Greenhouse and Energy Minimum Standards (Electric Water Heaters) Determination 2012

GEMS level requirements. Under section 6 of the Determination, the ‘energy use and greenhouse gas production’ requirements that must be met by each covered product are the maximum allowable heat loss values set out in subclauses 2.2.1.3, 2.2.2.3, and 2.2.3.3 of AS/NZS 4692.2:2005, depending on the product class. Heat loss is defined in the Determination as having the same meaning as in clause 1.6.3 of that standard. In practical terms, it is the rate at which a storage water heater loses heat from the stored water to the ambient environment, measured in kilowatt-hours per 24 hours or similar units. Meeting the maximum allowable heat loss is the core regulatory obligation. Failure to do so means the product cannot be legally supplied.

Product classes. The Determination defines three product classes in section 5(2):

• Class 1: Electric un-vented displacement water heaters with rated hot water delivery up to 630 litres.
• Class 2: Electric vented displacement water heaters with rated hot water delivery from 25 litres to 630 litres.
• Class 3: Electric heat exchange water heaters with heat storage volume from 45 litres to 710 litres.

These classes determine which heat loss limits and which test methods apply. The distinction between un-vented and vented matters because the standards treat them differently. Displacement water heaters are those where incoming cold water displaces hot water out of the tank; heat exchange water heaters use a separate heat transfer fluid to heat potable water. The Determination’s scope also captures the storage component of solar water heaters, heat pump water heaters, and indirectly heated systems, provided the overall unit meets the size and primary energy source criteria.

Category A products. Section 10 designates all products covered by the Determination as category A products under section 29 of the GEMS Act. This classification is not trivial: under the GEMS Act, category A products face a stricter compliance and enforcement regime, including the possibility of infringement notices, civil penalties, and the requirement to register models on the GEMS Registry before supply. It signals that the regulator considers these products high risk in terms of energy consumption or market volume. The determination itself does not explain the rationale, but the consequence is a heavier compliance burden compared to uncategorised or lower‑category products.

Families of models. Section 9 adopts the circumstances set out in subclause 1.6.2 of AS/NZS 4692.2:2005 for when two or more models are considered part of the same family. This allows suppliers to test one representative model and extend the test results to cover all models in the family, reducing testing costs. However, the criteria for grouping are defined by the standard and include factors such as same tank insulation, same heating element configuration, and same tank geometry. A supplier who misclassifies models into a family may find that non‑compliant models are not covered by the testing.

Incorporation of standards by reference. The Determination does not reproduce the substantive technical requirements. Instead it references Australian and New Zealand Standards (e.g. AS/NZS 4692.1:2005, AS/NZS 4692.2:2005, AS 1056‑1991, AS 1361‑1995) as they existed at the date of commencement. This means the legal requirements are contained in documents not set out in the Determination itself. Users must purchase or access the standards separately. Importantly, the Determination freezes the standards: later updates to AS/NZS 4692.2:2005 do not automatically become law. Any amendment would require a new determination. This reduces regulatory uncertainty for suppliers but also means the efficiency requirements may become outdated if the standards improve. The Interpretation provision in section 4(2) reinforces that the applicable version of any document referred to in a standard is the version at the commencement date.

The Determination directly affects suppliers of electric water heaters within the scope. ‘Supplier’ under the GEMS Act includes manufacturers, importers, and in some cases retailers who brand products. These entities must ensure that each model of electric water heater they supply in Australia meets the GEMS level requirements and product performance requirements. The compliance burden falls on businesses, not on end consumers or installers. However, indirect effects flow through the supply chain. Wholesalers and retailers cannot legally sell non‑compliant models, which may shrink product lines and alter pricing strategies. Plumbers and electricians may find that certain previously available lower‑cost models can no longer be installed, potentially increasing upfront costs for consumers.

Manufacturers and importers bear the primary cost of testing and certification. They must either test units themselves to the specified methods (Appendix C of AS/NZS 4692.1:2005 or alternative standards) or rely on families of models to limit the number of physical tests. The testing costs, including the need to use accredited laboratories, are a fixed cost that disproportionately impacts smaller suppliers with fewer models. This creates a barrier to entry, favouring established firms with larger market share and deeper pockets. Over time, this may reduce product diversity and competition, as smaller brands consolidate or exit the water heater market. The exclusions for solar and heat pump water heaters limit the scope but also create a competitive distortion: suppliers of conventional electric storage heaters face mandatory efficiency standards, while suppliers of heat pumps and solar systems with modest electric boosting are exempt. This tilts the market toward those technologies, which the official rationale may frame as environmental policy, but the effect is to impose a regulatory tax on one subset of products and not on others.

Consumers are affected through product availability and price. The Determination raises the minimum efficiency of electric storage water heaters, which likely translates to higher purchase prices due to better insulation and more expensive components. These costs are passed on to households and businesses. The benefit is lower running costs over the life of the product, but the upfront price increase may be regressive, falling hardest on low-income households who may rent or who cannot afford capital expenditure for longer‑payback periods. The exclusion of small vented water heaters (under 125 litres) means that compact, lower‑cost units remain available for limited hot water needs, preserving some choice for niche applications.

Trade and competition. Importers face the same compliance obligations as local manufacturers. The Determination applies equally to domestic and imported products, so it does not discriminate by origin. However, testing to Australian/New Zealand Standards may favour local manufacturers who are already familiar with those standards. Foreign suppliers may need to modify product designs or conduct additional testing to meet the heat loss limits, raising import costs. This can reduce the range of imported models available, particularly from Asian markets where lower‑efficiency, lower‑cost storage water heaters are common. The net effect on competition depends on the elasticity of substitution and the extent to which importers absorb or pass on compliance costs.

Regulators (the Department of Climate Change, Energy, the Environment and Water, and the GEMS Regulator) must maintain the registry, monitor compliance, and enforce the Determination. They incur administrative costs for rulemaking, testing surveillance, and legal action against non‑compliant suppliers. These costs are ultimately funded by taxpayers or through cost‑recovery levies on industry.

Duty to meet GEMS level requirements. The core obligation is set by section 6(1) of the Determination read with the GEMS Act. A supplier must not supply a covered product unless it meets the maximum allowable heat loss values for its product class. This is a strict liability obligation under the Act: there is no requirement to prove fault. The supplier must ensure that every unit supplied conforms to the tested model.

Duty to meet product performance requirements. Section 8(1) adds a second layer of obligations: for products in each class, the rated hot water delivery must meet the requirements of AS/NZS 4692.2:2005. For class 3, heat storage volume and hot water delivery must comply. Additionally, if a supplier makes a claim about rated mixed hot water delivery, that claim must be accurate per clause 2.4 of the standard. This means the supplier cannot simply avoid stating a mixed hot water delivery; but if they do, it must be tested and verified. This imposes an extra duty whenever a supplier chooses to make such a claim, common in marketing materials.

Duty to conduct tests. Sections 6(2) and 8(2) require that compliance be demonstrated through tests conducted according to the specified standards. The supplier cannot rely on other methods. For classes 1 and 2, heat loss tests must use Appendix C of AS/NZS 4692.1:2005 or Appendix B of AS 1056‑1991. For class 3, Appendix C of AS/NZS 4692.1:2005 or Appendix C of AS 1361‑1995. Performance tests for hot water delivery follow Appendix D of AS/NZS 4692.1:2005 or Appendix C of AS 1056‑1991 for classes 1 and 2, and subclause 6.2 of AS/NZS 4692.1:2005 for class 3. The supplier must keep records of these tests as required by the Act (not detailed in the Determination).

Right to rely on families of models. Section 9 provides that two or more models are in the same family of models under the circumstances specified in subclause 1.6.2 of AS/NZS 4692.2:2005. This right allows a supplier to test only one model per family and treat the test results as covering all models in that family. It reduces testing costs significantly. However, the supplier bears the risk that the family grouping was incorrect, because if any model in the family fails to conform, all models in that family are non‑compliant. The supplier should carefully document the basis for grouping and ensure that all models truly meet the standard’s criteria.

Right to apply for exemptions. The Determination itself does not confer exemption rights, but the GEMS Act allows suppliers to apply for exemptions from the requirements (for example, for innovative products or where compliance is not technically feasible). Those applications are made under the Act, not under this Determination.

No labelling duty. Explicitly, section 7 says there are no GEMS labelling requirements for products covered by this Determination. This means suppliers do not need to affix an energy rating label (e.g. star rating) under the GEMS regime for these electric water heaters. However, other laws (such as state‑based energy labelling laws or the national Water Efficiency Labelling Scheme) may still apply. The absence of a GEMS label reduces one compliance cost, but suppliers must still be careful not to make false or misleading representations about energy performance under the Australian Consumer Law.

Recording and notification duties. While not spelled out in the Determination, the GEMS Act requires suppliers of category A products to register models on the GEMS Registry before supply. This includes providing test reports and declarations. The Determination by itself does not create those duties; they arise from the parent Act by virtue of the category A designation.

The Determination itself does not prescribe penalties; it is an instrument under the Greenhouse and Energy Minimum Standards Act 2012. That Act creates the enforcement framework. However, because this analysis must be grounded in the source, we note that the Determination sets the substantive standards that, if breached, trigger the Act’s penalty provisions. A supplier who supplies a covered product that does not meet the GEMS level requirements or product performance requirements faces civil penalties under sections 69 and 70 of the GEMS Act. Those penalties are not stated in the Determination, but the Act provides for maximum penalties of up to 500 penalty units for an individual and 5,000 penalty units for a body corporate (penalty units are indexed periodically; at 2012 about $110 per unit, so corporate penalties could exceed $500,000). Additionally, the regulator can issue infringement notices (on‑the‑spot fines) for category A products, seek injunctions to stop supply, or require recall of non‑compliant products.

The Determination’s designation of products as category A is significant. Under the GEMS Act, category A products are subject to a regime of strict liability: the supplier does not need to intend to breach the standards. The regulator can also require suppliers to provide test reports or other information on request, and may conduct its own testing to verify compliance. If a product is found to be non‑compliant, the supplier may be liable for the reasonable costs of that testing. The Act also creates criminal offences for supplying products that do not meet GEMS level requirements if the supplier intends to defraud or is reckless. However, criminal prosecutions are rare; the civil penalty path is more common.

Enforcement typically begins with the GEMS Regulator identifying non‑compliance through market surveillance, tip‑offs, or random testing. The Regulator can issue a notice requiring the supplier to demonstrate compliance within a specified time. Continued non‑compliance can lead to civil penalty proceedings in the Federal Court or Federal Circuit Court. The court can order monetary penalties, injunctions, and declarations. The Determination does not contain any defence clauses; the only defences are those in the GEMS Act (e.g., reasonable mistake of fact, or that the supplier took all reasonable precautions and exercised due diligence). However, those defences are not specified in the Determination and are beyond the source text.

The very high penalties and strict liability regime mean that the stakes for suppliers are substantial. A single non‑compliant shipment could lead to catastrophic financial exposure. This is a significant compliance cost driver, as suppliers must invest in robust quality control and documentation to avoid even inadvertent breaches. The category A designation amplifies this risk, as the regulator is more likely to prioritise electric water heaters for surveillance compared to lower‑risk products.

The Determination sits within the broader GEMS Act framework. The Act provides the procedural and enforcement infrastructure; the Determination provides the substantive requirements. Any amendment to the Determination would follow the same legislative instrument process under the Legislation Act 2003 (Cth). The Determination also interfaces with state and territory energy efficiency regulations. For example, the National Construction Code (NCC) contains requirements for the energy performance of hot water systems in new buildings. In some states, the NCC mandates a minimum star rating for water heaters that may exceed the GEMS level requirements of this Determination. The Determination sets a national floor, but states can impose higher standards. Suppliers must navigate both sets of rules.

The Determination also interacts with the Competition and Consumer Act 2010 (Cth), specifically the Australian Consumer Law (ACL). Even though the Determination does not require energy labelling, suppliers who voluntarily display energy performance claims or imply efficiency must not mislead consumers under sections 18 and 29 of the ACL. A product that meets the Determination’s heat loss limits could still be the subject of a false claim if the supplier misstates the performance in advertising. Conversely, a product that fails the Determination’s limits would likely also breach the ACL if the supplier sells it anyway and claims it is compliant.

The incorporation of standards by reference means the Determination incorporates parts of AS/NZS 4692.1:2005, AS/NZS 4692.2:2005, AS 1056‑1991, and AS 1361‑1995. These standards themselves reference other documents (e.g., IEC standards). Section 4(2) of the Determination locks in the version of those referenced documents as at the commencement date. This limits regulatory creep but also means that if a supplier is using a later edition of a standard for other purposes (e.g., for export markets), they cannot rely on it for GEMS compliance without a new determination.

The Determination interacts with customs and import controls. Products covered must meet GEMS requirements before they can be supplied in Australia. The Australian Border Force may detain non‑compliant goods at the border, though this is not provided for in the Determination itself; the GEMS Act allows the regulator to request the Border Force to seize goods that do not comply. This means importers face a risk of goods being held at the border if they fail to register models and obtain compliance certificates.

There may also be interaction with the Water Efficiency Labelling and Standards Scheme (WELS) for water heaters. The WELS scheme requires certain products, including showerheads and taps, but not water heaters directly; however, some water heaters have integrated water‑efficiency claims that are separately regulated.

Finally, the Determination interacts with other GEMS determinations covering gas water heaters, air conditioners, and other appliances, but those are separate instruments. A supplier who produces both electric and gas water heaters must comply with both determinations. There is no coordination mechanism between them, potentially imposing overlapping compliance systems.

The source text provided is the original Determination dated 25 October 2012 and registered shortly after. There is no indication within that text of any subsequent amendments. However, this should not be taken as evidence that no amendments occurred. The Determination has likely been amended since 2012, perhaps to update the test standards, adjust product classes, or align with new editions of AS/NZS standards. But the user supplied only the original instrument. Therefore, based solely on the source we cannot state any amendments. The note on the Federal Register of Legislative Instruments suggests that compilations may include amendments, but the text we have does not. A prudent supplier would check the current compilation on the Federal Register of Legislation. The original determination froze standards at 2012 versions; any later update would require an amending determination. Common practice under the GEMS framework has been to make amending determinations to reflect new versions of standards, but that is not in this source. Our analysis must be grounded in the provided text: no amendment history is included, and we cannot invent one.

We can usefully note for practitioners that the Determination’s frozen standard dates create an ongoing risk of obsolescence. For example, AS/NZS 4692.2:2005 was later superseded by AS/NZS 4692.2:2017. If the Determination had not been amended, suppliers could be complying with a 2005 standard while the industry has moved to a more stringent 2017 edition. This could lead to a situation where the legal minimum is lower than the market norm, but compliance with the legal minimum is still required. Conversely, if an amendment was made, the version we have is no longer in force. Without the official register, we cannot tell. This uncertainty is a gotcha in itself: reliance on an unamended version may be dangerous.

For the deep dive, we must confine ourselves to the source: there are no amendment clauses, no schedules of amendments, and no reference to previous determinations. The Determination is dated 2012 and the standards noted include amendments up to 2005 and 2011. There is no mention of any amending instrument. Therefore, under this heading we state that the source text shows no amendment history; the original determination was made in 2012 and no subsequent amendments appear in the provided document. This is a neutral observation, not an assertion of fact about the current law.

The source text contains no reference to any court cases, tribunal decisions, or administrative reviews concerning this Determination. This is not surprising; most GEMS determinations operate below the litigation radar, with disputes settled through compliance notices or negotiated outcomes. We cannot invent cases. However, we can note that the GEMS Act has been the subject of occasional judicial consideration in other contexts (e.g., about the definition of ‘supply’ or the validity of determinations), but those cases do not specifically relate to this water heater determination.

The absence of litigation history may indicate that the Determination is relatively uncontroversial, or that enforcement has been effective enough to avoid formal court proceedings. Alternatively, it could simply reflect that the Determination has been in force only a few years (though 2012 to present is over a decade). Most likely, the industry has largely complied, and the regulator has not needed to take many high‑profile cases.

Practitioners should be aware that the GEMS Act allows for merits review of certain decisions (e.g., refusal to register a model, or an infringement notice) under the Administrative Appeals Tribunal (now the Administrative Review Tribunal). No such reviews appear in the source. This heading must be brief because the source says nothing. We will state that no litigation history is provided in the instrument, and the author is aware of no reported decisions specifically interpreting this Determination. This caveat is important: we are not asserting there is no litigation, only that the source does not discuss it.

Frozen standards trap. The most significant hidden trap is that the Determination incorporates standards as they existed at the commencement date (25 October 2012). Section 4(2) and the notes to the definitions confirm this. A supplier who assumes they can comply with the latest edition of AS/NZS 4692.2 (say, 2017) may actually be using a test method or limit that is not the legal requirement. The legal requirement remains the 2005 edition, plus its amendments up to the dates noted. If the 2017 edition is more lenient in some respects, the supplier might fail a test under the 2005 edition. Conversely, if the 2017 edition is stricter, the supplier could still be legally compliant while products fall short of newer market expectations. This split can cause confusion during design, import, and installation.

Exclusion ambiguity for solar and heat pump water heaters. Section 5(3)(a) excludes water heaters where electric‑resistive heating provides less than 50 per cent of annual energy, when simulated to AS/NZS 4234:2008 using climate zone 3 and 22.5 MJ/day delivery. The phrase ‘typical year’ and the specification of manufacturer‑provided energisation profiles give room for manipulation. A supplier could design a product that just meets the 50 per cent threshold to claim exclusion, even though in real‑world use the electric backup may dominate. The Determination does not define who does the simulation or whether the regulator can challenge the manufacturer’s assumptions. This uncertainty invites gaming and increases compliance risk for those who rely on the exclusion.

Definition of ‘primary energy source’. Section 5(1)(c) covers water heaters that ‘use electric resistive heating as the primary energy source’. ‘Primary’ is not defined in the Determination. In a dual‑source system (e.g., solar with electric boost), it is not clear whether primary refers to energy input over the year, installed capacity, or design intent. The exclusion in 5(3)(a) tries to clarify by reference to energy proportions, but for products that are not solar or heat pump, the definition remains ambiguous. A manufacturer who makes a hybrid water heater that uses both resistive and heat‑pump elements could be inadvertently swept into the Determination if the resistive element is considered the primary source by some interpretation.

Vented water heater attached feed tank exclusion. Section 5(3)(b) excludes vented water heaters with an attached feed tank and a hot water delivery under 125 litres. This requires the supplier to measure or declare the hot water delivery to claim the exclusion. If the delivery is just under 125 litres, the product is excluded from the Determination but may still be subject to other regulations. But if the delivery is over 125 litres, it falls back into class 2 and must meet the heat loss limits. The line is fine, and suppliers must accurately test the rated hot water delivery. Misclassifying a 130‑litre model as excluded could lead to supply of a non‑compliant product.

Heat loss definition and test method alternatives. Section 6(2) allows two alternative test methods for heat loss for classes 1 and 2: Appendix C of AS/NZS 4692.1:2005 or Appendix B of AS 1056‑1991. These are not identical. One may yield slightly different results. Suppliers must choose one and stick with it, and they must be aware that the regulator might use the other method for verification. There is no provision for reconciliation if results diverge. Similarly, for class 3, two test methods are available.

No labelling, but still performance claims. Section 7 says no GEMS labelling requirements. That means no mandatory energy star label under GEMS. However, section 8(1)(d) requires that if a supplier makes a claim about rated mixed hot water delivery, it must be accurate. A supplier who advertises a high mixed hot water delivery must have test evidence per Appendix E of AS/NZS 4692.1:2005. If the claim is unsupported, it could lead to liability under the ACL (misleading conduct) and under the GEMS Act for failing to meet the product performance requirement. This is a gotcha for marketing departments: making an unsupported efficiency claim triggers a legal obligation that may not be obvious.

Families of models grouping criteria. Section 9 adopts subclause 1.6.2 of AS/NZS 4692.2:2005. That subclause sets specific criteria (e.g., same tank diameter, same insulation type and thickness, same heat exchanger geometry). If a supplier groups two models that differ in insulation thickness, the family classification may be invalid. The consequences are serious: all units from that family are treated as not having been properly tested, and the supplier is at risk of enforcement for all models, not just the non‑conforming one.

Compliance with this Determination requires a systematic approach across product design, testing, documentation, and supply chain management. The steps below are derived from the Determination and the GEMS Act framework.

Step 1: Determine whether the product is covered. First, identify whether the electric water heater falls within the scope of sections 5(1) and 5(2). Check the rated hot water delivery (class 1 and 2) or heat storage volume (class 3). If the product is a storage water heater up to 630 litres or a heat exchange water heater up to 710 litres and uses electric resistive heating as the primary energy source, it is likely covered. But check the exclusions in section 5(3). If the product is a solar or heat pump water heater where electric resistive provides less than 50 per cent of annual energy (simulated to AS/NZS 4234:2008 using climate zone 3 and 22.5 MJ/day with manufacturer‑supplied energisation profile), it is excluded. Similarly, vented water heaters with attached feed tank and hot water delivery under 125 litres are excluded, as are non‑grid‑connected units. Document the analysis to support the coverage determination.

Step 2: Identify the product class. The product class (1, 2, or 3) determines which heat loss limit and which performance requirements apply. Also note the test method options. The manufacturer must decide which test method to use (e.g., Appendix C of AS/NZS 4692.1:2005 or Appendix B of AS 1056‑1991 for classes 1 and 2). Choose the method that best matches the product design; but be aware that the regulator or a competitor might test using the alternative method. If possible, test using both to avoid a divergence.

Step 3: Test for GEMS level requirements (heat loss). Arrange for testing at a laboratory accredited to the relevant standards. Ensure the test is conducted per the chosen method. The test report must demonstrate that the product’s heat loss does not exceed the maximum allowable heat loss specified in AS/NZS 4692.2:2005, subclause 2.2.1.3, 2.2.2.3, or 2.2.3.3, as applicable. Record the heat loss value. If the product is part of a family of models, test the representative model only after verifying that all models in the family meet the grouping criteria under subclause 1.6.2 of AS/NZS 4692.2:2005. Document the grounds for grouping.

Step 4: Test for product performance requirements. Section 8(1) requires that rated hot water delivery meet the values in the standard. For class 3, also verify heat storage volume and hot water delivery. If the supplier intends to make a claim about mixed hot water delivery, test according to Appendix E of AS/NZS 4692.1:2005. Even if no claim is made, the supplier should ensure the product meets the basic requirements. Keep test reports for each model or family.

Step 5: Register the model on the GEMS Registry. Because the product is a category A product, it must be registered before supply. Registration involves submitting the test reports, a declaration of conformity, and paying a fee (set under the GEMS Regulations). The registration must be updated if the model changes. The Determination does not cover this step, but it is mandatory under the Act.

Step 6: Maintain compliance records. The GEMS Act requires suppliers to keep records of test reports, declarations, and correspondence with the regulator for at least five years after the supply of the last unit of the model. The Determination does not specify a retention period, but the Act does. Ensure record‑keeping systems are robust.

Step 7: Monitor for amendments. The Determination is static in the source, but actual amendments may have occurred. Check the Federal Register of Legislation for the current version. Any changes to the standards or to the Determination itself could alter test methods or limits. Regularly review the GEMS website.

Step 8: Ensure marketing and claims comply. Since no GEMS labelling is required, the supplier has no mandatory label to affix. However, any voluntary energy claims must be accurate and substantiated, to avoid liability under the ACL and to ensure the mixed hot water delivery requirement is not triggered inadvertently. If a claim about mixed hot water delivery is made, test it.

Step 9: Manage family of models risk. If using families, maintain clear documentation showing that each model in the family meets the grouping criteria. If any model is found to be non‑compliant, the entire family is at risk. Consider testing more than one model if there is any doubt.

Step 10: Prepare for possible enforcement. Have a compliance plan, including a process for receiving and responding to notices from the regulator. Designate a person responsible for GEMS matters. Conduct internal audits. If the regulator requests test reports, they must be produced quickly. Non‑compliance can lead to infringement notices or civil penalties, so a proactive approach is cheaper than reacting.

By following these steps, a supplier can demonstrate due diligence and reduce the risk of penalties. However, the Determination itself does not provide a compliance checklist; these steps are inferred from its structure and the parent Act. The ultimate responsibility for compliance rests with the supplier, and there is no substitute for reading the current version of the Determination and the applicable standards.
