Government Employees' Housing Act 1964

Central concepts are defined and then operationalised through delegated powers. The Act defines the key institutional and subject terms that structure who does what: "Authority" is the Housing Authority referred to in s 6(4) of the Housing Act 1980 (s 5). "Department" is a defined term that includes (i) those assisting the Minister for Public Sector Management or the Minister in administering Part 3 of the School Education Act 1999, and (ii) any other department or Crown instrumentality, hospital, board, corporate or other body declared by the Governor by proclamation (s 5, s 7). "Government employee" means a person employed under the State in any capacity in a Department to which the Act applies (s 5). "House" is a broad property concept that covers single, attached or multi‑storey dwelling units and associated structures and appurtenances (s 5). "Tenant" includes persons deriving title under the original tenant (s 5). The Act also defines "owner" for the specific purpose of the tenancy termination provision (s 28(4)).

Function and powers: The Authority’s primary function is to provide adequate and suitable housing accommodation within the State for Government employees (s 16). To fulfil that function the Act gives express powers: to purchase or otherwise acquire land or houses other than by compulsory acquisition (s 16(a)); to erect houses on land acquired (s 16(b)); to let or dispose of houses or land owned by or under the Authority’s control (s 16(c)); to carry out planning and subdivision consistent with the Planning and Development Act 2005 (s 19(a)); to lay out and construct streets and expend moneys to make land suitable for housing (s 19(b)); to let, lease or dispose of land (s 19(c)); to erect, convert and maintain houses (s 19(d)-(e)); to set rents and tenancy conditions on a prescribed basis and reassess rents at intervals not exceeding three years or when a house becomes vacant (s 19(h)); to make inquiries and reports (s 19(i)); and to undertake all matters connected with the Act generally (s 19(j)). The Authority also has power to accept gifts and to carry trusts with Ministerial consent where the trust objects are not substantially different from Authority objects (s 20(1)-(2)).

Finance and accountability: Funds for the Authority are sourced from parliamentary appropriation, borrowings, rent and disposals income, gifts and other receipts (s 23). Borrowing requires prior written Treasurer approval and is able to be secured by a Treasurer guarantee (s 22(1)-(4)). The Government Employees’ Housing Authority Account is an agency special purpose account established under s 16 of the Financial Management Act 2006, into which all monies received by the Authority are to be credited and from which expenses of operation are charged (s 24(1), (1a), (3)). The Account is controlled by the Authority but may be operated in a manner approved by the Treasurer (s 24(2)). Moneys standing to the credit of the Account may be temporarily invested at the Treasurer’s request and interest credited to the Account (s 24(5)).

Tenancy control and enforcement: The Authority may determine a tenancy where a tenant defaults on rent for 14 days (s 28(1)(a)), breaches covenants for 14 days (s 28(1)(b)), ceases to be an employee in a Department (s 28(1)(c)), or is an owner or spouse/de facto partner of an owner of land where, in the opinion of the Authority, that tenant might reasonably reside (s 28(1)(d)). Where the Authority terminates a tenancy it may give notice and, on failure to vacate, apply to a court of summary jurisdiction for a warrant to regain possession (s 28(2)-(3)). The Act provides immunity from personal civil liability for members, officers and agents acting in good faith in carrying out functions under the Act (s 27).

Delegation and discretion: Several mechanisms vest wide discretion in the Authority and other executive actors. The Governor may expand which bodies are treated as Departments (s 7). The Authority has explicit discretion to refuse to accept vested land and houses if doing so would impose obligations it should not undertake (s 17(2)). The Authority may allocate houses to Departments on application by chief executive officers but is not required to provide housing except where required by the Act or by contract (s 18). Rents and tenancy conditions are to be fixed on a basis or formula "as may be prescribed" (s 19(h)), which creates a role for subsidiary regulation or instruments to specify formulae and procedures.

Interlocking statutory framework: The Act references and operates alongside other Acts. The Authority is that body referred to in s 6(4) of the Housing Act 1980 (s 5). Planning and subdivision powers are to be exercised subject to the Planning and Development Act 2005 (s 19(a)). The Account is established under the Financial Management Act 2006 (s 24(1)). Gifts are exempt from duty under the Duties Act 2008 (s 20(3)). The compilation table and notes record transitional interactions with financial administration legislation, including the Financial Administration and Audit Act 1985 and machinery of government changes (compilation notes).

Taken together the definitions and powers describe an administrative model that centralises government employee housing provision under the Housing Authority, permits commercial disposal and letting of assets (including to non‑employees, s 18(4)), finances operations through a mix of appropriation, rents, borrowings and gifts, and relies on executive approvals (Governor proclamations, Treasurer approvals, Ministerial consents) and subsidiary regulations to fill in operational detail.

This Act affects several identifiable groups and public actors by assigning rights, duties, funding flows and decision-making powers.

Primary affected groups

• Government employees: The Act is expressly designed to provide housing for Government employees (s 4, s 16). Employees who occupy Authority houses are tenants under tenancy agreements and are subject to the Authority’s tenancy rules, rent-setting and termination powers (ss 19(h), 28). Employees who cease to be employed by a Department can have tenancy determined under s 28(1)(c).

• Departments and chief executive officers: Departments are both potential applicants for allocation of houses and original owners of housing assets that transfer to the Authority upon commencement or upon proclamation that a body is a Department (s 17(1), s 7). A chief executive officer of a Department may apply to the Authority for allocation of houses (s 18(1)-(3)); the Authority must have regard to such applications but retains approval and refusal powers (s 18(2)-(3)). Departments may enter into arrangements and agreements with the Authority regarding building, maintenance, management, letting and renting of houses (s 19(g)).

• The Housing Authority (Authority): The Authority becomes the custodian of land, houses and improvements previously under Departments’ control on commencement (s 17(1)), subject to its right to refuse specific transfers (s 17(2)). It holds wide powers to acquire, build, let, lease, maintain, subdivide, exchange, sell and generally manage housing assets (ss 16, 19). The Authority controls the Account created under s 24 and is responsible for charging all operating and administrative costs to that Account (s 24(1a), (3)).

• Treasurer and Minister: The Treasurer plays a financial control role. Borrowing by the Authority requires the Treasurer’s prior written approval, and the Treasurer may give guarantees for borrowings (s 22(1)-(4)). The Treasurer also approves the manner in which the Account may be operated (s 24(2)) and may require security for guarantees (s 22(4)). The Minister has roles in review and in consent to certain gifts with trusts (s 20(1)(b), s 30).

• Tenants and owners: Persons occupying Authority houses are tenants and subject to the tenancy regime (s 28). The definition of "tenant" includes persons deriving title under an original tenant (s 5). The Act gives the Authority the power to determine tenancies where a tenant is an owner, or spouse/de facto partner of an owner, of land where the Authority believes the tenant might reasonably reside (s 28(1)(d)). Section 28(4) supplies a broad definition of "owner" capturing leaseholders, persons with beneficial interests such as entitlement to rent, and persons who have contracted to purchase land even before title transfer (s 28(4)(a)-(d)).

Other affected interests

• Donors and estates: Individuals or entities making gifts, devises or bequests to the Authority are affected because the Authority can accept absolute gifts or, with Ministerial consent, gifts subject to trust if the trust’s objects align substantially with the Authority’s objects (s 20(1)). Gifts to the Authority are exempt from duty under the Duties Act 2008 (s 20(3)), which affects tax and estate planning outcomes for donors.

• Courts and enforcement actors: The Authority may apply to a court of summary jurisdiction for a warrant to give possession where a tenant fails to vacate following termination (s 28(2)). Police or authorised persons executing such warrants will be affected by the statutory authorisation to enter premises "if need be by force" (s 28(3)).

• The Governor: The Governor has the formal power to declare bodies to be "Departments" for the Act’s purposes (s 7) and may make regulations under the Act (s 29(1)), thereby affecting the scope of the Act and its implementing detail.

Who pays and who decides

• Funding: Funds come from parliamentary appropriations (s 23(a)), moneys borrowed under s 22 (s 23(b)), rents and disposal proceeds (s 23(c)), gifts and legacies (s 23(d)), and other receipts (s 23(e)). Expenses of administration and operation are charged to the Account controlled by the Authority (s 24(1a), (3)). Borrowing requires Treasurer approval and security (s 22(2), (4)); thus the public fisc bears contingent liability through Treasurer guarantees (s 22(1), (3)).

• Decision‑making: Operational decisions about acquisition, disposal, letting, rent setting and tenancy enforcement are primarily for the Authority (ss 16, 19, 28). Financial decisions about borrowing and the operation of the Account are supervised by the Treasurer (ss 22-24). The Governor and Minister hold statutory powers to define Departments (s 7), approve certain gifts (s 20(1)(b)) and conduct reviews (s 30).

Geographic and sectoral scope

• The Act applies within the State of Western Australia and authorises housing provision "within the State" (s 16). The operational scope is targeted at Government employees in Departments to which the Act applies (s 5), but the Authority has latitude to let houses to persons other than Government employees where not required to provide a house under the Act or any agreement (s 18(4)). That latitude creates potential cross‑subsidy or commercial letting to non‑employees.

In sum, the Act affects the Housing Authority’s operations and finances, Government employees’ access to housing and tenancy security, Departments’ asset holdings and housing responsibilities, the Treasurer’s fiscal exposure and control, and donors’ tax/duty outcomes. It vests operational discretion in administrative actors while creating statutory financial controls and an enforcement route through the courts.

This section sets out the principal statutory duties imposed and rights created by the Act, with direct references to the controlling provisions.

Authority’s duties and rights

• Duty to provide housing for Government employees: The Authority’s statutory function is to provide adequate and suitable housing accommodation within the State for Government employees (s 16). That is framed as the Authority’s primary function and core duty.

• Rights to acquire and manage property: The Authority may purchase, contract for the use of, or otherwise acquire (other than by compulsory acquisition) land or houses (s 16(a)). It may erect houses on acquired land (s 16(b)), and let or dispose of houses or land under its control (s 16(c)). Section 19 expands these rights to include planning and subdivision subject to the Planning and Development Act 2005 (s 19(a)), constructing streets and works (s 19(b)), letting, leasing or disposing of land (s 19(c)), erecting, converting and maintaining houses (s 19(d)-(e)), exchanging land (s 19(f)), entering into arrangements with Departments (s 19(g)), setting rents and conditions of tenancy on a prescribed basis (s 19(h)), making investigations (s 19(i)) and generally undertaking other matters connected with the Act (s 19(j)).

• Right to accept gifts and trusts: The Authority may accept absolute gifts, devises or bequests of real or personal property, and, with the Minister’s consent, gifts subject to trusts aligned with Authority objects (s 20(1)(a)-(b)). It may give effect to trusts, conditions or stipulations even if other provisions might otherwise prevent that (s 20(2)). Gifts to the Authority are duty‑exempt (s 20(3)).

• Right to control and operate the Account: The Authority controls the Government Employees’ Housing Authority Account established under the Financial Management Act 2006 and may operate it subject to Treasurer approval (s 24(1), (2)). All monies received by or for the Authority are to be credited to the Account (s 24(1a)), and expenses of operation and administration are charged to the Account (s 24(3)).

• Discretion in transfers: Upon commencement, departmental housing assets vest in the Authority (s 17(1)), but the Authority may refuse to accept any land or house where acceptance would impose obligations it considers it should not undertake (s 17(2)). That gives the Authority an affirmative right to reject specific transfers.

Treasurer’s duties and rights

• Approval and guarantee of borrowings: The Treasurer must give prior written approval for the Authority to borrow money upon such terms and conditions as the Treasurer approves (s 22(2)). The Treasurer is authorised to give the guarantee referred to in subsection (1) , including guarantee of interest , for and on behalf of the Crown (s 22(3)). The Treasurer may require security and the Authority must execute instruments necessary for that purpose (s 22(4)).

• Approval of Account operation and investments: The Account may be operated in the manner the Treasurer approves (s 24(2)). The Treasurer may, at the Authority’s request, temporarily invest moneys standing to the credit of the Account and the interest derived from such investment is credited to the Account (s 24(5)).

Minister’s duties and rights

• Consent to gifts subject to trust: The Minister’s consent is required for the Authority to accept gifts subject to trust whose objects are not substantially different from the Authority’s objects (s 20(1)(b)). The Minister also bears the statutory duty to cause the five‑yearly review (s 30).

Departments and chief executive officers

• Application for allocation: A chief executive officer of a Department may apply to the Authority for allocation of houses where they are of the opinion houses are required for Government employees (s 18(1)). The Authority must have regard to such applications and may allocate houses if satisfied they are needed (s 18(2)-(3)).

Tenants’ duties and rights

• Rent payment and tenancy obligations: Tenants must comply with the covenants and conditions of their tenancy agreements; breaches of rent payment for 14 days or covenant breach continuing for 14 days are express grounds for termination (s 28(1)(a)-(b)). Tenants deriving title under the original tenant remain included in the definition of tenant (s 5).

• Right to notice and access to courts: If the Authority determines a tenancy, it must give notice requiring the tenant to vacate by a date specified in the notice (s 28(2)). Where a tenant fails to vacate, the Authority may seek a warrant through a court of summary jurisdiction to enter and give possession to the Authority (s 28(2)-(3)). This creates a statutory enforcement route rather than a private contractual remedy alone.

Owners

• Owner‑status triggers termination power: The Authority may determine the tenancy where the tenant is an owner, or spouse or de facto partner of an owner, of land where the Authority considers the tenant might reasonably reside (s 28(1)(d)). The Act gives a detailed definition of "owner" for that purpose, which includes Crown leaseholders, persons entitled to receive rent, beneficiaries under deceased estates and persons who have contracted to purchase land (s 28(4)(a)-(d)).

Regulations, fines and review

• Regulatory power and fine: The Governor may make regulations to prescribe matters contemplated by the Act (s 29(1)), and regulations may impose a fine of $40 for breach of any regulation (s 29(2)). The Minister must cause an investigation and review as to the need for the Act to continue in operation as soon as practicable after 1 July 1992 and every five years thereafter, and lay the report before Parliament (s 30).

Immunities and protections

• Exemption from personal liability: Members, officers and agents of the Authority and those carrying out functions under the Act are not personally liable for anything done or omitted in good faith in connection with the Act’s exercise (s 27). This is a statutory protection for administrative actors.

Rights not granted or limited duties

• No absolute entitlement for employees: The Authority is not required to provide a house for any Government employee except insofar as mandated by the Act or any agreement relating to a house taken over by the Authority under the Act (s 18(4)). That limits employees’ entitlement to housing and makes provision by the Authority discretionary in many circumstances.

• Authority’s refusal to accept transfers: The Authority may refuse to take over particular land or houses vested in Departments if acceptance would impose an obligation it should not undertake (s 17(2)). That is a duty of discretion that potentially places the onus on Departments to retain responsibility for properties the Authority rejects.

In summary, the statutory architecture assigns operational and financial responsibility to the Authority, places fiscal oversight with the Treasurer, gives Departments application and cooperative rights, creates tenancy rights and enforcement mechanisms, and protects official actors from personal liability when acting in good faith. The Act simultaneously preserves the Authority’s discretion in allocation, rent setting (subject to prescribed formulae), and accepting assets.

The Act operates mainly through administrative powers, contractual and statutory tenancy controls, and limited regulatory penalties. There are no express criminal offences with significant penal consequences in the Act; enforcement mechanisms are predominantly civil and administrative, with some enforcement assistance from courts.

Regulatory penalties

• Regulations and fines: The Governor may make regulations under s 29(1) to prescribe matters contemplated by the Act. Regulations may impose a fine of $40 for the breach of any regulation (s 29(2)). That figure is fixed in the Act and appears nominal; any regulatory enforcement under the Act will be constrained by that maximum where the regulation prescribes such a fine. The Act does not provide other monetary penalties or escalating fines within its text.

Tenancy enforcement

• Grounds for determining tenancy: The Authority may determine a tenant’s tenancy for specified reasons: non‑payment of rent for 14 days after it becomes due (s 28(1)(a)); failure to comply with covenants for 14 days (s 28(1)(b)); cessation of employment in a Department (s 28(1)(c)); or where the tenant is an owner, or spouse/de facto partner of an owner, of land where, in the Authority’s opinion, the tenant might reasonably reside (s 28(1)(d)). The specification of these grounds gives the Authority statutory justification for terminating tenancies on these bases.

• Notice and court warrant: If the Authority decides to determine the tenancy it may give written notice to the tenant requiring vacation by a specified date (s 28(2)). If the tenant fails to vacate by the date, the Authority or its agent may apply to a court of summary jurisdiction for a prescribed form warrant requiring a person to enter (if need be by force) and give possession to the Authority (s 28(2)-(3)). The Act empowers the named person to enter with necessary assistance and to give possession (s 28(3)). This provides an enforced possession remedy through the magistrates’ court rather than a private self‑help remedy.

• Judicial process: While the Act authorises application to a court of summary jurisdiction, it does not set out detailed procedural requirements for that court’s hearing of the application; those procedures will be governed by the court’s own practice and relevant court rules. The Act’s reference permits summary civil enforcement for possession, with the court acting as gatekeeper for warrants.

Immunities and liability limits

• Exemption from personal liability: Members and officers of the Authority, and others carrying out functions under the Act, are not personally liable for things done or omitted in good faith in connection with the exercise or purported exercise of functions or duties under the Act (s 27). That immunity limits civil claims against individuals but does not remove the Authority’s institutional liability where applicable. The Act does not provide immunity for bad faith acts.

Financial enforcement

• Borrowing security and guarantees: Before the Treasurer gives a borrowing guarantee, the Authority must give security as required and execute necessary instruments (s 22(4)). Failure to provide such security would prevent the Treasurer granting a guarantee. The Treasurer’s power to require security and to set terms and conditions for borrowings (s 22(2), (4)) is an enforcement mechanism of financial control; it enables the Crown to limit fiscal exposure.

Other enforcement levers

• Control of the Account: The Account established for Authority funds must be operated in a manner approved by the Treasurer (s 24(2)). The Treasurer’s power to control Account operation, and to invest Account funds at the Authority’s request (s 24(5)), are internal financial controls that affect the Authority’s liquidity and risk exposures.

• Contractual remedies: The Act recognises existing agreements or obligations attached to transferred houses (s 17(1)). Where the Authority takes over houses subject to contractual obligations, enforcement and remedies for breach will also depend on contract law and any continuing obligations expressly preserved by the Act.

Limitations in enforcement design

• Narrow regulatory fine: The $40 maximum fine for regulatory breaches (s 29(2)) is a low‑value penalty and limits deterrence through regulation. The Act provides no alternative or escalating monetary penalties for repeated or serious regulatory breaches.

• Reliance on court process for possession: The need to apply to a court of summary jurisdiction to obtain a warrant to regain possession means that enforcement of determinations of tenancy is subject to court processing time and procedural requirements; it is not an administrative self‑executing eviction power.

• Good faith immunity: The statutory exemption from personal liability (s 27) may reduce the risk of personal litigation against officers, which could limit individual deterrence for negligent but still "good faith" conduct; the Act does not define the contours of "good faith" within its text.

In short, enforcement in the Act is largely administrative and civil, focused on tenancy determination with judicial assistance for possession, limited regulatory fines, and financial control via Treasurer approval and security for borrowing. Personal liability protection for officials exists where acts are in good faith. The Act does not create significant criminal penalties or complex enforcement regimes beyond those mechanisms.

The Act is not a stand‑alone instrument; it explicitly cross‑references and operates in connection with several other enactments and legal processes. The interaction points govern institutional identity, planning and development, financial management, duties, and transitional arrangements.

Housing Act 1980

• Authority identity: The Act defines "Authority" by reference to the Housing Authority referred to in s 6(4) of the Housing Act 1980 (s 5). This linkage makes the Housing Authority the statutory body responsible for implementing the Act’s functions and brings the Government Employees’ Housing Act 1964 into the institutional framework of the Housing Act 1980. The compilation notes record transitional provisions that, post‑2006 machinery of government changes, treated references to former bodies as references to the Housing Authority (compilation notes, Division 6 Transitional matters, cl 339).

Planning and Development Act 2005

• Planning/subdivision constraint: The Authority’s planning and subdivision power under s 19(a) is expressly subject to the Planning and Development Act 2005. That means land use, subdivision approvals, planning instruments and statutory planning processes established under the Planning and Development Act 2005 regulate the Authority’s exercise of those powers to plan and subdivide land it acquires.

Financial Management Act 2006

• Account establishment and control: Section 24(1) establishes the Government Employees’ Housing Authority Account as an "agency special purpose account" under s 16 of the Financial Management Act 2006. That imports the Financial Management Act’s framework for agency accounts, reporting, and control while also providing the Act‑specific direction that all monies received by or for the Authority must be credited to the Account and that the Treasurer approves how the Account may be operated (s 24(1), (1a), (2)). The compilation notes also refer to the Financial Administration and Audit Act 1985 in transitional contexts, signalling interactions with broader public financial management regimes.

Duties Act 2008

• Duty exemption for gifts: The Act provides that no duty under the Duties Act 2008, probate or estate or succession duty shall be payable on property given, devised or bequeathed to the Authority (s 20(3)). This creates a specific statutory tax/duty exemption that affects charitable or public gifts to the Authority and aligns Authority gift‑taking with duties law.

School Education Act 1999

• Definition of Department: The Act’s definition of "Department" includes "any department which principally assists the Minister for Public Sector Management or the Minister in the administration of Part 3 of the School Education Act 1999" (s 5). That ties the Act’s scope to a particular set of education administration functions and links school sector employment to the housing provision scheme.

Financial Administration and Audit Act 1985 and Machinery of Government changes

• Transitional and reporting interactions: The compilation notes (Machinery of Government (Miscellaneous Amendments) Act 2006, Division 6, cl 336-340) record detailed transitional provisions integrating former bodies into the Housing Authority and mapping reporting and financial responsibilities under the Financial Administration and Audit Act 1985 (now relevant equivalents under updated financial legislation). These transitional clauses continue to have effect for final reports and reporting officer duties where applicable (compilation notes).

Courts and summary jurisdiction

• Enforcement via courts: The Act authorises the Authority to seek a warrant from a court of summary jurisdiction to regain possession of premises (s 28(2)). That places eviction and possession enforcement within the magistrates’ court system and subjects outcomes to the court’s procedural rules and judicial discretion. The Act does not specify further procedural law; those aspects will be governed by the general law governing courts of summary jurisdiction.

Regulations and subordinate instruments

• Prescription of rents and tenancy conditions: Section 19(h) allows the Authority to fix rents "upon such basis or formula as may be prescribed". That language indicates that regulations or other prescribed instruments are necessary to give operational content to rent setting. Similarly, the Governor’s regulation‑making power under s 29(1) may be used to prescribe matters contemplated by the Act. The Act's operation therefore depends in practice on any regulations made under it.

Interplay of Agency control and Treasurer consent

• Financial control framework: The Authority controls the Account (s 24(2)), but the Treasurer has power to approve how it is operated and to give guarantees for borrowing only with prior written approval (s 22(2), s 24(2)). That interaction creates a layered governance structure in which agency autonomy is subject to executive financial oversight under financial management statutes.

Existing agreements and obligations

• Continuity of rights and obligations on transfer: Section 17(1) transfers to the Authority all land, houses and improvements vested in Departments and all "powers, authorities, rights, title, interest and obligation in the same or with respect thereto" upon commencement. That preserves pre‑existing contractual obligations and rights unless the Authority elects to refuse a transfer under s 17(2). Consequently, pre‑existing promises or obligations may continue under the Authority’s stewardship, but the Authority’s limited refusal power (s 17(2)) permits rejection where assumed obligations would be inappropriate.

Taken together, the Act operates within an established statutory matrix covering housing institutional arrangements, planning and development, financial management and duties. Its practical operation will thus be shaped substantially by the Housing Act 1980, the Planning and Development Act 2005, the Financial Management Act 2006 and duties legislation, as well as any regulations made under s 29. Transitional machinery and reporting requirements recorded in the compilation notes reflect earlier institutional consolidations into the Housing Authority and the mapping of financial reporting responsibilities.

The compilation table and in‑text notes set out the Act’s amendment timeline and certain structural changes. Below is a chronological synopsis of key amendments and legislative events recorded in the provided text, with reference to the compilation table entries.

Deletions and continuing provisions

• The Act records a number of deletions: s 3 and s 6 were deleted (no. 10 of 1998, no. 28 of 2006 respectively), Part II (s 8-15) was deleted (no. 28 of 2006 s. 300), and several sections (including s 21, s 25, s 26) were deleted by later amending Acts (see textual notes: [21. Deleted: No. 28 of 2006 s. 303], [25. Deleted: No. 28 of 2006 s. 306], [26. Deleted: No. 98 of 1985 s. 3]).

Transitional provisions

• The compilation notes include Division 6 transitional matters stemming from the Machinery of Government (Miscellaneous Amendments) Act 2006, which mapped former bodies such as The State Housing Commission and the former Government Employees’ Housing Authority into the Housing Authority and dealt with financial reporting and continuity of funds and references (compilation notes, Division 6 cl 336-340). Those transitional matters affect how prior obligations and reports were to be finalised and how references to former bodies should be read post‑commencement.

Practical effect of amendments

• The cumulative effect of the amendments has been to fold the Government Employees’ Housing functions into the modern Housing Authority structure, to align planning, financial and reporting obligations with contemporary statutes (Planning and Development Act 2005, Financial Management Act 2006) and to remove obsolete or redundant sections. The s 20 duty exemption in 2008 and the establishment of the Account under the Financial Management Act 2006 (s 24(1)) are examples of later amendments integrating taxation and financial management considerations.

For exact commencement dates and references, the compilation table provides the formal legislative history and the specific amending Acts and sections. Users should consult the compilation table entries and the specific amending Acts listed there for precise amendment text and commencement mechanics.

The text of the Act as provided names no court decisions or judicial interpretations. There are no reported cases referred to in the Act itself and the compilation notes do not cite any judicial determinations. The Act does, however, interact with courts in a defined enforcement context and with tribunals and administrative processes by necessary implication.

Statutory interactions with courts

• Court of summary jurisdiction: The Act authorises the Authority to apply to a court of summary jurisdiction for a warrant to obtain possession of premises where a tenant has failed to vacate after notice (s 28(2)). That mechanism creates potential for litigation in the magistrates’ courts, where tenants may contest the grounds for termination, procedural fairness of notice, or the propriety of the Authority’s opinion (for example, under s 28(1)(d) concerning owners). Disputes about property rights or tenancy termination will be resolved under applicable court procedure on a case‑by‑case basis.

• Contractual and property disputes: Because s 17(1) imports "powers, authorities, rights, title, interest and obligation" in relation to land and houses vested in Departments into the Authority, litigation in respect of pre‑existing contracts, easements, leases or other property rights that continue after transfer could arise. Any adjudication would occur in the appropriate forum depending on the nature of the dispute , contract, property, equity or administrative review.

Absence of named litigation in the Act

• No cases cited in the Act: The statutory text and notes do not contain references to judicial decisions interpreting the Act. The compilation table lists only amending Acts and transitional provisions; it does not reference case law. Therefore, this deep dive cannot summarise or cite any litigation history beyond noting that none is recorded within the statutory text provided.

Potential litigation avenues (by implication)

• Judicial review or administrative law claims: Where an affected person asserts that the Authority or a Minister/Treasurer has acted beyond power or unlawfully (for example, unreasonable refusal to allocate houses under s 18, or improper exercise of discretion under s 17(2)), those persons could seek judicial review in the Supreme Court on the usual grounds (jurisdictional error, procedural unfairness, unreasonableness), although the Act itself does not create a specific review path.

• Civil actions: Tenants might bring civil proceedings for breach of tenancy contract, or for personal claims against the Authority; however, the Act provides statutory immunity from personal liability for officers and members acting in good faith (s 27). Institutional claims against the Authority remain possible where the Authority’s acts give rise to liability.

• Enforcement proceedings in magistrates’ court: Proceedings to obtain or resist warrants for possession are likely to appear in courts of summary jurisdiction under s 28(2). Those proceedings would shape practical enforcement outcomes and may generate case law on the application of s 28(1)(d) , the owner‑resident test , or on notice and procedural issues.

Because the provided statutory text does not record any judicial decisions, users seeking authorities on judicial interpretation should consult contemporaneous case law databases or appellate records for any reported decisions construing provisions such as ss 17, 18, 19(h) (rent-setting), 24 (Account operation) or 28 (tenancy termination). This deep dive does not create or infer litigation beyond the Act’s express provision for court involvement in possession enforcement.

The Act contains multiple drafting features and operational choices that can produce unexpected outcomes or require careful compliance and interpretation. The following points identify specific provisions and practical wrinkles that practitioners and administrators should watch for, with section citations.

1. Authority’s discretion and employees’ lack of entitlement (s 18(4), s 16)

• The Act does not create a guaranteed right for Government employees to housing. Section 18(4) explicitly states that the Authority is not required to provide a house for any Government employee except insofar as required under the Act or under the terms of any agreement relating to any house taken over. That means a chief executive officer’s application under s 18(1) is subject to Authority discretion in allocation (s 18(3)(c)-(d)). Practically, employees who expect housing as a statutory entitlement may be surprised to find allocation is discretionary.

2. Authority may refuse transfers of assets (s 17(2))

• On commencement or proclamation, departmental housing assets vest in the Authority (s 17(1)), but the Authority may refuse to accept any particular land or house where acceptance would impose obligations it should not undertake (s 17(2)). Departments should therefore not assume a seamless transfer; a property carrying unusual liabilities may stay with the Department or require negotiation.

3. Broad definition of "owner" triggers termination power (s 28(4), s 28(1)(d))

• The definition of "owner" for tenancy termination (s 28(4)) is wide: it includes leaseholders under Crown leases, persons entitled to receive rent, beneficiaries under deceased estates or life tenants, and even persons who have contracted to purchase land before title passes (s 28(4)(a)-(d)). That breadth can trigger tenancy termination under s 28(1)(d) in circumstances tenants may not expect, such as where a spouse has a beneficial interest in land or is purchasing land on contract. Practitioners should carefully assess "owner" status and the Authority’s opinion test underpinning s 28(1)(d).

4. Rents set by Authority "on such basis or formula as may be prescribed" (s 19(h))

• Section 19(h) gives the Authority power to determine rents on a prescribed basis or formula. However, the Act itself does not set the formula; it requires subordinate prescription. Absent published prescriptions or regulations, the scope and methodology of rent setting may be uncertain and litigable. Departments and tenants should look for any regulations, policies or instruments that provide the prescribed basis.

5. Treasurer’s control over borrowings and Account operation (ss 22(2), 24(2))

• Borrowing is subject to prior written approval of the Treasurer and requires security as the Treasurer may require (s 22(2), (4)). The Account is controlled by the Authority but may be operated in a manner the Treasurer approves (s 24(2)). This gives the Treasurer substantial budgetary and operational leverage: borrowing and expenditure strategies must align with Treasury approvals, and the Crown carries contingent guarantees if a Treasurer guarantee is given (s 22(3)). Practitioners must factor in Treasury processes and possible delays or conditions.

6. Nominal regulatory fine (s 29(2))

• Regulations made under the Act may impose a fine of $40 for breach (s 29(2)). That sum is likely a historical nominal amount; reliance on the regulatory fine as an enforcement tool is weak and may not be an effective deterrent or remedy in present‑day terms. Parties and regulators often need alternative compliance mechanisms.

7. Immunity from personal liability is limited to "good faith" acts (s 27)

• Section 27 protects members, officers and agents from personal liability for acts done or omitted in good faith. "Good faith" is not defined in the Act and may be litigated. The immunity does not protect actions taken in bad faith or outside the scope of statutory power. It therefore reduces but does not eliminate personal risk.

8. Transfer of rights and obligations includes pre‑existing contracts (s 17(1))

• Section 17(1) transfers "all powers, authorities, rights, title, interest and obligation" attached to departmental housing to the Authority. This carries the risk of inheriting contractual obligations, service contracts, maintenance liabilities or contingent liabilities. The Authority’s right to refuse transfers (s 17(2)) provides a safety valve, but where transfers occur, liabilities pass to the Authority.

9. Definition of "tenant" includes those deriving title from original tenant (s 5)

• The tenant concept includes successors who derive title from an original tenant (s 5). This may allow assignment or succession to create ongoing obligations and rights under tenancy agreements without the Authority’s direct consent, subject to the agreement’s terms and statutory restrictions.

10. Governor’s proclamation of Departments can expand scope unpredictably (s 7)

• The Governor can declare by proclamation that any department, Crown instrumentality or body be a "Department" for the purposes of the Act (s 7). A proclamation can be varied or cancelled. This executive mechanism can quickly expand or contract the Act’s reach, and stakeholders should monitor proclamations for changes in applicable Departments.

11. Review obligations and gaps (s 30)

• The Minister must cause a review every five years after 1 July 1992 (s 30). Failure to conduct these reviews or lay reports before Parliament could create governance or accountability gaps. Practitioners should check whether the five‑year reviews have been performed and the reports tabled.

12. Deleted sections and historical residues

• Several sections and an entire Part II have been deleted by subsequent amendments (textual notes indicate deletions of sections 3, 6, Part II s 8-15, s 21, s 25, s 26). Users relying on older references should ensure they consult the current reprint and be wary of references to repealed provisions in older documents or contracts.

13. Gifts exemptions and trust complexities (s 20)

• Section 20 permits acceptance of gifts or gifts subject to trust, with Ministerial consent where trusts’ objects are substantially aligned with the Authority’s objects (s 20(1)(b)). The Authority may give effect to trusts even where other provisions might prevent that (s 20(2)). Donors and executors should note the s 20(3) duty exemption but also the risk of resumed obligations or conditions attached to trusts that might complicate administration.

14. Interplay with planning and financial statutes

• The planning powers are subject to the Planning and Development Act 2005 (s 19(a)), and the Account is established under the Financial Management Act 2006 (s 24(1)). Practitioners must navigate these regimes in addition to the Act; failure to align with planning approvals or financial management rules could delay projects or result in non‑compliance.

These "gotchas" are points where the Act’s mechanics create practical risks, administrative discretion or legal uncertainty. They do not assert policy outcomes but identify operational hazards and interpretive tensions that should inform transactional due diligence, contract drafting, compliance programmes and administrative decision‑making.

Compliance under this Act requires coordinative action by the Authority, Departments, chief executive officers, tenants, donors and the Treasurer. The compliance tasks fall into operational, financial, regulatory and reporting categories. Below is a practical compliance checklist keyed to the Act’s provisions and framed for each key actor.

For the Authority

• Asset intake and review (s 17): On commencement or upon proclamations under s 7, review all assets purportedly vested in the Authority. Exercise s 17(2) where acceptance would impose obligations the Authority considers inappropriate. Keep written records of any refusal decisions and the reasons for refusal to support transparency and potential judicial review defences.

• Allocation processes (s 18): Establish documented procedures to receive, assess and decide on chief executive officer applications for allocation of houses under s 18(1)-(3). Record criteria used to assess "requires houses for Government employees" and retain evidence of consideration.

• Rent and tenancy policy (s 19(h), s 28): Ensure rent‑setting follows any prescribed formula where such prescriptions exist. If regulations or subsidiary instruments are absent, develop a clear internal rent‑setting policy consistent with s 19(h) and be ready to justify the methodology as reasonable and non‑discriminatory. Maintain tenancy agreements with clear covenant provisions and defined notice mechanisms to support enforcement under s 28.

• Tenancy termination and enforcement (s 28): Implement standard notice templates complying with s 28(2). Maintain procedures for applying to a court of summary jurisdiction for warrants, including evidence of default and proof of service. Coordinate with authorised persons to execute warrants lawfully.

• Financial compliance (ss 22-24): Before seeking borrowings, obtain written approval from the Treasurer as required under s 22(2). Prepare the security instruments the Treasurer may require (s 22(4)). Operate the Government Employees’ Housing Authority Account in accordance with Financial Management Act 2006 arrangements and any Treasurer approvals (s 24(1)-(2)). Document all investments made at the Treasurer’s request and ensure interest is credited to the Account (s 24(5)).

• Gift acceptance (s 20): Where accepting gifts, check whether they are absolute or subject to trust. For gifts subject to trust, seek Ministerial consent if required (s 20(1)(b)). Ensure legal review of trust terms to confirm they are compatible with Authority objects or to justify reliance on s 20(2) if necessary.

• Recordkeeping and reporting: Keep records to satisfy external audit, Treasury and any parliamentary review under s 30. Where the machinery of government transitional rules apply (compilation notes), maintain records to support final reports if required.

For Departments and chief executive officers

• Application for housing (s 18): When deciding whether to apply for allocation, compile a clear needs assessment to support the application and include data on employee numbers, location, and housing shortages. Submit applications in the format required by the Authority and be prepared to provide additional information on request (s 18(3)(b)).

• Asset transfer readiness (s 17): Where transfers to the Authority are envisaged, identify contractual obligations, maintenance liabilities, special encumbrances or statutory liabilities attached to properties. Engage early with the Authority to negotiate acceptance or retention if the Authority might refuse to accept an asset (s 17(2)).

For tenants and employees

• Understand tenancy terms (s 28): Read and understand the tenancy agreement covenants and rent payment schedules. Note that rent non‑payment for 14 days is an express ground for termination (s 28(1)(a)).

• Monitor owner relationships (s 28(1)(d)-(4)): Be aware that ownership or beneficial interest in other land by the tenant or their spouse/de facto partner can trigger tenancy determination if the Authority forms the opinion the tenant might reasonably reside on owned land (s 28(1)(d), s 28(4)). Notify the Authority of relevant changes of status where appropriate.

• Respond to notices: If given a notice to vacate under s 28(2), seek timely legal advice on potential defences, procedural sufficiency of notice and possible negotiation with the Authority.

For donors and executors

• Gift terms and duty exemptions (s 20): When considering gifts, be advised the Authority may accept absolute gifts and, with Ministerial consent, gifts subject to trust (s 20(1)). Gifts to the Authority are exempt from duties under the Duties Act 2008 (s 20(3)). Ensure wills and bequests properly designate the Authority and consider registering the bequest with the Authority to reduce disputes.

For the Treasurer and Minister

• Treasury approvals (ss 22-24): Establish clear internal processes for timely consideration of Authority requests to borrow and to provide guarantees, including assessment of required security under s 22(4). Set prescriptive guidance on how the Account may be operated and ensure such directions are timely and documented (s 24(2)).

• Ministerial review duty (s 30): Schedule and resource the five‑year statutory reviews required under s 30(1) and ensure reports are laid before each House of Parliament when completed (s 30(2)). Keep a public record of reviews and any reforms recommended or implemented.

Cross‑cutting governance

• Inter‑Act coordination: Comply with the Planning and Development Act 2005 when undertaking planning or subdivision work (s 19(a)). Ensure that financial practices conform to the Financial Management Act 2006 and other relevant financial legislation cited in the compilation notes. Verify that any regulations made under s 29 are incorporated into internal compliance manuals.

• Policies and delegated instruments: Draft and publish clear operating policies on rent setting, asset acquisition and disposal, tenancy management, gift acceptance and procurement. Where subsidiary prescriptions are required (for example, rent formulae under s 19(h)), either seek promulgation of regulations or document transitional administrative methods and publish them to reduce disputes.

• Legal review and recordkeeping: Prior to accepting property transfers, entering guarantees, accepting gifts subject to trust or setting rent formulas, obtain legal advice and keep full records of approvals, consents and instrumentalities required under the Act.

• Training and delegation: Train officers and agents on the limits of their delegated authority, the required "good faith" standard for immunity under s 27 and the procedural steps required for lawful tenancy terminations and possession enforcement under s 28.

Checklist summary

• Authority: asset audit; tenancy policy; rent formula; Treasurer approvals for borrowing; operate Account per Treasurer; gift and trust intake process; audit and reporting.

• Departments: needs assessment; asset due diligence; application submissions; monitor proclamations under s 7.

• Tenants: understand covenant obligations; pay rent timely; seek legal advice upon notice.

• Donors: confirm duty exemption; obtain Ministerial consent in trust situations; align bequest language.

• Treasurer/Minister: process approvals; plan and conduct statutory reviews; set Account operation parameters.

Meeting these steps aligns operational conduct with the Act’s statutory text and reduces legal and financial risk. Where the Act delegates prescription to regulation or other instruments (for example s 19(h)), ensure those instruments are obtained, reviewed, and implemented as part of compliance.
