Greenhouse and Energy Minimum Standards (Close Control Air Conditioners) Determination 2012

The central concept is the "close control air conditioner". It is defined in section 5(4) by reference to AS/NZS 4965.1:2008 clause 4.1: a unitary air conditioner designed for high sensible heat ratio applications capable of maintaining close control of both temperature and humidity. It consists of one or more factory-made assemblies including a compressor, a direct expansion evaporator, an air-moving device and air-filtering devices, and may include a condenser, a humidifier or a reheating function. The note in the Determination clarifies that these units are used in computer rooms, data processing units, telecommunications facilities and other industrial process areas. This definition imports two critical concepts: "high sensible heat ratio" (meaning the unit removes more sensible heat than latent heat, which is typical for equipment cooling) and "close control" (narrow tolerances for temperature and humidity). The Determination also defines related terms like "unitary air conditioner", "split system", "multi-split system", "spot cooler", "unbalanced air conditioner", "packaged unit", "water-to-air heat pump", "brine-to-air heat pump", "ground water sourced heat-pump", "ground loop sourced heat-pump", and "close-coupled row based cooling units". These definitions are mostly drawn from AS/NZS 3823.2:2011 or AS/NZS 3823.1.3:2005. They are essential because they delineate which products are excluded. The concept of a "standard" is broadly defined in section 3 to include Australian Standards, Australian/New Zealand Standards, CIE Standards, IEC Standards, or any other equivalent document. The Determination freezes the applicable version of all incorporated documents at the date it came into force. This is a critical interpretive rule: section 4(2) provides that the version of any document referred to in a standard under a "Referenced Documents" heading (or equivalent) that must be applied is the version that existed at the Determination's commencement. That means industry cannot rely on later amendments to those standards to reduce compliance burden; they are stuck with the 2012-era standards unless the Determination itself is amended. "Family of models" is another key concept. Section 9 allows multiple models to be treated as a single family if they share a brand, the same test report, and the same physical and energy performance characteristics relevant to the MEPS. But the cap of four models per family limits the cost-saving potential of this grouping. Finally, the product is designated "category A" under section 10. Under the GEMS Act, category A products are those where the GEMS Regulator may require registration and the supply of information. This means registration is mandatory, not optional, for products covered by this Determination.

The primary regulated entities are manufacturers, importers, and suppliers of close control air conditioners that fall within the scope of section 5(1) and are not excluded by section 5(3). Because the Determination applies to products supplied in or into Australia under the GEMS Act, importers bear particular compliance risk: they must ensure the products they bring in meet the MEPS even if the foreign manufacturer has not had the product tested to the Australian/New Zealand Standard. Domestic manufacturers must also test and register their products. Retailers and wholesalers who supply non-compliant units face enforcement action, though their liability may be attenuated if they can show they relied on a supplier's registration. The end users are principally commercial and industrial operators: data centre owners, telecommunications companies, industrial process facilities, and any business that requires precision environmental control. While they are not directly regulated, they are indirectly affected because the MEPS reduce the range of available products to those that pass the standard, and may increase purchase prices due to compliance costs. Compliance professionals are also affected: the Determination creates work for testing laboratories accredited to perform the tests under AS/NZS 4965.1:2008 sections 5 to 7, for lawyers advising on GEMS Act obligations, for regulatory affairs staff managing product registrations, and for energy auditors verifying compliance. The small number of model slots per family (maximum four) affects manufacturers with broad product lines; they may need to register multiple families or individual models, increasing registration fees and administrative overhead. Additionally, the exclusions in section 5(3) mean that many adjacent product sectors are not affected: makers of standard ducted or split-system air conditioners, commercial chillers, evaporative coolers, and close-coupled row based cooling units do not have to comply with this Determination (though they may be covered by other GEMS determinations). For those excluded products, there is no direct effect, but there may be competitive distortion: manufacturers of close control units bear additional costs that manufacturers of close-coupled row based cooling units (which perform a similar function in data centres) do not. This could shift market share toward excluded technologies if the MEPS raise costs for CCACs. The Determination also affects standards bodies: AS/NZS 4965.1:2008 and AS/NZS 4965.2:2008 become de facto regulatory instruments, and their amendment processes now have direct legal consequences. If Standards Australia updates those standards, the Determination will not automatically update; a new Determination would be required. That introduces statutory inertia: the test methods and MEPS levels are locked at 2008/2012 unless the Minister acts again.

The central duty imposed by the Determination is the obligation to ensure that any close control air conditioner supplied in Australia meets the energy performance requirements set out in clause 2.2 of AS/NZS 4965.2:2008 (section 6(1)). That clause, which is not reproduced in the Determination, presumably specifies minimum energy efficiency ratios (EERs) or coefficients of performance. The duty is not merely to achieve those performance levels in design but to demonstrate compliance through testing conducted according to clauses 2.3 and 2.4 of AS/NZS 4965.2:2008 and sections 5 to 7 of AS/NZS 4965.1:2008 (section 6(2)). This means a supplier must commission a test from an appropriate laboratory and retain the test report as evidence. There is no duty to affix an energy label or provide any specified communication to consumers (section 7). The supplier does, however, have a right to use the family of models mechanism in section 9 to group up to four models under a single test report, provided the models share a brand, the same test report, and the same physical and energy performance characteristics relevant to compliance. This reduces testing costs but imposes a cap: a family cannot exceed four models (section 9(2)). If a manufacturer has more than four models that differ only cosmetically or in minor ways, they must either limit the family or pay for additional testing. The right to rely on the family concept is contingent on the models genuinely having the same performance and physical characteristics; a supplier cannot bundle models with different compressors or coil configurations into one family. Another right is the ability to treat a registered family as satisfying the GEMS level requirements for each member model. Under the GEMS Act, once a product is registered (and the Determination makes these products category A, meaning registration is required under section 29 and section 10 of this Determination), the supplier can lawfully supply those models. There is also an interpretive right under section 4(1): if a term is not defined in the Act, Regulations, or Determination, but is defined in one of the incorporated standards, that standard definition applies. This gives suppliers a predictable source of meaning, but only if they have access to the relevant standard. The Determination does not impose any duty to disclose test results to purchasers or to mark products with energy performance data. The absence of labelling duties reduces compliance cost but also means that purchasers cannot easily compare efficiency at the point of sale; they must rely on the supplier's registration and the GEMS Regulator's database. The supplier's duty is to the Regulator, not directly to the customer, though the GEMS Act imposes liability for supplying non-compliant products regardless of whether the customer knew or cared about the standard.

The Determination itself does not prescribe penalties; it is a legislative instrument made under the GEMS Act. Therefore penalties and enforcement mechanisms are those set out in the GEMS Act. The Act provides for civil penalties, infringement notices, and criminal offences for serious non-compliance such as supplying a product that does not meet the GEMS level requirements or making false or misleading statements in connection with registration. Since this Determination creates a mandatory MEPS under section 6(1), a supplier of a close control air conditioner that does not meet clause 2.2 of AS/NZS 4965.2:2008 is supplying a non-compliant product and is liable under the Act. The maximum civil penalty for a body corporate can be substantial (though the exact figures are in the Act, not the Determination). The GEMS Regulator (currently the Secretary of the Department administered by the Minister administering the Renewable Energy (Electricity) Act 2000, or a delegate) has powers to issue infringement notices, seek court orders for civil penalties, and accept enforceable undertakings. The Regulator can also issue a recall notice for non-compliant products. There is a right of review under the Act for certain decisions. The determination of product class as category A means that the Regulator must maintain a register of registrable products, and a person must not supply a registrable product unless it is registered. Therefore, even if the product meets the MEPS, supplying it without registration is an offence. The enforcement risk is highest for importers who bring in products without checking compliance. The Regulator can require a supplier to provide test reports or other evidence of compliance. Because the Determination incorporates standards by reference, a supplier cannot argue that they complied with a different test method; the prescribed method is mandatory. The failure to test to the exact version of AS/NZS 4965.1:2008 that existed in October 2012 could be grounds for enforcement. The Regulator may also test products from the market to verify compliance. There is no amnesty for inadvertent non-compliance; the Act applies strict liability to some elements. The costs of enforcement are borne by the regulator and ultimately by taxpayers, but the threat of enforcement imposes a compliance burden on all suppliers, which can act as a barrier to entry for smaller firms that may lack the resources to meet testing and registration requirements. The absence of any litigation history in the public domain suggests that enforcement actions have been rare or resolved without contested court proceedings, but this does not mean the risk is trivial.

This Determination operates as a subordinate legislative instrument under the GEMS Act 2012. It does not replace or override the GEMS Act; rather, it specifies the particular requirements for one product class. The GEMS Act itself interacts with the Competition and Consumer Act 2010 (Cth) through the Australian Consumer Law (ACL). If a supplier makes false representations about energy performance (e.g., claiming a product meets a higher standard than it does), that conduct could also be a breach of the ACL prohibitions on misleading or deceptive conduct and false or misleading representations. The Determination's silence on labelling does not prevent the ACL from applying. Similarly, state and territory fair trading laws may apply, though GEMS is Commonwealth legislation and generally intends to create a national framework to avoid duplication. The Determination interacts with other GEMS determinations that cover different products. For example, the exclusions in section 5(3) (split systems, chillers, etc.) signal that those products are likely covered by separate determinations under the GEMS Act. A supplier that makes both close control units and standard split systems must comply with two different sets of MEPS and testing requirements. The Determination also incorporates standards that are themselves subject to copyright (as noted in the copyright notice). This creates a practical interaction with the Copyright Act 1968: users cannot reproduce the standards without permission or licence, which may raise the cost of compliance. The Determination's freezing of referenced documents at a point in time means that if the Occupational Health and Safety Act or electrical safety regulations later require compliance with a newer version of a standard, there could be a divergence between GEMS compliance and safety compliance. A product could meet the 2008 standard for GEMS but be required to meet a 2015 standard for electrical safety, forcing the manufacturer to test twice. The Determination does not interact directly with private contract law, but a supplier's failure to meet GEMS obligations could constitute a breach of warranty or an implied term in a sale contract (if the customer specifies GEMS compliance). Finally, the Determination's classification of products as category A means that registration is required under the GEMS Act, and the Regulator's decisions on registration are reviewable under the Administrative Decisions (Judicial Review) Act 1977 or under the GEMS Act's own merits review provisions. There is no direct interaction with international trade law, but the Determination could create a technical barrier to trade if foreign manufacturers find it costly to test to the Australian Standard rather than an international one. The GEMS Act allows for recognition of equivalent international standards in some cases, but this Determination does not specify any such recognition.

The Determination was made on 25 October 2012 by Mark Dreyfus as Parliamentary Secretary for Climate Change and Energy Efficiency, and it came into force the day after registration. The source text provided does not include any amending instruments, and the Federal Register of Legislative Instruments (now the Federal Register of Legislation) would need to be checked for subsequent amendments. However, based on the text supplied, there is no amendment history contained within this document. That is typical for a standalone principal instrument. The Determination may have been amended or replaced in later years, but such changes are not available from this source. A compliance professional should always check the current compilation on the Federal Register of Legislation. The absence of amendment history in the source should not be taken as evidence that the Determination has not been altered; GEMS determinations are regularly reviewed and updated as technology and standards evolve. The fact that the standards incorporated (AS/NZS 4965.1:2008 and AS/NZS 4965.2:2008) are from 2008 suggests that the underlying technical requirements may be outdated relative to current best practice, which creates an incentive for the regulator to update the Determination. However, without a later amendment, the 2008 standards remain legally mandatory. Any amendment would likely involve updating the referenced standards to newer editions, expanding or narrowing the scope, or adjusting the family model limits. It is also possible that this Determination has been remade or revoked and replaced by a newer determination for close control air conditioners. The user should verify the current status.

The source text contains no mention of any litigation related to this Determination. There are no cases cited in the Determination itself, and there has been no publicly recorded litigation brought under or challenging this Determination. This is not unusual for a relatively narrow technical instrument. The GEMS Act has seen limited litigation overall, and most disputes are likely resolved through administrative processes or infringement notices rather than court proceedings. The absence of litigation may indicate that industry has largely complied, that penalties are paid without contest, or that the Regulator has not aggressively enforced the MEPS. However, the lack of litigation does not mean the legal risk is zero; it may simply reflect that the cost of challenging a determination or a penalty exceeds the likely benefit. If a supplier were to challenge the validity of this Determination, grounds could include that the Minister did not have the power to make it (section 23 of the GEMS Act), that the Determination is ultra vires because it exceeds the scope of the enabling legislation, or that the incorporation of standards by reference is procedurally defective under the Legislation Act 2003 (formerly the Legislative Instruments Act 2003). No such challenge appears to have succeeded, at least in reported decisions. The interpretation of the GEMS Act, and particularly the interaction between a determination and the underlying Act, could be tested if a supplier argued that their product falls outside the product class definition. The Determination's definitions of close control air conditioner and the various excluded products leave room for borderline cases: for example, a unit that can operate in close control mode but also in a less precise mode. Litigation could arise over whether such a unit is "designed for high sensible heat ratio applications". However, without any reported case, these remain theoretical possibilities. The copyright notice on standards could also generate litigation, but that would be between Standards Australia and the user, not under this Determination.

Several traps await the unwary. First, the freezing of standards at the date of commencement (section 4(2)) means that a supplier cannot use a later version of AS/NZS 4965.1:2008 or AS/NZS 4965.2:2008 for compliance, even if the later version is more lenient or more rigorous. This is a static reference. If Standards Australia issues an amendment that changes a test procedure, the Determination still requires the 2008 version. A supplier that unknowingly tests to a newer version may be deemed non-compliant. Second, the family of models limit of four (section 9(2)) is easily overlooked. A manufacturer with five models that differ only in minor features (e.g., colour or trim) cannot group them all; one must either be tested separately or excluded. This cap raises compliance costs for broad product lines. Third, the definition of close control air conditioner requires it to be a "unitary air conditioner" (single casing). Many data centre cooling products are modular or have remote condensers; they may fall outside the definition or be caught by the exclusion for close-coupled row based cooling units. The definition of "close-coupled row based cooling units" in section 5(4) is detailed and includes a design requirement of up to a minimum of 35°C dry bulb entering air temperature. A supplier could inadvertently misclassify a product, leading to either unnecessary compliance (if they treat an excluded product as covered) or non-compliance (if they treat a covered product as excluded). Fourth, there is no labelling requirement, but the GEMS Act still requires registration. A supplier might assume that because there is no label, there is no requirement to register, but section 10 designates the product as category A, making registration mandatory. Supplying a non-registered product is an offence even if it meets the MEPS. Fifth, the Determination requires testing in accordance with specific clauses of AS/NZS 4965.1:2008 and AS/NZS 4965.2:2008. Those standards are not reproduced in the Determination; they must be purchased from Standards Australia. This imposes an access cost, and the copyright notice warns against reproduction. A small business may not be able to afford all relevant standards. Sixth, the definition of "standard" is broad enough to include "any other equivalent document". This could create ambiguity: what constitutes an equivalent document? The Determination does not define it, and the GEMS Act may not either. A supplier relying on an international standard may face a challenge if the Regulator disagrees on equivalence. Seventh, the exclusions list in section 5(3) is exhaustive, but many products that might seem similar to close control units (e.g., precision air conditioners that are not "unitary" because they have remote condensers) may slip through. There is no grandfathering for existing products; all new supplies after commencement must comply. Finally, the Determination does not specify any transitional period, so it applies immediately upon commencement. Suppliers of then-existing stock that did not meet the MEPS would have had to withdraw it or face penalties. The practical effect is that compliance is backward-looking with no grace period.

To comply with this Determination, a supplier of close control air conditioners must take several concrete steps. First, determine whether the product falls within the scope. The product must meet the definition of "close control air conditioner" in section 5(4): a unitary air conditioner designed for high sensible heat ratio applications capable of maintaining close control of temperature and humidity, with factory-made assemblies containing compressor, evaporator, air mover, and filter. It must not be excluded by section 5(3). In particular, check whether the product is a split system, multi-split, evaporative cooler, heat pump sourced from ground water or ground loop, unbalanced unit, spot cooler, commercial chiller, or close-coupled row based cooling unit. If it falls into any exclusion, this Determination does not apply (though another GEMS determination might). Second, if the product is covered, obtain a copy of AS/NZS 4965.1:2008 and AS/NZS 4965.2:2008 from Standards Australia. These are the testing and performance standards. Third, arrange for testing of the product (or a representative model if using the family of models concept) by a laboratory that is accredited or otherwise acceptable to the GEMS Regulator. The testing must be conducted in accordance with sections 5 to 7 of AS/NZS 4965.1:2008 for cooling capacity, effective power input, and energy efficiency ratio. Clauses 2.3 and 2.4 of AS/NZS 4965.2:2008 specify how to determine compliance with the MEPS. Fourth, compare the test results against the requirements in clause 2.2 of AS/NZS 4965.2:2008. If the product does not meet those minimum efficiency levels, it cannot be supplied in Australia. Fifth, if the product passes, it must be registered as a category A product under the GEMS Act. Registration is done through the GEMS Regulator's online system (currently the "GEMS Registration System" administered by the Department). The applicant will need to submit test reports, product details, and pay a registration fee. The registration process requires specifying the model(s) and, if using a family of models, ensuring that the group satisfies the conditions in section 9: all models are of a single brand, rely on the same test report, and have the same physical and energy performance characteristics relevant to compliance. The family cannot include more than four models. If a manufacturer has more than four models that otherwise qualify, they must either create additional families or submit separate applications for extra models (each requiring a test report). Sixth, maintain records of the test reports, registration certificates, and any correspondence with the Regulator for the duration of supply plus any retention period under the GEMS Act (typically five years). Seventh, there is no labelling requirement, so no need to design or print energy labels or energy consumption declarations. However, if the supplier makes any claim about energy performance (e.g., in marketing materials), those claims must be truthful and may be subject to the Australian Consumer Law. Eighth, monitor any amendments to the Determination and the underlying standards. If the Determination is revised, a new test may be required. Ninth, when importing, ensure the foreign manufacturer understands the Australian requirements and supplies a product that meets the tested parameters. The importer bears ultimate responsibility even if relying on the manufacturer's data. Finally, if a supplier is unsure whether a product is covered, they should seek legal advice or a ruling from the GEMS Regulator. The cost of obtaining a pre-clearance ruling is likely lower than the cost of defending a non-compliance action. Compliance is not optional: the GEMS Act imposes substantial penalties for supplying non-compliant or unregistered products, and the Determination makes the standards mandatory. The interaction of the family limit and the static reference to standards means that planning early testing and registration is essential to avoid supply disruptions.
