Graffiti Control Act 2001

The Act is structured around a small set of core legal concepts that determine coverage, obligations and enforcement levers.

• Graffiti implement. The Act defines “graffiti implement” primarily by reference to a can of spray paint (excluding pigment-free transparent sprays) and leaves open the ability to add other implements by regulation (s 3). The regulatory power is operational: the types of implements captured by criminalised carrying, sale restrictions and seizure powers can be adjusted without primary law amendment (s 13).
• Mark graffiti. The phrase “mark graffiti” expressly includes defacement of property “in any way” (s 3). The criminal offence (s 9) therefore hinges on the act of marking, not necessarily on the aesthetic or quantity of the marking, subject to the statutory exceptions and defences.
• Public place and public property. “Public place” includes places on private land where the public has access; “public property” is defined broadly to include Crown property, corporates established by Act, and councils (s 3; s 9(5)). These definitions determine application of enhanced penalties (s 9(1a)) and council removal powers (s 12).
• Minor and sale/supply restrictions. A minor is under 18 (s 3). It is an offence to sell graffiti implements to minors (s 5(1)) and to supply minors with certain prescribed classes of implements (s 5(2)). The Act provides evidential and reasonable belief defences tied to age verification and “lawful purpose” (s 5(3)-(4)); “lawful purpose” is defined by a non-exhaustive list including lawful occupation, education or non-offensive artistic activity (s 5(5)).
• Authorised persons. Local councils may appoint authorised persons under s 260 of the Local Government Act 1999 to enforce Part 2; these authorised persons and police officers have limited entry and inspection powers to premises selling implements during usual business hours, and must produce identification on demand (s 7).
• Reverse onus. Where the Part creates offences that turn on lawful authority or lawful excuse, the Act places the onus on defendants to prove lawful authority or lawful excuse (s 11). This is a structural evidence allocation, affecting defence preparation and proof strategy.
• Council removal and immunity. Councils can serve a written notice and, absent a timely objection, enter private property to remove graffiti visible from a public place, with statutory requirements for consultation and standards, and an express bar on civil liability for the council and its agents for actions taken under the section (s 12(1)-(5)).
• Court remediation and accessory penalties. Beyond fines and imprisonment, the courts can order community-service style program participation for removal or payment of compensation and payment to persons who remove graffiti visible from a public place or on public property (s 9(3), (3a), (4)). The court can also impose driver’s licence disqualification as a mandatory additional penalty for non-first offences (s 10A).
• Seizure without charge and regulatory detail. Police seizure of prescribed implements is allowed on reasonable suspicion and may occur without charging the person (s 10C(1)-(2)). The regulations may set procedures for seizure, return or forfeiture, and may prescribe codes and penalties for contraventions of regulations up to $1,250 (s 13).

These concepts interact: for example, the definition of graffiti implement feeds the seizure power (s 10C), the retail security requirements (s 4), and the prohibition on sale to minors (s 5). The Act centralises actionable conduct (marking, carrying, supplying), administrative prevention (retail controls, advertisement prohibition s 6A), and remedial responses (council removal, court-ordered remediation), creating multiple levers against graffiti activity.

The Act creates obligations and liabilities across several distinct groups. State resource allocation and private compliance burdens are concentrated in particular places; responsibilities are allocated as follows.

• Individuals who mark graffiti. Any person who “marks graffiti” is criminally liable under s 9. Increased maximum penalties apply where the marking occurs in certain sensitive locations (cemeteries, public memorials, places of worship) (s 9(1a)). Those convicted may face fine, imprisonment, court-ordered remediation or compensation, and possible driver’s licence disqualification where the offence is not a first offence (s 9, s 10A).
• Retailers and sellers of graffiti implements. Persons selling graffiti implements by retail from premises must secure implements stored in publicly accessible parts of the premises in a locked cabinet or in a manner prescribed by regulation, and must display notices complying with regulations (s 4, s 6). They must not sell certain implements to minors (s 5). Non-compliance attracts civil penalties and expiation fees in some cases (s 4, s 6).
• Minors (under 18) are direct beneficiaries of sale and supply restrictions. Suppliers face penalties for selling or supplying implements to minors unless the supplier exercised due diligence in verifying age or reasonably believed a lawful purpose existed (s 5(3)-(4)). The statute explicitly recognises lawful occupational, educational and artistic uses (s 5(5)).
• Councils and authorised persons. Councils can appoint authorised persons for Part 2 enforcement and have statutory powers to remove graffiti from private property visible from public places following specified notice procedures (s 7; s 12). Councils can also contract out removal work and are insulated from civil liability for acts taken under s 12(5).
• Police and authorised persons. Police officers are authorised persons for enforcement and have powers to seize prescribed implements in public places on reasonable grounds for suspicion, even absent charge (s 10C(1)-(2)). Authorised persons appointed under the Local Government Act 1999 have entry powers to premises during usual business hours to investigate compliance with Part 2 and to take photographs or recordings (s 7(2)-(4)).
• Owners and occupiers of private property. Property owners and occupiers whose property is marked and visible from a public place may be the subject of a council notice to allow council entry for removal (s 12). They may be required to respond to a notice and may object under the procedure set out; absent objection the council may enter after the notice period (s 12(1)-(2)). Owners or occupiers may receive compensation or payment orders from courts if they remove graffiti themselves or cause removal (s 9(3a)).
• Advertisers and media sellers. The Act criminalises advertising graffiti implements in a way that is likely to encourage or promote unlawful graffiti (s 6A). This creates compliance risk for advertisers and media platforms.
• Persons who possess implements in public or while trespassing. Carrying a graffiti implement with intent to use it, or carrying prescribed implements without lawful excuse in public or while trespassing, is an offence (s 10). Police seizure power (s 10C) can directly affect such persons even where no charge is brought.

Financially, the direct costs fall on offenders (fines, potential imprisonment, remediation costs), sellers (compliance costs for storage, signage, refusals, and potential fines), councils (administrative costs of notices, removal programmes, and potential contracted removal, although councils are not obliged to remove graffiti under s 12(6)), and police (operational costs to seize implements and support prosecutions). Benefits accrue to property owners by statutory provision for removal and to the public in seeking to reduce visible graffiti. The Act also creates compliance work for local government authorised persons and regulators who will manage codes and guidance under regulation.

The Act sets out discrete duties and corresponding rights across different actors. Below are the principal duties, statutory defences and procedural rights, with section references and operational implications.

Duties on sellers and premises:

• Secure storage. A person selling graffiti implements by retail must ensure implements stored in areas accessible to the public are kept in a securely locked cabinet or in a prescribed manner so that members of the public cannot access them without staff assistance (s 4(1)). The subsection contains an explicit regulatory carve-out for types of graffiti implements prescribed by regulation (s 4(2)).
• Display notices. A notice meeting regulatory requirements must be displayed prominently in premises selling graffiti implements (s 6(1)). The seller must ensure compliance; breach attracts a penalty (s 6(3)).
• Age verification and non-supply. It is an offence to sell a graffiti implement to a minor (s 5(1)) and to supply a minor with prescribed classes of implements (s 5(2)). Sellers have a statutory defence if they required evidence of age, the minor made a false statement or produced false evidence, and the seller reasonably assumed the person was over 18 (s 5(3)). For supply restrictions, a defendant may also prove on reasonable grounds that the minor intended to use the implement for a lawful purpose (s 5(4)).

Duties on individuals:

• Do not mark graffiti. A person must not mark graffiti (s 9(1)). The Act does not require damage thresholds; “mark graffiti” is defined broadly as including defacement in any way (s 3). Enhanced offences apply for marking in cemeteries, public memorials and places of worship (s 9(1a)).
• Do not carry implements with intent. Carrying an implement with intent to mark graffiti is an offence (s 10(1)(a)). Carrying prescribed classes of implements without lawful excuse in public or while trespassing is also an offence (s 10(1)(b)).
• Produce driver’s licence when required. A person holding a driver’s licence charged with a prescribed graffiti offence that is not a first offence must produce the licence to court if required (s 10B(1)). The person can still rely on a reasonable excuse as a defence (s 10B(2)).

Duties and powers of enforcement and councils:

• Authorised persons may enter premises during usual business hours to investigate compliance with Part 2 and may photograph or record (s 7(2)-(3)). They must produce identification on demand (s 7(5)).
• Police may seize prescribed graffiti implements from persons in public places where reasonable grounds of suspicion exist, and the seizure may occur with or without charge (s 10C(1)-(2)). Regulations may provide procedures for seizure, return or forfeiture (s 10C(3)).
• Councils may serve written notice on owners or occupiers and, if not objected to, enter private property to remove graffiti visible from a public place. Council must consult with the owner or occupier about manner of the action and endeavour to work expeditiously and with reasonable care and standard (s 12(1)-(3)). No civil liability attaches to a council, its employees, or authorised contractors for actions done under s 12(5).

Rights and defences:

• Defences for sellers. Reasonable age verification and reasonable belief of lawful purpose are available defences for sellers in relation to supply to minors (s 5(3)-(4)). “Lawful purpose” is defined to include occupational, educational, artistic activities not constituting offences, and construction/maintenance activities (s 5(5)).
• Defence of lawful authority or excuse. Where the Part criminalises acts done without lawful authority or lawful excuse, the onus of proof lies squarely on the defendant to demonstrate lawful authority or excuse (s 11). This affects the evidential burden and the tactical posture in proceedings.
• Procedural rights for persons affected by authorised person entry include the right to demand identification and the right to object to council removal action within the notice period before council entry (s 7(5); s 12(2)(d)(i)).

Ancillary court powers and constraints:

• Courts must consider remedial orders on conviction: order participation in an appropriate removal program where a suitable program exists and participation is practicable (s 9(3)(a)), or otherwise order compensation to owner/occupier (s 9(3)(b)). Courts may also order payment for removal work where graffiti is visible from a public place or on public property (s 9(3a)). The court may enforce participation orders as if they required performance of community service (s 9(4)).
• Driver’s licence disqualification is a mandatory additional order for non-first prescribed graffiti offences where the court so orders; the disqualification period is between one and six whole months and cannot be reduced, mitigated or substituted (s 10A(1)-(2)).

Regulatory scope:

• Regulations may prescribe further details including codes of conduct for sellers, classes of implements, penalties for regulatory non-compliance up to $1,250, and procedures connected to seizure and forfeiture (s 13(2)-(4)). The regulations may incorporate codes by reference and require public availability of such codes (s 13(4)-(5)).

These duties and rights create structured compliance expectations for retailers (secure storage, notices, age verification), an evidential burden on accused persons (s 11), operational powers for police and authorised council officers (s 7, s 10C), and remediation pathways for property owners via court orders or direct council action (s 9, s 12).

The Act deploys a mix of criminal penalties, administrative expiation fees, court-ordered remedial payments and regulatory fines. Enforcement responsibility is split between police, courts and local government authorised persons, with the regulations providing procedural detail and additional enforcement mechanisms.

Key penalties specified in the Act:

• Retail storage breach (s 4(1)): Maximum penalty $2,500; expiation fee $210.
• Failure to display prescribed notice (s 6(3)): Maximum penalty $750; expiation fee $105.
• Sale of graffiti implement to a minor (s 5(1)): Maximum penalty $5,000.
• Supply to a minor of prescribed class of graffiti implement (s 5(2)): Maximum penalty $2,500.
• Advertising likely to encourage unlawful graffiti (s 6A): Maximum penalty $5,000.
• Hindering or abusing authorised person (s 7(6)): Maximum penalty $5,000.
• Authorised person misconduct such as offensive language or unlawful use of force (s 7(7)): Maximum penalty $5,000.
• Marking graffiti (s 9(1)): Maximum penalty $5,000 or imprisonment for 12 months.
• Marking graffiti in cemetery, public memorial, or place of worship (s 9(1a)): Maximum penalty $7,500 or imprisonment for 18 months.
• Carrying implement with intent or carrying prescribed implement without lawful excuse in public or while trespassing (s 10(1)): Maximum penalty $5,000 or imprisonment for 12 months.
• Failure to produce driver’s licence when required (s 10B(1)): Maximum penalty $1,250.
• Regulations may impose penalties not exceeding a fine of $1,250 (s 13(2)).

Court and administrative enforcement measures:

• Court-ordered remediation and compensation. A court finding guilt for a prescribed graffiti offence must, if a suitable supervised removal program exists and participation is practicable, order participation in that program (s 9(3)(a)); otherwise the court must order payment of such compensation to the owner or occupier as it thinks fit (s 9(3)(b)). The court may also, in addition, order payment to any person who has removed or caused the removal of visible graffiti or graffiti on public property a reasonable amount for the removal or obliteration (s 9(3a)). Orders for program participation can be enforced like community service orders (s 9(4)).
• Driver’s licence disqualification. For non-first prescribed offences, the court may order disqualification from holding or obtaining a driver’s licence for between 1 and 6 whole months; that disqualification cannot be reduced, mitigated or substituted (s 10A(1)-(2)). Prior convictions under this Part or section 85 of the Criminal Law Consolidation Act 1935 are counted in determining whether the offence is a first offence (s 10A(3)).
• Seizure without charge. Police may seize a prescribed class of graffiti implement from a person in a public place on reasonable grounds of suspicion that the implement has been or may be used contrary to the Act, and the seizure may occur whether or not the person is to be charged (s 10C(1)-(2)). Regulations can prescribe procedures for seizure, return or forfeiture (s 10C(3)).
• Authorised person enforcement. Councils may appoint authorised persons under the Local Government Act 1999 for Part 2 enforcement; authorised persons may enter premises during usual business hours to investigate compliance and to take photographic and other recordings (s 7(1)-(4)). Obstructing authorised persons or using abusive language attracts penalties (s 7(6)).

Practical enforcement architecture:

• Operationally, police handle reactive enforcement, investigations, seizures and prosecutions for offences such as marking and carrying implements (s 9, s 10, s 10C). Local government authorised officers focus on retail compliance, executing inspections of premises selling implements, and using council powers to remove graffiti from private property where notice and procedural steps have been satisfied (s 7, s 12).
• The regulations fill procedural gaps and may add administrative penalties; for example, procedures for seizure return and forfeiture are left to regulation (s 10C(3)), and the regulation-making power allows the government to target classes of implements, require codes of conduct for sellers, and set specified penalties for regulatory breaches up to $1,250 (s 13(2)).

Enforcement trade-offs and constraints set by the Act:

• The Act permits seizure without charge (s 10C(2)), potentially increasing the operational use of seizure as a preventive tool, but leaves return and forfeiture procedures to regulation (s 10C(3)), placing emphasis on subordinate instruments and administrative practice.
• Councils are empowered to remove graffiti from private property visible from public places after notice (s 12(1)-(2)), but the Act does not impose any positive duty on councils to remove graffiti (s 12(6)). Councils also receive immunity from civil liability for acts under s 12(5), shifting risk away from councils but potentially concentrating contestation on notice procedures and standards of workmanship.
• The reverse onus on lawful authority or lawful excuse (s 11) places evidentiary burden on defendants in many offences under the Part, altering the typical prosecutorial burden and potentially affecting plea bargaining and defence strategies.

The statutory penalties are a combination of pecuniary fines, incarceration in the more serious cases, administrative penalties for sellers and expiation fees for some retail breaches, with court-ordered remedial payments and licence disqualification available as additional enforcement tools.

The Act is drafted to operate in conjunction with a number of other statutory instruments and legal regimes. It expressly cross-references the Local Government Act 1999, the Motor Vehicles Act 1959, and the Criminal Law Consolidation Act 1935, and it delegates significant detail to subordinate regulation.

Express statutory cross-references:

• Local Government Act 1999. Councils appoint authorised persons under section 260 of the Local Government Act 1999 to enforce Part 2 of this Act (s 7(1)). Section 12(7)(a) expressly states that the council removal power does not derogate from a council’s powers under Chapter 12 Part 2 of the Local Government Act 1999 or any other power under that Act, and s 12(7)(b) clarifies that councils may still contract for removal services (s 12(7)). Practically, enforcement by authorised persons and council removal functions must be co-ordinated with existing local government powers and procedures established under the Local Government Act 1999.
• Motor Vehicles Act 1959. “Driver’s licence” is defined as a licence under the Motor Vehicles Act 1959 and includes a learner’s permit (s 3). The court power to disqualify, s 10A, therefore interfaces directly with the licensing regime under the Motor Vehicles Act 1959; disqualification under s 10A is an order affecting entitlement under that other statute.
• Criminal Law Consolidation Act 1935. The term “prescribed graffiti offence” references offences under this Act and offences under section 85 of the Criminal Law Consolidation Act 1935 where conduct consists of marking graffiti (s 9(5), s 10A(3), s 10B(3)). This creates an evidentiary and prosecutorial link between the two Acts; past convictions under s 85 of the Criminal Law Consolidation Act count towards determining whether an offence is a “first offence” for s 10A and s 10B purposes.

Delegation and regulatory overlay:

• Regulations under s 13 can prescribe classes of implements, codes of conduct for sellers, penalties up to $1,250, procedures for seizure, and may include Ministerial discretionary determinations and incorporation of codes by reference (s 13(2)-(5)). Many operational details, the precise list of prescribed implements, procedures for return or forfeiture following seizure, notice forms and signage requirements, are left to regulation. This places substantive implementation choices into subordinate instruments and administrative practice.
• The Act’s extra‑territorial intention (s 3A) signals that the scheme is intended to apply beyond the State to the full capacity of the Parliament’s power. How that interacts with inter-jurisdictional enforcement or extraterritorial conduct will raise choice-of-law and enforcement questions in practice, but the Act simply records the legislative intention.

Procedural and evidentiary interaction:

• The reverse onus provision (s 11) interacts with criminal evidentiary principles and places the evidential weight upon defendants to prove lawful authority or lawful excuse for acts criminalised under the Part. This alters usual allocations of proof and must be navigated in conjunction with criminal procedure rules.
• The court’s power to order community-service style remedial participation (s 9(4)) requires courts to treat such orders as enforceable under community service enforcement mechanisms, thus interacting with sentencing and community corrections frameworks.
• The Act amended the Summary Offences Act 1953 and has been itself amended by subsequent Acts, which also affects interpretation and enforcement practices (legislative history).

Operational interactions and practical coordination:

• Local councils must coordinate their s 12 removal powers with property law, access, privacy and local planning considerations, and with any existing local government bylaws and powers under the Local Government Act 1999.
• Police seizure powers (s 10C) and the power to require production of licences (s 10B) interact with general policing powers, arrest and search procedures, and property return or forfeiture processes, with procedural details left to regulation.
• Advertising prohibitions (s 6A) interact with advertising regulation and media channels; the Act creates a criminal exposure for advertising that is “likely to encourage or promote unlawful graffiti,” which requires advertisers to assess the likely effect of communication against a statutory standard.

In short, the Act is not standalone. It relies on, and in places modifies, the operation of local government powers, the road transport licensing regime and criminal law provisions. Implementation therefore requires inter-agency coordination and attendant subordinate instruments.

The legislative history provided in the Act text records the original enactment in 2001 and subsequent amendments, most significantly those in 2013 which altered definitions, added driver’s licence measures and created the seizure regime. The key milestones are the following.

• Graffiti Control Act 2001 (No 46 of 2001). Assent 11 October 2001; commencement 1 February 2002 (except s 4 which commenced 1 April 2002). This is the principal Act establishing the framework.
• Graffiti Control (Miscellaneous) Amendment Act 2013 (No 1 of 2013). Assent 14 February 2013; commencement 3 August 2013. The 2013 amendments were relatively extensive and re-worked multiple provisions of the principal Act.
• Statutes Amendment (Attorney-General's Portfolio) Act 2013 (No 11 of 2013). Assent 18 April 2013; Pt 7 (s 15) commenced 3 August 2013 immediately after commencement of the 2013 No 1 Act provisions.

The legislative history table in the Act identifies how specific sections were varied by the 2013 instruments:

• s 3: the definition of driver’s licence was inserted by 1/2013 s 4(1), and the definition of graffiti implement was substituted by 1/2013 s 4(2) (commenced 3.8.2013).
• s 3A: the extra‑territorial operation clause was inserted by 1/2013 s 5 (3.8.2013).
• Part 2 heading and numerous sections in Part 2 were substituted or amended by 1/2013 (s 6-s 9), including substitution of s 5 (sale or supply provisions), substitution of s 6(1) and deletion of s 6(2) (3.8.2013).
• s 6A (Advertising graffiti implements for sale) was inserted by 1/2013 s 10 (3.8.2013).
• s 7(2) was amended by 11/2013 s 15(1) and s 7(5) was substituted by 11/2013 s 15(2) (3.8.2013).
• s 9: subsection (1) was amended and subsection (1a) was inserted by 1/2013 s 11; subsection (3) was substituted, and subsection (3a) inserted by 1/2013 s 11 (3.8.2013). Definitions of “prescribed graffiti offence”, “public memorial” and “public property” were inserted by 1/2013 s 11(4) (3.8.2013).
• ss 10A-10C (drivers licence orders, duty to produce licence, and seizure of prescribed implements) were inserted by 1/2013 s 13 (3.8.2013).

Transitional and review provisions associated with the 2013 amendments:

• The Graffiti Control (Miscellaneous) Amendment Act 2013 included a statutory review requirement (section 14 of that amending Act): the Legislative Review Committee must, as soon as practicable after three years from commencement, inquire into and report on the operation and impact of the Act, including the effectiveness of ss 10A and 10B in reducing offending for prescribed graffiti offences. This review obligation attaches to the 2013 reforms and indicates parliamentary intent to assess the driver’s licence measures and related provisions after they have been in operation for an initial period.

Other statutory editorial changes:

• The long title and other minor numbering or editorial changes have been effected under the Legislation Revision and Publication Act 2002 as recorded in the notes. Section 2 and schedule provisions were omitted under that Revision Act.

Taken together, the legislative history shows the 2013 amendments were the major modernising package, broadening enforcement options (seizure), adding ancillary penalties (driver’s licence disqualification and production requirements), and consolidating definitions and retail controls. The review obligation in the amending Act requires monitoring of certain provisions’ effectiveness, signalling that Parliament intended the practical impact of those measures to be empirically scrutinised.

The statutory text provided does not include any reported cases or judicial consideration. No litigation history is named or summarised in the Act as presented. The Act itself identifies connections to other statutes (for example section 85 of the Criminal Law Consolidation Act 1935) that can inform prosecutorial practice and prior-conviction counting, but the source contains no appellate or lower court decisions to report.

That said, the Act contains several features that are likely to attract litigation in practice, based on the text:

• Reverse onus and evidential burden. Section 11 expressly places the onus on a defendant to prove lawful authority or lawful excuse where the Part creates offences turning on lack of lawful authority or excuse. That statutory allocation of burden can give rise to pretrial and trial litigation about the sufficiency of evidence, admissibility of evidence concerning lawful authority, and the interface with general criminal proof obligations.
• Seizure without charge. Section 10C allows police to seize prescribed graffiti implements on reasonable grounds of suspicion and permits seizure whether or not a person is to be charged (s 10C(1)-(2)). The absence of an accompanying in‑text procedure for return or forfeiture beyond a broad regulatory delegation (s 10C(3)) is likely to generate contestation about property rights, timeliness of return, and administrative procedures in operational contexts.
• Council entry and immunity. Section 12 authorises councils to enter private property after notice and to take reasonable action to remove graffiti visible from a public place, while section 12(5) grants councils and their agents immunity from civil liability for actions taken under the section. Litigation could arise where owners or occupiers dispute adequacy of notice, the standard of care or workmanship used in removal, or claim damage despite the statutory immunity; the Act’s terms focus on notice procedures and consultation, which are potential loci for dispute.
• Driver’s licence disqualification. Section 10A permits courts to order disqualification from holding or obtaining a driver’s licence for prescribed graffiti offences that are not first offences, and section 10A(2) provides that such disqualification cannot be reduced, mitigated or substituted. This inflexibility may provoke sentencing challenges, appeals on proportionality or procedural grounds, and litigation over the counting of prior offences for the “first offence” determination (s 10A(3) counts prior convictions under this Part and under s 85 of the Criminal Law Consolidation Act 1935 regardless of when committed relative to commencement).
• Advertising prohibition. Section 6A criminalises advertising a graffiti implement for sale where the advertisement is “likely to encourage or promote unlawful graffiti”. The statutory standard is prospectively applied, which may give rise to contested factual and legal questions about mens rea, the threshold for “likely to encourage or promote,” and the scope of protected commercial speech in context.

Practitioners should note that operational disputes are more likely to be decided under procedural and administrative law principles (for seizure, return, and council removal) and under criminal evidentiary and sentencing regimes for prosecutions. The Act’s legislative history requires a three-year post-amendment review by the Legislative Review Committee focussed on the effect of ss 10A and 10B; that review record could become material in litigation about legislative intent or proportionality. The source text does not provide decisions, but these statutory features identify predictable flashpoints for litigation arising from the Act’s enforcement mechanics.

The statute contains several drafting features and operational mechanics that can produce traps for the unwary. These are “gotchas” drawn from the text that practitioners should surface for clients and operational teams.

• Broad definition of “mark graffiti” and low threshold for offence. “Mark graffiti” includes “deface property in any way” (s 3). There is no minimum damage threshold in s 9; even minor defacement can attract criminal liability, including potential imprisonment. Practitioners should note the absence of de minimis language.
• Carrying includes “having about one’s person”. The definition of carry in s 3 includes “to have about one’s person”. This captures possession in pockets, bags and immediate control and may extend to implements kept in vehicles or on the person (s 3; s 10). That definition widens the scope of s 10 offences and seizure exposure under s 10C.
• Seizure without charge. Police may seize prescribed implements from a person in a public place whether or not the person is, or is to be, charged (s 10C(2)). Property loss and administrative delay can occur even in the absence of prosecution, and return/forfeiture procedures are delegated to regulation (s 10C(3)), leaving procedural details uncertain until implemented in subordinate instruments.
• Reverse onus for lawful authority/excuse. Section 11 places the onus on defendants to prove lawful authority or lawful excuse where the Part prescribes that an act done without lawful authority/excuse constitutes an offence. This changes typical criminal proof dynamics and may impair defendants’ procedural positions where documentary proof of lawful permission is contested or unavailable.
• Driver’s licence disqualification is not negotiable. For prescribed graffiti offences that are not first offences, a court may order driver’s licence disqualification for between one and six months and s 10A(2) provides that this cannot be reduced, mitigated or substituted. This imposes an inflexible collateral punishment that cannot be bargained away as part of sentencing negotiations if the court exercises the power.
• Advertising standard is fact-sensitive and subjective. Section 6A makes it an offence to advertise a graffiti implement in a way “likely to encourage or promote unlawful graffiti”. The statutory test,“likely to encourage or promote”,is fact-dependent and potentially subjective, producing compliance risk for advertisers and sellers. The Act includes no safe-harbour examples or objective criteria in the text itself.
• Council removal powers with immunity. Councils can enter private property to remove graffiti visible from a public place after notice and may use contractors; s 12(5) immunises councils and their agents from civil liability for acts done under the section. That immunity may limit private remedies where removal causes damage, leaving owners reliant on procedural notice and consultation safeguards rather than tort remedies.
• Retail storage exemptions may be regulatory. Section 4 requires locked cabinet storage or a prescribed alternative except for classes of implements prescribed by regulation (s 4(2)). A regulator could exempt certain types of implements, changing compliance obligations for particular sellers. Retailers must therefore monitor regulations to know which implements are captured or exempt.
• Notice Form, signage and codes left to regulation. The Act requires display of prescribed notices (s 6(1)) and permits regulations to require codes of conduct (s 13(2)(a)), but the content and form are not in the Act. Non-compliance penalties and expiation fees vary by provision, so non-compliance risk depends on the regulator’s prescriptions.
• “Public place” includes private land with public access. Because “public place” includes a place on private land to which the public has access (s 3), offences tied to “public place” may be engaged on private premises that are open to the public, e.g. shopping centres, cafes, and events. This alters the conventional public/private boundary and affects carrying and marking offences.
• No duty imposed on councils to remove graffiti. Despite powers to remove, s 12(6) clarifies nothing in the section imposes a duty on councils to remove or obliterate graffiti. Property owners cannot compel a council to act simply because the council may, in its discretion, enter and remove after following notice procedures.

For compliance and risk assessment, these features jointly indicate that statutory exposure may hinge on narrow factual facts (possession, access to property, advertisement wording), that administrative procedures and subordinate instruments will materially affect enforcement practice, and that collateral penalties (licence disqualification, equipment seizure) are capable of immediate operational impact even where prosecution follows later or not at all.

Compliance requires tailored actions for sellers, councils, police, property owners and advertisers. The Act mixes statutory obligations with numerous regulatory delegations, so implementing a compliance program should combine immediate statutory steps with monitoring of subordinate instruments.

For retailers selling graffiti implements:

• Secure storage. Ensure all graffiti implements stored in parts of the premises to which the public has access are kept in a securely locked cabinet or in the alternative manner if prescribed by regulation (s 4(1)). Audit stock layout and customer access routes and implement keyed or electronic lock control with staff-only access. Record lock and access procedures.
• Age verification policy. Implement an age-verification policy for all sales of graffiti implements. Require production of evidence of age for purchasers who appear to be minors, and train staff to use acceptable ID checks and to document the check (s 5(3)). Keep transaction records for a suitable retention period to support the s 5(3) defence if required.
• Notices and signage. Display the notice required under s 6(1) in a prominent position where graffiti implements are sold. Monitor the regulations for specific notice wording and format. Maintain a compliance checklist and post a copy of the current code or regulatory guidance if one is prescribed under s 13.
• Staff training and refusal protocols. Train staff on refusal protocols when presented with suspicious ID or when dealing with minors. Establish policies on supply for lawful purposes (s 5(4)-(5)) and require documented evidence when sale is made to individuals claiming lawful occupational or artistic use. Implement incident logs for refusal events.
• Advertising compliance. Review all advertising copy and online listings to ensure no content is likely to “encourage or promote unlawful graffiti” (s 6A). Avoid imagery or phrasing that could plausibly be read to promote illegal marking; consult counsel where borderline language is used.

For councils and authorised persons:

• Appointment and training. Appoint authorised persons under s 260 of the Local Government Act 1999 as contemplated by s 7(1). Develop written instruments of appointment that specify conditions of appointment and ensure authorised persons understand entry powers limited to usual business hours, requirements to produce ID on demand, and limits on use of force and offensive language (s 7(2)-(7)).
• Entry and inspection protocols. Adopt protocols for s 7 inspections that respect business hours, identify the scope of inspection (Part 2 compliance), and document photographic and recording practices, including data retention and privacy considerations (s 7(3)-(4), (5)).
• Council removal procedures. If councils intend to exercise s 12 removal powers, implement a standardised notice template that meets s 12(2) requirements (written, particulars of proposed action, date specified, and statement of objection rights). Establish internal timelines to allow the ten-day minimum and a clear objection handling process to avoid disputes (s 12(1)-(2)). Ensure procurement and contractor agreements specify the standards of workmanship and insurance requirements consistent with s 12(3).
• Consultation and mitigation. Build minimal-disruption procedures, notify occupants where feasible, schedule work to minimise disruption and document steps taken to consult as required by s 12(3)(a)-(b). Keep records of consultation and remedial work to evidence compliance and to rebut potential claims despite s 12(5) immunity.

For police and enforcement agencies:

• Seizure policies and procedures. Develop clear operational guidelines for s 10C seizures including articulating the reasonable grounds standard, documentation of grounds, and chain-of-custody procedures. Monitor and prepare to apply regulatory procedures for return and forfeiture once regulations are in force (s 10C(3)).
• Evidence and charging decisions. Given s 11 reverses the onus on lawful authority/excuse in many cases, gather documentary proof at the outset when lawful permission is plausible, and record statements that may be used to rebut a defendant’s lawful authority defence.
• Driver’s licence considerations. When prosecuting a non-first prescribed graffiti offence, ensure checks for prior convictions under this Part and s 85 of the Criminal Law Consolidation Act 1935 are performed, because previous convictions count for s 10A(3) first-offence determinations and can trigger licence disqualification exposure (s 10A).

For property owners and occupiers:

• Notice response. If served with a council notice under s 12(2), be aware of the right to object before the specified date. If you do not wish council action, use the objection mechanism; otherwise expect council entry after the notice period (s 12(1)-(2)).
• Document condition and value. Maintain photographic records of graffiti and property condition before council action or removal work, and keep invoices and records if you cause removal, as courts can order payment to persons who remove visible graffiti (s 9(3a)).
• Engage with councils. Where possible, engage early with the council about the proposed method of removal to influence standards and timing as required by s 12(3)(a). If the council acts, its immunity under s 12(5) constrains civil recourse for damage done during removal, so negotiation over method and contractor selection before removal is prudent.

For advertisers and media platforms:

• Content review. Institute pre-publication review of advertisements for graffiti implements to ensure they are not “likely to encourage or promote unlawful graffiti.” Adopt conservative editorial policies for user-generated content and marketplace listings and implement takedown procedures for content that may breach s 6A.
• Platform response protocols. For digital platforms, maintain notice-and-takedown or compliance procedures and identify points of contact for councils and police in case of enforcement inquiries.

Cross-cutting compliance actions:

• Monitor regulations. Many operational details (prescribed implements, permitted storage alternatives, notice content, seizure procedures, codes of conduct, and regulatory penalties) are left to regulation under s 13. Entities subject to the Act should monitor subordinate instruments continually.
• Recordkeeping. Maintain contemporaneous records of sales, age verification, signage compliance checks, request-and-refusal logs, seizure incident reports, council notices received or served, repair/removal invoices and photographs. These documents are tailored to the Act’s defences (s 5(3)-(4)) and to respond to seizure and court orders.
• Legal review and training. Provide periodic legal briefings for frontline staff, authorised persons and enforcement officers on evidentiary standards (s 11), seizure powers (s 10C), and how to implement the Act without exceeding the powers or breaching other statutory duties such as those under local government or transport legislation.

A compliance programme grounded in written procedures, staff training, recordkeeping and active monitoring of regulations will reduce enforcement risk and enable robust defences where statutory defences or rights are engaged.
