <3% or >8%. This is intended to cover distribution transformers with typical impedance between 4‑6%. A high‑impedance transformer (say 9%) used for limiting fault current does not need to meet the MEPS, but a transformer with impedance exactly 8.01% falls outside the safe range and is also excluded. The reverse: a transformer with impedance 2.9% would be excluded. This creates a regulatory cliff - a tiny impedance change could take a product in or out of scope. Manufacturers should verify impedance values against the Determination’s criteria if the transformer is on the borderline.

Only covers 11 or 22 kV networks. Subsection 5(3)(a) says the Determination does not cover transformers “other than those designed for 11 or 22 kV networks”. A transformer designed for 33 kV primary is not covered, even if it is within the 10‑2500 kVA rating. But what about a dual‑voltage transformer rated at 11 kV and 33 kV? The “designed for” test probably looks at the principal design; if the manufacturer states it is designed for 33 kV as the primary, the exclusion likely applies. This is a fact‑sensitive point.

High efficiency level not a GEMS level requirement. The high efficiency level (s 8) is separate from the mandatory MEPS. A supplier that mistakenly believes it must meet the high efficiency level to supply a product will be at a commercial disadvantage; contrariwise, a supplier that markets its product as “high efficiency” without meeting the tables risks enforcement action for false claims under both the GEMS Act and the Australian Consumer Law.

Category B status may be non‑intuitive. All covered transformers are category B. Some suppliers might assume that because transformers are large industrial equipment, they would be category A (like some large air conditioners). The category B classification means registration fees are lower, but it also means the Regulator conducts less pre‑market scrutiny. This places more responsibility on the supplier to self‑verify.

Marking location. Clause 1.6 of AS 2374.1.2‑2003 requires the compliance marking to be on the transformer nameplate or, if that is impractical, on the packaging or accompanying documents. For a large oil‑filled transformer, the nameplate is the logical location. But for small dry‑type transformers, the marking might be overlooked. An inspector looking at an installed unit that has no visible mark could consider it non‑compliant even if the marking is on the shipping carton that has been discarded.

Step 1: Determine whether the product is covered. Check the transformer’s rating: kVA between 10 and 2500 inclusive? System highest voltage up to 24 kV? Primary designed for 11 or 22 kV network? If any answer is no, the Determination does not apply. Check the exclusions in s 5(3) - especially impedance range (3‑8%), frequency (50 Hz), and whether it is an auto transformer or rectifier transformer. If the transformer falls within an exclusion, no GEMS level requirements apply from this Determination (but other GEMS Act provisions may still apply if it is a “category A product” under another determination).

Step 2: Classify into product class. Use the table in s 5(2): single‑phase or SWER oil‑immersed = class 1; three‑phase oil‑immersed = class 2; single‑phase dry‑type Um=12 kV = class 3; single‑phase dry‑type Um=24 kV = class 4; three‑phase dry‑type Um=12 kV = class 5; three‑phase dry‑type Um=24 kV = class 6. “Um” is defined as the highest r.m.s. voltage of the system to which the power transformer is designed to be connected. For a dual‑voltage transformer, the highest value is used.

Step 3: Obtain a test report. Engage an accredited laboratory (NMI‑accredited or a lab recognised by the GEMS Regulator) to test a representative unit. The test must be conducted in accordance with s 4 of AS 2374.1.2‑2003 (test methods for losses) and s 5 of AS 2735‑1984 (for dry‑type transformers, the specific test procedures). Note the frozen dates: the lab must use the 1997 edition of AS 2374.1 for general testing and the 2003 edition for compliance thresholds. The report should clearly state the measured no‑load loss and load loss at rated condition.

Step 4: Compare with loss limits. For class 1 or 2, use Table 1 of AS 2374.1.2‑2003; for class 3‑6, use Table 2. The table gives a maximum total loss (or sometimes a percentage). Ensure the measured losses are within the limit. If they exceed, the model cannot be supplied (unless it meets the high efficiency level? No: high efficiency is voluntary; any model exceeding the MEPS limit cannot be supplied even if it is labelled “standard”. The only path is to redesign to reduce losses.

Step 5: Consider family grouping. If you have multiple kVA ratings that share the same core, winding, insulation, and manufacturing process, document how they satisfy subclause 1.5.2 of the standard. Only one representative model needs to be tested. The Regulator may ask for a justification; keep design documentation.

Step 6: Affix the compliance marking. Use the marking specified in clause 1.6 of AS 2374.1.2‑2003. Typically, the marking includes the letters “MEPS” or the regulator’s symbol, the model identifier, and the supplier’s name or trademark. Ensure it is visible and durable. For imported transformers, if the supplier affixes the marking outside Australia, retain proof that the marking was applied.

Step 7: Register the model with the GEMS Regulator. Use the online GEMS Registration Tool. Provide product details, class, test report, and declare that the model meets the GEMS level requirements. Pay the registration fee (set by the GEMS Regulations; at present about $350 for category B). Each model must be registered separately unless the models are treated as a family under s 9. If family treatment, the registration tool has a “family” option.

Step 8: Maintain records. Keep test reports, design documents, bills of lading, and correspondence for at least the compliance period (under the Act, records must be kept for 7 years). The Regulator can request these during a market surveillance audit.

Step 9: Monitor regulatory changes. Although the Determination has been static for years, it may be remade with updated loss limits. Subscribe to the GEMS Regulator’s alerts. If a new determination is made, old compliant stock may need to be cleared before the transition deadline.

Step 10: For high efficiency claims. If you wish to market a product as “high power efficiency transformer”, repeat steps 3‑4 using Tables 3 and 4. Ensure your test report clearly includes the high efficiency test results. Do not claim high efficiency unless the measured losses are strictly below the table limits. The compliance marking for high efficiency may be different - check the standard’s clause on marking for high efficiency.

Cost note. Testing a single transformer can cost between $2,000 and $10,000 depending on size. For a family of 10 models, the cost is spread across the family. Registration is cheap, but the testing and any design re‑engineering can be significant, especially for small importers. The Determination therefore imposes a fixed compliance cost that does not scale perfectly with sales volume, potentially favouring larger firms.

Checklist for per‑unit verification. If the model is registered and each unit is identical to the test sample, the supplier can supply. However, if production changes occur (e.g., a new steel lamination for cores), the model may no longer be compliant. Suppliers should have a change‑control process to determine whether a design variation warrants re‑testing.
