What it does
This instrument prescribes how amounts of consideration expressed in digital currency are to be converted into Australian currency for the purposes of working out the value of a taxable supply under the goods and services tax rules. The conversion rule is a single formula: multiply the quantity of digital currency by "your particular exchange rate" on a specified conversion day (s 4). The determination applies to any entity that, when working out the value of a taxable supply, has any amount of consideration for the supply expressed in digital currency (s 3). It commences the day after registration (Commencement).
Mechanically, the determination (a) fixes the arithmetic to be applied (Amount of digital currency x your particular exchange rate on the conversion day, s 4); (b) prescribes how the conversion day is selected depending on the entity's GST accounting basis and residency status (definition of conversion day in s 5); and (c) defines permissible sources and processes for selecting "your particular exchange rate" including special treatment where an agreed rate has been struck between supplier and a registered recipient, and where exchange rates are only quoted in a foreign currency (definitions in s 5). The instrument requires consistent use of the chosen particular exchange rate (s 4). Other defined terms are imported from the GST Act where not otherwise defined in the determination (s 6).
The determination does not insert new tax bases, change who is taxable, nor set penalties or enforcement mechanics within its text. Its scope is narrowly technical: it governs currency conversion methodology when any part of the consideration is expressed in digital currency. It also cross‑refers to an earlier instrument , the Goods and Services Tax: Foreign Currency Conversion Determination 2018 , for converting foreign currency amounts into Australian currency when the relevant digital currency rates are quoted only in a foreign currency (s 5(b) Step 2 and link).
For an entity that needs to comply, the immediate operational effect is to require a documented, consistent choice of "particular exchange rate" and a clear rule for which date to use to determine that rate, together with a one-step arithmetic conversion mandated by s 4. The determination prescribes that, other than an agreed rate, the chosen exchange rate must reflect the GST inclusive market value of the digital currency in Australian currency (s 4). The legal text supplies definitions for agreed rate, conversion day, digital currency exchange, digital currency website, exchange rate, foreign currency, and transaction date (s 5).
