Greenhouse and Energy Minimum Standards (Household Refrigerating Appliances) Determination 2012

The Determination relies on a small set of structural concepts and cross‑references to the Act and to specific clauses within the two incorporated AS/NZS standards. The main concepts, as used in the Determination, are these.

Specified requirements and incorporation by reference. The Determination does not itself reproduce technical test procedures or energy numbers. Instead it specifies that particular clauses of AS/NZS 4474.1:2007 and AS/NZS 4474.2:2009 are the operative requirements for the relevant provisions of the Act. For example, the specified energy use requirements are the requirements mentioned in clause 3.5 of AS/NZS 4474.2:2009 (s 6(1)). Testing procedures are specified by reference to section 2 of AS/NZS 4474.1:2007 (ss 6(2), 7(2), 8(2)). Labelling and communication requirements are the requirements in section 5 of AS/NZS 4474.2:2009 (s 7(1)).

Product coverage and classes. The Determination covers "household refrigerating appliance" as defined in s 3, and maps product classes 1 to 10 to the groupings in table 1.1 of AS/NZS 4474.1:2007 (s 5(2)). Where a term is not defined in the Act, the Regulations, or the Determination, and that term is defined in an incorporated standard, the Determination requires that the definition in the standard be used for the Determination’s purposes (s 4(1)). The Determination also freezes the applicable versions of referenced documents to those in existence on the date the Determination came into force (s 4(2)).

Exclusions. The Determination lists specific categories of products that are not covered (s 5(3)). These exclusions are concrete and volume‑based: for example, appliances with total gross volume under 60 litres designed exclusively for caravans or vehicles, portable products under 30 litres, or refrigeration that is secondary where gross volume is under 30 litres are excluded. The Determination defines "gross volume", "portable products", "total gross volume" and "wine storage cabinet" by reference to AS/NZS clauses and reproduces explanatory notes (s 5(4)).

Performance, labelling and testing triad. The Determination links three regulatory levers to the standards: (a) energy use and greenhouse gas production levels (the GEMS levels) (s 6); (b) labelling and consumer information (s 7); and (c) other product performance characteristics, such as rated volume, pull down, operating temperature performance, automatic ice‑making capacity and energy test performance requirements (s 8). For each lever, the Determination states which clause or section of the standards provides the operative requirements and which section supplies the testing method.

Families of models and product categorisation. For purposes of section 28 of the Act on families of models, the Determination delegates the test‑aggregation rule to subclause 1.6.6 of AS/NZS 4474.2:2009 (s 9). It also designates all products covered by the Determination as category A products under section 29 of the Act (s 10). The Determination therefore ties the Act’s administrative categories to the standards’ model family rules.

Copyright, availability and frozen references. The Determination records that the referenced standards are copyrighted, that full copies are available for purchase and that the versions referenced are those as they existed on the Determination’s commencement date (front matter; s 3; s 4(2)). It also cautions that referenced documents should be applied in the form current at commencement (s 4(2) and the accompanying note).

Collectively, these concepts mean that compliance is achieved by measuring, testing and labelling a household refrigerating appliance to the referenced clauses and sections of the specified AS/NZS standards, as those standards existed on the date the Determination came into force.

The Determination identifies the covered products rather than named persons. From that product focus, the economic actors affected are those who supply, import, manufacture, test or represent the covered household refrigerating appliances into the Australian market, because the Determination supplies the "specified requirements" that apply for the purposes of the named paragraphs and subsections of the Act governing energy use, labelling and performance (see ss 6-8). The Determination also states that it applies irrespective of the context in which the product is used, for example commercial use, so the commercial purchaser and operator of covered appliances are within the scope of products that must meet the specified requirements (s 5(2), note 2).

More concretely, the following classes of actors will need to consider the Determination when dealing with covered appliances:

• Suppliers, importers and manufacturers of household refrigerating appliances, because the Determination supplies the operative GEMS level, labelling and performance requirements the Act applies to such products (ss 6-8). The Determination repeatedly frames its specifications as being "for paragraphs" of the Act that address energy use, labelling and performance, thereby linking the standards to the Act’s duties.

• Test laboratories and conformity assessment bodies, because the Determination prescribes which test methods must be used: section 2 of AS/NZS 4474.1:2007 is the specified test procedure for energy and other performance measurements (ss 6(2), 7(2), 8(2)).

• Retailers and those who communicate product information to consumers, because labelling and communication requirements that will govern what information must appear on labels and in marketing material are those in section 5 of AS/NZS 4474.2:2009, as specified by the Determination (s 7(1)).

• Regulatory administrators and compliance officers acting under the Act, because the Determination provides the technical yardstick against which products are assessed under the Act’s enforcement provisions. The Determination itself points users to the Act for other defined terms and legal context (s 3 notes; s 4).

By design the Determination does not itself say "who pays" in the sense of issuing fines or levies. It supplies the technical content that front‑line duties under the Act will reference. Consequently the immediate costs imposed by the Determination will fall on the parties who must meet the technical, testing and labelling specifications: most obviously manufacturers, importers and suppliers of the covered household refrigerating appliances. Indirectly, purchasers and retailers will face product availability and disclosure changes that flow from those upstream compliance activities.

Finally, the Determination’s exclusions matter to actors who manufacture niche or specialised appliances. Excluded categories such as wine storage cabinets, stand alone ice‑makers and non‑vapour compression units are outside the Determination’s scope (s 5(3)(e)-(g)). Entities dealing primarily in excluded products will not be subject to the specified AS/NZS clauses under this Determination.

The Determination does not recite offence provisions, enforcement sanctions or procedural rights. Instead it specifies, for the purposes of particular sections and paragraphs of the Act, which technical and labelling requirements apply to covered household refrigerating appliances. The key operational duties and entitlements therefore derive from the interaction between the Determination and the Act. The Determination itself creates the following obligations or legal effects in concrete terms.

Obligation to use the specified AS/NZS provisions as the technical standard. For the Act’s paragraphs dealing with energy use and GEMS levels, the Determination makes clause 3.5 of AS/NZS 4474.2:2009 the specified energy use requirement (s 6(1)). For testing, section 2 of AS/NZS 4474.1:2007 is the specified requirement to be used when conducting tests for the Act’s relevant paragraphs and subparagraphs (s 6(2)). This means that, for the purposes of the referenced provisions of the Act, compliance is measured against the specified clauses and section of the incorporated standards.

Labelling and communication duties. The Determination identifies section 5 of AS/NZS 4474.2:2009 as the specified labelling and communication requirements for the Act’s paragraphs concerned with labelling and information (s 7(1)). The Act’s labelling duties will therefore be implemented by reference to that section of the standard. The Determination also specifies that tests underpinning the labelling obligations must be conducted in accordance with section 2 of AS/NZS 4474.1:2007 (s 7(2)).

Product performance obligations. The Determination specifies the clauses within the standards that set out product performance requirements that the Act will rely upon: general requirements (clause 3.1 of AS/NZS 4474.1:2007), rated volume (clause 3.2 of AS/NZS 4474.2:2009), pull down (3.3), operating temperature performance (3.4), automatic ice‑making capacity (3.5 of AS/NZS 4474.1:2007) and energy test performance requirements (3.7 of AS/NZS 4474.1:2007) (s 8(1)). Tests related to these performance requirements are likewise specified as section 2 of AS/NZS 4474.1:2007 (s 8(2)).

Family‑of‑models aggregation rule. For the purpose of determining when two or more models are a family of models under section 28 of the Act, the Determination points to subclause 1.6.6 of AS/NZS 4474.2:2009 (s 9). This affects when a single test result or rating may be used for multiple models within a family for compliance or labelling purposes.

Category designation. The Determination declares covered products to be category A products under section 29 of the Act (s 10). That designation will import whatever legal consequences the Act attaches to category A products; the Determination does not itself restate those consequences.

Rights and interpretative aids. The Determination provides interpretative rules for undefined terms. If a term is undefined in the Act, the Regulations, or the Determination but is defined in a referenced standard, the definition in the standard applies (s 4(1)). The Determination also fixes the applicable versions of referenced documents to those in existence at commencement, meaning parties can rely on a frozen text when determining compliance obligations (s 4(2)).

Practical legal effect. In practice, the Determination means that a person or entity required by the Act to comply with energy use, labelling or performance obligations must follow the clauses and sections specified here. Those obligations will typically manifest as duties to measure gross volume according to Appendix A of AS/NZS 4474.1:2007, to conduct energy tests under section 2 of AS/NZS 4474.1:2007, to meet the numeric or algorithmic requirements in clause 3.5 of AS/NZS 4474.2:2009 and to produce labels and communications conforming with section 5 of AS/NZS 4474.2:2009 (s 5(4); ss 6-8).

What the Determination does not do. It does not, by itself, set penalties, enforcement mechanisms, administrative processes like registration, or procedural rights and remedies. Those aspects remain governed by the Act and any Regulations made under the Act. The Determination instead supplies the technical framework that the Act’s enforcement and compliance machinery will apply to the covered household refrigerating appliances.

The Determination is silent on specific penalties and enforcement procedures. It is an instrument that specifies technical and labelling requirements "for the purposes of" specified paragraphs and subsections of the Greenhouse and Energy Minimum Standards Act 2012 (see ss 6-10). As such, the Determination functions as the technical content that the Act’s enforcement provisions will reference; the Act itself and its Regulations will need to be consulted for the nature and scale of civil or criminal penalties, administrative contraventions, seizure powers, evidentiary rules and procedural requirements.

What the Determination does provide that is relevant to enforcement:

• A single source for the technical test methods and thresholds. By designating particular clauses and sections of AS/NZS 4474.1:2007 and AS/NZS 4474.2:2009 as the specified requirements for the Act’s identified provisions, the Determination creates the measurement and labelling yardsticks that enforcement officers and courts will use to assess compliance or contravention in proceedings under the Act. For example, energy use compliance will be assessed against clause 3.5 of AS/NZS 4474.2:2009 as specified (s 6(1)). Tests must be conducted under section 2 of AS/NZS 4474.1:2007 (ss 6(2), 7(2), 8(2)).

• A clarified scope for enforcement. The Determination narrows what products fall within the Act’s reach by listing covered product classes and exclusions (s 5). Enforcement authorities therefore have a defined universe of products to inspect and test. The Determination expressly notes that it applies to household refrigerating appliances irrespective of the context in which they are used, i.e. including commercial use (s 5(2), note 2).

• A frozen technical baseline. The Determination fixes the versions of incorporated documents to those in force at commencement (s 4(2)). Enforcement will therefore be against the frozen versions of the standards, rather than later revisions, unless the Determination itself is amended.

Limitations and practical enforcement considerations deriving from the Determination text:

• The Determination references testing sections and labelling sections in the AS/NZS standards but does not itself set the process for submitting test reports, maintaining records, or providing labels to regulators. Those administrative processes must be found in the Act or in Regulations or guidance provided by the enforcing agency.

• Because the Determination relies on copyrighted standards that are not reproduced in full in the instrument, enforcement will typically require access to the referenced standards. The Determination notes availability and copyright of the standards and that full copies must be purchased (front matter and s 3 notes). This creates an evidentiary need for enforcement agencies, compliance officers, industry and courts to possess or have access to the same frozen texts.

• Where the standard refers to other "referenced documents", the Determination instructs that the applicable version is that which existed at commencement (s 4(2)). Enforcement must therefore track a potentially complex web of referenced documents and their versions as frozen at the Determination’s commencement date.

In short, the Determination supplies the technical substance that enforcement under the Act will apply, but it does not itself authorise enforcement powers or prescribe penalties. For specifics on penalties, enforcement powers and administrative processes, users must consult the Greenhouse and Energy Minimum Standards Act 2012 and associated Regulations.

This Determination is expressly framed as an instrument under the Greenhouse and Energy Minimum Standards Act 2012 and therefore interacts centrally with that Act and any Regulations made under it. The Determination is not a standalone regulatory regime; it is the technical specification that the Act’s regulatory provisions reference. The following interactions are apparent from the text.

Primary statutory interface with the Act. The Determination repeatedly states that particular clauses or sections of the AS/NZS standards are the "specified requirements" for named paragraphs and sections of the Act (for example, ss 6-8, 9-10). Consequently, the legal effect of the Determination depends on the substantive obligations, definitions and enforcement powers set out in the Act. The Determination refers to defined terms as given in section 5 of the Act (s 3 note), meaning definitions such as "category A product", "GEMS", "supply" and "model" are taken from the Act where the Act provides them. Implementation therefore requires reading the Determination alongside the Act.

Incorporation of industry standards. The Determination incorporates external technical standards by reference. That means that compliance with the Act’s requirements for household refrigerating appliances will require parties to apply AS/NZS 4474.1:2007 and AS/NZS 4474.2:2009 as frozen at commencement. The Determination also provides that, where a standard refers to other documents under a 'Referenced Documents' heading, the applicable versions are those in existence on the date the Determination commenced (s 4(2)). This interaction can create a dependency on a chain of external documents, each with its own copyright status and access model.

Copyright and statutory notice obligations. The front matter records copyright ownership by the Commonwealth and Standards Australia for parts of the Determination, and it notes that the referenced AS/NZS standards are subject to Standards Australia copyright and are available for purchase. The Determination therefore intersects with the Copyright Act 1968 in practice, because compliance will typically require acquiring or accessing copyrighted technical standards. The Determination itself notes these constraints and the route to obtain the standards (front matter and s 3 notes).

Legislative instruments regime. The Determination is a legislative instrument registered under the Legislative Instruments Act 2003 and its registration and publication will occur on the Federal Register of Legislative Instruments (note at end). That interaction means legal practitioners must check the Register for the instrument's registration details and any later amendments or repeal instruments.

Interplay with technical or electrical safety laws. The Determination limits its scope to energy, labelling and performance requirements and expressly excludes products that cannot connect to standard mains supplies or that use non‑vapour compression cooling (s 5(3)(d) and (e)). It does not displace electrical safety requirements, equipment standards or other regulatory regimes. Parties should therefore consider other regulatory obligations, such as electrical safety approvals, electromagnetic compatibility requirements or consumer product safety laws, in addition to the GEMS/Determination requirements. Those other regimes are not discussed in the Determination but will operate alongside it.

Regulatory change management. Because the Determination freezes the applicable versions of the referenced standards at commencement (s 4(2)), there is a statutory lock‑in to the specific wording and references that existed on the date the Determination came into force. Subsequent changes to the AS/NZS standards or to referenced documents will not automatically change the Determination’s requirements. Any update to the technical requirements arising from later standards would require amendment of the Determination.

Overall, the Determination operates as a bridge between the procedural and enforcement architecture of the Greenhouse and Energy Minimum Standards Act 2012 and the technical content of industry standards. Practitioners must therefore use the Determination and the Act together, and secure access to the specified versions of the standards and any directly referenced documents.

The instrument text supplied contains no amendment record beyond its initial making. The Determination itself was made by Mark Dreyfus, Parliamentary Secretary for Climate Change and Energy Efficiency, under section 23 of the Greenhouse and Energy Minimum Standards Act 2012 and is dated 25 October 2012 (front matter). Section 2 provides that the Determination "comes into force on the day after it is registered", which is the standard commencement rule for many legislative instruments.

Key points from the Determination relevant to amendment history and status:

• Single‑issue origin. The Determination is a single instrument that identifies the two AS/NZS standards and specifies which of their clauses and sections apply to the Act’s named paragraphs and sections (ss 3-10). It therefore stands as the 2012 technical specification for household refrigerating appliances under the GEMS regime.

• Frozen reference date. The Determination fixes the applicable versions of the referenced standards to those "as they existed on the date this Determination came into force" (s 3 definitions and s 4(2)). The instrument’s initial text records the included amendments to the two standards that are specifically captured: AS/NZS 4474.1:2007 includes amendments up to and including Amdt 2:2011 made on 31 March 2011; AS/NZS 4474.2:2009 includes amendments up to and including Amdt 1:2011 made on 28 March 2011 (s 3 notes).

• No subsequent amendments recorded in this text. The copy provided contains no later amending instrument, no expiry, and no notation of revocation. Users must check the Federal Register of Legislative Instruments for any later instruments that amend, revoke or replace this Determination, as the Determination itself reminds readers that legislative instruments and compilations are registered on that Federal Register (closing note).

• Process for change. Because the Determination is an instrument made under s 23 of the Act, any amendment or replacement would require a further legislative instrument made under the Act’s provision for Determinations. The Determination does not provide a mechanism for updating its incorporated standards automatically; amendment requires a new instrument.

If you need a definitive amendment history, consult the Federal Register of Legislative Instruments and the Commonwealth Law database for instruments that may have amended or repealed this Determination after its original registration date.

The Determination text supplied contains no references to litigation, cases, judicial decisions or disputes relating to this instrument. It does not cite any case law, nor does it record that it has been subject to challenge in any tribunal or court. The Determination is a technical instrument that incorporates external standards; any litigation that might arise would likely involve interpretation of the incorporated standards, the Act’s substantive covenants, or disputes about compliance testing and labelling. None of those matters are reflected in the instrument text provided.

Given the absence of litigation references in the Determination, practitioners seeking litigation history should search:

• Federal courts and administrative tribunal databases for cases that reference the Greenhouse and Energy Minimum Standards Act 2012 together with the Determination or its specified AS/NZS clauses.

• Decisions or compliance notices issued by the agency responsible for administering the Act, which may be published separately.

• The Federal Register of Legislative Instruments and any associated registers for notices of enforcement actions or public guidance that might record compliance activity.

This Determination’s text does not supply litigation outcomes, precedent or summaries of disputes. Any assertion about litigation or applicability in a contested setting would require external case research beyond the instrument itself.

The Determination is short and precise but contains several practical traps and implementation‑sensitive points that practitioners and compliance teams should note. These are drawn strictly from the Determination text and the way it incorporates external documents.

Frozen standard versions. The Determination applies the AS/NZS standards as they existed on the date the Determination came into force and names specific amendments included at that time (s 3 and s 4(2)). That means subsequent editions or amendments to AS/NZS 4474.1 or 4474.2 will not alter the Determination’s requirements unless the Determination itself is amended. Practitioners must therefore apply the frozen versions, not the latest available version of the standards.

Referenced documents versioning. Clause s 4(2) specifies that where a standard refers to other documents under a 'Referenced Documents' heading, the applicable version of those documents is the version that existed on the date the Determination came into force. Compliance therefore requires tracing chains of referenced documents and ensuring the correct historical versions are used for testing and labelling. This can be onerous where referenced documents are numerous or where changes to referenced documents post‑commencement diverge materially from the frozen versions.

Copyrighted standards and access costs. The Determination notes that complete AS/NZS standards are available for purchase from Standards Australia and that reproduction beyond limited exceptions requires permission (front matter and s 3 notes). Compliance therefore typically requires purchasing the relevant standards, and the cost and licensing restrictions can be non‑trivial for smaller suppliers or start‑ups.

Scope exclusions determined by volume and design. The Determination excludes various product types by specific volume thresholds and design characteristics (s 5(3)). For example, caravan appliances under 60 litres, portable products under 30 litres, and devices where refrigeration is secondary under 30 litres are excluded. Mis‑classification of product volume or of "intended use" (for example a device used in both domestic and light commercial settings) could expose suppliers to compliance risk because the Determination applies irrespective of the context in which an otherwise covered appliance is used (s 5(2), note 2). The Determination relies on definitions and measuring methods in the AS/NZS standards (s 5(4)), so following Appendix A of AS/NZS 4474.1:2007 is necessary to determine gross volume.

Voltage and technology exclusions. The Determination excludes products not connectable to a 230 volt or 400 volt mains supply at 50 hertz and those that cool by technologies other than the vapour compression cycle (s 5(3)(d)-(e)). Novel technologies or products designed for alternative electrical systems may fall outside the Determination, but suppliers should document such technical differences since classification may be reviewable by regulators.

Labelling and testing are standards‑driven. The Determination does not replicate labelling or testing protocols; it points to section 5 of AS/NZS 4474.2:2009 for labelling and to section 2 of AS/NZS 4474.1:2007 for testing (ss 7(1)-(2), 6(2), 8(2)). This means the content, format and tolerances set out in those standards determine compliance. Without access to the full texts, it is difficult to be confident that labelling and test artefacts meet the legal specification.

Family of models aggregation. The rule for when multiple models are treated as a "family of models" for the purposes of the Act is delegated to subclause 1.6.6 of AS/NZS 4474.2:2009 (s 9). That subclause likely contains material rules about tolerances and permitted model variations. Misapplying the family rule can lead to improper aggregation of test results across models and thus to incorrect labelling or non‑compliance.

Category A designation. The Determination declares covered products to be category A products under s 29 of the Act (s 10). The Determination does not explain the administrative consequences of category A; these consequences must be read from the Act. Users who assume particular administrative processes or defences apply to category A should verify that assumption against the Act itself.

No standalone penalties or process. Because the Determination does not include enforcement mechanics, practitioners unfamiliar with the Act might mistakenly assume the Determination alone is sufficient to identify offences, penalties and procedural steps. It is not. The practical "gotcha" is to rely solely on this Determination when preparing compliance policies; the Act and Regulations must be considered in parallel.

In short, the key operational risks are incorrect versioning of standards, mis‑classification of covered or excluded products, the cost and practicalities of obtaining and applying copyrighted standards, and the need to map the technical specifications back to the Act’s administrative and enforcement architecture.

The Determination establishes a technical and procedural roadmap for compliance. The following pragmatic checklist sets out steps, grounded in the Determination’s text, that a manufacturer, importer, supplier, test laboratory or compliance officer should follow to determine and achieve compliance for a household refrigerating appliance.

1. Confirm whether the product is covered. Start with section 5. Determine whether the appliance fits the Determination’s definition of "household refrigerating appliance" in s 3 and whether it falls into one of the product classes 1-10 as mapped to table 1.1 of AS/NZS 4474.1:2007 (s 5(2)). Check the exclusions in s 5(3) carefully: caravan/vehicle appliances under 60 litres, portable products under 30 litres, secondary refrigeration under 30 litres, non‑230 V/400 V equipment, non‑vapour compression cooling, wine storage cabinets and stand alone ice‑makers are excluded.

2. Measure gross and total gross volume correctly. Use Appendix A of AS/NZS 4474.1:2007 as specified by s 5(4) to determine gross volumes. Many of the exclusions and class assignments turn on gross volume measurements, so ensure a laboratory or competent engineer conducts the measurement per the standard.

3. Obtain the applicable versions of the standards. The Determination requires application of AS/NZS 4474.1:2007 and AS/NZS 4474.2:2009 as they existed at commencement, including the amendments noted in s 3. Because these are copyrighted texts available for purchase, acquire the correct editions so you can apply section 2 (testing), section 5 (labelling) and the performance clauses (clause 3.1, 3.2, 3.3, 3.4, 3.5 and 3.7 as mentioned in s 8). Remember s 4(2) freezes the versions of any documents referenced by the standards.

4. Conduct tests under the specified methods. For energy use and performance testing, use section 2 of AS/NZS 4474.1:2007 as the specified test procedure (ss 6(2), 7(2), 8(2)). Use an accredited laboratory competent in the standard’s methods. Ensure test reports clearly reference the frozen version date of the standard used to generate results.

5. Verify energy use against clause 3.5 of AS/NZS 4474.2:2009. For GEMS level compliance, the Determination designates clause 3.5 of AS/NZS 4474.2:2009 as the specified energy use requirement (s 6(1)). Confirm that measured energy consumption meets the numeric or algorithmic limits in that clause.

6. Prepare labels and communications in accordance with section 5. For labelling and information duties under the Act, use section 5 of AS/NZS 4474.2:2009 as specified by s 7(1). Ensure labels include any mandated content, format and energy rating displays required by that section and that they are provided wherever the Act requires labelling (consult the Act for placement and timing requirements).

7. Apply the performance clause requirements. For other product performance characteristics referenced in s 8(1), apply the clauses listed: general requirements (clause 3.1 of AS/NZS 4474.1:2007), rated volume (3.2 of AS/NZS 4474.2:2009), pull down (3.3), operating temperature performance (3.4), automatic ice‑making capacity (3.5 of AS/NZS 4474.1:2007), and energy test performance requirements (3.7 of AS/NZS 4474.1:2007). Use section 2 of AS/NZS 4474.1:2007 for associated testing (s 8(2)).

8. Determine family of models status. If you have multiple related models, determine whether they are in the same family of models under subclause 1.6.6 of AS/NZS 4474.2:2009 as specified by s 9. This affects whether a single test result can be used to characterise multiple models.

9. Categorise product as category A. The Determination specifies covered products are category A under s 10. Check the Act for the administrative consequences of that category and comply with any related administrative or reporting duties imposed by the Act or Regulations.

10. Keep documentary evidence. Although the Determination does not itself set out record‑keeping duties, the practical path to demonstrating compliance before regulators will require retaining test reports, measurement worksheets, label proofs, procurement invoices for the standards used, and decision records for classification choices. Ensure test reports and labels explicitly cite the exact version of the AS/NZS standards used, consistent with the Determination’s frozen reference rule (s 4(2)).

11. Check for any later amendments or replacement instruments. The Determination notes that all legislative instruments are registered on the Federal Register of Legislative Instruments (closing note). Before relying on an old compliance regimen, check the Register to confirm whether this Determination has been amended, replaced or repealed.

12. Coordinate with legal and technical advisors. Because the Determination incorporates technical standards and interacts with the Act, align technical testing personnel and legal counsel to ensure that results and labels satisfy both the standards and the Act’s procedural and enforcement environment.

Costs and resource implications to expect, based on the Determination text:

• Purchase costs for the AS/NZS standards and any referenced documents, because the Determination does not reproduce the standards and indicates they are copyright material available for purchase (front matter; s 3 notes).

• Laboratory testing costs to perform tests per section 2 of AS/NZS 4474.1:2007 and to produce compliant test reports.

• Potential labelling redesign and printing costs to match the format and content requirements of section 5 of AS/NZS 4474.2:2009.

• Administrative costs for classifying products, maintaining test files, and documenting family‑of‑model decisions to withstand scrutiny.

Following this checklist and documenting each step against the specific clauses and sections cited in the Determination will materially reduce the risk of misinterpretation and provide an evidentiary trail for regulators or in dispute contexts.
