Greenhouse and Energy Minimum Standards (Double-capped Fluorescent Lamps) Determination 2017

This Determination is a legislative instrument made under sections 23 and 35 of the Greenhouse and Energy Minimum Standards Act 2012 (Cth) (the Act). It sets mandatory minimum energy performance standards (MEPS) for double-capped fluorescent lamps (colloquially, linear fluorescent tubes) of the type used for general illumination in commercial, industrial and some residential settings. It revokes and replaces the earlier 2012 Determination of the same name.

Mechanically, the Determination does four things. First, it specifies which products are covered: double-capped fluorescent lamps with a nominal length between 550 mm and 1500 mm, a nominal wattage of 16 watts or more, for use in a luminaire, and designed for either alternating current mains (FD) or high frequency (FDH) operation with a ballast connected to a 230 V 50 Hz single phase supply. Lamps not for general illumination are excluded, such as those with a dominant colour output outside the visible spectrum, colour matching lamps with a colour rendering index above 90, lamps for industrial or agricultural processes, medical applications, or flame proof luminaires. The covered products are divided into four product classes based on nominal length bands: 550 mm to less than 700 mm (class 1), 700 mm to less than 1150 mm (class 2), 1150 mm to less than 1350 mm (class 3), and 1350 mm to 1500 mm inclusive (class 4).

Second, it imposes GEMS level requirements for energy use. Products must meet the initial efficacy and maintained efficacy levels specified in clause 2.2 of AS/NZS 4782.2:2004. Testing for initial efficacy must follow Annex B of AS/NZS 4782.1:2004, with an important concession for T5 (16 mm diameter) high frequency lamps: they may be tested at an ambient temperature of 35°C instead of 25°C. Maintained efficacy testing is per Annex C of the same standard.

Third, it sets non-energy requirements. Products must meet a minimum colour rendering index (specified in clause 2.2 of AS/NZS 4782.2:2004). More critically for environmental and health impact, the mercury content of each lamp must not exceed 5 milligrams. Testing for mercury must be conducted using either AS/NZS 4782.3:2014 or the combination of IEC 62321 4 and IEC 62554.

Fourth, it specifies that there are no GEMS labelling requirements for these products, and declares all covered products to be category A products under the Act (the highest risk category, requiring registration). It also provides for families of models: up to five models from a single product class, of a single brand, relying on the same test report and sharing the same physical and performance characteristics, can be grouped. The Determination affects the registration of one specific model from the previous 2012 Determination: the Arlec F21T5 (registration ALA0042), which ceases to be registered. All other models registered under the 2012 Determination are automatically taken to be registered under this Determination.

The core concepts are defined partly in the Determination itself and partly by reference to the incorporated Australian/New Zealand and international standards. The key term is double-capped fluorescent lamp: a fluorescent lamp with two separate caps, mostly of tubular form and linear shape, as defined in AS/NZS 4782.1:2004 subclause 1.4.2. The scope is limited to lamps for general illumination purposes, for use in a luminaire (an apparatus that distributes, filters or transforms light, including all parts for fixing and protecting the lamps and connecting them to the supply). The Determination only catches lamps for alternating current mains (FD) or high frequency (FDH) applications, with a ballast connected to a 230 V 50 Hz single phase supply.

The Determination establishes four product classes based on nominal length bands. These classes matter because the efficacy and colour rendering requirements in the referenced standard are specified per class. The classes are not incremental performance tiers but categories that allow different stringency for different tube lengths.

Efficacy is defined in subclause 1.5.3 of AS/NZS 4782.2:2004 and refers to the ratio of luminous flux (lumens) to electrical power (watts). The GEMS level requirements for energy use are expressed as minimum initial efficacy and minimum maintained efficacy (after a specified burn time). Initial efficacy is the efficacy measured after a short ageing period, defined in subclause 1.5.4 of the same standard. Maintained efficacy is the ratio of luminous flux after a given operating time to initial luminous flux, defined in subclause 1.5.5.

Colour rendering index (CRI) is a relative measure of the shift in surface colour of an object when lit by the lamp compared with natural daylight, which has a CRI of 100. The Determination requires compliance with the minimum CRI specified in clause 2.2 of AS/NZS 4782.2:2004.

The mercury content limit of 5 mg is an absolute cap per lamp. This is not a performance standard but an environmental and health impact requirement under section 27(1)(c) of the Act. The Determination provides two alternative test methods for mercury: AS/NZS 4782.3:2014 (a specific Australian/New Zealand standard for quantitative analysis of mercury in fluorescent lamps), or the combination of IEC 62321 4 (determination of mercury in electrotechnical products) and IEC 62554 (sample preparation for measurement of mercury in fluorescent lamps). This dual pathway gives flexibility in testing, but the test methods may yield different detection limits and require different sample preparation.

The primary affected entities are manufacturers, importers, and suppliers of double-capped fluorescent lamps that fall within the scope. Any person who supplies such a lamp in Australia, whether by sale, lease, hire, or gift, must ensure it is registered under the GEMS scheme and meets the Determination’s requirements. This includes original equipment manufacturers, brand owners, private label importers, and distributors who place products on the Australian market. The Determination does not apply to end users, but downstream purchasers may be indirectly affected if non compliant products are unavailable or if prices rise due to compliance costs.

The scope is narrower than the full universe of fluorescent tubes. Lamps shorter than 550 mm, those with nominal wattage below 16 watts, or those designed for non standard voltages (e.g., 277 V) are not covered. This tends to benefit suppliers of compact fluorescent lamps and smaller linear lamps, which are not caught. Similarly, specialised lamps (medical, industrial process, flame proof, colour matching with CRI >90) are excluded, meaning their manufacturers do not need to comply.

Compliance service providers are also affected. Testing laboratories that wish to conduct tests for GEMS registration must be competent to perform the specific test methods in AS/NZS 4782.1:2004 Annexes B and C, and either AS/NZS 4782.3:2014 or the two IEC standards for mercury. The 35°C ambient testing allowance for T5 lamps creates a niche testing requirement that may not be standard in all labs.

The Determination directly affects one specific model: the Arlec F21T5. Its registration under the 2012 Determination ceases, meaning the model is no longer registered against any GEMS Determination. Unless the supplier re registers it under this Determination (by demonstrating compliance with the new standards), it cannot lawfully be supplied. All other models registered under the 2012 Determination are automatically transitioned to the new Determination, so their suppliers face no immediate registration gap. However, they still must ensure those models comply with the new substantive requirements (e.g., the 2017 version may incorporate updated standards or test methods). The Determination does not provide any transitional period for existing stock beyond the six month commencement delay.

GEMS Regulator staff and enforcement bodies are affected in that the Determination gives them concrete benchmarks against which to assess compliance. The category A designation means that the Regulator may target these products for compliance audits. For importers and manufacturers, the administrative burden of maintaining registration, keeping test records, and ensuring supply chain compliance is ongoing.

The Determination imposes several duties on persons who supply covered products. The primary duty is to ensure that each model of double-capped fluorescent lamp supplied meets the GEMS level requirements (section 6) and the other requirements (section 8) before it is supplied. This includes: achieving the minimum initial and maintained efficacy levels; meeting the minimum colour rendering index; and not exceeding 5 mg of mercury per lamp. The responsible person must also ensure that testing has been conducted in accordance with the prescribed methods.

A related duty is to ensure that the model is registered under the GEMS scheme. Since covered products are category A, registration is mandatory. The Determination specifies that a model can be registered either individually or as part of a family of models. There is a duty to ensure that the family does not include more than five models, and that all models in the family share the same brand, test report, and relevant physical and performance characteristics. Using an invalid family could render all models in the family unregistered.

The Determination also creates a duty to maintain records of compliance. Although not stated explicitly in the Determination, the Act requires that registration holders keep records of testing and supply for prescribed periods. The Determination’s detailed test method prescriptions mean that record keepers must be able to produce evidence that testing followed the specific annexes and standard versions.

On the rights side, suppliers have the right to choose between the two alternative mercury test methods: AS/NZS 4782.3:2014 or the combination of IEC 62321 4 and IEC 62554. This flexibility may reduce testing costs if one method is more accessible or cheaper. For high frequency T5 lamps, there is a right to test at an ambient temperature of 35°C rather than 25°C, which may be easier to achieve in some laboratories and more representative of real world conditions in hot climates.

There is a right to use the family of models mechanism to group up to five models under a single registration, reducing registration fees and administrative burden. However, the condition that all models must rely on the same test report limits the usefulness: a manufacturer cannot group models that have different physical dimensions or performance characteristics (e.g., different colour temperatures or wattages) unless they are all covered by one test report. That report must demonstrate the worst case model within the family.

Suppliers have the right to rely on the incorporation by reference of the standards as they existed on the commencement date. This means that if a standard is updated after that date, a product that complies with the older version is still compliant under this Determination. Conversely, a product that only complies with a newer, more stringent version of the standard may still need to be tested against the frozen version to demonstrate compliance, which could be inefficient.

The Determination itself does not set penalties; it is a legislative instrument that sets the standards. Enforcement occurs through the Greenhouse and Energy Minimum Standards Act 2012. The Act provides for a range of civil and criminal penalties for supplying products that do not comply with GEMS level requirements or other prescribed requirements, for making false or misleading statements in relation to registration, and for failing to keep records. Under section 44 of the Act, a person must not supply a GEMS product unless it is registered and meets the GEMS level requirements. Contravention attracts a maximum civil penalty of 300 penalty units for an individual and 3,000 penalty units for a body corporate. Criminal offences may apply where there is intentional or reckless non compliance.

The Determination’s role is to define the precise requirements that must be met. If a product fails to meet the initial efficacy minimum for its product class, or contains more than 5 mg of mercury, the supplier is potentially liable. The test methods prescribed are mandatory; using a different test method without demonstrating equivalence could result in a product being treated as non compliant.

The GEMS Regulator (part of the Department of Climate Change, Energy, the Environment and Water) has enforcement powers including the ability to issue infringement notices (a form of on the spot fine), apply to a court for injunctions, and accept enforceable undertakings. The Regulator may also conduct audits of registered models, request test reports, and require suppliers to conduct additional tests. If a product is found non compliant, the Regulator can cancel or suspend its registration, effectively prohibiting supply.

The Determination affects enforcement in a subtle way: by specifying that covered products are category A, the Regulator may use a more rigorous compliance checking regime. Category A products are prioritised for inspection and market surveillance. The Regulator may purchase samples from retail outlets and test them against the Determination’s requirements. If a product fails, the supplier may face both enforcement action and the commercial cost of recall.

The family of models provision also has enforcement implications. If one model in a family is found non compliant, the entire family’s registration could be at risk. A supplier cannot isolate liability to a single model if it has grouped them under one registration. This creates an incentive to carefully select the representative model for testing and to ensure that all other models in the family truly have identical performance relevant characteristics.

The Determination sits within a broader regulatory framework. It is made under the Greenhouse and Energy Minimum Standards Act 2012, which is the primary legislation. The Act establishes the GEMS scheme for a wide range of energy using products. This Determination is one of many product specific instruments. It interacts with other GEMS determinations by creating a consistent compliance regime: registration, record keeping, and enforcement are common. Suppliers of double-capped fluorescent lamps may also be affected by determinations covering related products such as ballasts or luminaires, but those are separate determinations with their own scope.

The Determination incorporates standards by reference, including Australian/New Zealand Standards (AS/NZS 4782 series) and IEC standards. This creates a link to copyright law: the standards are not free to access. Suppliers must purchase the standards from SAI Global or Standards Australia to know the precise efficacy and CRI numbers. The Copyright Act 1968 applies to the standards. The Determination does not require that a copy of the standard be supplied with the product, but the compliance burden includes the cost of accessing the standards.

The Determination interacts with state and territory energy efficiency regulations. Under the Australian Energy Market Agreement, states and territories have largely harmonised their energy efficiency requirements with the GEMS scheme. However, there may be state based product registration schemes (e.g., the Victorian Equipment Energy Efficiency program) that impose additional requirements. The Determination does not override state laws; it operates concurrently. A product that complies with this Determination may still need to meet state level registration or labelling requirements, although in practice most states rely on GEMS as the lead scheme.

Environmental laws are relevant because of the mercury limit. The National Environment Protection (Used Packaging Materials) Measure and state waste management regulations apply to disposal of fluorescent lamps containing mercury. The Determination’s 5 mg limit is a design requirement, not a waste management rule, but it aligns with broader efforts to phase down mercury under the Minamata Convention on Mercury. Australia is a signatory. The Determination implements part of that commitment by capping mercury content. Suppliers must also consider the Hazardous Waste (Regulation of Exports and Imports) Act 1989 if exporting used lamps.

Trade practices law interacts with the Determination through the Australian Consumer Law (ACL), which is Schedule 2 to the Competition and Consumer Act 2010. A product that fails to comply with the Determination could also be considered as not of acceptable quality or not fit for purpose under the ACL. False claims about energy performance could trigger misleading or deceptive conduct provisions. Compliance with the Determination provides a defence to some ACL claims only if the product meets the prescribed standards, but does not guarantee immunity.

The present Determination revokes and replaces the Greenhouse and Energy Minimum Standards (Double-capped Fluorescent Lamps) Determination 2012 (F2012L02127). It is the second generation of GEMS requirements for these products. The 2012 Determination was the original instrument made under the then new GEMS Act. The 2017 Determination updates the references to standards and makes technical changes.

The most significant change is the introduction of the mercury content requirement and associated test methods. The 2012 Determination did not include a specific mercury limit; it only dealt with energy performance and colour rendering. The 2017 Determination adds a maximum mercury content of 5 mg and provides two alternative test methods. This reflects the increased regulatory focus on the environmental impact of mercury in lighting products, consistent with international developments such as the Minamata Convention and the EU’s RoHS directives.

The 2017 Determination also updates the references to standards. The 2012 Determination referenced AS/NZS 4782.2:2004 (including amendment 2) and AS/NZS 4782.1:2004, but did not reference the specific mercury test standards (AS/NZS 4782.3:2014 and the IEC standards). The 2017 Determination explicitly lists these. It also adds a definition of IEC 62321 4 and IEC 62554.

The family of models provision was also revised. The 2012 Determination allowed families of up to five models with similar characteristics. The 2017 Determination retains the limit of five but makes the criteria more explicit, listing the required physical and performance characteristics that must be identical. This reduces ambiguity and likely makes enforcement easier.

The product classes table remains unchanged from 2012. The scope exclusions are also essentially the same. The 2017 Determination continues to declare covered products as category A. The labelling provision (no labelling required) is unchanged.

The Determination was made by the Minister for the Environment and Energy on 1 June 2017 and came into force six months after registration. There have been no subsequent amendments to this Determination as of the date of the source. However, the GEMS Act itself has been amended several times, and other GEMS determinations have been updated. The Determination is a static instrument; any future changes would require a new amending determination or a replacement.

The revocation of the 2012 Determination means that models registered under it are automatically taken to be registered under the new Determination (section 36 of the Act), except for those specifically listed in Schedule 1. Only one model, the Arlec F21T5, had its registration affected. The reason for this singling out is not apparent from the Determination; it may have been non compliant with the new standards or the supplier may have chosen not to transition.

The source text of the Determination does not record any litigation history, and no cases are cited. As a legislative instrument, the Determination itself is not typically the subject of direct litigation; rather, enforcement actions under the GEMS Act may lead to court proceedings. There is no publicly known Australian case that specifically discusses this Determination. However, the GEMS Act has been considered in a small number of administrative law matters, usually concerning the validity of determinations or the exercise of the Regulator’s powers.

A potential area of dispute is the interpretation of incorporated standards. Because the standards are not reproduced in the Determination, there could be arguments about whether a particular product meets the efficacy requirements if there is ambiguity in the standard. Courts would apply ordinary principles of statutory interpretation to the Determination, reading the incorporated standard as part of the instrument. The High Court of Australia has held that standards incorporated by reference are to be interpreted as at the date of incorporation (the rule in Collector of Customs v Agfa Gevaert Ltd). This reinforces the freezing of versions specified in section 4(3).

Another potential litigation avenue is judicial review of a decision by the GEMS Regulator to refuse registration or to cancel a registration based on alleged non compliance with this Determination. A supplier could seek review under the Administrative Decisions (Judicial Review) Act 1977 or under section 39B of the Judiciary Act 1903, arguing that the Regulator misapplied the Determination. The specific test methods and the family of models provisions could be contentious. For example, if the Regulator rejects a family of models because it considers the models do not have the same ‘geometric form factor’ (an undefined term), a court might need to interpret that phrase.

There is also a possibility of private litigation between suppliers and testing laboratories if incorrect test results lead to compliance failures. But that would be contract or negligence law, not directly about the Determination.

The Determination’s mercury limit could also lead to litigation in the context of product liability. If a lamp causes harm due to mercury exposure, the 5 mg limit might be used as evidence of what is a safe level. However, the Determination is a regulatory minimum, not a safety standard.

In summary, there is no recorded litigation specifically about this Determination. The risk of future litigation is moderate, given the commercial value of the lighting market and the potential for enforcement. But the Determination is now several years old, and the industry has likely adapted. The biggest legal risk for suppliers is administrative enforcement, not court proceedings.

Several aspects of the Determination can trip up unwary suppliers or compliance professionals.

First, the standards are frozen at the date the Determination came into force (six months after registration). This is not the date of making (1 June 2017) but the later commencement date. A supplier who checks the current version of AS/NZS 4782.2 and finds that it has been updated must still test against the older version. Conversely, a product designed to meet a newer, more stringent standard may not automatically comply if the older standard allowed lower efficacy. The freezing also means that if Standards Australia issues an amendment that corrects a typographical error, the error remains in the applicable standard for compliance purposes unless the Determination is amended.

Second, the family of models provision allows only five models per family. A supplier with a large range of colour temperatures or wattages within a product class might need multiple registrations. The requirement that all models share the same test report is particularly restrictive. If a supplier wants to add a model with a different colour rendering index, it would need its own report and cannot join the existing family. This increases per model costs.

Third, the mercury limit of 5 mg is absolute. There is no allowance for measurement uncertainty. If a test report shows mercury content of 5.1 mg, the product is non compliant, even if the measurement uncertainty of the test method is ±0.2 mg. Suppliers should build in a safety margin. The test methods themselves may have different detection limits and uncertainties; the Determination does not provide guidance on how to reconcile results from the two alternative methods. If the Regulator tests using one method and the supplier used the other, conflicting results could lead to dispute.

Fourth, the test temperature allowance for T5 high frequency lamps (35°C ambient instead of 25°C) is an option, not a requirement. The test report must clearly state which temperature was used. If the report uses 35°C but the standard’s test conditions normally require 25°C, the supplier must be prepared to justify that this is permitted. The Determination says ‘may be made at an ambient temperature of 35°C’, not ‘must’. A supplier could inadvertently use 25°C and obtain a lower efficacy reading, potentially failing to meet the minimum. Conversely, using 35°C could give higher efficacy, but the product must still comply under real world conditions.

Fifth, the definition of ‘luminaire’ in section 5(4) is broad and includes all parts necessary for fixing and protecting the lamps and connecting them to the supply. This could be interpreted to include the ballast. But the Determination’s scope covers lamps only, not luminaires. However, the phrase ‘for use in a luminaire’ is a scope condition. If a lamp is sold as a replacement part for a specific luminaire, it may still be covered. The exclusion for lamps ‘specifically for use in a flame proof luminaire’ is narrow; it requires the lamp to be designed specifically for that purpose, not merely used in one.

To comply with this Determination, a supplier of double-capped fluorescent lamps should follow a structured process.

Step 1: Determine if the product falls within scope. Check that the lamp is double capped, tubular, linear, for general illumination, for use in a luminaire, and designed for FD or FDH operation on a 230 V 50 Hz ballast. Confirm that the nominal length is between 550 mm and 1500 mm inclusive, and the nominal wattage is 16 W or more. If the lamp is outside these parameters, it is not covered and no GEMS registration is needed under this Determination, though other determinations may apply. If the lamp meets the scope, check whether it falls within any exclusion: dominant colour, colour matching with CRI >90, industrial/agricultural process, medical application, or flame proof luminaire. Document the basis for any exclusion claim.

Step 2: Identify the product class from the table in section 5(2) based on nominal length. This determines which efficacy and CRI minimums from AS/NZS 4782.2:2004 apply. Obtain a copy of that standard as it existed on the commencement date (six months after registration of this Determination). Note the precise version; do not rely on a later amended version.

Step 3: Conduct or commission testing for initial efficacy and maintained efficacy per the prescribed methods. For initial efficacy, use Annex B of AS/NZS 4782.1:2004. For T5 high frequency lamps, the test may be done at 35°C ambient; for all others, 25°C. For maintained efficacy, use Annex C. Ensure the test laboratory is familiar with the exact standard versions. Record the test results, including ambient temperature, lamp conditioning, and the calculated efficacy values. Compare against the minimum values in the standard for the product class.

Step 4: Test for minimum colour rendering index. The requirement is per clause 2.2 of AS/NZS 4782.2:2004. Again, use the prescribed test method from clause 2.3 of that standard.

Step 5: Test for mercury content. Choose either AS/NZS 4782.3:2014 or the combination of IEC 62321 4 and IEC 62554. Ensure the test method is followed strictly. The result must show mercury content not exceeding 5 mg per lamp. Given measurement uncertainty, it is prudent to aim for significantly lower than 5 mg, e.g., 4 mg or less, to allow for variability.

Step 6: Decide whether to register the model individually or as part of a family. If you have multiple models of the same brand within the same product class that share the same relevant physical and performance characteristics (size, form factor, colour temperature, CRI, efficacy, wattage), and you have one test report covering them, you can register up to five models together. Ensure that the test report covers the worst case model (e.g., the lowest efficacy or highest mercury). Do not exceed five models per family. Keep records showing that each model meets the same characteristics.
