GEOTHERMAL ENERGY REGULATIONS 2009

The Regulations work through a set of recurring administrative concepts. Understanding these is central to compliance and to advising clients.

• Geothermal authority: a term used generically in the Regulations to cover geothermal exploration permits, geothermal retention licences and geothermal production leases. The Register entries distinguish among these types (reg 18(a), Sch 1, Sch 2). The Act is the primary instrument that creates the authorities; the Regulations set procedural and administrative rules for them.
• Authority year: a 12 month period that begins on the date the geothermal authority comes into force and each subsequent 12 month period (reg 7). The annual fee obligation is tied to the authority year and must be paid before its beginning (reg 8(1)).
• Annual fee and prescribed lodgment day: Schedule 2 prescribes annual fees per block depending on the type and year of the authority. An annual report must be lodged no later than the prescribed lodgment day, defined as 28 days after the end of the authority year for that authority (reg 9(4)); late lodgment attracts Schedule 3 fees.
• Reviewable decision and review pathway: certain Ministerial decisions and actions must be notified as reviewable decision notices and are subject to Tribunal review (regs 24 to 26). The Regulations state which decisions are reviewable (reg 25) and how the Tribunal must proceed and communicate recommendations (reg 26).
• Infringement notice offence and prescribed amount: Schedule 5 identifies offences that may be dealt with by infringement notice and specifies prescribed amounts in penalty units. The Minister may issue infringement notices where there are reasonable grounds to believe an offence has occurred (regs 32 and 33).
• Register: a public administrative register maintained by the Minister or Agency recording applications, granted geothermal authorities, transfers and related entries. The Regulations specify the minimum information to be entered and allow additional discretionary entries by the Minister (regs 17 to 20).
• Notice and specified time: several procedures require the Minister to give written notice to applicants or holders, and to allow a specified time for responses. The Regulations set the minimum specified time at 28 days for many processes (regs 4(3), 5(3), 11(3)). The definition of extended time refers to s 38(2) of the Act (reg 3).

Legal character and fault elements are central. Two duties are identified explicitly as strict liability offences with a maximum penalty of 20 penalty units: the holder notification duty about changes in name or contact details (reg 12) and the operator change notice duty (reg 13(2)). The Regulations also incorporate other Acts into their mechanisms: the Fines and Penalties (Recovery) Act 2001 is invoked for enforcement and payment processing in relation to infringement notices (reg 34(2)), and the Northern Territory Civil and Administrative Tribunal Act 2014 is incorporated for review processes and transitional rules (reg 3 and Part 7).

Key documents and actions are defined or referenced: geothermal operations plans (content in reg 14), technical work programs (operator appointment notices in reg 13), sample management and surrender (reg 10), and the required contents of many Ministerial notices (regs 4 and 5). Fees schedules quantify the economic burden of permitting, annual holding costs and transactional costs for transfers and register access (Schedules 1 to 4). The Regulations therefore combine procedural law, financial imposition and enforcement modalities into a single administrative framework.

The Regulations affect a defined set of actors and, indirectly, stakeholders who interact with geothermal activities in the Northern Territory.

• Applicants for geothermal authorities: People or entities applying for exploration permits, retention licences or production leases are affected by prescribed application fees, the Minister's notice and response process, and registration entries (regs 4, 5, 6, 17). Schedule 1 prescribes specific application fees for grant and renewal.
• Geothermal authority holders: Holders must pay annual fees before each authority year (reg 8), lodge annual reports by the prescribed lodgment day (reg 9), preserve and surrender samples (reg 10), notify changes to name and contact details within 14 days (reg 12), and comply with approved operations plans (regs 14, 15). The Regulations explicitly make the notification duty a strict liability offence with a maximum penalty of 20 penalty units (reg 12).
• Operators and persons appointed to conduct technical work: Where an operator is appointed, the holder must notify the Minister of notifiable changes including resignations, changes in appointment terms, or appointment of new operators within 14 days (reg 13). The notification duty under reg 13 is also a strict liability offence with a maximum penalty of 20 penalty units.
• The Minister and the Agency: The Minister must give prescribed notices, consider submissions and requests for variation, grant or refuse authorities, and may enter additional register information (regs 4, 5, 11, 20). The Agency holds samples and receives annual reports (regs 9, 10, 17, 18).
• Enforcement agencies under the Fines and Penalties (Recovery) Act 2001: Infringement notices specify the enforcement agency to which prescribed amounts are payable (reg 34(1)(f), (2)(a)). The Fines and Penalties (Recovery) Act supplies the recovery mechanism for unpaid penalties.
• The Tribunal: Persons aggrieved by reviewable decisions may apply to the Civil and Administrative Tribunal for review (reg 24). The Tribunal conducts reviews, issues recommendations within two months, and notifies the parties of reasons (reg 26).
• Persons involved in transfers or devolutions of geothermal authority interests: Transfers and devolutions must be registered in approved forms (reg 21) and attract registration fees (Sch 4). The register records proposed holdings, transfer details and caveats (regs 17, 18, 19).
• Third parties with an interest in register entries: The public may inspect the register or obtain copies for a fee (Sch 4; reg 23). Caveats may be lodged and continued, with fees prescribed (Sch 4).

Who bears costs. Fees schedules impose quantifiable carrying costs on holders and transactional costs on applicants and transferees (Schs 1 to 4). The annual fee structure varies sharply by authority type: Schedule 2 sets low per-block fees for early years of exploration permits and much higher fees for licence or lease areas. Non-compliance produces potential financial penalties under the infringement scheme (Sch 5) or criminal penalties for certain strict liability breaches (regs 12, 13).

Who decides. The Minister retains decision-making discretion over grant, renewal, variation and cancellation processes (regs 4, 5, 11, 26). The Tribunal reviews the Minister's decisions and provides recommendations within set timeframes, but the Minister is not required to follow Tribunal recommendations (reg 26(3)). The Agency performs administrative tasks such as receiving reports and holding samples (regs 9, 10).

This section summarises the principal operational duties imposed on holders and applicants, and the rights available to them under the Regulations.

Principal duties

• Pay annual fees before the start of each authority year (reg 8(1)). Schedule 2 specifies the fee by block and by authority type and year. The Minister may refuse to accept a surrender until the annual fee for the whole area and entire authority year has been paid (reg 8(3)).
• Lodge an annual report in writing with approved forms no later than the prescribed lodgment day, which is 28 days after the end of the authority year (reg 9(1), (4)). Late lodgment attracts Schedule 3 fees; waiver of those fees is available only if the Minister is satisfied there is a reasonable excuse (reg 9(3)).
• Keep samples (drill cores, cuttings and other samples) protected from damage and deterioration, label them clearly with nature, date and place of recovery, and deliver them to Agency storage premises when geothermal activities under the authority cease, or when otherwise required by the Minister (reg 10(1)-(7)). Applications are required in approved form to seek earlier disposal (reg 10(4)). The Agency permits inspection of samples during normal business hours (reg 10(6)).
• Notify the Minister in writing within 14 days of any change in the holder's name or contact details (reg 12). This notification duty is a strict liability offence with a maximum penalty of 20 penalty units.
• When an operator is appointed or ceases to be appointed or the operator details change, the holder or applicant must notify the Minister in writing within 14 days; notices of appointment must include the information required by s 65(1)(b)(i), (ii) and (c) of the Act (reg 13(1)-(3)). Reg 13(2) is a strict liability offence with a maximum 20 penalty unit penalty.
• Maintain an approved geothermal operations plan that includes specific information about operations, personnel, site plans and proposed infrastructure, and details of proposed restoration and rehabilitation including anticipated costs if operations are to cease permanently (reg 14).
• If the holder intends to allow a permit or licence to expire, review the approved operations plan at least three months before expiry and, if it lacks comprehensive restoration and rehabilitation detail and cost estimates, vary the plan and apply for Ministerial approval of that variation (reg 15).

Principal rights

• Applicants have the right to receive written notice from the Minister when the Minister intends to grant, renew, vary or refuse to grant or renew, including reasons where required, and to be given specified time to respond (regs 4 and 5). Where the Minister's decision limits grant or renew to some but not all blocks, the applicant may accept the decision, request variation, or lodge a submission seeking reconsideration within at least 28 days (reg 4(2)-(5)).
• Where a decision is required to be notified, the decision is a reviewable decision and the applicant or holder may apply to the Tribunal for review (regs 24-26). The Tribunal must make a recommendation within two months and provide reasons (reg 26(1)). The Minister must then consider the recommendation and decide whether to reverse, vary or confirm the decision and must notify the applicant within 28 days (reg 26(2) and (4)).
• Persons issued with infringement notices have the statutory options described in reg 34(2): pay the prescribed amount within 28 days to expiate the offence and avoid further action; or elect to have the matter dealt with by a court under the Fines and Penalties (Recovery) Act 2001 by completing a statement of election and giving it to the enforcement agency (reg 34(2)(a)-(b)).
• Applicants and holders may apply for variation of conditions; if the Minister refuses to vary or adopts a different variation than requested, the applicant must be given a reviewable decision notice in accordance with the Act and these Regulations (reg 5 and reg 16).

Additional procedural safeguards and constraints

• The Regulations fix minimum timeframes for responses and submissions to Ministerial notices (at least 28 days in many cases), while the concept of extended time remains available under s 38(2) of the Act and is referenced in definitions (reg 3; regs 4(3), 5(3), 11(3)).
• The Minister has reserved discretions,such as refusing to accept a surrender until fees are paid (reg 8(3)), refusing to vary an original decision (reg 4(4)(c)), and entering additional register information at the Minister's discretion (reg 20). These discretions produce administrative risk for holders and applicants.

The Regulations create a layered enforcement architecture combining administrative penalties by infringement notice, criminal/penalty unit sanctions for specified contraventions, and discretionary administrative actions including cancellation. The relevant mechanics and amounts are set out below.

Criminal/penalty unit sanctions

• Two regulatory duties are expressly described as strict liability offences carrying a maximum penalty of 20 penalty units: failing to give the Minister written notice of a change in the geothermal authority holder's name or contact details within 14 days (reg 12), and failing to notify the Minister in writing within 14 days of a notifiable change relating to an operator (reg 13(2)). The Regulations record the fault element as strict liability and the maximum penalty (reg 12; reg 13(2)).

Infringement notices

• Schedule 5 lists infringement notice offences and prescribes amounts in penalty units. It lists:
  • Geothermal Energy Act 2009, s 122(4) with a prescribed amount of 5 penalty units.
  • Geothermal Energy Regulations 2009, regs 12 and 13(2) with prescribed amounts of 2 penalty units (Sch 5).
• The Minister may give an infringement notice when, on reasonable grounds, the Minister believes a person has committed an infringement notice offence (reg 33).
• Content requirements for an infringement notice include the offender's name and address (if known), the date the notice is given, date and time and place of the alleged offence, description of the offence, the prescribed amount payable, and the enforcement agency to which payment must be made (reg 34(1)). The notice must also set out payment, election to take the matter to court, and consequences of inaction, and must include an appropriate form for statement of election (reg 34(2)).
• Payment mechanics are specified: payment by electronic means is effected only when credited to the payee's bank account; a cheque is not effective unless cleared on first presentation (reg 35).
• Withdrawal is possible: the Minister may withdraw an infringement notice by written notice given within 28 days after the infringement notice is given and before payment of the prescribed amount (reg 36).
• The infringement notice scheme does not preclude court prosecution for the same conduct where no infringement notice has been given, nor prevent more than one infringement notice being given for the same offence; where multiple notices are given the person may expiate by complying with any of them (reg 37).

Administrative cancellation

• The Minister may cancel a geothermal authority or part of it if satisfied about a matter mentioned in s 58(2) of the Act, but must give the holder a notice with reasons and allow at least 28 days for a written submission before deciding whether to reverse, vary or proceed to cancellation. If no submission is made within the specified time the Minister may proceed and must give a reviewable decision notice (reg 11(1)-(5)). Cancellation is therefore both an enforcement tool and an administrative outcome that triggers review rights.

Fees and non-refund rules as enforcement and economic discipline

• Application fees in Schedule 1 are not refundable where the Minister refuses to grant, renew or vary an authority (reg 6(3)). A fee paid for an application to which s 14(1) of the Act applies is refundable only if the Minister decides the application does not have the greatest merit to be considered for grant (reg 6(2)).
• The Minister may refuse to accept surrender until annual fees have been paid for the whole area and year (reg 8(3)).
• No pro rata refund if part of the area is excised, surrendered or cancelled during the authority year (reg 8(4)).

Tribunal review

• Reviewable decisions must be notified and may be reviewed by the Tribunal (regs 24-26). The Tribunal must make a recommendation within two months and notify parties; the Minister then decides within 28 days and is not bound to follow the Tribunal recommendation (reg 26(1)-(4)). The Tribunal pathway imposes time-limited procedural protections but does not eliminate Ministerial discretion.

Interaction with recovery legislation

• The Fines and Penalties (Recovery) Act 2001 is invoked for enforcement recovery mechanisms. Infringement notices must inform recipients of their options under that Act and specify an enforcement agency defined in that Act (reg 34(1)(f), (2)). This means unpaid prescribed amounts may be recovered under the Territory's fines recovery regime.

The Regulations are subordinate to and operate in conjunction with several other legislative instruments referred to in their text. The Regulations frequently point to the parent Act for definitions, powers and certain procedural hooks; they also invoke provisions of other Territory statutes for enforcement and review.

Primary parent statute: Geothermal Energy Act 2009

• The Regulations implement procedural and administrative detail under the authority of the Geothermal Energy Act 2009. Numerous references in the Regulations point back to specific Act sections, for example: application decision pathways under ss 17 and 19 (reg 4(1)); refunds for certain applications under s 14(2) (reg 6(2)); obligations relating to samples under s 53 (reg 10); content requirements for operations plans under s 67(2)(c) (reg 14); approvals and variations under ss 68 and 69 (reg 16); transfer and devolution registration under ss 72 and 73 (reg 21); and cancellation under s 58(2) (reg 11).
• Where the Regulations use terms such as “extended time” they explicitly reference s 38(2) of the Act (reg 3 definition), meaning the Act’s procedural provisions supplement the Regulations’ timelines.

Tribunal and transitional interaction: Northern Territory Civil and Administrative Tribunal Act 2014

• The Regulations define “reviewable decision” with reference to the Tribunal and provide a review pathway to the Tribunal (regs 24-26). Part 7 of the Regulations implements transitional arrangements that preserve review entitlements and the jurisdiction of the former Lands, Planning and Mining Tribunal for matters that were under way at the commencement of the Northern Territory Civil and Administrative Tribunal Act 2014 (regs 38-41). The Regulations therefore coordinate the administrative decision-making and review jurisdictional boundaries between the Act and the Territory’s tribunal system.

Enforcement recovery framework: Fines and Penalties (Recovery) Act 2001

• The infringement notice framework in regs 32-37 operates together with the Fines and Penalties (Recovery) Act 2001. Infringement notices must identify the enforcement agency defined in that Act, advise recipients of their election rights under s 21 of that Act, and state the consequences of non-payment (reg 34(1)(f), (2)). Collection, withdrawal and court election mechanics therefore rely on the recovery and court processes in that separate statute.

Agency roles and administrative law

• The Regulations create administrative obligations for the Minister and the Agency,entry and maintenance of register information, storage of samples, receiving reports and fees, giving reviewable decision notices,without creating new private rights of action in the Regulations themselves. Remedies for affected persons lie in the procedural review pathway to the Tribunal or in the courts where the Act or other statutes provide.

Other potential legal interfaces

• The Regulations do not expressly reference environmental protection, land tenure or native title instruments within their text. However the regulated processes,permitting, operations plans, infrastructure plans, restoration and rehabilitation costs,are the kinds of matters that ordinarily intersect with federal and Territory environmental and land tenure law. The Regulations themselves, however, confine their legal cross-reference to the Geothermal Energy Act 2009, the Northern Territory Civil and Administrative Tribunal Act 2014 and the Fines and Penalties (Recovery) Act 2001 (see reg 3 and regs 34, 38-41). Any additional interactions therefore arise at the level of the Act or at operational permitting stages not specified in the Regulations.

The Regulations have been amended on a number of occasions; the reprint includes Endnotes that describe the legislative instruments and amendments. Key changes recorded in the Regulations’ endnotes and list of amendments are the following.

• Initial notification and commencement: Geothermal Energy Regulations (SL No. 29, 2009) were notified 2 September 2009 and commenced 1 December 2009, in conjunction with the Geothermal Energy Act 2009 (Endnotes, List of Legislation).
• Northern Territory Civil and Administrative Tribunal (Conferral of Jurisdiction Amendments) (No. 2) Act 2014 (Act No. 35, 2014): Assent 13 November 2014. Relevant parts of that Act commenced 1 June 2015 and 1 January 2015 for different parts. The 2014 conferral amendments resulted in numerous Regulations changes: Part 5 heading and many provisions in Part 5 were substituted or reworked to reflect the Tribunal reforms, and new Part 7 (transitional matters) was inserted (Endnotes rrs 24-26, pts 5 and 7).
• Geothermal Energy Amendment Regulations 2020 (SL No. 19, 2020): Notified 1 July 2020 and commenced 1 July 2020. The Endnotes record amendments to r 3 (definitions), r 6 (fees), r 8 (annual fees), r 9 (annual report), and substitution of r 23 among other formal changes (Endnotes, List of Amendments).
• Interpretation Legislation Amendment Act 2018: This Act made general formal amendments of a formal nature (noted in the Endnotes) to rr 1, 3, 34 and 38 and Schedule 5. The Endnotes treat those as formal redrafting amendments rather than policy changes.
• Specific regulation substitutions, insertions and repeals were recorded: for example rr 24-25 were substituted under Act No. 35, 2014; other rr and Parts were repealed or reinserted as part of the 2014 Tribunal conferral amendments (Endnotes List of Amendments, rrs 24-31, pt 5, pt 7).
• The Endnotes give a consolidated list of formal amendments and dates in the “List of Amendments” and “General Amendments” paragraphs. Those notes document both the 2014 Tribunal-related rework and the 2020 amendment regulations that updated fees and other technical provisions.

What the amendments show mechanically

• Tribunal conferral amendments (2014) reallocated review jurisdiction and reworked Part 5 to align with the Northern Territory Civil and Administrative Tribunal Act 2014. The Regulations were amended to track the new tribunal structure and to add transitional rules preserving rights where proceedings were already in train prior to the tribunal changes (regs 38-41).
• The 2020 amendment regulations updated several fees and possibly other administrative provisions. The reprint shows rr 6, 8 and 9 being amended by r 5-7 of SL No. 19, 2020, and substitution of r 23 under r 8 of that instrument (Endnotes).

Practical note for advisers

• Any compliance or cost analysis must use the current consolidated text and the applicable Schedule figures in the reprint. The Endnotes and List of Amendments provide the provenance of the current text and should be checked when advising on historical fee obligations or transitional review rights.

The Regulations themselves do not record case law or litigation history. The reprint does, however, embed procedural routes and transitional protections that create the practical architecture for any future litigation or review. The key litigation-related provisions and transitional design decisions to note are the following.

• Reviewable decisions and Tribunal review: The Regulations define that decisions required by the Regulations to be notified by a reviewable decision notice are reviewable decisions (reg 25(1)). This includes the Minister’s actions to implement a decision, refusals to approve applications, or refusals to take actions (reg 25(2)). A person aggrieved by a reviewable decision may apply to the Tribunal for review (reg 24). The Tribunal is obliged to make a recommendation within two months and give written reasons to the parties (reg 26(1)). The Minister must then decide whether to reverse, vary or confirm the decision and must notify the applicant within 28 days (reg 26(2) and (4)). The Minister is not required to follow the Tribunal’s recommendation (reg 26(3)). These provisions set the procedural limits on administrative review and are likely to be front and centre in any judicial review or merits review litigation stemming from Ministerial decisions.
• Transitional provisions preserving prior proceedings: Part 7 preserves the rights of persons who had been given reviewable decision notices before the commencement of the NT Civil and Administrative Tribunal Act 2014 and ensures that proceedings that were in train before the change continue to be dealt with under the former legislation and Tribunal where applicable (regs 39-41). This reduces jurisdictional uncertainty for matters that were underway at the time of the tribunal reforms and may be relevant in litigation topics arising from timing of decisions.
• Infringement notice withdrawals and election to court: The Regulations allow the Minister to withdraw an infringement notice within 28 days and before payment (reg 36). Recipients of infringement notices may elect to have the matter dealt with by a court instead of under the Fines and Penalties (Recovery) Act 2001 (reg 34(2)(b)). That election mechanism gives rise to court proceedings where parties choose the court route. The Regulations specify the form for election and the enforcement agency to receive payment or election (reg 34(2)).
• Cancellation and review: The cancellation procedure (reg 11) requires notice with reasons and an opportunity to make submissions with at least 28 days. Where the holder does not make submissions or the Minister proceeds after submissions are considered, the holder receives a reviewable decision notice and has Tribunal review rights (reg 11(2)-(5)). Cancellation decisions are therefore a likely locus of litigation or review.

Absence of recorded cases

• The Regulations do not name any decisions, cases or tribunal determinations. There is no litigation history contained in the reprint text. Any actual litigation or case law that interprets these Regulations will exist outside the reprint and must be sourced from case databases and tribunal records.

What advisers should do

• Where clients face cancellation, refusal, or adverse variation, engage promptly with the 28 day timeframes in regs 4, 5 and 11 and prepare to seek Tribunal review where appropriate. Understand that Tribunal recommendations are not binding on the Minister (reg 26(3)), so prepare administrative law grounds as well as merits arguments.
• Where an infringement notice is given, note the election right to go to court and the 28 day window for expiation or withdrawal (regs 34, 36). The choice between expiation and court has implications for costs, record of offence and subsequent enforcement.

Practical pitfalls that commonly trigger compliance failures or unexpected costs are flagged below, with the relevant regulatory hooks identified.

1. Non-refundable fees in many cases

• Application fees for grants, renewals and variations are not refundable where the Minister refuses (reg 6(3)). Only in the narrow circumstance explained in reg 6(2) (an application under s 14(1) of the Act that is judged to lack greatest merit) is a refund prescribed. Advisers should warn clients that unsuccessful application work and fees can be sunk costs unless the narrow refund test applies.

2. Annual fees payable in advance and surrender blockage

• Annual fees must be paid before the beginning of each authority year (reg 8(1)). If a holder applies to surrender all or part of the authority after the authority year has started the Minister need not accept the surrender until the annual fee has been paid for each block in the whole area and for the entire 12 month period (reg 8(3)). Surrender does not trigger a refund for part-year absence if the area is excised, surrendered or cancelled during the year (reg 8(4)). This creates an obvious cashflow trap for holders seeking to exit.

3. Late annual report fees steep and waivers narrow

• The prescribed lodgment day is 28 days after the end of the authority year (reg 9(4)). Schedule 3 imposes escalating fees for late lodgment, with the top band applying after 112 days and additional fees for each further 28 day period. The Minister’s power to waive a late fee is limited to situations where the Minister is satisfied the holder has a reasonable excuse; that is a narrow and discretionary relief avenue (reg 9(3)).

4. Strict liability notifications with substantial penalty

• Two notification obligations are strict liability offences carrying a maximum penalty of 20 penalty units: change in holder name or contact details (reg 12) and notification of operator changes (reg 13(2)). Strict liability means the prosecution does not have to prove fault beyond the act itself. The prescribed amounts in Schedule 5 for these Regulations are 2 penalty units for regs 12 and 13(2) when dealt with by infringement notice, but a breach could attract the higher maximum penalty if prosecuted (reg 12; reg 13; Sch 5).

5. Samples must be preserved and surrendered

• Samples must be protected from damage, labelled with nature, date and place, and delivered to Agency premises when geothermal activities cease (reg 10). Disposal before that point requires Ministerial authorisation in writing with reasons. Failure to preserve or surrender samples can trigger compliance action and movable asset disputes.

6. Ministerial discretion and truncated remedies

• Several places permit the Minister to vary, refuse or proceed after considering submissions and then give a reviewable decision notice (regs 4(4), 5(4), 11(4)). The Tribunal gives non-binding recommendations; the Minister may confirm the decision notwithstanding the Tribunal’s recommendation (reg 26(3)). Parties must therefore prepare for administrative outcomes even if they receive a favourable Tribunal recommendation.

7. Register fees and transfer costs

• The registration of a transfer of a geothermal authority interest costs 620 revenue units and devolution 207 revenue units (Sch 4). The register inspection fee and per page copy fee may produce transactional costs when performing due diligence (Sch 4). The Regulations also state the Minister need not enter the details of an agreement relating to a transfer in the register (reg 19(2)), which can produce gaps in public transparency.

8. Infringement notice election traps

• Infringement notices require a prompt decision: pay within 28 days to expiate, or elect to go to court (reg 34(2)). Payment is only effective once funds are credited to the enforcement agency account (reg 35). The Minister may withdraw an infringement notice within 28 days and before payment, but there is no guarantee of withdrawal (reg 36). Failure to elect or pay can lead to enforcement action under the Fines and Penalties (Recovery) Act 2001 (reg 34(2)(c)).

9. Timings for pre-expiry restoration obligations

• Holders intending to let permits or licences expire must review the operations plan at least three months before expiry and, where restoration and rehabilitation detail and cost are not included, vary the plan and apply for approval (reg 15(1)-(2)). Last minute failures to include restoration cost estimates risk the Minister refusing to approve the variation or imposing conditions to secure rehabilitation.

10. Currency of fees: “revenue units” not monetary values in the Regulations

• Fee Schedules express amounts in “revenue units” rather than dollar amounts. Advisers must consult the current revenue unit conversion applicable in the Territory to calculate actual monetary obligations. The Regulations themselves do not provide the conversion factor.

References: regs 6(2)-(3), 8(1), (3)-(4), 9(1)-(4), 10(1)-(7), 11, 12, 13(2), 14-15, 19(2), 34-36; Schs 1-4, 5.

Below is a practical compliance checklist and recommended internal processes mapped to the Regulations. Use this as a minimum compliance playbook when advising clients.

Registration and application stage

• Pre-application due diligence: identify the blocks in the proposed application area and calculate application fees from Schedule 1; understand that fees are non-refundable if the Minister refuses to grant, renew or vary (reg 6(1)-(3); Sch 1).
• Prepare applications in approved forms where required, and ensure all applicants’ contact details and proposed geothermal authority interests are clearly specified so the register entries can be accurate (reg 17(2)(c)-(d); reg 21).
• Anticipate the Minister’s notice: where the Minister intends to grant or renew a permit only over some blocks, the applicant has at least 28 days to accept the decision or request variation (reg 4(2)-(3)). Prepare to provide reasons if requesting variation, because the Regulations require the request to give reasons (reg 4(2)(e)).

Operational compliance and yearly cycle

• Authority year calendar: note the date each authority comes into force and compute the authority year (reg 7). Pay the annual fee before the beginning of the authority year to avoid surrender blockage (reg 8(1), (3); Sch 2).
• Annual report process: set an internal deadline to have the annual report lodged at least 28 days before the prescribed lodgment day to allow correction and payment processing. The prescribed lodgment day is 28 days after the end of the authority year (reg 9(4)). Prepare the report with approved forms and ensure any late lodgment is justified to the Minister if seeking a waiver (reg 9(2)-(3)).
• Sample management protocol: immediately upon recovery, label samples with nature, date and place, store under conditions that prevent damage and deterioration, and maintain an inventory mapped to the operations plan and authority area (reg 10(1)-(3)). If a holder ceases geothermal activities under an authority, deliver samples to Agency storage premises promptly and obtain receipts (reg 10(5)-(6)). If disposal is desired before cessation, prepare a written application with reasons for Ministerial authority (reg 10(4)).

Notification and record-keeping

• Change-notice practice: adopt a 7 day internal escalation process to detect and report changes in the holder’s name, address or contact details and operator appointments so the 14 day statutory notification window is met (regs 12, 13(2)). Treat failure to notify as a strict liability risk with a potential 20 penalty unit maximum penalty (reg 12; reg 13(2)).
• Operator appointment documentation: when appointing an operator, ensure the appointment and technical work program include the information required by s 65(1)(b)(i)-(ii) and (c) of the Act because the notice of appointment must include that information (reg 13(3)).
• Record all Ministerial notices and dates. For any Minister notice allowing at least 28 days to respond, create ticklers for the specified time plus margin for postal or administrative delays (regs 4(3), 5(3), 11(3)).

Operations plans and pre-expiry restoration

• Operations plan content checklist: ensure the plan contains the items specified in reg 14:
  • details of operations for the technical work program (reg 14(a));
  • description of how operations will be conducted and who will conduct them (reg 14(b));
  • plans of proposed and current work sites including buildings and infrastructure (reg 14(c));
  • descriptions and plans of infrastructure including any road construction under s 42 of the Act (reg 14(d));
  • details of proposed restoration and rehabilitation with anticipated costs if operations are to cease permanently (reg 14(e)).
• Pre-expiry action: at least three months before expiry of a permit or licence, review the approved operations plan and, where necessary, vary the plan to include comprehensive restoration and rehabilitation details and anticipated costs and apply for Ministerial approval of the variation under s 69(1) of the Act (reg 15).

Transfers, devolutions and register

• Transfer checklist: prepare applications in approved form for registration of transfers or devolutions (reg 21). Budget for the registration fee (Sch 4).
• Register due diligence: inspect the register and obtain relevant certified extracts where required; note fees in Sch 4 for inspection and copies. Keep copies of entries and any caveats lodged against the authority (reg 17-19; Sch 4).

Responding to adverse decisions and enforcement

• Respond timely to Minister notices: where the Minister notifies an intention to refuse or cancel, prepare submissions within the minimum 28 day period and consider whether to seek an extended time under s 38(2) of the Act where relevant (reg 5(2)-(3); reg 11(2)-(3)).
• Tribunal pathway: if given a reviewable decision notice, prepare for Tribunal review promptly because the Tribunal must issue a recommendation within two months; also prepare for the possibility the Minister will not follow the recommendation and will confirm the decision (reg 26(1)-(4)).
• Infringement notice option assessment: where an infringement notice is received, advise on the choice to expiate by paying the prescribed amount within 28 days or elect court. Consider financial and reputational effects of each option and the potential for withdrawal by the Minister within 28 days before payment (regs 33-36).

Internal compliance governance

• Maintain an obligations register mapping each geothermal authority to:
  • authority year start and end;
  • annual fee due date and payment proof;
  • prescribed lodgment day and annual report status;
  • sample inventory and location;
  • operations plan version, variations and approval dates;
  • contact details of holder(s), operators and any transferees;
  • any Ministerial notices received and the timeline for response.
• Legal and technical review: require legal review for any submissions to the Minister seeking variation or seeking to contest a cancellation or refusal. Keep technical evidence ready to support restoration cost estimates required under reg 14(e) and reg 15.
• Financial forecasting: build the Schedule 2 annual fees and potential late fees (Sch 3) into forecast budgets and include the cost of register transfer fees (Sch 4) when planning corporate transactions.
