New South Wales regulation
This Determination formally defines four senior executive bands for the NSW Public Service (Band 4 = Secretary down to Band 1 = Director) and takes effect on 24 February 2014. It applies to Public Service senior executives (including department Secretaries and non‑statutory agency heads) and will also apply to statutory officers or other executives only where their enabling legislation or Schedule 4/regulations adopt the bands.

1 Name of Determination
This Determination is the Government Sector Employment (Senior Executive Bands) Determination 2014.
2 Commencement
This Determination commences on 24 February 2014 and is required to be published on the NSW legislation website.
3 Public Service senior executive bands
For the purposes of the Government Sector Employment Act 2013, the Public Service senior executive bands are as follows:
BAND 4—Secretary level
BAND 3—Deputy Secretary level
BAND 2—Executive Director level
BAND 1—Director level
4 Application to Public Service senior executives
The Public Service senior executive bands prescribed by this Determination apply to the employment of Public Service senior executives (including Secretaries of Departments and heads of other Public Service agencies who are not statutory officers).
5 Application to certain statutory officers and other executives
The Public Service senior executive bands prescribed by this Determination also apply to the employment of statutory officers or other executives to whom the Public Service senior executive bands are applied by the legislation that provides for the employment of the statutory officers or other executives or by Schedule 4 to the Government Sector Employment Act 2013 (or the regulations made under that Schedule).
