#### 38FB Liability for ship used in committing offence: offence (1) A person commits an offence if: (a) the person is an owner of or the master of a vessel; and (b) the vessel is used in committing an offence against a provision of another Division of this Part; and (c) the conduct constituting the offence is engaged in in a zone; and (d) the vessel is a ship within the meaning of the zoning plan for the zone. Penalty: 500 penalty units. (2) Strict liability applies to subsection (1). > Note: For strict liability, see section 6.1 of the Criminal Code.
