What it does
This determination prescribes a single, legally authoritative method for converting amounts of consideration expressed in a foreign currency into Australian dollars for the purpose of working out the value of a taxable supply under the GST rules. It takes effect from 1 July 2018 (s 2) and expressly repeals and replaces the prior 2017 determination (s 3). The instrument applies to any entity that uses the method in section 5 because an amount of the consideration for the supply is expressed in a foreign currency (s 4).
Mechanically, the conversion is a multiplication: the amount expressed in the foreign currency multiplied by “your particular exchange rate” on the conversion day (s 5). The determination requires the entity to select one of a defined set of exchange-rate sources for “your particular exchange rate” and to use that rate consistently (s 5; s 6 definition of your particular exchange rate). The permitted rate sources are: the Reserve Bank of Australia (RBA) rate, a rate published by a foreign exchange organisation, an agreed rate between supplier and registered recipient, or, for taxable supplies of offshore supplies of low value goods, a rate chosen under a separate determination (s 6 definitions: RBA rate; foreign exchange organisation; agreed rate; your particular exchange rate; cross-reference to the Goods and Services Tax: Foreign Currency (Customs Value of Low Value Goods) Determination 2018).
The determination sets the “conversion day” , the date whose exchange rate must be used , according to the taxpayer’s GST accounting method and, for certain non-resident registrants, according to the tax period in which GST is payable (s 6, conversion day). For entities that account on a basis other than cash, the conversion day is the earlier of receipt date or the transaction date or invoice date, depending on which of the latter two the entity has chosen. For entities on the cash basis, the conversion day can be the transaction date, invoice date or the date consideration is received. Special rules permit certain non-resident registrants to use the final day of the relevant tax period for inbound intangible consumer supplies and offshore low value goods, or for all supplies if the entity is a limited registration entity (s 6 conversion day, paras (c) and (d)).
