16Acting directors of the Authority

#### 16 Acting directors of the Authority Acting Chair of the Authority (1) The Minister may appoint a person to act as the Chair of the Authority: (a) during a vacancy in the office of the Chair of the Authority (whether or not an appointment has previously been made to the office); or (b) during any period, or during all periods, when the Chair of the Authority: (i) is absent from duty or Australia; or (ii) is, for any reason, unable to perform the duties of the office. Acting director of the Authority (other than the Chair of the Authority) (2) The Minister may appoint a person to act as a director of the Authority (other than the Chair of the Authority): (a) during a vacancy in the office of a director of the Authority (other than the Chair of the Authority), whether or not an appointment has previously been made to the office; or (b) during any period, or during all periods, when a director of the Authority (other than the Chair of the Authority): (i) is absent from duty or Australia; or (ii) is, for any reason, unable to perform the duties of the office. Eligibility (3) A person is not eligible for appointment to act as: (a) the Chair of the Authority; or (b) a director of the Authority (other than the Chair of the Authority); unless the person is eligible for appointment as a director of the Authority. > Note 1: See subsections 14(2) and (3). > Note 2: For rules that apply to acting appointments, see sections 33AB and 33A of the Acts Interpretation Act 1901.
