Greenhouse and Energy Minimum Standards (Computers) Determination 2013

The Determination rests on several core legal and technical concepts. First, it establishes the product definition and scope. “Computer” is defined in functional terms: a device performing logical operations that must have a CPU, capability for standard input devices (keyboard, mouse, digitizer, game controller) and an integrated display or the ability to support an external display (s 3(2)). The tabulated breakdown in s 3(3) then elaborates five named types of computers: desktop, integrated desktop, notebook, tablet and small‑scale server, with specific physical or marketing‑based characteristics for each type.

Second, product classification and exclusions are a central mechanism. Section 5(1) places covered computers into four classes for regulatory treatment, but section 5(2) lists specific product types not covered. These exclusions are detailed and technology‑specific: for example, “slate computers” are excluded if they lack a physical keyboard, are supplied only with touchscreen input, connect to networks only via wireless systems and are primarily battery‑powered (s 5(2) item 8). “Thin client computers” are excluded when their main computation is performed remotely (s 5(2) item 9). High‑end Category D computers are excluded when they meet an explicit hardware profile including four or more cores, specified GPU class, at least six gigabytes RAM and a power supply unit of at least 500W nameplate output (s 5(2) item 10).

Third, the Determination incorporates standards as the substantive technical content. The relevant standards (AS/NZS 5813.1:2012, AS/NZS 5813.2:2012 and AS/NZS 5814.1:2012) are pulled into the regulatory framework by reference. The Determination specifies which clauses of those standards supply the MEPS (s 6(1) and (3)), which clauses set test methods (s 6(4)-(5) and s 8(2)), and which clauses define families of models (s 9(1) referencing clause 1.5.7 of AS/NZS 5813.2:2012). The Determination also references AS/NZS 4665.1:2005 where external power supply material is relevant (s 3 definitions).

Fourth, the “deemed‑to‑comply” concept creates a volume‑based alternative compliance route. If no more than 200 units of a model are supplied in the specified annual counting period, the model is treated as a deemed‑to‑comply computer and is subject to the requirements in clause 4.4 of AS/NZS 5813.2:2012 rather than the typical energy consumption provisions that apply to other models (s 6(2)-(3)). The Determination also prescribes different test procedures for deemed‑to‑comply models that are direct mains powered or use external power supplies (s 6(5)).

Fifth, there is a distinction between energy measurement requirements and labelling. The Determination prescribes measurement and MEPS clauses, and separately states there are no GEMS labelling requirements for the covered products (s 7). That decouples operational/measurable obligations from a requirement to affix an energy label under this Determination (although labelling could remain relevant under other parts of the Act or other instruments).

Sixth, the Determination contains procedural and interpretative rules: any term defined in a standard specifically mentioned in s 3 is to be read as having the meaning provided in that standard for the purposes of the Determination (s 4(1)); and where a standard refers to normative references, the version to be applied is the version as at commencement of the Determination (s 4(2)). Those provisions limit interpretative drift by tying legal meanings and test methods to the identified versions of standards.

Finally, families of models are regulated to constrain aggregation: models may be grouped per clause 1.5.7 of AS/NZS 5813.2:2012, but a family cannot exceed ten models (s 9(1)-(2)). That affects how compliance testing and declarations might be performed across model ranges.

Collectively these concepts link product identification, technical standards, counting rules and volume exceptions into a compliance framework applied to suppliers of specified computer types supplied to the Australian market at 230/240 volts mains.

The Determination places obligations and effects primarily on suppliers of the specified computer classes, and indirectly affects testing laboratories, standard‑writers and purchasers. The instrument repeatedly frames product obligations in terms of products “supplied” and uses definitions from the Greenhouse and Energy Minimum Standards Act 2012 (noted in s 3 and the note under s 3), thus importing the Act’s supply‑focused regulatory construct. Practically the following actors are affected:

• Manufacturers and brand owners who design, market and place computers on the Australian market. They must classify products under the Determination’s definitions (s 3(2)-(3)), ensure the model falls within one of the covered classes in s 5(1), and either meet the MEPS and test requirements set out in the referenced standard clauses (s 6(1), (4)) or rely on the deemed‑to‑comply pathway where permitted (s 6(2)-(3)). Manufacturers of excluded categories listed in s 5(2) will not be subject to these particular MEPS obligations under this Determination.
• Importers and distributors, who in the Act’s regime are typically treated as suppliers and therefore responsible for ensuring products they supply comply with the Determination (see the Determination’s repeated cross‑references to the Act’s supply concepts). Those actors must retain compliance evidence because the Determination prescribes test protocols and clauses which compliance officers may request to examine (s 6(4)-(5), s 8(2)).
• Retailers and resellers, to the extent they supply products into the market, may be affected by commercial decisions taken by upstream suppliers to alter product ranges, packaging, or pricing to accommodate compliance costs. While the Determination does not expressly impose duties on retailers, supply chain responsibility under the Act means retailers should be alert to whether items being sold are compliant.
• Testing laboratories and conformity assessment bodies, who will perform the tests required by the referenced standards (AS/NZS 5813.1:2012, AS/NZS 5813.2:2012, AS/NZS 5814.1:2012, and possibly AS/NZS 4665.1:2005 for external power supplies). The Determination specifies which sections/lists of those standards are the operative test requirements (s 6(4)-(5), s 8(2)). These bodies bear the operational burden of conducting tests in accordance with particular versions of standards as of the Determination’s commencement (s 3, s 4(2)).
• Consumers and institutional purchasers, who face indirect effects in prices, product availability and product design. Suppliers confronted with testing and compliance costs may change model offerings, adjust prices or modify energy management features to meet the network and power management requirements referenced in AS/NZS 5813.2:2012 section 4.3 (s 8(1)).
• Standards bodies and rights holders. The Determination incorporates specific standards and notes copyright restrictions (front matter). It directs users to purchase complete standards from Standards Australia Limited and indicates reproduction restrictions for the standards material (front matter and s 3 notes). Suppliers and laboratories therefore face the transaction cost of acquiring the standards.
• Entities producing external power supplies used with the covered products, because the Determination references external power supply testing standards and the separate External Power Supplies Determination 2012 for certain testing provisions (s 3 definitions, s 6(5)).

The Determination also has indirect market effects for product types whose inclusion or exclusion influences suppliers’ design choices. For instance, the specific exclusion of slate computers (s 5(2) item 8) and thin clients (s 5(2) item 9) may steer manufacturers towards or away from certain design decisions if they want to avoid MEPS requirements. The high‑end Category D exclusion (s 5(2) item 10) clearly delineates a class of high‑performance machines that fall outside the Determination’s scope.

Who pays: the immediate compliance costs fall on suppliers (manufacturers, importers, distributors), who must ensure models meet the specified MEPS and conduct or commission required testing in accordance with particular standards. Testing and standards acquisition costs, product redesign costs and ongoing compliance record‑keeping costs will be borne by those parties. Consumers pay indirectly through pricing and product selection changes driven by those supplier costs.

Who decides: the Minister made the instrument under s 23 of the Act (front matter). Beyond that, classification decisions rest with suppliers who apply the definitions in s 3 and the exclusion criteria in s 5(2); compliance bodies and authorities under the Act will interpret and enforce those definitions in practice.

The Determination sets out technical duties for suppliers by reference to standards and classifications. It does not itself set out civil penalties or enforcement procedures; those are matters of the principal Act and regulations. The duties and rights that follow from the Determination are primarily obligation to comply with specified measurement methods and GEMS level requirements, entitlement to rely on a deemed‑to‑comply pathway if the factual conditions are met, and a right to use the family of models provisions subject to a numerical cap.

Key duties imposed by the instrument:

• Duty to classify products accurately. Suppliers must determine whether a product is a “computer” within the Determination’s meaning (s 3(2)) and then which type it is under the tabulated definitions in s 3(3). This classification determines which class under s 5(1) applies, and whether the product may be excluded under s 5(2). The Determination instructs users to apply the versioned standards for undefined terms (s 4(1)), which creates a duty to consult the referenced standards when classifying ambiguous features.
• Duty to meet the MEPS expressed in particular clauses of AS/NZS 5813.2:2012. For non‑deemed‑to‑comply Class 1-3 products, suppliers must meet the typical energy consumption thresholds in subclauses 4.5.1 and 4.5.2 of AS/NZS 5813.2:2012 (s 6(1)(a)). For Class 4 products, suppliers must meet the idle and standby power mode consumption thresholds in subclause 4.5.3 (s 6(1)(b)). The Determination ties compliance to those standard clauses; failing to meet them means the product does not satisfy the Determination’s requirements.
• Duty to conduct testing under specified methods. For ordinary covered products the test method requirement is sections 2 and 3 of AS/NZS 5813.1:2012 (s 6(4)). For deemed‑to‑comply products the test method differs depending on power source: for direct mains power use AS/NZS 5814.1:2012 sections 2, 3 and 4; for external power supply powered products refer to subsections 6(2)-6(4) of the External Power Supplies Determination 2012 (s 6(5)). Section 8(2) reiterates the AS/NZS 5813.1:2012 test sections for covered products.
• Duty to satisfy performance requirements in section 4.3 of AS/NZS 5813.2:2012, which covers network and power management requirements (s 8(1)). That places obligations on device behaviour where network connection and power management features are concerned.
• Duty to respect family of models rules. Suppliers may use family testing as set out in clause 1.5.7 of AS/NZS 5813.2:2012, but families cannot exceed ten models (s 9(1)-(2)). This constrains how many models may be aggregated for testing and compliance declarations.

Key rights or allowable pathways:

• Deemed‑to‑comply relief. A supplier may treat a model as “deemed‑to‑comply” where no more than 200 units of the model are supplied in the specified 12‑month counting period (s 6(2)). A deemed‑to‑comply model is subject to the requirements in clause 4.4 of AS/NZS 5813.2:2012 (s 6(3)). This offers a simplified route for low‑volume models, albeit tied to alternative energy use requirements.
• No GEMS labelling requirement under this Determination. Section 7 states explicitly that there are no GEMS labelling requirements for the products covered by the Determination. Suppliers therefore are not required under this Determination to affix GEMS labels, although other instruments or the Act could impose labelling duties elsewhere.
• Right to rely on versioned standards. The Determination prescribes the applicable versions of standards (s 3 and s 4(2)). Suppliers can plan compliance against those specific versions rather than continuously adapting to later revisions.

Operational implications of the duties and rights:

• Suppliers must maintain records demonstrating how each model is classified, which tests were conducted and which standard clauses were applied. The Determination’s prescription of specific clauses and dated versions is an evidentiary baseline for compliance enforcement.
• The deemed‑to‑comply threshold creates an explicit-counting duty: suppliers must monitor the number of units supplied in each annual period that begins on the date after the first supply date for that model (s 6(2)(a)-(b)). This counting methodology means suppliers seeking the deemed‑to‑comply pathway must apply precise supply metrics and track anniversaries for each model.
• Family grouping is allowed but capped at ten models, which constrains testing economies of scale that suppliers might otherwise obtain by grouping large model ranges (s 9(2)).

The Determination does not itself prescribe fines, civil penalties, product recall rules or enforcement mechanisms. Those mechanisms are located in the principal Act and its regulations; the Determination focuses on technical obligations and the specific procedures and thresholds necessary to demonstrate compliance with the GEMS MEPS framework for computers.

The Determination is primarily a technical instrument and does not itself set out specific penalties, fines or enforcement procedures. It repeatedly notes its statutory basis in the Greenhouse and Energy Minimum Standards Act 2012 (see the instrument heading and the notes in s 5, s 6 and s 10), and therefore the enforcement and penalty framework that applies to breaches of its requirements resides in the Act and any associated regulations. The Determination makes no express modification to the Act’s enforcement regime.

Practical enforcement implications flowing from the Determination’s content include the following observable mechanisms and evidential expectations:

• Compliance evidence will centre on tests and documentation that show models meet the clauses of the referenced standards specified in s 6, s 8 and s 9. The Determination spells out particular clauses and sections of AS/NZS standards to be followed for measurement and MEPS (s 6(1)-(5); s 8(1)-(2)). Enforcement officers or authorised compliance bodies under the Act will therefore expect access to test reports, measurement records, and records of supply volumes for counting deemed‑to‑comply eligibility.
• The deemed‑to‑comply threshold (s 6(2)-(3)) creates a verifiable counting metric. Enforcement action could focus on whether a supplier has correctly counted supplies in the relevant counting period and whether the product met the clause 4.4 requirements of AS/NZS 5813.2:2012 if the supplier claimed deemed‑to‑comply status.
• Family of models claims are limited by s 9. An enforcement investigation could challenge the inclusion of a model within a family if that inclusion contravenes clause 1.5.7 of AS/NZS 5813.2:2012 or causes a family to exceed ten models, given the explicit bar in s 9(2).
• The Determination specifies which version of standards applies for normative references (s 4(2)). Enforcement will apply those versions as the legal benchmark rather than the most recent standard revisions. This reduces uncertainty over shifting technical thresholds but also means suppliers cannot rely on later standard revisions without legislative change.

Limitations and implementation risk in enforcement:

• The Determination does not create bespoke enforcement procedures. Enforcement actions, penalties, prosecution thresholds, and administrative sanctions are matters of the principal Act and any regulations. The Determination itself is silent as to the specific penalty architecture.
• The practical ability of enforcement agencies to verify compliance will depend on access to full standards, testing evidence and understanding of the numbering and dating conventions embedded in the instrument. The front matter emphasises copyright restrictions and requires purchase of standards from Standards Australia (front matter). That creates an evidential cost for both suppliers and enforcement bodies.
• Because testing clauses are specified at the clause and section level (for example sections 2 and 3 of AS/NZS 5813.1:2012 for ordinary products, s 6(4)), disputes are likely to be technical and expert‑intensive. Enforcement will have to rely on laboratory reports, test accreditation and technical interpretation of the standard language.

In short, the Determination supplies the technical benchmarks and evidentiary yardsticks that enforcement under the GEMS Act will use, but it delegates the exercise of coercive powers, sanctioning and procedural enforcement to the Act and subordinate instruments. Any practical enforcement action will centre on documentary evidence of classification, testing conducted in accordance with the listed standard clauses, supply volume records for deemed‑to‑comply claims, and family‑of‑models justifications.

The Determination operates as a legislative instrument made under the Greenhouse and Energy Minimum Standards Act 2012 and is therefore one node in that statutory framework. The text itself references the Act multiple times and instructs that expressions used in the Determination have the same meanings as defined in the Act where applicable (note under s 3). Key interaction features include:

• Dependence on the principal Act for enforcement and broader GEMS regime infrastructure. The Determination sets technical obligations; the Act provides the regulatory architecture for supply liability, enforcement, offences, powers of authorised officers, and labelling rules generally. The Determination explicitly notes that it is made under s 23 of the Act (instrument heading) and cross‑references Act provisions in notes to several sections (for example note under s 5).
• Cross‑instrument references within the GEMS regime. The Determination refers to the Greenhouse and Energy Minimum Standards (External Power Supplies) Determination 2012 specifically when prescribing test requirements for products powered by an external power supply that are deemed‑to‑comply (s 6(5)(b)). This creates a direct operational link: compliance with the computers Determination may require applying clauses from the external power supplies Determination.
• Incorporation by reference of Australian/New Zealand Standards. The Determination designates particular standards and dated versions as the operative technical content (s 3; s 4(2)). That creates a legal relationship between the Determination and privately authored standards documents. The Determination also clarifies that where a term is defined in a standard specifically mentioned, that definition applies for the Determination’s purposes (s 4(1)). Practically that means obligations are framed by the text and definitions in those standards, and any stakeholder seeking compliance must acquire and apply those standards exactly as dated in the Determination.
• Copyright and licensing interactions. The front matter draws attention to copyright restrictions for standards material and the need to purchase complete standards from Standards Australia Limited, and the Determination’s incorporation of standards therefore creates a copyright‑linked compliance cost. The Determination itself is Commonwealth copyright material under a Creative Commons licence except for standards content which remains subject to Standards Australia’s copyright conditions.
• Potential interplay with other product safety, telecommunications, electromagnetic compatibility and consumer protection laws. The Determination expressly addresses energy performance and network/power management (s 8(1)), but it does not displace obligations that suppliers may have under other laws governing safety, electromagnetic compatibility, telecommunications equipment rules or consumer guarantees. Suppliers must therefore consider compliance with this Determination alongside those regimes. The Determination neither negates nor replaces other statutory obligations; it acts as an additional, energy‑focused regulatory layer.
• Static reference to historic standard versions. Section 4(2) provides that versions of normative documents referenced by the standards are to be the versions existing at the date this Determination came into force. This creates a fixed technical reference point and prevents automatic incorporation of later amendments to standards. If broader regulatory or technical changes occur later, they will not alter compliance tests under this Determination unless the Determination is amended.

As a consequence, compliance with this Determination will often require navigating an ecosystem of legal instruments: the GEMS Act and associated enforcement rules, other GEMS determinations (for example the External Power Supplies Determination), and applicable Commonwealth or state laws applicable to electronic goods. Suppliers should also be aware of contractual and commercial obligations (warranties, reseller contracts) that interact with the Determination’s technical duties.

The Determination records its making date, commencement date and the specific versions of standards it incorporates. Mechanically the amendment history and versioning features embedded in the Determination are as follows:

• Instrument metadata. The Determination is dated 30 April 2013 and, under section 2, came into force on 1 October 2013. The instrument was made under section 23 of the Greenhouse and Energy Minimum Standards Act 2012 (instrument heading and s 1).
• Versioned standards specified by date. The Determination defines the operative versions of the standards by reference to the versions as they “existed” on particular dates:
  • AS/NZS 4665.1:2005 , as it existed on 27 February 2009 including amendments up to and including Amdt:1 (s 3).
  • AS/NZS 5813.1:2012 , as it existed on 17 July 2012 (s 3).
  • AS/NZS 5813.2:2012 , as it existed on 17 July 2012 including amendments up to and including the Amdt 1 made on 8 March 2013 (s 3).
  • AS/NZS 5814.1:2012 , as it existed on 17 July 2012 (s 3).
• Fixing normative reference versions. Section 4(2) clarifies that where a standard referred to in another standard (under a normative references heading) must be applied to give effect to the Determination, the operative version is the version that existed at the date this Determination came into force. That statutory saving ties downstream references to the same commencement‑era versions.
• No subsequent amendments recorded in the text provided. The instrument text as supplied does not include any later amendments or repeals. It sets out the standards and clauses to be used as at commencement; any subsequent legislative amendments to the Determination would be recorded on the Federal Register of Legislative Instruments and in the Act’s legislative history (the Determination includes a note to that effect pointing to frli.gov.au).

Implications of the amendment approach:

• The Determination’s incorporation of specific dated versions of standards creates a stable, known compliance baseline. Suppliers can plan to meet the requirements as they existed at commencement without needing to follow later standard revisions unless the Determination is itself amended.
• If standards bodies publish new versions with materially different test methods or thresholds after the dates specified, those new versions do not automatically apply to the Determination. That may increase administrative friction if suppliers wish to use newer test procedures or if equipment design evolves to exploit more modern energy‑saving features not contemplated by the specified versions.
• Any amendment to the Determination (for example to adopt later standard versions, change MEPS thresholds, or alter exclusions) would require a fresh instrument made under the Act. The Determination includes a procedural note citing the Federal Register of Legislative Instruments for registration and access to updates.

For any practitioner or compliance officer, the practical step is to check the Federal Register of Legislative Instruments and the GEMS database to confirm whether any amendments have been made after the instrument’s commencement date before relying on the Determination’s text for compliance actions.

The Determination itself does not record any litigation history. It is a regulatory technical instrument and the text provided includes no references to judicial decisions, disputes or challenge proceedings. Therefore, based on the content supplied, there are no named cases, tribunal decisions or statutory appeals recorded in the instrument.

However, the Determination contains several features that could, in practice, give rise to legal disputes and administrative reviews. Areas where litigation or legal contestation might arise include:

• Classification disputes. The Determination provides specific definitions (s 3(2)-(3)) and exclusions (s 5(2)). Ambiguous borderline devices could prompt disputes about whether a product is a “tablet computer”, “slate computer”, “notebook computer” or “thin client”. For example, devices with detachable keyboards or devices using both wireless and wired connectivity might be subject to different classifications. Enforcement actions or administrative decisions applying those classifications could be challenged on statutory interpretation grounds.
• Counting and deemed‑to‑comply eligibility. The deemed‑to‑comply threshold applies where “no more than 200 computers of the same model have been or will be supplied” in a defined annual period (s 6(2)). Disputes could arise over how to count supplies (which events count as supply under the Act), the applicable counting period for models supplied across calendar years, and whether promotional or demonstrator units are included. Suppliers denied deemed‑to‑comply status might seek merits review or judicial review of an administrative decision that applies the counting methodology.
• Family of models aggregation. The Determination allows family testing subject to clause 1.5.7 of AS/NZS 5813.2:2012 but bars families larger than ten models (s 9(1)-(2)). Disagreements over whether particular models legitimately belong to a family or whether the family cap has been exceeded could lead to legal contestation.
• Technical test disputes. The Determination prescribes specific clauses and sections of standards for test procedures (s 6(4)-(5), s 8(2)). Disputes could arise over the correct application of those clauses, laboratory accreditation, reproducibility of results, or acceptable tolerances in measurements. Those disputes are technical and would require expert evidence.
• Interaction with other regulatory obligations. Suppliers may face enforcement in parallel under other Commonwealth or state laws (product safety, telecommunications, consumer law). Litigation could involve arguments about which regulatory regime governs a specific product or whether a product's non‑conformity under the Determination constitutes a breach of other statutory duties.

Because the Determination fixes dated standard versions, another potential litigation node is whether an enforcement body may require compliance with later standard revisions indirectly. The Determination’s s 4(2) appears to prevent such reinterpretation, but contested enforcement actions could test the limits of that principle in administrative review or judicial contexts.

Absent any cases named in the instrument, practitioners should treat the Determination as a technical statutory instrument that will generate expert‑intensive compliance disputes rather than broad doctrinal litigation. For up‑to‑date litigation information, one must consult court records and the Federal Register of Legislative Instruments for any subsequent amendments or legal challenges.

The Determination contains a number of specific wording, counting and technical points that can produce non‑obvious compliance traps. Below are concrete “gotchas” drawn from the instrument text that practitioners and compliance officers should watch for.

1. Version locking of standards

• The Determination fixes particular versions of AS/NZS standards as they “existed” on specified dates (s 3; s 4(2)). That means later amendments or clarifications to the referenced standards do not automatically apply to compliance testing for these products. A supplier relying on a newer test method should confirm whether the Determination has been amended; otherwise, enforcement will apply the original versions.

2. Deemed‑to‑comply counting method and the “first supply” anniversary rule

• Deemed‑to‑comply status hinges on the count of supplies in the year commencing on the day after the first supply of that model and then each anniversary year (s 6(2)(a)-(b)). Practically that requires precise record‑keeping of the first supply date for each model. A model first supplied late in a calendar year will have a counting period that spans the following 12 months, which can be counterintuitive when aligning internal annual reporting cycles.

3. Family of models cap at 10 models

• Clause 1.5.7 of AS/NZS 5813.2:2012 is the rule for grouping models, but the Determination adds an absolute bar that a family cannot exceed 10 models (s 9(2)). Suppliers who have historically grouped more than ten models for testing will need to restructure test plans, possibly increasing testing costs.

4. The difference between “tablet computer” and “slate computer”

• The Determination includes “tablet computer” in s 3(3) item 4 and excludes “slate computers” in s 5(2) item 8. The distinction turns on whether the device is “supplied with both a touch‑sensitive screen and a physical keyboard” for the Determination’s definition of tablet (s 3(3) item 4) and whether it lacks a physical keyboard, is supplied only with touchscreen input, connects only via wireless and is primarily battery‑powered for the slate exclusion (s 5(2) item 8). Many modern devices have detachable keyboards, optional wired networking or hybrid power arrangements; classification differences can therefore be subtle and material to compliance.

5. External power supply testing cross‑reference

• For deemed‑to‑comply products powered by an external power supply, the Determination requires application of subsections 6(2)-6(4) of the External Power Supplies Determination 2012 (s 6(5)(b)). Compliance therefore requires familiarity not only with the computers Determination but also with the referenced External Power Supplies Determination. Missing that cross‑reference could cause incorrect testing.

6. No GEMS labelling requirement under this Determination

• Section 7 states there are no GEMS labelling requirements for products covered. That may be misread as meaning no labelling obligations whatsoever; however, other instruments or parts of the Act may impose labelling obligations. The correct reading is that this particular Determination does not impose a GEMS label requirement.

7. “Small‑scale server” coverage and different MEPS

• Small‑scale servers are included as Class 4 (s 5(1), Class 4) and are subject to different MEPS: idle and standby power mode consumption thresholds are in subclause 4.5.3 of AS/NZS 5813.2:2012 (s 6(1)(b)). Suppliers of small servers must ensure appropriate measurements of idle and standby, not the same “typical energy consumption” metrics applying to Class 1-3.

8. High‑end computer exclusion specific hardware thresholds

• The high‑end Category D exclusion is narrowly defined by multiple hardware thresholds (s 5(2) item 10). A device narrowly missing one threshold may be captured; small specification differences can change whether a device is excluded or included. Suppliers should apply the literal hardware criteria when assessing coverage.

9. Copyright and access to standards

• The Determination requires reliance on clauses of AS/NZS standards. The front matter warns that full standards must be purchased from Standards Australia, which introduces a direct cost to compliance and may delay testing while standards are acquired. Practitioners must budget for standards procurement.

10. Network and power management requirements

• Section 8(1) imports the network and power management requirements in AS/NZS 5813.2:2012 section 4.3. These are functional behavioural requirements and may require firmware or OS settings that influence user experience. Suppliers must ensure that default settings and network behaviours comply with the standard's expectations.

11. The Determination’s silence on enforcement detail

• Because the Determination does not state enforcement mechanisms or penalties (it defers enforcement to the Act), parties may misread the instrument as providing a complete compliance picture. Practitioners must review the Act and any regulations to understand enforcement risks fully.

These “gotchas” are concrete operational features that can catch suppliers unaware: counting period peculiarities, family size limits, cross‑instrument testing rules, specific hardware thresholds for exclusions and reliance on dated versions of standards. Each of these can lead to unexpectedly different compliance obligations and costs depending on product design and supply strategy.

Compliance requires a structured process aligned to the Determination’s definitions, classification rules, testing clauses and counting rules. The following practical compliance roadmap is grounded in the Determination’s provisions.

1. Determine whether the product is covered

• Apply the Determination’s definition of “computer” in s 3(2): confirm the device has a CPU, supports user input devices and has an integrated display or supports an external display screen.
• Map the device to the types in s 3(3) (desktop, integrated desktop, notebook, tablet, small‑scale server) using the textual definitions. Pay close attention to specifics such as “designed for portability”, “integrated battery”, “single power cable” and whether the display is physically combined or powered from the same supply.
• Check excluded product lists in s 5(2) item 1-10. If any of those exclusions apply (for example “slate computer” per s 5(2) item 8, “thin client” per s 5(2) item 9), the Determination does not apply.

2. Classify product class under s 5(1)

• If the product is covered, assign it to Class 1, 2, 3 or 4 per s 5(1). Class assignment determines which MEPS clauses apply.

3. Decide whether to use the deemed‑to‑comply pathway

• Assess likely supply volumes. A model is a “deemed‑to‑comply” computer where no more than 200 units of the same model are supplied in the relevant 12‑month counting period that begins the day after the first supply (s 6(2)). Keep accurate records of the first supply date and subsequent supplies to apply this rule correctly.
• If the model qualifies as deemed‑to‑comply, plan testing and documentation according to clause 4.4 of AS/NZS 5813.2:2012 (s 6(3)) and the testing pathways in s 6(5). If the model does not qualify, use the standard MEPS clauses for the class.

4. Acquire the specified standards and apply the correct versions

• Purchase the full texts of:
  • AS/NZS 5813.1:2012 (measurement methods)
  • AS/NZS 5813.2:2012 (MEPS)
  • AS/NZS 5814.1:2012 (internal power supplies test methods) where relevant
  • AS/NZS 4665.1:2005 (external power supplies) where relevant.
• Use the versions and amendments identified in s 3 and apply the normative reference versioning rule in s 4(2). Do not substitute later versions unless the Determination has been formally amended.

5. Conduct required testing

• For ordinary covered products (non‑deemed‑to‑comply), conduct tests per AS/NZS 5813.1:2012 sections 2 and 3 as required by s 6(4) and s 8(2).
• For Class 1-3 products, ensure the product meets the typical energy consumption requirements set out in subclauses 4.5.1 and 4.5.2 of AS/NZS 5813.2:2012 (s 6(1)(a)).
• For Class 4 products, test for idle power mode consumption and standby (off) power mode consumption per subclause 4.5.3 of AS/NZS 5813.2:2012 (s 6(1)(b)).
• For deemed‑to‑comply products:
  • If the product has a direct mains connection, test per AS/NZS 5814.1:2012 sections 2, 3 and 4 (s 6(5)(a)).
  • If the product is powered by an external power supply, apply the methods set out in subsections 6(2)-6(4) of the External Power Supplies Determination 2012 as required by s 6(5)(b).
• Ensure laboratories are accredited and can attest that tests followed the correct sections and versions of the standards specified.

6. Meet network and power management requirements

• Implement and document compliance with network and power management requirements contained in section 4.3 of AS/NZS 5813.2:2012 as required by s 8(1). This may involve default power state settings, wake/sleep network behaviour and firmware-level power management.

7. Family of models strategy

• Where appropriate, use family grouping in accordance with clause 1.5.7 of AS/NZS 5813.2:2012 (s 9(1)) to reduce testing burden, but ensure no family exceeds ten models (s 9(2)). Maintain documentation showing why models grouped together meet the family‑of‑models criteria.

8. Documentation and record keeping

• Keep records of product classification decisions, first supply dates, supply counts, test reports, laboratory accreditation, firmware/power management settings and family grouping justifications. Records will be the primary evidence relied upon in any enforcement action because the Determination ties compliance to specific tests and counting rules.
• Maintain audit trails for supply counts to justify deemed‑to‑comply claims.

9. Pricing, labelling and market communications

• Although s 7 states there are no GEMS labelling requirements under this instrument, suppliers should review other parts of the Act and related instruments to confirm whether other labelling or disclosure obligations apply. Avoid claiming GEMS labelling unless legally permitted.

10. Supplier and supply chain alignment

• Ensure contracts with OEMs, ODMs, contract manufacturers and importers allocate responsibility for compliance testing, records retention and notifications. Because the Act framework treats a range of parties as suppliers, contractual clarity reduces enforcement and commercial risk.

11. Monitor for amendments

• Regularly check the Federal Register of Legislative Instruments and GEMS updates for amendments to the Determination or changes to the applicable standards versions. The Determination locks in specific versions; any change to those versions in the Determination requires formal legislative amendment.

12. Budget for costs

• Budget for standards purchase, testing costs, firmware/OS power management development, potential redesign to meet MEPS, and administrative processes to track supply counts and family sizes. Testing may require accredited laboratory time and multiple test runs to verify idle, standby and typical consumption metrics.

Following these steps will produce a defensible compliance posture corresponding to the Determination’s requirements (s 3-10). The Determination’s clarity about which clauses and versions apply simplifies compliance in a technical sense but imposes detailed record‑keeping and testing obligations which must be executed precisely.
