What it does
This by‑law, made under the Government Railways Act 1904, prescribes the procedural mechanism by which an alleged trespass on government railway land (the offence in section 48(2) of the Act) can be dealt with by way of an infringement notice and modified penalty, rather than only by prosecution. Rule 3 expressly prescribes the offence under section 48(2) of the Act for the purposes of section 53A of the Act and fixes the modified penalty at $500 (r 3). Rule 4 prescribes the two standard forms to be used under the Act’s infringement‑notice procedure: Schedule 1 Form 1 is the infringement notice for issuing a modified penalty under s 53A(3), and Schedule 1 Form 2 is the withdrawal of an infringement notice for the purposes of s 53A(7) (r 4(1)-(2)). The by‑law also clarifies that its main legislative units are called “rules” (r 1(2)), establishes the date of publication commencement for rules 1 and 2 and the day after for the remainder (r 2), and is compiled as SL 2023/119 published 26 July 2023 (compilation table).
Mechanically, the by‑law does three things: it (1) enables an authorised person to issue an infringement notice for the trespass offence listed in s 48(2) of the Government Railways Act using a prescribed Form 1, (2) fixes the monetary amount of the modified penalty at $500, and (3) prescribes Form 2 as the standard form to withdraw an issued infringement notice and to facilitate refunds where a modified penalty has already been paid (Schedule 1 Forms 1 and 2; r 3; r 4). The text of Form 1 sets out required fields for an issuing officer to complete, the 28‑day payment window, the effect of payment (avoidance of court prosecution), the alternative of electing prosecution by returning the signed form within 28 days, and a proximate summary of enforcement measures that may follow non‑payment under the Fines, Penalties and Infringement Notices Enforcement Act 1994 (Schedule 1, Form 1). Form 2 sets out the information required to document the withdrawal of an infringement notice and the administrative process for refunding a paid modified penalty (Schedule 1, Form 2).
