#### 34I Notice of entry 34I Notice of entry > > (1) Before an authorised officer exercises a power of entry under this Division, the Authority or an ETNO must give the owner or occupier of the premises written notice of the intention to enter the premises. > > > (2) The notice must— > > > > > (a) state the purpose for which the power is to be exercised, and > > > > > (b) specify the day on which the authorised officer intends to enter the premises, and > > > > > (c) be given to the owner or occupier of the premises before that day. > > > (3) Notice is not required to be given to the owner or occupier of the premises if— > > > > > (a) the owner or occupier consents to the entry, or > > > > > (b) entry is required for an emergency. > > **s 34I:** Ins 2022 No 20, Sch 1\[4\].
