What it does
This instrument, the Governor‑General Superannuation Age Factors (Division 293 Tax Law) Determination 2019 (No. 1), is a statutory determination made by the Secretary of the Department of Finance under subsection 4BA(10) of the Governor‑General Act 1974, dated 20 May 2019. The Determination performs a single operational role: it prescribes numeric age factors for use “for the purposes of section 4BA of the Governor‑General Act 1974” (see the instrument heading and section 3). The Determination comes into force the day after it is registered on the Federal Register of Legislation (s 2).
Mechanically, the instrument (a) names itself (s 1); (b) fixes its commencement (s 2); and (c) specifies how an age factor is to be determined by reference to a tabulated Schedule (s 3 and the Schedule). The Schedule sets out a pair of age factors for each whole number age from 30 through to 90 inclusive, one factor labelled “Male Age Factor” and one labelled “Female Age Factor”. The table is keyed to “Age at last birthday prior to start of pension” (Schedule heading and s 3(b)). The numerical entries are given to three decimal places.
The Determination is a delegated instrument. Its operative effect is to supply the numeric parameters that the Governor‑General Act 1974, in particular section 4BA, requires be specified by instrument. The title also references Division 293 Tax Law, but the body of the Determination limits its stated legal effect to providing the age factor for the purposes of s 4BA (s 3). The instrument itself contains no operational rules about how the age factor is to be applied beyond that cross‑reference to s 4BA, no transitional provisions, no appeal or review mechanism, and no penalty or enforcement provisions.
Who made it is explicit: Rosemary Therese Huxtable, Secretary of the Department of Finance, signed and dated the Determination (instrument header). The instrument also makes explicit where to find the registered text, noting instruments are registered on the Federal Register of Legislation kept under the Legislation Act 2003 (Note). Administrators who must apply the Determination will need to ensure they are using the registered text after its registration date, because commencement is tied to registration (s 2).
