#### 49 Performance management 49 Performance management > > (1) A Public Service senior executive must, in accordance with the performance management system applying to the executive under section 67 of the Act— > > > > > (a) enter into a performance agreement with his or her employer, and > > > > > (b) have his or her performance reviewed at least annually. > > > (2) A Public Service senior executive may be employed under a contract of employment even though the agency’s performance management system has not been implemented or the executive has not entered into a performance agreement. In that case, the executive’s contract of employment is to be construed accordingly.
