#### 38DC Contravening order or direction: offence (1) A person commits an offence if: (a) the Authority or another body gives the person an order or direction under the regulations; and (b) the order or direction is of a kind declared by the regulations to be an order or direction to which this section applies; and (c) the person engages in conduct; and (d) the conduct contravenes the order or direction. Penalty: 500 penalty units. (2) Absolute liability applies to paragraphs (1)(a) and (b). > Note: For absolute liability, see section 6.2 of the Criminal Code. (3) The fault element for paragraph (1)(d) is negligence. > Note: For negligence, see section 5.5 of the Criminal Code.
