Greenhouse and Energy Minimum Standards (External Power Supplies) Determination 2014

Single output external power supply (EPS) is the central concept that defines coverage. Under section 4, a single output EPS must: have an input from mains supply (typically 110 V, 230 V, or 240 V); produce one extra low voltage output (ELV) defined as not exceeding 50 V AC or 60 V DC; be sold with or intended for a separate end use product; be in a separate physical enclosure from that end use product; be connected via a hard wired or removable electrical connection; not have batteries or battery packs that physically attach to the unit; and not have a battery chemistry/type selector switch, indicator light, or state of charge meter. This definition excludes multi output power supplies (such as those found inside desktop computers), DC-DC converters, ELV lamp transformers, therapeutic devices registered under the Therapeutic Goods Act, and battery powered equipment. The careful construction of this definition means that many power supplies that look like EPS in ordinary language are not covered. For example, a charger that has a removable battery pack is excluded, as is any unit with a battery type selector switch.

Extra low voltage (ELV) is defined in section 4 consistently with AS/NZS 4665.1:2005 subclause 1.3.7. It caps the output voltage at 50 V AC or 60 V DC. This means that power supplies with higher output voltages, such as those used for some industrial or laboratory equipment, fall outside the scope of this Determination unless specifically included by another instrument. The ELV threshold also affects the testing regime, as the standard's efficiency measurements are calibrated to typical low voltage outputs.

Product classes are fourfold under subsection 6(2), based on two binary characteristics: AC-DC versus AC-AC output, and user selectable versus non user selectable output voltage. This classification matters because the energy use requirements differ between classes. For AC-DC classes (1 and 2), both no load power and average active mode efficiency are regulated. For AC-AC classes (3 and 4), only average active mode efficiency is required. The rationale appears to be that AC-AC transformers have inherently higher no load losses, but the Determination does not explain this distinction. The classification also affects testing protocols: user selectable products (classes 2 and 4) require testing at the highest and lowest output voltage settings, not just the nominal voltage.

GEMS level requirements under section 7 are the substantive efficiency mandates. For classes 1 and 2, the mandatory threshold is the MEPS level in AS/NZS 4665.2:2005 clause 2.1, which sets limits on no load power (in watts) and minimum average active mode efficiency (as a percentage of output power). For classes 3 and 4, only the average active mode efficiency requirement in clause 2.2 applies. These thresholds are essentially static: they are fixed as at the day the Determination takes effect. Any subsequent amendment to the Australian standard does not automatically tighten these requirements; a new determination would be needed.

High efficiency level under section 9 is voluntary. It is defined as either the requirements in section 3 of AS/NZS 4665.2:2005 or, if the product meets the performance thresholds for Mark VI of the IEMP, those requirements. A supplier may choose to meet the high efficiency level to differentiate its product, but it is not mandatory. However, designating a product as meeting Mark VI allows it to use the IEMP labelling alternative in section 8.

International Efficiency Marking Protocol (IEMP) is a document incorporated by reference. Version 3.0, September 2013, created by the US Department of Energy, defines Mark VI performance levels and marking requirements. By referencing this protocol, the Determination allows suppliers who also sell into North America to use a consistent mark across markets, potentially reducing labelling costs. However, the IEMP is not incorporated dynamically: it is the version in force on the day the Determination takes effect. Any later revision of the IEMP would not automatically apply.

Families of models under section 10 allow a supplier to treat multiple models as a single group for testing purposes, provided the circumstances in AS/NZS 4665.1:2005 clauses 1.3.8 (non user selectable) or 1.3.9 (user selectable) are met. This concept reduces compliance costs but requires the supplier to carefully document why models are similar. If the regulator later finds that two models are not actually in the same family, all models in that family could be deemed non compliant.

Category A product under section 11 means all covered EPS are in the highest risk category under the Act. This triggers mandatory registration on the GEMS Registry, periodic compliance audits, and enhanced enforcement powers for the Regulator. Category A classification suggests the regulator treats EPS as having significant energy saving potential or high non compliance risk. The practical consequence is increased administrative burden: every model must be registered before supply, and registration requires test reports and other documentation.

The Determination directly affects any person or entity that supplies, offers to supply, or manufactures for supply in Australia a single output EPS that falls within the four product classes and has a maximum output power of 250 watts or 250 volt-amperes. This includes Australian manufacturers, importers, and distributors. It also covers foreign manufacturers who export EPS to Australia, because the GEMS Act imposes obligations on the person who "supplies" the product in Australia, which typically is the importer or local distributor.

Importers bear the primary compliance burden. They must ensure that every EPS model they bring into Australia meets the GEMS level requirements, has been tested by an accredited laboratory, and carries the correct energy performance mark. Importers must also register each model on the GEMS Registry before first supply. The cost of testing a single model can range from several hundred to several thousand dollars depending on the complexity and the number of output voltage configurations. For a product family, testing one representative model reduces that cost, but the importer must still pay for registration fees (set by the GEMS Regulations, not this Determination) and maintain records.

Manufacturers who produce EPS in Australia are similarly affected. However, Australia has very little domestic manufacture of EPS; most are imported from China, Taiwan, and other Asian countries. The practical impact on local manufacturing is minimal.

OEM and private label suppliers who brand EPS for use with specific end use products (such as laptop adapters, phone chargers, or medical device chargers) must ensure that the bundled EPS meets the Determination. This applies even if the EPS is packaged separately or sold as an accessory. The definition in section 4(c) specifically includes units "sold with, or intended to be used with, a separate end use product". So a manufacturer of a portable speaker that includes an EPS in the box must ensure that EPS complies, even if the speaker itself is not covered.

End users are indirectly affected. Because the Determination raises the minimum efficiency of EPS sold in Australia, consumers may pay higher upfront prices for replacements. Over the life of the product, they may save on electricity bills. But the net effect depends on the retail price increase and the typical usage pattern of EPS. Many EPS are left plugged in continuously (for example, laptop adapters at desks), so reductions in no load power can yield modest savings. However, if the cost of compliance pushes marginal suppliers out of the market, reduced competition may increase prices.

Small businesses that import low volumes of EPS are disproportionately affected. The fixed costs of testing and registration can be high relative to the margin on each unit. For a small importer bringing in 100 units of a niche EPS, the compliance cost might add $2 to $5 per unit. For a high volume importer, the cost per unit is negligible. This creates a barrier to entry for small suppliers and may reduce product variety.

Exempted entities are specifically carved out. The Determination does not affect suppliers of: multi output EPS (e.g., PC power supplies), DC-DC converters, ELV lamp transformers, therapeutic devices on the Australian Register of Therapeutic Goods, and DC or battery powered equipment. Those product categories remain subject to other GEMS determinations or no GEMS obligations at all.

Compliance professionals including energy efficiency consultants, testing laboratories, and legal advisors are affected as they must understand the Determination's specific requirements. The incorporation by reference of AS/NZS 4665 and the IEMP means that professionals need access to these standards, which are sold by Standards Australia and SAI Global. This creates an additional cost for those advising clients.

The central duty is to ensure that any single output EPS supplied in Australia meets the GEMS level requirements specified in section 7. This duty falls on the supplier (importer, manufacturer, or distributor) at the point of first supply. The duty is not strict liability in the sense that the Act provides a defence of reasonable mistake, but the supplier must have test evidence to demonstrate compliance.

The duty to test is specified in section 7(2) for user selectable products and section 7(3) for non user selectable products. Testing must comply with the methods in AS/NZS 4665.1:2005 sections 2 and 3, and the specific voltage conditions in AS/NZS 4665.2:2005 clauses 4.2 and 4.3. The supplier has a right to test a single model from a family and claim compliance for the whole family, provided the conditions in section 10 are met. This right reduces costs but comes with the risk that if the family is incorrectly defined, all models are non compliant.

The duty to label is under section 8. Each product must bear an energy performance mark as specified. However, the Determination grants a right: if the product meets the high efficiency level (either under AS/NZS 4665.2:2005 section 3 or under the IEMP Mark VI thresholds), the supplier may choose to label with either the Mark V (from the Australian standard) or the Mark VI (from the IEMP). This flexibility allows suppliers to use a single global mark for products sold in multiple markets, but it is only available for products that actually achieve the high efficiency level. For mandatory level products, only the Australian standard's mark is permitted.

The right to use the IEMP markings is found in section 8(1)(b). This is a notable feature because it incorporates a US Department of Energy protocol into an Australian regulatory instrument. The IEMP is not an Australian standard; it is a voluntary international protocol. By recognising it, the Determination reduces the regulatory burden for suppliers who also sell into North America, where Mark VI is used. However, the IEMP version is fixed at 3.0 September 2013. If the US updates the protocol, any new mark levels would not automatically be recognised in Australia.

Suppliers have a right to rely on the family of models provisions. Section 10 sets out that two or more models are in the same family under the circumstances described in AS/NZS 4665.1:2005 clauses 1.3.8 or 1.3.9. These clauses typically require that models share the same physical construction, circuit topology, and safety agency approvals, differing only in output voltage or current within a range. The supplier must document this similarity. If challenged, the supplier bears the burden of proving the models are in the same family.

Suppliers are also subject to record keeping duties under the Act, though not directly in this Determination. They must keep test reports, declarations of conformity, and records of supply for a prescribed period. The Act creates a duty to respond to requests for information from the Regulator.

There is no duty under this Determination to achieve the high efficiency level. It is entirely voluntary. A supplier can choose to supply only MEPS compliant products and avoid any further cost. However, the market may push suppliers toward higher efficiency if retailers or end use product manufacturers demand it for marketing purposes.

The Determination itself does not set penalty amounts. It operates under the GEMS Act 2012, which creates civil and criminal penalties for supplying non compliant products. While the source text does not repeat those penalties, the Act imposes penalties of up to 600 penalty units for an individual and 3,000 penalty units for a body corporate for contravening a GEMS level requirement. At the current penalty unit rate (around $313 per unit as of 2024), that translates to approximately $187,800 for an individual and $939,000 for a corporation. These are substantial sums that reflect the regulator's view that energy efficiency non compliance is serious.

Enforcement is carried out by the GEMS Regulator, which is a statutory office within the Department of Climate Change, Energy, the Environment and Water (as at 2024). The Regulator has powers under the Act to issue infringement notices (on the spot fines), accept enforceable undertakings, seek injunctions from the Federal Court, and pursue civil penalty orders. The Determination does not specify the Regulator's enforcement priorities, but EPS are a common product with high turnover in retail channels, making them a target for compliance sweeps.

The product category A designation in section 11 means that EPS are subject to the highest level of regulatory oversight under the Act. Category A products must be registered on the GEMS Registry before supply. Failure to register is itself a contravention. The Regulator can also conduct audits of registered models by requesting test reports or purchasing samples and conducting independent tests.

If the Regulator finds that a product does not meet the GEMS level requirements, it may issue a notice requiring the supplier to cease supply, recall the product, or both. Civil penalties apply, and the Regulator can also publish details of non compliance, which can cause reputational damage.

It is not enough for a supplier to rely on a test report from the manufacturer. The supplier must be satisfied that the report is accurate and that the product as actually supplied matches the tested model. Section 7 specifies that testing must be conducted in accordance with the prescribed methods. If a test is not conducted correctly, the test results are not valid and the product is deemed non compliant.

Because the Determination incorporates standards by reference, any failure to meet the standard is a failure to meet the legal requirement. There is no margin of error; the thresholds in AS/NZS 4665.2:2005 are absolute. If a product's average active mode efficiency is 0.5% below the threshold, it is non compliant, even if the difference is within measurement uncertainty. The testing protocols in AS/NZS 4665.1:2005 include provisions for measurement uncertainty, but the Determination itself does not provide an allowance for manufacturing tolerances.

The GEMS Act also contains offences for providing false or misleading information in connection with registration or compliance. A supplier who submits a test report that misrepresents the product's performance risks both GEMS penalties and potentially charges under the Criminal Code.

The Determination does not create a private right of action. Only the Regulator can enforce it. Competitors or consumer groups cannot sue for non compliance directly, but they can report suspected non compliance to the Regulator.

The Determination sits within the broader GEMS regulatory architecture. It is made under the GEMS Act 2012 and is subject to the GEMS Regulations 2013 (which deal with registration fees, registry operations, and enforcement procedures). The Determination does not duplicate or override those regulations; it operates as a specific product rule that triggers obligations under the general law.

Because the Determination references AS/NZS 4665.1:2005 and AS/NZS 4665.2:2005, those Australian standards are effectively given legal force for covered products. However, the standards themselves are not published as part of the Determination. To ascertain the exact efficiency thresholds, a supplier must purchase the standards from SAI Global or Standards Australia. This incorporation by reference is common in Australian regulatory instruments but creates a cost and access barrier for small businesses. It also means that if Standards Australia later revises the standard, that revision does not automatically update the Determination because the Determination fixes the standard version as at the date it took effect.

The Determination excludes therapeutic devices registered under the Therapeutic Goods Act 1989 and the Therapeutic Goods (Medical Devices) Regulations 2002. This is a deliberate carve out to avoid regulatory duplication, because medical devices are subject to safety and performance requirements administered by the Therapeutic Goods Administration. However, the exclusion only applies to devices that are on the Australian Register of Therapeutic Goods. An EPS that is used with a medical device but is not itself a registered therapeutic good is still covered. For example, a charger for a hospital bed control panel is covered unless the charger itself is separately registered.

The IEMP reference in section 8 interacts with US and other international energy efficiency regulations. The IEMP version 3.0 sets out Mark VI performance levels that are already recognised in North America and some other jurisdictions. By allowing its use, the Determination harmonises Australian labelling requirements with those jurisdictions, potentially reducing the need for different product variants. However, the static reference means that if the IEMP is updated to Mark VII or VIII, those new levels will not be recognised until this Determination is amended.

The Determination does not affect state or territory electrical safety laws. EPS must still comply with Australian electrical safety standards such as AS/NZS 60950 or AS/NZS 62368, which deal with electrical shock and fire hazards. The GEMS Determination is solely about energy efficiency. A product can be electrically safe but fail the GEMS requirements, and vice versa. Suppliers must comply with both sets of obligations.

There is potential overlap with the Australian Consumer Law (ACL). If a supplier labels a product with the Mark VI but the product does not actually meet the IEMP thresholds, that could constitute misleading or deceptive conduct under section 18 of the ACL, in addition to a GEMS contravention. Conversely, if a product meets MEPS but the supplier voluntarily labels it as "high efficiency" without meeting those thresholds, the ACL provides an additional enforcement avenue.

The Determination does not interact directly with state based energy efficiency schemes such as the Victorian Energy Upgrades program or the NSW Energy Savings Scheme. Those schemes provide certificates for energy savings, and they may accept GEMS registration as evidence of baseline efficiency, but that is not part of this Determination.

The source text provides limited amendment history. The Determination itself was made on 21 November 2014 by the then Minister for Industry, Ian Macfarlane, and it revoked and replaced the Greenhouse and Energy Minimum Standards (External Power Supplies) Determination 2012. The 2012 determination was the first to impose GEMS requirements on EPS under the newly enacted GEMS Act 2012. The 2014 version updated the references to standards and incorporated the IEMP alternative.

There is no indication in the source text of any later amendments to this Determination. The text provided appears to be the original version as registered. However, it is important to note that the Determination includes a note about copyright and Creative Commons licensing, which suggests it was published by the Commonwealth. The note confirms that the Determination is a legislative instrument registered on the Federal Register of Legislative Instruments (now known as the Federal Register of Legislation).

Since 2014, the GEMS Act has been amended, and other product determinations have been updated. However, as far as this source goes, the 2014 Determination remains unamended. This is significant because the underlying AS/NZS 4665 standards may have been revised. If Standards Australia has updated AS/NZS 4665.2:2005 to include stricter efficiency levels, those updates are not reflected in this Determination because it references the standard "as it exists on the day this Determination takes effect". To tighten requirements, the Minister would need to make a new determination. As of 2024, no such determination appears in the source.

A potential trigger for a new determination would be if the regulator considers that technology has improved to the point where stricter MEPS are economically justified. The static nature of this Determination means that the efficiency thresholds are effectively frozen at 2014 levels. This gives regulatory certainty to suppliers, but it also means that the energy savings achievable from EPS are not increasing over time as technology improves.

The revocation of the 2012 determination was presumably done to incorporate the IEMP and to align the Australian requirements with international developments. The 2012 version would have referenced earlier editions of the standards and would not have included the IEMP alternative.

The source text does not mention any litigation involving this Determination. There is no record of cases brought under the GEMS Act in the source, and the Determination itself is not a subject of judicial interpretation in the provided text.

At a general level, challenges to GEMS determinations are rare. This is because the GEMS Act provides for merits review of certain decisions by the Administrative Appeals Tribunal (now the Administrative Review Tribunal), but suppliers who disagree with a determination usually have the option of seeking a variation or exemption rather than litigating the validity of the instrument. Judicial review under the Administrative Decisions (Judicial Review) Act 1977 or section 75(v) of the Constitution is theoretically available, but there is no reported instance in the source of a challenge to this Determination.

The static reference to standards could theoretically be challenged on the ground that it impermissibly delegates legislative power to a private body (Standards Australia), but that argument has been largely settled in Australian administrative law. Courts have upheld the incorporation of standards by reference, provided they are available and the legislation is clear about which version applies. The fact that the Determination fixes the version at a specific date strengthens its legality.

The exclusion of certain products could lead to boundary disputes. For example, what constitutes a "therapeutic device" for the purposes of the carve out? If a supplier considers its EPS to be part of a therapeutic device but the regulator disagrees, that could lead to litigation. However, no such case appears in the source.

Enforcement actions by the regulator under the Act would be dealt with in the Federal Court. If a supplier were found to have supplied non compliant EPS, the penalty proceedings would be the main source of litigation. But that litigation would be about the supplier's conduct, not about the validity of the Determination itself.

The absence of litigation may also reflect that most suppliers comply, or that the regulator has not aggressively pursued non compliance for EPS. Alternatively, disputes may be settled through infringement notices or enforceable undertakings without reaching court.

The most significant trap for suppliers is that the Determination references AS/NZS 4665 as it existed on the day it took effect. That date is fixed: the Determination takes effect the day after registration. This means that if Standards Australia later amends AS/NZS 4665.2:2005 to tighten the efficiency thresholds (for example, reducing allowable no load power), those amendments do not apply. However, it also means that if the standard is amended to relax the requirements, the relaxation also does not apply. The supplier is locked into the 2014 version of the standard. This creates a risk that the supplier's test report must be based on the version of the standard it refers to. If the supplier inadvertently tests to a later edition of the standard that has different test methods, the regulator may reject the results.

Another gotcha lies in the definition of "single output external power supply" itself. The phrase does not capture multi output units, but many EPS are sold with multiple output connectors via a cable or cradle. The definition requires only one ELV output. However, if the unit has multiple outputs (even if only one is used at a time), it may fall outside the definition and be covered by a different determination (or none). Conversely, a unit that has a selectable voltage but only one physical output is covered in product class 2 or 4. The presence of a user selectable switch triggers the more onerous testing requirements in section 7(2), which require testing at both the highest and lowest output voltage settings. A supplier who inadvertently classifies a user selectable product as non user selectable will be non compliant.

The exclusion for batteries that "physically attach directly to the power supply unit" is narrowly drawn. A battery pack that is attached via a detachable cable is not excluded; only batteries that physically clip onto the unit are excluded. This means that many rechargeable battery chargers that have a removable battery cradle are covered by the Determination. The note in section 4(g) gives the example of a battery pack for a portable electric drill, but even then the exclusion applies only if the battery physically attaches directly to the power supply unit. If the charger has a separate battery pack that connects via a cable, the charger may be covered.

The family of models provisions in section 10 are a potential trap. The supplier must ensure that all models in the claimed family meet the conditions in AS/NZS 4665.1:2005 clauses 1.3.8 or 1.3.9. Those clauses are not reproduced in the Determination, so the supplier must purchase the standard to understand them. Common mistakes include grouping models that have different circuit topologies or different safety approvals. If the regulator later determines that the models are not in the same family, every model in that family is deemed untested and therefore non compliant.

The labelling alternatives under section 8 are another source of risk. If a supplier chooses to use the IEMP Mark VI label, it must first ensure that the product meets the performance requirements for Mark VI in the IEMP. Simply using the Mark VI label without achieving those thresholds is a contravention. Moreover, the IEMP is a separate document that must be sourced from the US Department of Energy's docket. The supplier must have access to that version and ensure compliance.

The Determination does not provide for any transitional arrangements. It revokes the 2012 determination and replaces it immediately. Any supplier who had been relying on the 2012 determination and had registered models under that instrument must ensure that those models also comply with the 2014 version. However, because the 2014 version largely mirrors the 2012 one in terms of MEPS levels, the main change is the addition of the IEMP option. Existing compliant products should still comply, but the labelling requirements may have changed if the supplier was using a different mark.

Suppliers should also note that the Determination covers products with a maximum output power of 250 watts or 250 VA. If an EPS is rated at exactly 250 W, it is covered. If it is rated at 251 W, it is not covered by this Determination and may fall into a different regulatory gap or be subject to no GEMS requirement at all. This creates an incentive for suppliers to slightly increase the rated output to avoid the coverage, but that might affect product safety certifications.

Finally, the Determination does not specify the consequences of failing to meet the high efficiency level when labelling with Mark VI. It is likely that the product is considered non compliant with labelling requirements if it bears Mark VI but does not meet the thresholds. The supplier could face penalties for false labelling.

Compliance with this Determination requires a systematic approach across design, testing, registration, and labelling. The following steps assume the product is a single output EPS with maximum output power not exceeding 250 W or 250 VA.

First, determine whether the product is covered. Check that it falls within the definition in section 4: it must have mains input, one ELV output, be separate from the end use product, and not have attached batteries or a battery chemistry selector switch. Also confirm that it is not excluded under section 6(3), such as a therapeutic device on the ARTG, a DC-DC converter, a ELV lamp transformer, or a multi output unit. If the product is a charger with a removable battery pack that physically attaches to the unit, it may be excluded; if the battery pack connects via a cable, it is likely covered.

Second, identify the product class using the table in section 6(2). Determine whether the output is AC-DC or AC-AC, and whether the output voltage is user selectable via a switch. If the voltage is fixed (or adjustable only by internal configuration), it is non user selectable (class 1 or 3). Products with a selector switch that the end user can operate fall into classes 2 or 4. Be careful: some products have an automatic voltage sensing feature that switches between outputs internally; the user does not select. That is likely non user selectable.

Third, design the product to meet the GEMS level requirements. For classes 1 and 2, meet the no load power and average active mode efficiency thresholds in AS/NZS 4665.2:2005 clause 2.1. For classes 3 and 4, meet the average active mode efficiency in clause 2.2. These thresholds are expressed in the standard as tables or formulas. Obtain the standard and refer to the specific values. Design the product with sufficiently efficient components: use synchronous rectifiers, low leakage transformers, and power factor correction where needed. If aiming for high efficiency (voluntary), design to meet section 3 of the standard or the IEMP Mark VI thresholds.

Fourth, arrange testing by an accredited laboratory. The testing must be conducted in accordance with AS/NZS 4665.1:2005 sections 2 and 3, using the specific voltage conditions in AS/NZS 4665.2:2005 clause 4.2 (230 V or 240 V input). For user selectable products, testing must also be done at the highest and lowest output voltage settings as per clause 4.3. For non user selectable products in a family of models, those settings are also required. Ensure the laboratory provides a test report that clearly states the results and the method used.

Fifth, if the product is part of a family of models, document how the models meet the conditions in AS/NZS 4665.1:2005 clause 1.3.8 or 1.3.9. Keep records of the differences and similarities. Only one model needs to be tested, but the test report must cover the representative worst case model.

Sixth, label the product. If the product meets only the mandatory MEPS level, apply the energy performance mark as required by Appendix A of AS/NZS 4665.1:2005 and section 5 of AS/NZS 4665.2:2005. If the product meets the high efficiency level (either under the standard or under IEMP Mark VI), choose either the Mark V or the Mark VI label. Ensure the label is affixed to the product or packaging as per the standard's specifications. Note that the marking must be legible and durable.

Seventh, register the model on the GEMS Registry before supplying the product. The Act and Regulations set out the registration process, which typically involves submitting the test report, a declaration of conformity, and paying a fee. Because the Determination designates all covered EPS as category A, registration is mandatory. The registration must include the product class, model name, and declared efficiency levels.

Eighth, maintain records. Keep copies of test reports, declarations, and records of supply for at least the period prescribed in the Regulations (likely 5 years). These records may be requested by the Regulator during a compliance audit.

Ninth, monitor regulatory changes. The Determination is static, but the Regulator may release guidance or update other instruments. Subscribe to updates from the Department's GEMS office. If a new determination is made that tightens requirements, plan for a transition period.

Tenth, consider voluntary high efficiency labelling if targeting markets that value energy efficiency, such as government or corporate procurement. Achieving Mark VI may also allow use of the same product in North America, reducing product variants. Ensure that any marketing claims about efficiency are accurate to avoid ACL exposure.
