Greenhouse and Energy Minimum Standards (Clothes Washing Machines) Determination 2024

The instrument depends on a set of technical concepts and statutory constructs drawn from the GEMS Act and the referenced Australian/New Zealand Standards. Understanding those concepts is essential for compliance and regulatory planning.

PAEC (projected annual energy consumption) is the primary metric for the energy cap. It is defined in the instrument as the PAEC calculated in accordance with AS/NZS 2040.2:2021 and measured in kilowatt‑hours per year (cl 6). The energy ceiling applicable to a clothes washing machine model is expressed as PAEC ≤ 700 + 124 × rated load capacity (cl 8(2)). The constants 700 (kWh/year) and 124 (kWh/year per kg) are explicit in the text (cl 8(2) and accompanying note), so compliance depends directly on the model’s rated load capacity figure and the PAEC derived from standardised testing protocols.

Rated load capacity is the manufacturer‑claimed maximum mass of textile material that can be treated in all operations, measured in multiples of 0.5 kg and including an 8% allowance for moisture in a cotton load (cl 6). The definition cross‑refers to AS/NZS 2040.1:2021 clause 1.4.19 and explains that rated load capacity is typically claimed in product literature such as the operating manual (cl 6, note).

Star rating index is the claimed energy efficiency indication determined under clause 2.7 of AS/NZS 2040.2:2021 (cl 6). The instrument does not itself set star rating bands; it relies on the AS/NZS standard’s algorithms and label format (cl 6; cl 9(2)).

Energy rating label is defined by reference to the content and format requirements in sections 2 and 5 of AS/NZS 2040.2:2021 (cl 6). The instrument requires that the label accompany the product or its packaging at retail in GEMS retail premises (cl 9(3)).

Product class scope is set out in cl 7. The instrument covers electric household clothes washing machines regardless of context (cl 7(1) and notes). Examples in the notes include top loading non‑drum washers, drum type washers (front and top loading), multi‑compartment machines, and combination washer/dryer units (cl 7(1) note 3). However, three narrow categories are excluded: (a) machines ≤2 kg rated load with no mains water connection and no pump or extraction mechanism (cl 7(3)(a)); (b) machines only capable of cold wash operations meeting a list of conditions (cl 7(3)(b)); and (c) machines with rated load capacity <1 kg (cl 7(3)(c)). These exclusions are express and must be applied when determining whether a product is “covered by” the determination for GEMS purposes.

Testing and performance: the instrument delegates to AS/NZS 2040.2:2021 for test requirements, calculations and algorithms for the energy label and for test procedures (cl 8(3), cl 9(4)). For performance measures beyond energy use, the instrument specifies requirements in AS/NZS 2040.2:2021 clauses 3.2, 3.4, 3.5 and 3.6 (percentage soil removal, water extraction index, severity of washing action index, rinse performance) and refers back to AS/NZS 2040.1:2021 for some test details (cl 11(1)-(2) and notes).

Families of models is a statutory device to reduce duplication of testing. Two or more models are in the same family for s 28 of the Act if they are declared to the GEMS regulator and meet the instrument’s criteria: same energy performance characteristics relevant to compliance (including comparative energy consumption and star rating index), same physical characteristics relevant to compliance (including rated load capacity), and reliance on a single test report prepared prior to application for registration (cl 12(1)-(2)). The family mechanism allows a single test report to support multiple models, subject to the specified sameness requirements and regulator declaration.

Transitional labelling is permitted for models registered before the commencement day: those products may comply with either this instrument’s labelling requirements or the old determination’s labelling (cl 10(4)). The instrument also sets a mechanism for treated compliance where future replacement determinations include transitional provisions (cl 9(5)).

Product categorisation: models covered by this instrument are Category A products for the purposes of s 29 of the Act (cl 13). The instrument does not unpack the legal consequences of Category A within this text; that is governed under the GEMS Act.

Other practical concepts include GEMS retail premises (definition in cl 6) and the preservation of existing registrations (cl 14). The instrument integrates the 2021 versions of the AS/NZS standards as the compliance baseline (cl 6), which has intellectual property and access implications (Copyright section).

The instrument primarily affects manufacturers, importers, brand owners, testing laboratories, product certifiers, and retailers involved in the supply chain of electric household clothes washing machines in Australia. The statutory chain of responsibility follows the GEMS Act, and this instrument specifies product‑level technical and labelling requirements that those entities must meet before and at the point of retail supply.

Manufacturers and brand owners are responsible for determining rated load capacity (cl 6), conducting or commissioning tests to derive PAEC under AS/NZS 2040.2:2021 (cl 8(3), cl 9(4)), preparing or commissioning energy rating labels in the format required by section 5 of AS/NZS 2040.2:2021 (cl 9(2)), and ensuring star rating claims are consistent with the standard (cl 6). They also decide whether to group models into families and, if so, must ensure the models satisfy the sameness criteria and rely on a single pre‑registration test report (cl 12).

Importers and suppliers must ensure that products they bring into Australia are registered where required under the Act and the model’s PAEC and labelling comply with the instrument before supply (see cl 8 and cl 9). Retailers that operate GEMS retail premises (as defined in cl 6) must display products with their energy rating labels accompanying the product or packaging at the time of retail supply or offer for retail supply (cl 9(3)). The instrument limits the labelling obligation to “GEMS retail premises” (cl 9(3)), a statutory concept derived from the Act (cl 6 definition), so the immediate obligation is tied to physical premises where products are displayed for retail supply.

Testing laboratories and conformity assessment bodies are affected because the instrument requires that test procedures be those in AS/NZS 2040.2:2021 section 2 for energy labelling and other specified clauses for performance (cl 8(3), cl 9(4), cl 11(2)). These bodies will carry the operational burden of performing standardised testing to produce test reports that manufacturers or registrants use in registration applications (cl 12(2)(c), referencing s 41 of the Act for registration applications).

Consumers and purchasers are indirect stakeholders: the instrument mandates energy rating labels to accompany products at retail premises (cl 9(3)), enabling consumers to compare energy consumption and star ratings prepared under a common standard. The instrument’s energy ceiling affects the range of models available in the market by excluding models that cannot meet the PAEC limit.

Small‑scale and specialised product makers are specifically affected by the exclusions in cl 7(3). Products that meet the narrow criteria in cl 7(3)(a) (portable, ≤2 kg load, no mains water connection, no pump/extraction) or cl 7(3)(b) (cold‑wash‑only appliances meeting enumerated conditions) or cl 7(3)(c) (rated load <1 kg) are not covered by this determination. This creates a carve‑out for certain niche or portable appliances; manufacturers whose products fall into these categories are not subject to the PAEC ceiling and labelling duties set out here.

Regulatory actors, including the GEMS Regulator, are central decision‑makers: the instrument relies on regulator processes for declaring families of models (cl 12(1)(a)), for the registration of models under the Act (cl 12(2)(c) referencing s 41), and for linking transitional compliance if future determinations include reciprocal transitional provisions (cl 9(5)). The instrument therefore affects regulator workload in terms of assessing declarations, registrations and compliance.

Finally, the instrument affects businesses that rely on the technical standards documents, because AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021 are copyrighted and must typically be purchased from Standards Australia (Copyright section; cl 6 notes). This imposes an information‑access cost on those who must apply the standards for testing, labelling and compliance.

The instrument creates a set of concrete duties for anyone supplying covered clothes washing machines in Australia, and it preserves a small set of rights for existing registrants.

Primary duties

• Comply with the PAEC ceiling. For the purposes of ss 24(1)(a) and 25(a) of the Act, each model’s PAEC must satisfy PAEC ≤ 700 + 124 × rated load capacity (cl 8(1)-(2)). This is a model‑level numerical limit derived from standardised testing.

• Conduct tests according to AS/NZS 2040.2:2021 section 2. The instrument specifies that the requirements for conducting tests for energy determination and labelling are those in section 2 of AS/NZS 2040.2:2021 (cl 8(3), cl 9(4)). For product performance metrics listed in cl 11, the relevant clauses of AS/NZS 2040.2:2021 (3.2, 3.4, 3.5, 3.6) apply.

• Provide energy rating labels. The instrument specifies GEMS labelling requirements by incorporating section 5 of AS/NZS 2040.2:2021 (cl 9(2)). Additionally, at the time of retail supply or offer of retail supply at a GEMS retail premises, an energy rating label must accompany the product or its packaging (cl 9(3)).

• Ensure product performance criteria. Clauses referenced in cl 11 require that models meet specified performance metrics for soil removal, water extraction, wash action severity and rinse performance, as provided in AS/NZS 2040.2:2021 (cl 11(1)).

• Declare family membership if relying on family testing. If multiple models are to be treated as a family under s 28 of the Act, they must be declared to the GEMS Regulator and meet the sameness criteria in cl 12 (cl 12(1)-(2)).

• Maintain accurate product claims and literature. Rated load capacity is the manufacturer’s claim (cl 6), and product literature and manuals should align with the functional limitations and labelling obligations discussed in the definition of energy rating label and in the exclusions for cold‑only appliances (cl 6; cl 7(3)(b)).

Rights and transitional protections

• Existing registrations preserved. Models that were registered under the old determination remain registered and are taken to be registered under this new instrument (cl 14). This is an explicit right that avoids immediate de‑registration or the need for re‑registration at commencement.

• Transitional labelling choice for pre‑commencement registrations. For models registered before the commencement day and supplied while that registration is in force, the product may comply with either the labelling requirements of this instrument or the old determination (cl 10(2)-(4)). This gives registrants a binary compliance path for a transitional period.

Operational duties to the regulator and recordkeeping

• The family mechanism requires that models rely on a single test report prepared prior to the registration application (cl 12(2)(c)). This imposes a sequencing duty: testing, report preparation and registration application timing must align with the family‑of‑models strategy.

• Compliance with the AS/NZS standards will likely necessitate retention of test reports and evidence to support PAEC and star rating claims, as these documents are the foundation for any registration or regulator assessment (cl 8(3), cl 9(4), cl 12(2)(c), cl 11(2)).

Delegated or implied duties under the Act

• While the instrument itself does not list penalties, many duties are enforceable under the GEMS Act because the instrument specifies GEMS level and labelling requirements “for the purposes” of the relevant paragraphs in the Act (see cl 8(1), cl 9(1), cl 11(1)). Therefore, failure to meet the instrument’s requirements is actionable under the Act’s enforcement provisions, including registration consequences and enforcement action by the GEMS Regulator; those specific mechanisms and penalties are in the Act rather than in this instrument (cl 3 and cross‑references).

Practical limitations and rights

• The instrument limits the scope of its duties by defining product exclusions (cl 7(3)). If a product satisfies an exclusion (for example, a true portable non‑mains‑connected washer with ≤2 kg rated load and no extraction), then the duties in cl 8, cl 9 and cl 11 do not apply.

• The instrument also offers a mechanism (cl 9(5)) to recognise compliance where a future replacement determination contains transitional labelling provisions that treat compliance with the replacement requirement as compliance with the revoked requirement. This preserves rights across regulatory updates when the replacement determination explicitly provides a reciprocal transitional provision.

This instrument does not itself create offence provisions or specify monetary penalties. Instead, it operates as a GEMS determination made under ss 23 and 35 of the Greenhouse and Energy Minimum Standards Act 2012 (cl 3), thereby prescribing GEMS level and labelling requirements to which the Act’s enforcement and penalty regimes apply. The instrument repeatedly frames its requirements “for the purposes of” specific paragraphs in the Act (for example cl 8(1) for ss 24(1)(a) and 25(a) of the Act; cl 9(1) for paragraph 24(1)(b) of the Act; cl 11(1) for subsection 24(2) and paragraph 27(1)(b) of the Act). That construction means the Act’s compliance, registration suspension, enforcement notices, injunctions, and penalties attach to contraventions of the requirements set out here, but the instrument itself delegates the precise enforcement architecture to the parent statute.

Practical enforcement pathways that flow from the instrument’s drafting include:

• Registration enforcement. Because models must meet the PAEC and labelling requirements to be lawfully registered and supplied, the GEMS Regulator will assess registrations and may suspend, cancel or refuse registrations under the Act if the model does not comply with the instrument’s requirements. The instrument explicitly preserves registrations from the old determination (cl 14), but new registrations and renewals must satisfy this instrument’s requirements when it commences.

• Compliance at retail premises. The instrument requires that an energy rating label accompany the product or its packaging at the time of retail supply or offer of retail supply at a GEMS retail premises (cl 9(3)). Retailer non‑compliance with this display requirement will be addressed under the Act’s labelling and supply provisions, not within this instrument.

• Test report and family declaration scrutiny. The instrument requires that family groupings rely on a single test report prepared prior to the registration application (cl 12(2)(c)). The regulator can scrutinise test reports and family declarations through the Act’s investigatory powers and may take regulatory action where reports are deficient, misrepresented, or lacking.

• Product performance and safety interplay. The instrument specifies performance requirements (cl 11) which, if breached in a way that constitutes false or misleading claims, may trigger action under consumer protection laws; while the instrument does not assert those other regimes, the practical enforcement environment will include intersections with the Australian Consumer Law and other statutory frameworks.

Points to note about enforcement burden and uncertainty

• Because the instrument relies on AS/NZS standards for testing and labelling (cl 6; cl 8(3); cl 9(2)-(4); cl 11), the accuracy, reproducibility and availability of testing facilities and competent test reports are central to enforcement. The instrument does not itself set accreditation criteria for laboratories; those operational details will be handled by regulator guidance and the standard procedures.

• The instrument’s preservation of pre‑commencement registrations (cl 14) and the transitional labelling choice for models registered before commencement (cl 10(2)-(4)) create staggered compliance obligations, which can complicate enforcement priority and monitoring.

• The instrument references regulator functions such as declarations of families (cl 12(1)(a)) and registration applications under s 41 of the Act (cl 12(2)(c)). The practical enforcement capacity depends on regulator resourcing and the procedures established under the Act, which the instrument does not itself specify.

In short, the instrument prescribes binding technical and label duties and thereby triggers the Act’s enforcement regime, but particulars of penalties, investigative procedures and administrative enforcement are located in the GEMS Act and related regulator instruments, not within this Determination text.

This Determination operates as a statutory instrument under the Greenhouse and Energy Minimum Standards Act 2012. It does not exist in isolation; its practical operation intersects with other legal instruments and concepts, and those interactions determine compliance risk and regulatory scope.

Primary statutory integration

• GEMS Act 2012. The Determination is made under ss 23 and 35 of the Act (cl 3). The instrument frames its provisions to fulfil the Act’s definition of GEMS level requirements, GEMS labelling requirements and related regulatory constructs (see cl 8, cl 9, cl 11). Consequently, compliance, registration, enforcement and penalties are to be pursued under the Act’s powers and processes. The Determination repeatedly references specific paragraphs and sections of the Act (for instance, ss 24, 25, 26, 27, 28, 29, 35, 36 and 41 are invoked implicitly or explicitly in cls 8-14), meaning that parties must read both the Act and this instrument together.

• Australian Consumer Law and product safety law. While not referenced directly in this Determination, practical interaction with consumer protection regimes is inevitable. The Determination requires accurate labelling and performance claims calibrated by the AS/NZS standards (cl 9, cl 11). Misleading energy claims or non‑conforming labels could also engage the Australian Consumer Law and product safety obligations. The Determination does not displace those existing obligations.

Standards and intellectual property

• AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021. The Determination embeds these standards as the technical backbone for testing, labelling and performance assessment (cl 6; cls 8, 9, 11). The Determination notes explicitly that those standards are available from Standards Australia and are subject to copyright; reproducing the standards is limited (Copyright section). Practically, this means compliance requires access to copyrighted materials, and that access cost is a compliance cost. It also means that interpretations of test procedures default to the standards’ text.

• State and territory laws. The Determination prescribes federal regulatory requirements for supply and labelling that will coexist with state and territory consumer protection and product safety frameworks. It does not purport to override state or territory laws that operate concurrently; businesses must ensure compliance with both federal GEMS obligations and any applicable local requirements.

Registration and regulatory instruments

• Previous GEMS Determination (2015). The Determination expressly revokes and replaces the old Determination (cl 5; Schedule 1). It also preserves registrations made under the old Determination by taking them to be registrations under this instrument where they are not affected (cl 14). That preserves continuity and avoids immediate conflicts between instruments.

• Future GEMS determinations. The instrument contains a mechanism to recognise compliance where a replacement determination includes reciprocal transitional labelling provisions (cl 9(5)). This creates an explicit pathway for the regulator to coordinate transitions across successive determinations, limiting gaps in labelling compliance when the regulatory standard changes.

Market regulation and labelling obligations

• Retail obligations are limited to GEMS retail premises as defined in cl 6. The Determination’s labelling duty (cl 9(3)) applies where products are “displayed for the purposes of retail supply or offers of retail supply” at premises that are GEMS business premises. That definition interacts with the Act’s concept of GEMS business premises and will determine whether particular retailing models (for example, online marketplaces without a physical display) are subject to the same display obligations.

Operational interfaces and compliance workflows

• Testing accreditation and conformity assessment. The Determination requires testing in accordance with the AS/NZS standards (cl 8(3), cl 9(4), cl 11(2)). The Determination does not itself define laboratory accreditation or conformity assessment schemes; these practical elements will be managed under regulator guidance and any applicable international testing accreditation frameworks, and they will intersect with other regulatory requirements such as those under the National Measurement Act or relevant standards for test laboratories.

In summary, the Determination must be read in tandem with the GEMS Act, the AS/NZS standards (which are incorporated by reference and copyrighted), and broader consumer law and product safety frameworks. The Determination sets the federal technical floor; other legal obligations remain concurrently applicable.

This instrument expressly revokes and replaces the earlier Greenhouse and Energy Minimum Standards (Clothes Washing Machines) Determination 2015 (cl 5; Schedule 1). The revocation is unconditional: Schedule 1 repeals the whole 2015 instrument. Clause 5 notes the operation of s 35(2) of the Act, which provides that a revoked determination ceases to be in force immediately before the replacement determination comes into force. Clause 14 preserves registrations made under the old determination by providing that those registrations are not affected and are taken to be registrations against this instrument (cl 14 and note).

The instrument adopts the 2021 versions of the key Australian/New Zealand Standards: AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021 (cl 6). This is a substantive technical update compared with prior instruments that referenced earlier versions of the standards. Embedding the 2021 standards updates the methods for measuring performance, energy and water consumption, and updates algorithms and labelling requirements for star ratings and energy labels (cl 6 notes; cl 8(3); cl 9(2)-(4); cl 11). The copyright section reiterates that the standards are third‑party copyright material requiring acquisition from Standards Australia.

Commencement mechanics are set out in cl 2. The whole instrument commences the day after the end of the period of 12 months beginning on the day the instrument is registered (cl 2(1)). This provides a fixed transitional lead time between registration and operation. The instrument defines “commencement day” (cl 6) to anchor transitional provisions such as those in cl 10.

The instrument includes transitional labelling provisions for models registered under either the old determination or this instrument before commencement (cl 10). Specifically, models registered before the commencement day and supplied while registration remains in force may comply with either the labelling requirements of this instrument or those of the old determination (cl 10(2)-(4)). That transitional rule is an amendment‑management mechanism to smooth the shift from the 2015 instrument to the 2024 instrument.

The instrument also anticipates future replacements. Clause 9(5) provides that if the instrument is revoked and replaced and the replacement determination includes a transitional labelling requirement that treats compliance with the replacement requirement as compliance with the revoked requirement, then the revoked requirement is taken to be complied with. This clause sets a self‑executing bridge for future amendments when they provide reciprocal transitions.

No other amendment history is recorded in the text. The instrument itself is the latest iteration and includes the repeal of the prior instrument in Schedule 1. Any subsequent amendments to the Determination would be recorded through statutory amendment processes under the Act and as new schedules or replacement determinations.

The Determination text contains no references to litigation, court decisions, or judicial consideration. It does not cite any cases, nor does it summarise litigation history relating to the earlier Determination. The instrument is a statutory administrative instrument; it integrates technical standards and sets compliance obligations, but it does not, within its text, report past litigation or judicial interpretation.

Implications for prospective litigation and compliance risk

• Enforcement and judicial review. Although the Determination itself is not accompanied by litigation history, its requirements will become enforceable under the GEMS Act. Any enforcement action taken by the GEMS Regulator, or any administrative decision about registration, suspension or cancellation, will be reviewable in the courts or tribunals according to the procedural and judicial review pathways in the Act and general administrative law. The Determination does not preclude such review but does not address it directly.

• Standards interpretation disputes. Because the Determination incorporates AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021 as the test and labelling baseline (cl 6; cl 8(3); cl 9(4); cl 11(2)), disputes over the interpretation or application of standardised test procedures could give rise to contested regulatory or contractual disputes. Questions may arise about the proper conduct of tests, the calibration of equipment, or the translation of a test result into PAEC and star ratings under the standards’ algorithms.

• Family declarations and evidentiary challenges. The family‑of‑models mechanism (cl 12) depends on the sameness of energy and physical characteristics and on reliance on a single test report prepared prior to registration. Where manufacturers declare families but rely on incomplete or contested test evidence, disputes could arise over the validity of registrations, potential misrepresentation, or regulator reliance on family declarations.

• Transitional compliance and retroactivity claims. Clause 10 offers transitional labelling options for models registered before commencement, and clause 14 preserves old registrations. Nevertheless, disputes could arise over whether particular supplies or offers for supply fall within the transitional regime, particularly where migration of stock or imports crosses the commencement threshold.

Because the Determination does not itself record litigation, any legal precedents that will shape future interpretation will emerge only after regulator action or private litigation occurs post‑commencement. Practitioners should monitor enforcement activity and any judicial interpretation arising under the GEMS Act once the Determination is operational.

The Determination contains several technical and procedural features that can create pitfalls for manufacturers, importers, retailers and advisers. These are items that may be overlooked or misinterpreted if one reads only the headline obligations.

1. PAEC formula and dependence on rated load capacity (cl 8(2)). The energy ceiling is not a flat kWh/year cap; it varies with rated load capacity via the formula PAEC ≤ 700 + 124 × rated load capacity. That means a model’s permitted PAEC increases linearly with the claimed rated load. Two practical consequences follow: first, the manufacturer’s declared rated load directly affects the allowable energy consumption, so the rated load figure is a regulatory lever; second, inconsistencies between declared rated load in product literature and the figure used in PAEC calculations can create compliance risk. The rated load capacity is measured in multiples of 0.5 kg and includes an 8% moisture allowance for cotton loads (cl 6). Beware of small differences in rounding or declaration practice.

2. Exclusions are narrow but specific (cl 7(3)). If a product is a portable, non‑mains water washer with a rated load ≤2 kg and no pump/extraction mechanism, it falls out of scope (cl 7(3)(a)). Similarly, cold‑wash‑only machines that satisfy a defined list of conditions are excluded (cl 7(3)(b)). These exclusions are functionally narrow and precisely worded: manufacturers should be careful that marketing literature, manuals, or software that suggest more functionality than the exclusion permits will bring the product into coverage. For example, a cold‑only unit that includes a program indirectly suggesting other wash types may lose the exclusion (cl 7(3)(b)(iv)).

3. Labelling duty tied to “GEMS retail premises” (cl 9(3)). The requirement that an energy rating label accompany the product or packaging applies at GEMS retail premises, defined in cl 6 by reference to the Act. Retailers that sell online but do not physically display products in premises that meet the GEMS definition may have different immediate obligations under this Determination. Parties selling through multiple channels need to map their retail model to the Act’s definition to determine when and where physical labels must be present.

4. Access to standards is not free (Copyright section; cl 6 notes). The Determination incorporates AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021 by reference, but those standards are copyright material sold by Standards Australia. Compliance therefore imposes an information cost , the need to purchase and rely on a copyrighted standard to perform tests, prepare labels and validate claims. The Determination notes the copyright constraints and limits on reproduction (Copyright section).

5. Family‑of‑models reliance on a single test report must be prepared before registration (cl 12(2)(c)). If a registrant intends to group models into a family, the single test report must exist prior to the registration application. That sequencing requirement means testing and test report commissioning must be planned and timed correctly; otherwise, the family grouping may be invalid.

6. Transitional labelling choice for pre‑commencement registrations (cl 10). Models registered prior to commencement may comply with either the old or new labelling regime while the registration remains in force. However, the supply timing, whether before or after commencement, and the location of manufacture or importation are irrelevant to the transitional choice (cl 10(3)), so careful recordkeeping of registration dates and inventory movement is crucial to avoid inadvertently non‑complying supplies.

7. Product performance metrics beyond energy (cl 11). The Determination imposes performance criteria for soil removal, water extraction index, wash action severity and rinse performance via specified clauses in AS/NZS 2040.2:2021 (cl 11(1)). Compliance is not solely an energy test; poor performance on those indices could affect registration or marketability. Manufacturers must ensure holistic compliance across energy and performance metrics.

8. Legal consequences live in the Act, not the Determination (cl 3; cls 8-11 refer to Act paragraphs). Because enforcement, penalties and many administrative mechanisms are in the GEMS Act, parties must map the Determination’s obligations into the Act’s enforcement architecture. Practitioners should not assume the Determination sets out complete enforcement processes.

9. Small differences in definitions matter. For example, “energy rating label” is defined by reference to two separate sections of the standard (cl 6). The content, format and affixing requirements are in section 5, while test algorithms and calculations are in section 2; both matter for label accuracy. Any discrepancy between label content and test result can create non‑compliance.

10. Future replacements and reciprocal transitions (cl 9(5)). The Determination anticipates that future replacement determinations may include transitional labelling provisions that treat compliance with the replacement requirement as compliance with the revoked requirement. Registrants should watch for future determinations and transitional regimes that may affect labelling obligations retroactively or prospectively.

In short, the instrument combines a numerical energy rule, standardised testing and labelling obligations, narrow product exclusions and procedural conditions for family declarations and transitional compliance. Small drafting details in definitions, timing and product literature can have outsized regulatory effect.

Compliance requires integrating product design, testing, labelling, registration and retail display practices with the instrument’s numerical and procedural rules. The following checklist is a practical roadmap rooted in the Determination’s text (clauses cited).

1. Determine whether the product is covered (cl 7). Confirm the appliance is an electric household clothes washing machine (cl 7(1)). If the product potentially falls within an exclusion (cl 7(3)(a)-(c)), document how the product satisfies each element of the exclusion criteria, including rated load, water connections, extraction mechanisms, program capability and user manual claims. Do not rely on marketing alone; manual statements and product hardware must align.

2. Calculate and document rated load capacity (cl 6). Establish the manufacturer’s claimed rated load capacity in multiples of 0.5 kg and include the 8% moisture allowance where applicable (cl 6). Ensure product manuals and literature consistently state the rated load used in PAEC calculations.

3. Commission testing under the specified standards (cl 8(3), cl 9(4), cl 11(2)). Arrange for tests to be conducted in accordance with AS/NZS 2040.2:2021 section 2 for energy calculations and section 3 clauses referenced in cl 11 for performance metrics. Acquire the standards from Standards Australia (see Copyright section) to ensure full procedural compliance. Retain test reports and supporting evidence; the instrument requires reliance on test reports for families and registrations (cl 12(2)(c)).

4. Verify PAEC against the energy ceiling (cl 8(2)). Convert the test results to PAEC per AS/NZS 2040.2:2021 and confirm PAEC ≤ 700 + 124 × rated load capacity. If a model’s PAEC exceeds the ceiling, remedial design changes or a change in declared rated load (consistent with physical capabilities and marketing) will be necessary.

5. Prepare energy rating labels per AS/NZS 2040.2:2021 section 5 (cl 9(2)). Labels must accurately display star rating index, PAEC and other required information in the format prescribed by the standard. Ensure label production uses the same algorithms as the test report and that labelling reflects the final declared rated load.

6. Registration and family strategy (cl 12). If registering multiple models, assess whether grouping as a family under s 28 is appropriate. To use a family grouping: (a) declare the family to the GEMS Regulator (cl 12(1)(a)); (b) ensure models have the same energy performance and relevant physical characteristics (cl 12(2)(a)-(b)); and (c) rely on a single test report prepared before submitting the registration application (cl 12(2)(c)). Sequence testing so the test report is final before registration is lodged.

7. Use transitional options where available (cl 10). For models registered prior to the commencement day, maintain records of registration dates. If those models are supplied while registration remains in force, they may comply with either the new or old labelling requirements (cl 10(2)-(4)). Document which label regime is used and ensure all on‑hand inventory and labeling match the chosen path.

8. Ensure retail display compliance (cl 9(3)). For sales at GEMS retail premises, an energy rating label must accompany the product or its packaging at the time of retail supply or offer. Map your retail channels: physical stores with displayed products must have the physical label present; for online or catalogue offers, determine whether the point of offer falls within the GEMS retail premises definition and, if not, ensure other legal obligations are met.

9. Keep coherent product literature. Manuals, product literature and labels must be consistent. For cold‑only exclusion (cl 7(3)(b)), ensure manuals and other literature explicitly state the appliance is only suitable for cold washing operations and that no program indicates other wash types (cl 7(3)(b)(iv)-(vi)). Any contradictory wording can undermine an exclusion claim and trigger coverage.

10. Maintain records and be prepared for regulator scrutiny. Keep test reports, registration documents, family declarations, product literature, manufacturing records and labelling proofs accessible. The instrument anticipates regulator review of test evidence (cl 12 and cross‑references to registration under the Act), and good documentation will ease compliance verification.

11. Account for standards access and IP. Factor in the cost and timing of obtaining AS/NZS 2040.1:2021 and AS/NZS 2040.2:2021 from Standards Australia when budgeting testing and labelling processes (Copyright section).

12. Monitor for future determinations and transitional rules (cl 9(5)). The instrument provides for reciprocal treatment if a replacement determination includes transitional measures. Keep regulatory watch so that labelling strategy and registrations are adapted in a timely manner.

13. Seek regulator guidance where definitions are ambiguous. Where questions arise about whether premises constitute “GEMS retail premises”, or whether a product meets an exclusion, seek guidance from the GEMS Regulator or obtain legal advice. These definitional determinations drive practical compliance obligations under cl 9(3) and cl 7(3).

By following these steps, a manufacturer or supplier aligns testing, labelling and registration processes with the Determination’s technical and procedural rules. The critical operational points are sequencing (ensure test reports precede registration where families are declared), consistency (labels, manuals and claims must match), and documentation (retain test reports and records for regulator review).
