Governor's Establishment Act 1992

The Act is built around a small set of definitional and operational concepts that determine who decides, who pays, and how employment relationships are to be treated.

Key defined concepts in section 3 are:

• Government House, Perth, explicitly includes the appurtenant grounds (definition in s 3).
• “Member of the Governor’s Establishment” means a person employed as staff at Government House, Perth (s 3).
• “Official Secretary” is defined as the person for the time being holding or acting in that office (s 3).
• “The Director‑General” is defined as the current chief executive officer of the department principally assisting the Minister administering the Constitution Act 1889 (s 3).

Employer status and administrative authority

• Employer status: Section 4(1) places legal employer status with the Governor for each member of the Establishment. That status carries the functions and powers normally attendant on an employer subject to the Act and any other applicable law.
• Autonomy from Executive Council consent: Section 4(2) makes explicit that, except for the regulation‑making power in section 10, the Governor is not required to act with the advice and consent of the Executive Council when exercising powers or performing duties under the Act. The Act therefore provides the Governor with discretion to act administratively without triggering Executive Council processes for most functions under the Act.

Appointment and transitional arrangements

• Appointment/dismissal power: Section 5(1)(a) authorises appointment of members to the Establishment. Section 5(1)(b) permits the Governor to exercise, subject to awards, orders or industrial agreements under the Industrial Relations Act 1979, any of the powers conferred by sections 52 and 53 of the Interpretation Act 1984; the Act does not restate those powers but expressly incorporates them by reference for administration of members’ employment.
• Transitional deeming: Section 5(2) deems existing members to have been appointed under the new statutory power from the commencement date, subject to the exception in s 5(3) for persons whose services are the subject of an arrangement under s 6.

Use of other government staff and facilities

• Section 6 allows the Governor to enter arrangements with Ministers to make use of public service officers, State agency staff or Crown servants and departmental facilities, full time or part time. Those arrangements are to be on terms agreed between the Governor, the Minister concerned and the relevant employing authority under the Public Sector Management Act 1994 (s 6(2)). The Act therefore contemplates cross‑agency resource sharing via contract or memorandum of arrangement rather than wholesale transfer of employment.

Continuity of public service rights

• Section 7 preserves rights for persons appointed under s 5 who were public service officers immediately before appointment. Those individuals retain existing and accruing rights, and prior service is taken into account as service as a member of the Establishment for the purpose of determining those rights (s 7(a)-(b)).

Financial mechanics and delegation

• Payments by the Governor as employer are to be made by the Treasurer and charged to the Consolidated Account, with appropriation to the extent necessary (s 8).
• Delegation is permitted to the Official Secretary by writing signed by the Governor, but the Governor cannot delegate the delegation power itself nor the regulation power in s 10 (s 9).

Regulation‑making power

• Section 10 grants the Governor regulation‑making power for matters required or permitted to be prescribed or necessary or convenient to give effect to the Act. The regulation power is excluded from delegation under s 9.

The Act thus frames the Governor as an employer with direct appointment powers, while creating mechanisms that rely on other statutes and inter‑agency arrangements to manage staffing and funding. The Act does not provide detailed employment terms or disciplinary procedures within its text; those matters fall to industrial instruments or to other statutes referenced in the Act.

Primary persons and offices affected are clearly specified or implicit in the Act’s text.

Directly affected:

• Members of the Governor’s Establishment, defined in s 3, are the primary cohort affected. The Act makes the Governor their employer (s 4(1)) and supplies the legal basis for appointment, dismissal and service continuity (s 5, s 7).
• The Governor is the principal decision maker under the Act. The Act gives the Governor appointment and dismissal powers (s 5(1)(a)), authority to make arrangements for staff and facilities (s 6), power to delegate to the Official Secretary (s 9), and a regulation‑making power (s 10). The Governor also has responsibility for actions under the Act without need for the Executive Council’s advice and consent except where the Act provides otherwise (s 4(2)).

Offices and officials with operational roles:

• The Official Secretary is a defined office (s 3) and is the permitted recipient of delegations from the Governor under s 9. That creates an administrative chain of command: the Governor may authorise the Official Secretary in writing to exercise powers and duties under the Act, subject to the delegation limits in s 9.
• The Treasurer is directed to pay moneys payable by the Governor in the Governor’s capacity as employer, and to charge them to the Consolidated Account, subject to appropriation (s 8). That places the financial execution obligation with the Treasurer and frames the public appropriation mechanism as the default funding pathway.
• Ministers and employing authorities under the Public Sector Management Act 1994 are affected when the Governor seeks to make use of other government staff or facilities, because arrangements under s 6 must be made on terms agreed by the Governor, the Minister concerned, and the relevant employing authority (s 6(2)). Those parties must therefore negotiate and agree terms before staff or facilities are used.

Persons indirectly affected:

• Public service officers whose services are used under arrangements in s 6 will be affected operationally by secondment‑type arrangements because their employing authority must agree terms (s 6(2)). The Act also preserves rights for persons who were public service officers before being appointed under s 5, treating prior service as service for Establishment purposes (s 7).
• Departments and State agencies that supply staff or facilities under s 6 will have to allocate resources and potentially negotiate costs or operational terms with Government House and the Minister concerned.

Excluded or not directly altered by this Act:

• The Act does not create new categories of occupational safety, discipline, or remuneration terms in the text itself. Instead, it cross‑references existing industrial instruments and the Interpretation Act 1984 for particular powers and treats awards, orders and industrial agreements under the Industrial Relations Act 1979 as applicable constraints on the Governor’s exercise of powers under s 5(1)(b). As such, industrial stakeholders and unions that rely on awards or agreements under the Industrial Relations Act 1979 will remain relevant, because their instruments continue to operate as constraints on appointments and employment terms where applicable.

In short, the Act reassigns employer status to the Governor, imposes financial mechanics through the Treasurer and the Consolidated Account, creates a delegation path to the Official Secretary, and requires inter‑agency agreement when public service personnel or facilities are used. Those arrangements implicate human resources, finance and legal offices across Government House, the Treasurer’s department, Ministers and employing authorities under the Public Sector Management Act 1994.

The Act creates a compact of administrative duties, appointment powers, financial directions and preservation of employment rights. Below are the operative duties, powers and rights the Act establishes or preserves.

Principal duties and powers of the Governor

• Employer status: The Governor is the employer of each member of the Governor’s Establishment (s 4(1)). That status is a legal fact created by statute rather than an incidental administrative practice.
• Appointment and dismissal: The Governor may appoint persons to be members of the Establishment (s 5(1)(a)). The Governor also may exercise specific powers under the Interpretation Act 1984 in respect of members, subject to awards, orders or industrial agreements under the Industrial Relations Act 1979 (s 5(1)(b)). The Act does not itself set out a separate detailed disciplinary or dismissal procedure; rather the Governor’s appointment and other powers are exercised within the constraints of applicable industrial instruments and the Interpretation Act 1984 powers as invoked.
• Use of other staff and facilities: The Governor may, by arrangement with the Minister concerned, make use of services of public service officers, State agency staff or other Crown servants, and may make use of departmental facilities (s 6(1)). Those arrangements must be on terms agreed by the Governor, the Minister concerned and the relevant employing authority within the meaning of the Public Sector Management Act 1994 (s 6(2)). The Act therefore imposes a duty on the Governor to obtain agreement on terms before such use occurs.

Delegation and administration

• Delegation to Official Secretary: Section 9 permits the Governor to delegate powers or duties under the Act, either generally or subject to conditions in the instrument of delegation, to the Official Secretary, provided the delegation is in writing and signed by the Governor. The delegation power is itself non‑delegable; section 9 explicitly forbids delegating the delegation power. The Governor may not delegate the regulation‑making power in section 10 (s 9).

Financial direction and payments

• Payment mechanism: Any moneys payable by the Governor in his or her capacity as employer under the Act are to be paid on behalf of the Governor by the Treasurer and charged to the Consolidated Account, with appropriations to the extent necessary (s 8). The duty to fund employment liabilities therefore sits with the Treasurer’s execution of payments and the appropriation framework.

Preservation of existing rights for public service officers

• Rights retention: If a person appointed under s 5 was immediately before appointment a public service officer under the Public Sector Management Act 1994, that person retains existing and accruing rights. For determining those rights, prior service as such an officer is to be treated as service as a member of the Governor’s Establishment (s 7(a)-(b)). This creates a legal duty to preserve accruals and continuity for affected employees.

Regulation‑making

• The Governor may make regulations prescribing matters required or permitted by the Act, or matters necessary or convenient for giving effect to the Act (s 10). That confers an executive duty on the Governor to fill in administrative detail by regulation if required.

Constraints and applicable external instruments

• Industrial instruments: Appointment and exercise of certain powers are subject to any award, order or industrial agreement in force under the Industrial Relations Act 1979 (s 5(1)(b)). The Act therefore places a duty to operate consistently with existing industrial regulation where applicable.
• Interpretation Act powers: Section 5(1)(b) authorises the Governor to use the powers in ss 52 and 53 of the Interpretation Act 1984, but the Act does not restate those provisions; it assumes their application to Employment matters for members of the Establishment.

Powers not requiring Executive Council consent

• Section 4(2) expressly notes that the Governor, when exercising powers or performing duties under this Act other than the regulation power in s 10, is not obliged to do so with the advice and consent of the Executive Council. That changes the governance rule for most actions under the Act by removing the procedural requirement for Executive Council involvement.

Rights of employees

• Members of the Establishment gain the statutory designation of being employed by the Governor (s 4(1)).
• Public service officers appointed under s 5 retain accrued and accruing rights and have their prior service counted for entitlement purposes (s 7).

What the Act does not do in terms of duties and rights

• The Act does not set out detailed remuneration scales, leave entitlements, disciplinary rules, or occupational safety obligations within its text. Those matters are either to be governed by industrial instruments referenced in s 5(1)(b) or by other legislation and administrative arrangements not restated in this Act.
• The Act contains no express penalty or offence provisions. It is primarily administrative and fiscal.

Taken together, the Act allocates employer responsibilities around Government House staff to the Governor, provides mechanisms for funding and delegation, and preserves continuity for public service appointees, while relying on other statutes and industrial instruments for detailed employment rights and obligations.

The Act contains no express criminal offences, fines, or administrative penalty regime within its text. There are no sections that create prosecutable breaches or financial penalties to be imposed for non‑compliance with the Act’s provisions. Enforcement therefore proceeds indirectly through administrative and funding mechanisms and through the operation of external statutes referenced in the Act.

Mechanisms for enforcement and compliance built into the Act

• Administrative compliance: The Act vests powers and duties in the Governor and allows delegation to the Official Secretary (s 9). Administrative enforcement of the Act’s requirements would therefore be undertaken within the executive branch through the Governor’s exercise of powers, through delegation to the Official Secretary, and through the negotiation and performance of arrangements with Ministers and employing authorities under s 6. The Act thereby relies on executive administrative processes rather than court‑oriented sanctions.
• Financial enforcement via Treasurer: Section 8 prescribes the payment route for moneys payable by the Governor as employer. The Treasurer pays on behalf of the Governor and charges those payments to the Consolidated Account, which is appropriated to the extent necessary. That financial mechanism creates an administrative control: if funds are not appropriated or processed correctly, the practical effect is that payments will not be made, which is a non‑judicial form of enforcement affecting pay and supplier arrangements.

External instruments as enforcement channels

• Industrial instruments: Where awards, orders or industrial agreements under the Industrial Relations Act 1979 apply, those instruments may provide their own enforcement mechanisms, including industrial tribunals, orders or remedies. Section 5(1)(b) makes the Governor’s powers subject to such instruments. The Act itself does not specify enforcement paths under those instruments, but it leaves intact whatever enforcement mechanisms are available under the Industrial Relations Act 1979 and associated instruments, which will be the operative enforcement vehicles for employment disputes covered by those instruments.
• Interpretation Act powers: The Governor is empowered to exercise powers from ss 52 and 53 of the Interpretation Act 1984 in relation to members of the Establishment (s 5(1)(b)). The Act does not restate those powers; any enforcement or remedial effects flowing from their exercise are therefore to be found in the Interpretation Act 1984.

Judicial remedies and review

• The Act does not restrict access to judicial review or common law remedies. Employment decisions by the Governor or delegates that are ultra vires, procedurally unfair, or otherwise legally infirm may be susceptible to judicial review, but the Act itself does not establish specific litigation procedures or remedies.

Absence of penalties

• Because there are no penalties in the Act, disciplinary, contractual or statutory breach consequences will depend on (a) the terms of employment or secondment arrangements, (b) applicable awards or industrial instruments referenced by the Act, and (c) the general law. The Act’s silence on penalties means stakeholders must look to other statutory or contractual mechanisms for enforcement and sanctions.

In sum, the Act’s enforcement architecture is administratively oriented, relying on delegation, funding mechanisms and external industrial instruments rather than on a bespoke penalty or offence framework within the Act itself.

The Act deliberately cross‑references a small number of other statutes and leaves substantive matters to be governed, where relevant, by those instruments. Those cross‑references both limit and enable the Governor’s powers under this Act. The interactions are textual and operational.

Primary statutory cross‑references and their functional roles

• Industrial Relations Act 1979: Section 5(1)(b) makes exercise of certain powers by the Governor subject to “any award, order or industrial agreement in force under the Industrial Relations Act 1979”. This means industrial instruments created under that Act continue to bind employment relations for members of the Governor’s Establishment to the extent they apply, and the Governor must exercise appointment and related powers with due regard to existing awards and agreements. The Act therefore does not displace industrial instruments; it operates within their constraints.
• Interpretation Act 1984: Section 5(1)(b) authorises the Governor to exercise “any of the powers conferred by sections 52 and 53 of the Interpretation Act 1984” in respect of members of the Establishment. The Act does not reproduce those Interpretation Act powers; it imports them for application to employment matters under this Act. The precise content of those powers is therefore governed by the Interpretation Act 1984 rather than by this Act’s text.
• Public Sector Management Act 1994: Section 6(2) requires that an arrangement under s 6 for the use of public service staff or facilities be on terms agreed by the Governor, the Minister concerned and the relevant employing authority within the meaning of the Public Sector Management Act 1994. Section 7 also uses the term “public service officer within the meaning of the Public Sector Management Act 1994” to identify persons whose prior service is to be counted for rights under s 7. The Act therefore depends on the Public Sector Management Act 1994 to define “public service officer” and “employing authority” and to establish the institutional contours of cross‑agency personnel agreements.
• Constitution Act 1889 (indirectly): The definition of “the Director‑General” in s 3 references the chief executive officer of the department principally assisting the Minister administering the Constitution Act 1889. That definition connects the Act to the departmental structure that supports constitutional administration, although the Director‑General is not directly assigned functions under the short Act text.

Financial and appropriation law

• Financial administration and appropriation: Section 8 directs that moneys payable by the Governor as employer must be paid by the Treasurer and charged to the Consolidated Account, which “to the extent necessary is appropriated accordingly”. The Act therefore operates within standard public finance and appropriation frameworks. The Treasurer’s payment duty is a mechanism that aligns the Governor’s employer liabilities with executive budget processes and appropriation law.

Delegation and executive law

• Delegation: Section 9 permits delegation of powers or duties under the Act to the Official Secretary in writing, subject to limits. The delegation power is constrained by two express exclusions: the power of delegation itself and the regulation‑making power under s 10. That delegation design reflects executive law principles about non‑delegation of certain core powers and preserves a non‑delegable regulation competence.

Regulation‑making and subordinate legislation

• Regulation power: Section 10 authorises the Governor to make regulations necessary or convenient for giving effect to the Act. The Act does not indicate whether regulations require Executive Council approval, but it does state in s 4(2) that the Governor is not obliged to have the advice and consent of the Executive Council when exercising powers under the Act other than the power conferred by s 10. That suggests section 10 may be the function that the Governor must exercise with Executive Council involvement, as a common feature of regulation‑making under State statutes, although that procedural implication is read from the Act’s carve‑out language rather than stated expressly.

Transitional and amendment interactions

• The Act’s commencement is linked to section 7(1) of the Industrial Relations Amendment Act (No. 4) 1987 (s 2). The compilation table records subsequent amendments to the Act made by several later statutes, including financial and public sector management amendments. Those amendment links indicate that the Act has been adjusted to align with evolving public sector and financial administration frameworks, as set out in the compilation table’s entries for the Financial Administration Legislation Amendment Act 1993, the Acts Amendment (Public Sector Management) Act 1994, the Financial Legislation Amendment Act 1996, the Financial Legislation Amendment and Repeal Act 2006, and the Statutes (Repeals and Miscellaneous Amendments) Act 2009.

Operational implication of these interactions

• The Act functions as a narrowly framed statutory node that assigns employer status to the Governor but deliberately leaves detailed employment regulation, industrial dispute resolution, remuneration and administrative definitions to other statutes and instruments. Employment terms and dispute mechanisms therefore will be found in awards, industrial agreements and the other Acts the Governor must take into account, not in this Act. Departments, Ministers and employing authorities must therefore coordinate under the Public Sector Management Act 1994 and financial officers must act in accordance with appropriation law to give effect to payments directed under s 8.

In sum, the Act is integrative rather than autonomous. It reallocates employer status to the Governor and sets funding and delegation arrangements but prescribes that existing industrial law, interpretation powers and public sector management structures continue to govern the detailed terms, procedures and institutional agreements necessary to implement the Governor’s employer role.

The Act’s compilation table lists a concise amendment history and commencement information. The compiled entries in the source document should be treated as authoritative for the textual amendments referenced.

Original enactment and commencement

• Governor’s Establishment Act 1992, No. 39 of 1992, assented 2 October 1992. The Act’s commencement is tied to section 2: it came into operation on 3 November 1992 as noted in the Gazette reference (see s 2 and Gazette 3 Nov 1992 p. 5389).

Subsequent statutes amending the Act (as recorded in the compilation table)

• Statutes (Repeals and Miscellaneous Amendments) Act 2009, noted as No. 8 of 2009 and includes s 66; the compilation table records an amendment to section 3 effected by that Act, with an assent date and commencement on 22 May 2009 (see the table and the line “Section 3 amended: No. 8 of 2009 s. 66”).

Textual specifics from the source

• Section 3 was amended by No. 8 of 2009 s 66, according to the Act’s text which includes a bracketed note: “[Section 3 amended: No. 8 of 2009 s. 66.]”
• Sections 6 and 7 include bracketed notes indicating amendment by No. 32 of 1994 s 19.
• Section 8 includes bracketed notes indicating amendments by No. 6 of 1993 s 11; No. 49 of 1996 s 64; No. 77 of 2006 s 4.

Reprints and consolidation

• The compilation table records “Reprint 1: The Governor’s Establishment Act 1992 as at 2 May 2003” which included the amendments listed up to that reprint. Later amendments are recorded in the compilation table for the 2006 and 2009 Acts.

Implications of amendments as evidenced by the text

• The amendments recorded in the table and bracketed notes principally update definitions (s 3) and the financial/payment mechanics (s 8), and adjust the cross‑statutory arrangements referenced in ss 6-7 to align with the Public Sector Management Act 1994. The Act as printed in the source therefore reflects those textual changes.

What the compilation table does not record in the Act text

• The compilation table lists formal amendment sources, commencement and reprint dates. It does not provide the drafting changes in full or legislative history commentary beyond the statutory references and dates. For a complete textual history and comparison of pre‑ and post‑amendment wording, the original amendment Acts should be consulted, but those amendments are identified in the compilation table entries quoted above.

In sum, the Act was enacted in 1992 and has been amended periodically to align its financial mechanics and definitional cross‑references with broader public sector and financial administration legislation. The compilation table in the source document records the amending statutes and commencement dates, and the body of the Act carries bracketed amendment notes for the specific sections changed.

The source document contains no reported litigation history, case citations, or judicial decisions concerning the Governor’s Establishment Act 1992. The Act’s text and compilation table, as provided, do not record any court cases or tribunal determinations. Therefore there are no named cases in the source that can be cited as interpreting or applying the Act.

What the absence of litigation records in the source implies for practitioners

• No statutory cases named in the Act: Because the Act’s text and compilation table do not list any cases, a practitioner relying solely on this source cannot point to judicial construction of the provisions contained in the Act.
• Potential sources of dispute: Although the source contains no litigation history, the Act does create points at which disputes could plausibly arise and hence where litigation or tribunal proceedings might later be brought. Those potential dispute loci include:
  • Employment status and entitlements. Section 4(1) makes the Governor the employer and s 7 preserves rights for persons who were public service officers. Disputes could arise over the classification of an individual as a “member of the Governor’s Establishment”, the treatment of prior service for entitlements, or whether particular accruing rights have been preserved and correctly calculated.
  • Application of industrial instruments. Section 5(1)(b) subjects the Governor’s exercise of certain powers to any award, order or industrial agreement under the Industrial Relations Act 1979. Litigation or tribunal proceedings could arise if there is disagreement about whether an award applies, its interpretation, or whether the Governor’s exercise of power complied with the award.
  • Delegation and procedural fairness. Section 9 authorises delegation to the Official Secretary but forbids delegating the delegation power and s 10. Challenges could be framed around alleged unlawful delegation, or procedural fairness in appointment or dismissal processes exercised under delegated authority.
  • Arrangements under s 6. Disputes could arise between the Governor, employing authorities and Ministers about the terms agreed under s 6(2), including disagreements over cost allocation, secondment conditions or the scope of duties performed by staff made available under such arrangements.
  • Financial execution. Section 8 directs the Treasurer to pay on behalf of the Governor; practical disputes may concern whether payments were properly charged to the Consolidated Account, appropriation sufficiency, or whether expenditure complied with public finance rules.

Likely forum and remedies (not specified in the source)

• The source does not prescribe a tribunal or court forum for disputes under this Act. Where disputes relate to industrial instruments, those instruments and the Industrial Relations Act 1979 will typically provide the relevant tribunal or dispute resolution mechanism. Where disputes raise questions of administrative law, judicial review in the Supreme Court could be a plausible remedy. Contractual disputes about terms of arrangements under s 6 would be governed by contract law and could be litigated in civil courts. However, these procedural and forum implications are derived from the Act’s cross‑references and common legal practice rather than from case law recorded in the source.

Practical consequence for research and litigation readiness

• Because the source contains no litigation history, practitioners should not assume settled judicial interpretation. For contentious matters that hinge on interpretation of s 5(1)(b), s 6(2), s 7, s 8, or s 9, legal research beyond this source will be required to identify any case law, administrative decisions or tribunal rulings that have since considered these provisions in practice. The absence of cases in the Act text means factual and legal issues could be open to argument and may require authoritative judicial or tribunal clarification.

In short, the source contains no litigation history. It identifies possible dispute areas by reference to employment classification, industrial instruments, delegation and fiscal execution; each of those could give rise to litigation in appropriate circumstances, but the source itself supplies no concrete litigation precedents.

The Act is short and specific, but it contains several drafting features and cross‑references that create practical pitfalls for implementers and advisers. These are concrete operational risks and ambiguities arising directly from the Act’s text.

1. Employer status is statutory and singular

• The Governor is expressly the employer of members of the Establishment (s 4(1)). That changes who is legally responsible for employment decisions and liabilities. Practitioners must not assume departmental employer status applies; the statutory text overrides pre‑existing administrative practice. Contracts, payroll arrangements and liability exposure should be checked to ensure they reflect the Governor’s statutory employer role.

2. Executive Council procedural carve‑out

• Section 4(2) provides that, except for the regulation power in s 10, the Governor is not obliged to act with the advice and consent of the Executive Council when exercising powers or duties under the Act. This is a procedural exception and may catch those who assume Executive Council processes apply to all Governor actions. Confirm whether particular actions require Executive Council steps, particularly regulation‑making under s 10.

3. Reliance on external industrial instruments

• Section 5(1)(b) makes the Governor’s powers subject to awards, orders or industrial agreements under the Industrial Relations Act 1979. The Act does not specify which awards apply or their content. Advisers must verify which industrial instruments bind particular posts and how those instruments interact with any decisions the Governor or delegates intend to make.

4. Use of powers from the Interpretation Act 1984 without restatement

• Section 5(1)(b) authorises use of sections 52 and 53 of the Interpretation Act 1984. Because those powers are not reproduced, implementers must consult the Interpretation Act 1984 to understand the scope and limits of the powers the Governor may exercise under the Governor’s Establishment Act.

5. Section 6 arrangement negotiation burden

• Section 6 allows the Governor to use other government staff and facilities but requires arrangements to be “on such terms as the Governor and the Minister concerned and the relevant employing authority within the meaning of the Public Sector Management Act 1994 agree” (s 6(2)). Operationally, that introduces a three‑party negotiation requirement that may delay access to staff or facilities and create negotiation friction about costs, supervision and indemnities. The Act does not prescribe dispute resolution for disagreements about terms.

6. Transitional exception in s 5(3)

• Section 5(2) deems existing members appointed under the new power, but s 5(3) excludes persons whose services are the subject of an arrangement under s 6. Implementers must check whether a particular person falls within the transitional deeming or the s 6 exception, because that affects continuity and the application of s 7 protections.

7. Preservation of public service rights, but limited scope

• Section 7 preserves “existing and any accruing rights” for persons who were public service officers immediately before appointment under s 5. Practically, that requires accurate calculation of prior service for entitlements. The Act does not define “existing and accruing rights” in detail; advisers should map entitlements and ensure payroll and HR records treat prior service correctly.

8. Financial flow depends on Treasurer and appropriation

• Section 8 directs that moneys payable by the Governor as employer shall be paid on behalf of the Governor by the Treasurer and charged to the Consolidated Account, “which to the extent necessary is appropriated accordingly”. The practical implication is that payment depends on appropriation and the Treasurer’s processes. Payment timing and budget planning must align with appropriation cycles; lack of appropriations can affect cashflow to staff or suppliers.

9. Delegation constraints and the need for written instruments

• Delegation to the Official Secretary must be in writing and signed by the Governor (s 9). Delegations cannot include the delegation power or the regulation power (s 9). Practically, written delegations must be carefully drafted to avoid inadvertent delegation of excluded powers and to meet the Act’s formal requirement.

10. Regulation‑making power potentially subject to Executive Council or other procedural steps

• Section 10 grants regulation‑making authority but s 4(2) excludes s 10 from the Executive Council carve‑out. That suggests regulations may require procedural formality. Practitioners should not assume the regulation power can be exercised unilaterally without reference to Executive Council processes or other subordinate legislation requirements.

11. Definitions and institutional links require checking

• The definition of Director‑General in s 3 links to a department principally assisting the Minister administering the Constitution Act 1889. That definition may shift if departmental arrangements change. Similarly, the term “employing authority within the meaning of the Public Sector Management Act 1994” in s 6(2) requires reference to the Public Sector Management Act to identify the correct employing authority.

12. Absence of penalties and dispute mechanisms in this Act

• Because the Act contains no offences or penalties and no explicit dispute resolution mechanisms, affected parties must rely on industrial instruments, contract terms and general law remedies. That can create uncertainty about enforcement pathways and timelines.

Each of these points flows directly from the Act’s text. They are operational vulnerabilities or decision points that require attention by HR, legal, financial and ministerial staff when implementing the Governor’s employer role and negotiating arrangements with employing authorities.

Complying with the Act requires coordinated action across Government House administration, the Treasurer’s office, employing authorities and Ministers. The Act is concise; compliance is primarily about implementing its allocation of responsibilities and observing the cross‑statutory constraints it imposes. Below are concrete steps aligned to each operative provision.

1. Record employer status and update employment documentation

• For all members of the Governor’s Establishment, ensure employment contracts, payroll records and HR systems reflect that the Governor is their statutory employer under s 4(1). Where prior administrative practice identified a department as employer, update documents to avoid legal ambiguity. Confirm that job descriptions and supervision arrangements align with the Governor’s role as employer.

2. Implement appointment and dismissal processes under s 5

• When appointing or dismissing members of the Establishment, act under the statutory appointment power in s 5(1)(a). Before taking action, verify the applicability of any award, order or industrial agreement under the Industrial Relations Act 1979, which may constrain appointments or dismissal procedures under s 5(1)(b). Consult the Interpretation Act 1984 (ss 52 and 53) where those powers are proposed to be used.

3. Manage transitional and existing staff per s 5(2)-(3) and s 7

• Identify persons who were members immediately before commencement and determine whether they are deemed appointed under s 5(2) or excluded by s 5(3) because their services are subject to a s 6 arrangement. For persons who were public service officers immediately before appointment, ensure their existing and accruing rights are preserved and that prior service is credited as service as a member of the Establishment for entitlement calculations (s 7). Record and document prior service periods accurately for leave, superannuation or pension calculations.

4. Negotiate and document s 6 arrangements with Minister and employing authority

• If the Governor intends to use other public service staff or departmental facilities, negotiate terms with the Minister concerned and the relevant employing authority under the Public Sector Management Act 1994, and document the arrangement in a written instrument as required by s 6(1)-(2). Ensure the arrangement addresses supervision, reporting lines, cost allocation, indemnities, duration, performance expectations, and dispute resolution. Secure appropriate approvals from the employing authority in compliance with its governance obligations.

5. Ensure written delegations conform to s 9

• If delegating powers or duties to the Official Secretary, provide a written instrument signed by the Governor describing the delegated powers and any conditions (s 9). Do not attempt to delegate the power of delegation or the regulation‑making power in s 10. Keep a register of delegations and ensure the Official Secretary acts within the scope of the instrument.

6. Coordinate payment flows and appropriations with Treasurer

• For salary and other moneys payable by the Governor as employer, coordinate with the Treasurer’s office so payments can be made on behalf of the Governor and charged to the Consolidated Account, in accordance with s 8. Plan budgets and seek necessary appropriations in advance to avoid payment delays. Maintain clear records of amounts payable and the appropriation lines used.

7. Consider industrial instrument compliance and dispute pathways

• Before implementing employment terms, promotions or changes affecting members, check applicable awards, orders and industrial agreements under the Industrial Relations Act 1979 and ensure compliance. Where a dispute arises, follow the dispute resolution and tribunal processes set out in the relevant industrial instruments, because the Governor’s powers are expressly subject to such instruments (s 5(1)(b)).

8. Draft regulations under s 10 only where necessary and with procedural care

• If matters need to be prescribed by regulation to give effect to the Act, prepare regulations under s 10 and confirm whether Executive Council processes or other procedural requirements apply, since s 4(2) excludes s 10 from the Executive Council carve‑out for other powers. Engage the relevant legislative and policy units to draft subordinate legislation compliant with statutory drafting standards and procedural requirements.

9. Maintain HR records and rights preservation mechanics

• For public service officers who transfer to the Establishment or whose service is seconded under s 6, maintain personnel files that document prior service, accruals, and any variations to entitlements so that s 7’s preservation of rights can be implemented accurately.

10. Legal and governance checks

• Obtain legal advice when exercising powers that interact with the Industrial Relations Act 1979, the Interpretation Act 1984 (particularly ss 52 and 53), or when drafting s 6 arrangements that require agreement by employing authorities. Confirm that delegations, appointments and payments are authorised by the Act and consistent with public sector governance frameworks.

11. Recordkeeping and transparency

• Keep written records of all appointments, delegations, s 6 arrangements, and communications with the Treasurer regarding payments. These records will be necessary for financial audits, to demonstrate compliance with appropriation rules, and to defend against any legal challenges related to employer status or procedural fairness.

12. Anticipate and manage operational risks identified in the Gotchas section

• Address the negotiation friction risk under s 6 by establishing template terms for secondments or facility use. Ensure payroll systems can handle the Governor as employer, and that delegation instruments clearly circumscribe authority to avoid ultra vires concerns.

Following these steps will align operations with the statutory text. Because the Act relies on external industrial and public sector statutes for many substantive employment details, compliance requires coordinated action across legal, HR, finance and ministerial offices and verification of applicable awards and employing authority rules prior to substantive employment changes.
